On this day the seventh of January in the year of our Lord one thousand eight hundred and sixty seven, before me the undersigned Notary Public duly commissioned and sworn for Lower Canada resident in the District of Quebec, and in the presence of Hugh Breslow residing in the parish of Sr. Gabriel of Valcartier, labourer, witness hereunto required for the effort hereof, the said witness signing with the said Notary, personally came and appeared Henry Abraham, residing in the Parish of St. Gabriel of Valcartier in the County and District of Quebec aforesaid, farmer, stipulating for himself and in his own name of the one part.-

And Jessy Goodfellow, residing in the Township of Stoneham in the County and District of Quebec aforesaid, spinster, a minor child of the marriage of the late Catherine Conn and Robert Goodfellow, now about for the last ten years, by and with the consent and approbation of Robert Conn of Stoneham, aforesaid, farmer, her Grandfather testifying his consent and approbation by witnessing and signing these presents of the other part.-

Which said Henry Abraham & Jessy Goodfellow in the view of the marriage which it is intended by God's permission to be shortly made & solemnized between them the said parties with the consent of the said Robert Conn, her Grandfather, have made & entered into the general stipulations, covenants, and agreements, for the disposal of the property which under the good Providence of God they now have and will hereafter have and acquire in the manner following, That is to say,

Firstly, it is agreed and covenanted between the said parties that there shall be a community of property or Communauté de biens between the said Henry Abraham and Jessy Goodfellow notwithstanding the Coutume de Paris & the common law of the Country from which they do by their presents expressly derogate and the provisions whereof they renounce.

Secondly, it is agreed and covenanted that neither of them, the said Henry Abraham and said Jessy Goodfellow, shall be holden or obliged for the debts of the other contracted and incurred before their intended marriage, nor for those that shall be contracted or incurred during the same. And those which have not been or shall be so contracted or incurred shall be paid or satisfied by him or her that hath or shall have contracted and incurred the said debts, and the property of the other of them shall in no way be answerable or responsible for the same.

Thirdly, it is further agreed and covenanted between the said parties that all and singular the respective property now belonging to the said Jessy Goodfellow and Henry Abraham of whatever nature and dissipation soever the same may be, and all and singular the property hereafter to belong to them or either of them shall be by them respectively held to the particular and individual behalf of each of them, to the extent whereof they do hereby expressly declare that there shall be a separation of property, une parution de biens, between them in as full and complete manner as such separation may under the Law of the County be made.


Fourthly, it is however hereby expressly covenanted and agreed by and between the said parties that the said Henry Abraham shall receive the rents, issue, and profits of this property real and personal moveable and immoveable which the said Jessy Goodfellow now hath and shall or may hereafter acquire, and that he shall be bound and by these presents doth bind himself to apply the same during their joint lives to the support and maintenance of their house and family.

Fifthly, and in as much as it is the duty of him the said Henry Abraham out of the property which under Divine Providence he now hath and such as hereafter he may acquire, , to secure the said Jessy Goodfellow a means of providing a subsistence for herself in the event of her being left in a state of widowhood, it is hereby covenanted and agreed that the said Henry Abraham and and he hereby doth stipulate to and in favor of the said Jessy Goodfellow for her own individual benefit and behalf with full power and authority to dispose of it, as may seem good to her, the douaire prefix of three thousand five hundred dollars, to be taken out of all the goods and chattels, lands and tenements now belonging to the said Henry Abraham and which shall be in his possession and belonging to him at the day of his death, the same being hereby declared and stipulated to be realisés and propres according to the Law of the Country.

And for the execution and registering of these presents where need may be, they the said parties do hereby constitute the bearer hereof their attorney (Law firm named here).

Thus done and executed in the District of Quebec in the Parish of St. Gabriel aforesaid, at the residence of the said Henry Abraham, in the day and year first above written, under the number one thousand four hundred and twenty eight, and the said parties have after the due reading hereof, signed with me the said Notary and the said above named witness, together with John Dacres uncle by marriage of the said Jessy Goodfellow, in faith and testimony of the premises.
