On this day the sixteenth of November in the year of our Lord one thousand eight hundred and sixty four, before us the undersigned Notaries Public duly commissioned and sworn for Lower Canada residing in the District of Quebec personally came and appeared Thomas O’Neill, farmer and Bridget Martin, his wife, by him duly authorized for the effect hereof, both residing in the Seigniory of Saint Gabriel, at the place called ValCartier, of the one part;

     And Joseph Harriet, of the same place, farmer, of the other part.

     Which said parties have covenanted and declared, promised and agreed to and with each other in manner following. That is to say; the said Thomas O’Neill and his said wife, authorized as aforesaid have and by these presents do sell, transfer, convey, assign and make over from henceforth and forever with warranty jointly solidairement one for the other and one of them for the whole, from all encumbrances, mortgages, dowers, debts, claims and demands whatsoever unto the said Joseph Harriet, accepting hereof purchased for himself, his heirs and assigns, that is to say. Firstly, a certain lot of land situate and being in the Seigniory of Saint Gabriel aforesaid in the fifth concession, being lot number twenty two, containing three arpents in front by thirty seven and a half arpents more or less in depth, bounded on one side to the southwest in front by the line between the fourth and firth concession and to the northeast, the depth of the Seigniorial line, joining on one side to the southwest to lot number twenty one and on the other side to the northwest to lot number twenty three. Secondly, another lot of land situate in the Seigniory of Saint Gabriel aforesaid in the fifth concession, being lot number twenty three, containing three arpents in front, by thirty seven arpents and a half more or less in depth, bounded to the southeast, in front by the line between the fourth and firth concession, to the northeast in depth to the Seigniorial line to the southeast by lot number twenty two herein first above described and to the southwest to a triangle, together with the house, barn and other buildings thereon erected and such as the whole now stands without any reserve whatsoever, the said purchaser declaring himself therewith satisfied, having viewed and examined the same.

     To the vendor belonging, the said above said and described two lots of land, part as having acquired by and in virtue of a certain deed of sale, consented to the said Vendor by James O’Neill, his brother, as appeareth by the deed thereof, executed at Quebec, before A.G. Cannon and colleague notaries, bearing date the seventh of October one thousand eight hundred and forty six and partly and in virtue of the last will and testament of the late John O’Neill, made and received before the Reverend Hugh Paisley and witnesses, bearing date the thirteenth day of October one thousand eight hundred and forty one and proved on the twenty seventh of November, one thousand eight hundred and fifty five.

     Being the said lots of land in the … of the domain of the Representatives of the late Order of Jesuits in Canada and toward them charged with such seigniorial rents, the exact amount whereof the parties could not ascertain.

     This present sale and conveyance is thus made subject to the payment by the said purchaser of such seigniorial rents which are now due and those which will become due, in future and for and in consideration of the price or sum of fourteen hundred dollars on account of which said sum the said Vendors, so hereby acknowledge and confess to have received from the said purchaser previous to the execution hereof the sum of seventy five dollars, in consequence whereof they hereby give and grant the said purchaser a receipt for so much, don’t Quittance d’ cuitant, and to the sum of thirty hundred and twenty five dollars, remaining due, the said purchaser doth hereby bind and oblige himself, his heirs and assigns at the following terms to wit; two hundred dollars in one year from the first of May next ensuing, two hundred dollars in two years from the said first of May next, two hundred dollars in three years from the first of May next, two hundred dollars in four years from the said first of May next, two hundred dollars in five years from the said first of May next, two hundred dollars in six years from the said first of May next, and one hundred and twenty five dollars for the full and perfect payment in seven years from the said first of May next and with interest thereon at the rate of six per centum per annum; said interest to be computed from the said first of May next and payable yearly, said interest to diminish in proportion to each payment.

     And for the security of the said sum of thirteen hundred and twenty five dollars remaining due and of the interest which will thereon accrue and become due the said purchaser doth hereby – Firstly, specially bind, oblige, mortgage and hypothecate the said above sold and described lots of land, the sum understood hereby expressly reserving all their rights and privileges of Bailleur de fondo.

     Secondly, the said purchaser doth hereby specially, bind, oblige, mortgage and hypothecate two certain lots of land being number five and six situation lying and being in the Seigniory of St. Gabriel aforesaid in the fifth concession, northwest of River Jacques Cartier, containing the said two lots together six arpents in front by thirty arpents more or less in depth, bounded in front by the River Jacques Cartier, and in the rear by ungranted land, on one side to the west by the property of Edward Brown on the other side to the east by Laurence Corrigan.

     And by these presents the two – Bridget Martin authored as aforesaid hath of her own free will and accord renounced as well for herself as for the children born or to be born of her marriage with the said Thomas O’Neill to all dowers and to all right of dowers whatsoever whether … or conventional or in virtue of any title whatever which she may or might have on the said above sold and described lots of land.

