Cowan fell on his knees, then James Duffy jostled him down again and John Duffy lifted a wrightly (?) hand stick with a big lump at the end of it and struck him twice over the head when he was down. Birth* | between 1786 and 1789 | County Dublin, Leinster Province, Ireland; Place of birth is on her tombstone. Research on birthdate: Julia Duffy - died 25 aug 1871. Gravestone and burial record states she was 85 years of age. This would put birthdate between Aug. 1785 and Aug. 1786. In Jan. 1852, the census lists her as 65, which implies birthdate as 1786. In April 1861, she is 73 - so birthdate would be 1788. I searched many records and could not find her in the 1871 census - I found all of her children and she was not listed with them or in Valcartier or in Ancienne Lorette where the burial record says she died. I suspect she was there but left off the census. My best guess is that she was born 1786, however, that would make her 46 when she had her last child.3,4 |

This is somewhat confusing because in previous and future documents, there is no evidence that he lived in the 4th Concession, only in the 5th. The Census goes on to say that John has 1 male child, 2 female children, and 3 male servants. These servants are likely men that he has hired to help him clear the land. He owns a horse, 4 oxen, 6 cows and 4 cows and he has now cleared 30 acres on the 4th Concession and 2o acres on the 5th Concession.7 |

Includes: 30 minots of oats, 4 minots of peas, 60 minots of potatoes, 2 arpents sown in turnips, 16 arpents in timothy, 1/2 arpent each in hemp and flax. He has 3 cows, 2 pigs, and 1 gelding. He produced 100 minots of wheat, 400 minots of potatoes, 200 minots of turnips, 1000 bundles of hay and clover, 4 minots of carrots, and 500 lbs. of butter. He has peas in production but they are still green and have not been harvested.8 |

It appears that he was ill for sometime – since he had written the will three weeks before he died and at a relatively young age. Did he have consumption (tuberculosis)? When he died he left Julia, his wife, and seven surviving children, aged 11 through 27. The two eldest children, Elizabeth (married to John Wilson), and Bridget (married to Thomas Cassin) are not mentioned in the will presumably because they had already married and had husbands to care for them. The two boys, Thomas and James, who were left the land, were 21 and 18 when their father died. James sold his portion of the land to Thomas, five years later, in 1846. We have found James in Guelph, Ontario records by 1855. It is possible that he left Quebec after the land sale to find another type of work. Thomas, kept the land until 1864, he, his wife (Bridget Martin) and children and his mother, Julia, had relocated to Little River in 1863. ……………………………………………………………………………………………… Proved before me at Quebec this 27th of November 1855. “J. Deed: 16th November 1864 Sale (Vente) From Thomas O’Neill To Joseph Harriet Ratification by Judith Duffy, widow of John O’Neill From records of Benjamin Lelievre, Notary Public Record No. 1306 Quebec Archives Film #4MO1-4421, Images 631+ On this day the sixteenth of November in the year of our Lord one thousand eight hundred and sixty four, before us the undersigned Notaries Public duly commissioned and sworn for Lower Canada residing in the District of Quebec personally came and appeared Thomas O’Neill, farmer and Bridget Martin, his wife, by him duly authorized for the effect hereof, both residing in the Seigniory of Saint Gabriel, at the place called ValCartier, of the one part; And Joseph Harriet, of the same place, farmer, of the other part. Which said parties have covenanted and declared, promised and agreed to and with each other in manner following. That is to say; the said Thomas O’Neill and his said wife, authorized as aforesaid have and by these presents do sell, transfer, convey, assign and make over from henceforth and forever with warranty jointly solidairement one for the other and one of them for the whole, from all encumbrances, mortgages, dowers, debts, claims and demands whatsoever unto the said Joseph Harriet, accepting hereof purchased for himself, his heirs and assigns, that is to say. Firstly, a certain lot of land situate and being in the Seigniory of Saint Gabriel aforesaid in the fifth concession, being lot number twenty two, containing three arpents in front by thirty seven and a half arpents more or less in depth, bounded on one side to the southwest in front by the line between the fourth and firth concession and to the northeast, the depth of the Seigniorial line, joining on one side to the southwest to lot number twenty one and on the other side to the northwest to lot number twenty three. Secondly, another lot of land situate in the Seigniory of Saint Gabriel aforesaid in the fifth concession, being lot number twenty three, containing three arpents in front, by thirty seven arpents and a half more or less in depth, bounded to the southeast, in front by the line between the fourth and firth concession, to the northeast in depth to the