On this twenty first day of September one thousand nine hundred and nine, before Mtre. Édouard Antill Panet, the undersigned Notary Public, duly commissioned and sworn in and residing and practicing in the Parish of Saint Raymond in the Province of Quebec and in the presence of Philias Plante, Carriage Maker, and Philemon Leboeuf, Saddler, both of the Village of Saint Raymond, witnesses expressly requested to witness this present last will and testament, personally came and appeared Dame Martha Jane Livingston, widow of the late David Smith in his life time of the Parish of Saint Raymond, Farmer, who being in sound and disposing mind, memory, judgment and understanding as it appeared unto us, Notary & witnesses from her words and actions yet considering the certainty of death and the uncertainty of the time thereof and being desirous of regulating her worldly affairs whilst yet she hath the health and strength left to do so, hath named, dictated and nominated unto us said Notary and witnesses her present last will and testament in the manner & form following:

1º I recommend my soul to Almighty God my Creator

2º I will and order that all my just debts, funeral & testamentary expenses be  paid by my Executor hereinafter named as soon as possible after my death.

3º I give, devise and bequeath to my well beloved son, William Smith, the whole of my property moveable and immoveable, real and personal, of which I may die possessed hereby constituting my said son my universal legatee and devisee and Executor of this my last will and testament hereby revoking all wills and codicils I may have heretofore made.

The present will was thus declared by the said Testatrix to us the said Notary and in the presence of the said witnesses, the present will being duly read to the said Testatrix in the presence of said witnesses and she declared to well and truly understand the same and to persist therein.

Done and passed in the said Village of Saint Raymond on the day & month and year first above written under number eight thousand seven hundred and sixty five of the original deeds remaining of record in the office of the undersigned Notary and signed by the said Testatrix with and in the presence of us said Notary and witnesses also hereunto subscribing in her presence and in the presence of each other after due reading hereof.

NOTE: Marriage: “David Smith of Bourg Louis, Farmer, Bachelor, son of Hugh Smith of the same place, farmer, and of Eliza Larmer, his wife and Martha Jane Livingston of the same place, Spinster, daughter of Thomas Livingston and Nancy Gilkinson, his wife, also all of B. Louis, were married by me by license on this twenty first of August in the year one thousand eight hundred and seventy three in the presence of subscribing witnesses.