     To those presents personally came and appeared Judith Duffy, widow of the late John O’Neill, residing at ValCartier aforesaid which said Judith Duffy, after having taken communication and lecture was made to her, by Benjamin Lelievre, one of the undersigned notaries, of the foregoing deed of sale, which she declared well to understand, hath and doth hereby ratify, allow and confirm the same, being willing and agreeing that it be executed according to its full form, tenor and meaning, freely renouncing to all claims, pretentions and demands whatsoever she may or might have hand on the premises, therein described and sold and in consideration of the premises, the said Vendors do further cede, transfer, convey assign and make over all their right, title, interest, property, right of property claims and demands, whatsoever which they may or might have in to and over the said above sold and described lots of land and to and over every part and parcel thereof being willing and agreeing that the said purchaser his heirs and assigns do hold, use, occupy, possess and enjoy the same in full property from henceforth and forever and that he or they be put in good and lawful possession and investiture by and in virtue of these present. And for the due execution of these present the parties have made … of Domiciles at their actual residences at which place, thus promising, obliging, renouncing and ratifying.

     This done and executed in the District of Quebec aforesaid at ValCartier aforesaid, at the residence of the said vendors on the day and year first above written, under the number one thousand three hundred and six and the said vendors and purchaser have after the due reading, have signed with the said notaries having the said Judith Duffy declared that she could not write nor sign her name, but made her ordinary mark by a cross in faith and testimony of the promises. Marginal notes approved are goo. Words struck out are null.

My Notes:
The O’Neill’s moved to the farm at Little River shortly before they sold all of their land through this transaction. The Valcartier land had been in the family for over 40 years. It can only be assumed that Thomas believed the land at Little River would be more fertile and more productive than the Valcartier land.

On the thirteenth day of May in the year f our Lord one thousand eight hundred and eighty two, at the request of Joseph Harriet, Farmer, of the Parish of Ancienne Lorette, I the undersigned Public Notary went to the residence of the said Joseph Harriet in the said parish where I found him being sick of body, but apparently sound of mind, memory and understanding who requested me the undersigned Public Notary to write down and receive in the form of law his last will and testament which he instantly made and dictated unto me the undersigned Public Notary in the manner and form following, viz.:

1º I recommend my soul to the Almighty God, hoping for a free pardon and remission for all my sins and my body I commit to the earth to be buried in the cemetery, leaving the care of my funeral to my Executors.

2º I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my Executors hereinafter named.

3º I give and bequeath to my sons William and Richard Harriet, living with me, all my properties, possessions and effects real and personal of whatever kind and wherever situated, and all sums of money, which I may leave, at the time of my death, and I institute the said William and Richard Harriet my universal legatees in full property, en pleine propriété.

And lastly, I do hereby nominate and appoint my sons William and Richard Harriet my sole Executors, and in hands of whom I divest and disseize myself of all my estate and property according to law.

And I hereby revoke and make null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true and last will and testament.

It was thus made, dictated and named by the said Joseph Harriet to Mtre. Jos. Laurin, Notary, at the place aforesaid, in presence of Mr. Thomas O’Neill, Farmer, and Joseph Voyer, Coach Maker, both of the Parish of Ancienne Lorette, especially demanded for and to the effect of these presents, and the present last will and testament having been read in full to the said Testator by the said Jos. Laurin, Public Notary, in the presence of the aforesaid witnesses, he the said Testator declared that he had perfectly heard and understood the same and found it to contain his true last will and intentions, therefore persisted therein, at the place aforesaid, on the day, month and year first above written under the number eight thousand four hundred and twenty eight.

And in faith and testimony of the premises, the said Testator has signed his name in the presence of the witnesses, who have signed these presents in the presence of the said Testator and of the said Public Notary, and in the presence the one of the other, the said Public Notary having signed these presents in the presence of the said Testator and witnesses, these presents having been first duly read according to law.

On the twenty ninth day of August in the year of our Lord one thousand eight hundred and ninety four, before me Cyrille Renaud Notary residing in the Parish of St. Ambrosie of Jeune Lorette personally came and appeared Mary Hartery, wife of John McLaughin, Farmer residing in the Parish of St. Gabriel of Valcartier, who being of sound and disposing mind, memory and understanding hath requested us the said Notary to write down and receive in due form of law her last will and testament which she has declared in manner and form following, that is to say:

1º I most willingly resign my soul into the hands of Almighty God my Creator in the humble hope that he will receive it to his favor through the sole merits and intercession of Jesus Christ my Saviour.

2º I desire that all my just debts, funeral and testamentary expenses be paid by my executor herein after named as soon as possible after my death.