Seigniorial line to the southeast by lot number twenty two herein first above described and to the southwest to a triangle, together with the house, barn and other buildings thereon erected and such as the whole now stands without any reserve whatsoever, the said purchaser declaring himself therewith satisfied, having viewed and examined the same. To the vendor belonging, the said above said and described two lots of land, part as having acquired by and in virtue of a certain deed of sale, consented to the said Vendor by James O’Neill, his brother, as appeareth by the deed thereof, executed at Quebec, before A.G. Cannon and colleague notaries, bearing date the seventh of October one thousand eight hundred and forty six and partly and in virtue of the last will and testament of the late John O’Neill, made and received before the Reverend Hugh Paisley and witnesses, bearing date the thirteenth day of October one thousand eight hundred and forty one and proved on the twenty seventh of November, one thousand eight hundred and fifty five. Being the said lots of land in the … of the domain of the Representatives of the late Order of Jesuits in Canada and toward them charged with such seigniorial rents, the exact amount whereof the parties could not ascertain. This present sale and conveyance is thus made subject to the payment by the said purchaser of such seigniorial rents which are now due and those which will become due, in future and for and in consideration of the price or sum of fourteen hundred dollars on account of which said sum the said Vendors, so hereby acknowledge and confess to have received from the said purchaser previous to the execution hereof the sum of seventy five dollars, in consequence whereof they hereby give and grant the said purchaser a receipt for so much, don’t Quittance d’ cuitant, and to the sum of thirty hundred and twenty five dollars, remaining due, the said purchaser doth hereby bind and oblige himself, his heirs and assigns at the following terms to wit; two hundred dollars in one year from the first of May next ensuing, two hundred dollars in two years from the said first of May next, two hundred dollars in three years from the first of May next, two hundred dollars in four years from the said first of May next, two hundred dollars in five years from the said first of May next, two hundred dollars in six years from the said first of May next, and one hundred and twenty five dollars for the full and perfect payment in seven years from the said first of May next and with interest thereon at the rate of six per centum per annum; said interest to be computed from the said first of May next and payable yearly, said interest to diminish in proportion to each payment. And for the security of the said sum of thirteen hundred and twenty five dollars remaining due and of the interest which will thereon accrue and become due the said purchaser doth hereby – Firstly, specially bind, oblige, mortgage and hypothecate the said above sold and described lots of land, the sum understood hereby expressly reserving all their rights and privileges of Bailleur de fondo. Secondly, the said purchaser doth hereby specially, bind, oblige, mortgage and hypothecate two certain lots of land being number five and six situation lying and being in the Seigniory of St. Gabriel aforesaid in the fifth concession, northwest of River Jacques Cartier, containing the said two lots together six arpents in front by thirty arpents more or less in depth, bounded in front by the River Jacques Cartier, and in the rear by ungranted land, on one side to the west by the property of Edward Brown on the other side to the east by Laurence Corrigan. And by these presents the two – Bridget Martin authored as aforesaid hath of her own free will and accord renounced as well for herself as for the children born or to be born of her marriage with the said Thomas O’Neill to all dowers and to all right of dowers whatsoever whether … or conventional or in virtue of any title whatever which she may or might have on the said above sold and described lots of land. To those presents personally came and appeared Judith Duffy, widow of the late John O’Neill, residing at ValCartier aforesaid which said Judith Duffy, after having taken communication and lecture was made to her, by Benjamin Lelievre, one of the undersigned notaries, of the foregoing deed of sale, which she declared well to understand, hath and doth hereby ratify, allow and confirm the same, being willing and agreeing that it be executed according to its full form, tenor and meaning, freely renouncing to all claims, pretentions and demands whatsoever she may or might have hand on the premises, therein described and sold and in consideration of the premises, the said Vendors do further cede, transfer, convey assign and make over all their right, title, interest, property, right of property claims and demands, whatsoever which they may or might have in to and over the said above sold and described lots of land and to and over every part and parcel thereof being