On the third day of January in the year one thousand eight hundred and seventy three

At the request of Mr. Michael Fogarty of the Parish of Ste. Catherine de Fossambault, Farmer, and in my office situate in the Victoria Chambers in the Lower Town of the City of Quebec, I the undersigned Notary duly commissioned and sworn and residing at the city of Quebec in the Province of Quebec did in the presence of John Fraser of the City of Quebec, Esquire Notary, write down and receive his last will and testament which he made and dictated in manner and form following, that is to say:

I will and direct that all my just and funeral expenses be paid and satisfied as soon as possible after my decease.

I give, devise and bequeath unto my beloved wife, Mary Mulroney, the whole of my property moveable and immoveable real and personal which I may die possessed of without any exception whatsoever to have and to hold the same after my decease in full and absolute property, hereby declaring the present to be my only true last will and testament.

It was thus made, dictated and named by the said Testator unto me the said Notary in the presence of my colleague Notary the present will having been read to the said Michael Fogarty in the presence aforesaid, the said Michael Fogarty declared to have perfectly heard and understood the same and persisted therein declaring that it contained entirely his last will and testament.

Notes by Patricia Balkcom: Michael was only 35 years of age when he wrote this will, however, he had already lost his first wife and daughter, and had recently remarried. I have not found a burial record for him, but he and Mary Mulroney had eight children (three of whom died) after he wrote this will. It is possible there is a later will .5