willing and agreeing that the said purchaser his heirs and assigns do hold, use, occupy, possess and enjoy the same in full property from henceforth and forever and that he or they be put in good and lawful possession and investiture by and in virtue of these present. And for the due execution of these present the parties have made … of Domiciles at their actual residences at which place, thus promising, obliging, renouncing and ratifying. This done and executed in the District of Quebec aforesaid at ValCartier aforesaid, at the residence of the said vendors on the day and year first above written, under the number one thousand three hundred and six and the said vendors and purchaser have after the due reading, have signed with the said notaries having the said Judith Duffy declared that she could not write nor sign her name, but made her ordinary mark by a cross in faith and testimony of the promises. Present: Thomas O'Neill and Claude Guerin Guil. Giroux, Priest From Gerry Neville: " John O'Neill and Judith Duffy are buried in Valcartier. A few years ago a Mr. Griffin and a Mr. Conway, while visiting the cemetery, found the O'Neill monument thrown over the bank at the cemetery along with a number of other old broken monuments. I know that they retrieved the O'Neill monument that was split in two pieces. Mr. Conway told me that on the monument it gave John O'Neill's place of birth as County Kildare and Judith Duffy's place of birth as County Dublin." Don Michaud has said that he has seen to it that both of the stones have been repaired and replaced in the cemetery. However, he states that the date of Julia's death on the stone states 1872 - will research whether the church records are wrong or if the stone is wrong. The stone states: "Sacred to the memory of Julia Duffy who died 25 August 1872, Native of County Dublin, Ireland, And Relict of the Late John O'Neill, Aged 85 years." Note: The gravestone states she died in 1872 which appears to wrong based on the order of the burial records in the church records.18,4,20 |

Lelièvre Notary Public, the eight day of January in the year of our Lord one thousand eight hundred and forty one. And I further appoint my said son Bernard Doyle to be the sole Executor of this my will hereby revoking all other wills made by me at any time heretofore, In witness whereof I the said Margaret Duffy have hereunto set my hand and signature this eighteenth day of July one thousand eight hundred and fifty three. Where being in the presence of James Flinn and John Jack, both residing in the Parish of Saint Gabriel aforesaid, farmers, witnesses here unto required for the effect hereof and the said Sarah Duffy is in good health and sound of mind, memory, judgment and understanding as appeared to me the said Notary and to the said above named witnesses by her actions, words and discourse. And the said Sarah Duffy considering the certainty of death and the uncertainty of the hour thereof, doth hereby make fullest declare and dictate to Benjamin Lelievre, the said undersigned Notary in the presence of the said above named witnesses, her last will and testament in manner and form following. That is to say, Firstly, the said Sarah Duffy, recommends her soul to God, her Creator, whereas it shall please Him to dissolve her mortal body of all her sins through the intercession of his blessed Son and Savior. Secondly, the said Sarah Duffy doth hereby give and bequeath unto Bridget Margaret Corrigan, a minor, aged six years, issue of the marriage between James Corrigan and Ann Navin, the sum of four hundred dollars, and the interest which may happen to be due at the decease of her the said Sarah Duffy. The said Sarah Duffy doth further give and bequeath unto the said Bridget Margaret Corrigan, one silver watch, one pair gold mounted spectacles with silver case being those formerly belonging to the late John Navin also her best bedstead with the best feather bed and bedding, also all her wearing apparel. Thirdly, the said Sarah Duffy doth hereby give and bequeath unto Mary Corrigan, also a minor, aged eight years, issue of the said herein above mentioned marriage, the sum of two hundred dollars, one feather bed and her gold mounted spectacles. Fourthly, the s the said Sarah Duffy doth hereby give and bequeath unto Sarah Corrigan, also a minor aged three years, issue of the said marriage, the sum of two hundred dollars, And as to the remainder of all her moveable property generally said sum and sums of money whether note of lien, obligation, covenant or otherwise of which the said Sarah Duffy may be possessed of. The said Sarah Duffy doth hereby give and bequeath the use and enjoyment of the same unto Ann Navin, wife of James Corrigan, during her lifetime at the charge by his of making an inventory of the same. But as to the full property thereof, the said Sarah Duffy, doth hereby give and bequest the same to Jane Corrigan, aged two years, to Elizabeth Corrigan, aged six months and to such other children as many issue from the said herein above mentioned marriage. And in the event of the said Bridget Margaret Corrigan, Mary Corrigan or Sarah Corrigan deceasing before the age of twenty one and without having legitimate heirs, then and in that case the said Sarah Duffy directs that their share or shares of such as may decease be equally divided between the said Jane Corrigan, aged two years, Elizabeth Corrigan, aged six months and such other children as may issue from the said marriage. But that the shares of such as may decease be enjoyed by the said Ann Navin during her lifetime as aforesaid. The said Sarah Duffy directs that her body be buried in the Roman Catholic Church of ValCartier, and that one solemn grand mass be sung the day of her funeral, and that two hundred said masses of requiem be said for the repose of her soul during the two years following her decease. The said Sarah Duffy directs that all her lawful debts be paid by her executor herein after named. The said Sarah Duffy doth hereby nominate and appoint as Executor of this her last will and testament the person of Henry Patton, residing in the parish of Saint Gabriel aforesaid, Esquire, whom she doth hereby request to render this last act of kindness. The said Sarah Duffy hereby annulling, cancelling, objurgating, and making void all former wills which may have been heretofore made and executed by the said Sarah Duffy. Thus done, made and dictated word by word by the said Sarah Duffy to the said Benjamin Lelievre, the said undersigned Notary in the presence of the said above named witnesses, in this day and year, first above written, under the number one thousand four hundred and forty and after having read and re-read the present last will and testament to the said Sarah Duffy, which she declared well to understand, she hath persisted therein as being her last will and meaning and hath declared that she cannot write nor sign her name, but made her mark by a cross. Transcribed by Patricia Balkcom, 22 October 2010 My Notes: This is an interesting will. Judith leaves her main possessions to a 6 year old grand-daughter (Bridget Margaret Corrigan). In the same year as this will was written, Bridget’s parents, James Corrigan and Ann Navin, leave Valcartier and move to Wisconsin. Four years later, in the 1871 Valcartier census, Bridget is living with her grandmother, Sarah Duffy, and she is not listed in the 1870 Wisconsin census with her parents. Apparently, Bridget stayed to live with her grandmother and did not go to Wisconsin (this seems unusual for a 6 year old child). Sarah Duffy did not die 19 December 1882, fifteen years after this will was written. It appears that, her only child, Ann Navin, who is mentioned in the will, predeceased her sometime between 1880 and 1882 when James Corrigan remarried. Granddaughter, Bridget Margaret is not listed in the 1881 Valcartier census and at this time I have not found either a death or marriage certificate for her. It is possible that there Sarah might have made a later will after her daughter died. Research into looking for the probate of this will would help to answer this question and also possibly give information as to what happened to Bridget Margaret.8 |

Ann died about 1881 before this second will was written. Sarah now leaves all of her estate to her two nieces (Bridget Margaret Corrigan – daughter of Ann Navin) and Catherine O’Neill Kindelan (daughter of Judith Duffy, sister to Sarah). It is obvious that Sarah was especially close to Bridget and that as a child, Bridget lived with Sarah for a period of time, even though her family had moved to Wisconsin. It is also obvious that Sarah and her husband, the late John Navin, were very religious, as they left money to the church for masses and Sarah stipulated that Bridget must remain in the church to receive her inheritance. BEFORE ME, the undersigned, one of the Justices of our Sovereign Lady the Queen assigned to keep the Peace within the District of Quebec, this seventeenth day of September in the year of our Lord Christ, one thousand eight hundred and forty nine personally came and appeared James Cullen of the place called Stoneham, farmer. Who being duly sworn upon the Holy Evangelists of Almighty God, doth declare, depose, and say, as follows: - to wit, on Sunday the ninth instant I was in Thomas Wright’s house at Stoneham when we perceived James Duffy and Thomas Duffy and John Duffy chasing James Cowan and his family in Mr. Cowan’s own field. I perceived that Mr. James Cowan was running toward Mr. Wright’s house pursued by James, John and Thomas Duffy. I went out of the home with Mr. Thomas Wright and I saw James Duffy strike James Cowan with an iron hay fork over the head. Cowan fell on his knees, then James Duffy jostled him down again and John Duffy lifted a wrightly (?) hand stick with a big lump at the end of it and struck him twice over the head when he was down. I came down to Mr. Cowan and lifted him up. His face was all covered with blood flowing from the cuts that were inflicted by the blows he had received from James and John Duffy and Mr. Wright brought him into his house.