3º I give and bequeath to my husband all money that I can have in the Banks.

4º I give and bequeath to my two sons by equal share Francis Joseph McLaughlin and Thomas George McLaughlin all my other moveable and immoveable properties that I constitute my universal legatees.

5º I nominate, constitute and appoint my said husband John McLaughlin as Executor of this my will.

6º I revoke all wills and codicils I may have heretofore made and I declare the present to be my only true last will and testament.

The present will was thus declared by the said Testator to the said Notary in presence of Thomas Hartery and Mark McLaughlin both farmers of St. Gabriel of Valcartier & Ste. Catherine witnesses for the effects of these presents, read to the said Testatrix by said Notary in presence of said witnesses who declared to understand it fully and persist therein.

Done and passed at the residence of the said Testatrix under Notarial Number eight hundred and seventy seven. And after the reading of these presents the said Notary and witnesses have signed in presence of the Testatrix and in presence of each other, the said Testatrix having declared her inability by sickness has made her mark in presence of Notary and said witnesses.

Notes by Patricia Balkcom: Mary died two weeks later at the age of sixty years. The two sons mentioned in the will were her two youngest sons. She and John had seven known children.3

...The present sale, grant & transfer is further made in consideration and subject to a constituted and annual rent of one dollar and fifty cents currency representing the former cens and rentes at which land in the said Seigniory were formerly granted to the principal of twenty five dollars currency, said rent payable every year on the 11th of November...

Miss Catherine Hartery of the same place, spinster. Of the second part: and Thomas Hartery of the same place, farmer. Of the third part: Which said parties have covenanted and agreed together in manner following that is to say: The Said part of the first part did doth hereby give, grant and make over unto the said Thomas Hartery, her son, party of the third part, present and accepting hereof, for himself, his heirs and assigns that is to say: the whole of her property moveable and immoveable which she is now possessed, together with all the rights that she may have or may become entitled to in and to the communante de biens which has existed between her and her said husband, capital interest and revenue of every nature and kind whatsoever, whatever situation and to whatever the same may amount.

The said party of the second part did and doth hereby also by these presents, give, grant and make over unto the said Thomas Hartery, her brother, party of the third part, present and accepting hereof, for himself his heirs and assigns that is to say: all and singular the successive rights which she has or may become entitled to in and to the estate of the late Michael Hartery, her father deceased, moveable and immoveable, capital interest and revenue, due and to become due of every nature and kind whatsoever, whatever situate and to whatever the same may increase, that may ultimately come or be acquired by the renunciation of one or more of the co-heirs of the Said Succession, the whole without any exception or reserve.

The said parties of the first and second part do hereby moreover give, grant and make over unto the said Thomas Hartery all and singular their rights which they have or may become entitles to in and to that certain lot of land being known as number seventy-four on the official plan and in the book of Reference thereto for the said parish of St. Gabriel of Valcartier, and described as follows in a deed of sale by Widow John Neilson and others to Michael Hartery and passed before Mr. Aut. A. Parant, Notary at Quebec and bearing date at Quebec the seventeenth of June one thousand eight hundred and fifty one, that is to say:

“A lot of land situate and lying in the Parish of St. Ambroise, Fief of St. Gabriel, in the first concession of Valcartier, on the northwest side of River Jacques Cartier, containing ten arpents in front by fifteen arpents in depth bounded in front by the Queen’s Highway, in rear by a lot occupied by James and William Finlay, on one side by the Fossambault Seigniory line and on the other side Martin Moylen.”

To have, hold use and dispose of the said hereby donated goods unto the said Thomas Hartery from this day forth, they the said donors, substituting and subrogating the said Thomas Hartery in and to all their rights claims and privileges in the above gived and granted goods.

The present gift is thus made at the charge by the said done, who herself binds and obliges himself –

1st – To pay and acquit to the exoneration of the said donors the share for which they may be held liable of the debts and charges of the said communante de biens and Succession in such wise that they, the said donors shall not be hereafter troubled for on account thereof.

2nd – To pay all the rents, due, taxes, school taxes and assessments which might now affect or may I future affect the hereby granted immoveable property.

3rd – To pay all and singular the capital sums and interests mortgaged in the said hereby granted immoveable property.

4th – To pay on demand to the said Catherine Hartery a sum of one hundred dollars without interest.

5th – To keep with him and in his own house the said Dame Bridget Boyle and to provide her with all what is necessary for life and clothing.

And for securing the due execution of the above charges and conditions the said Thomas Hartery do hereby mortgage and hypothecate the hereby gived and granted immoveable property number twenty-four  (sic – should be seventy-four) of the official cadastral plan aforesaid, thus done and passed at the said parish of St. Gabriel of Valcartier at the residence of the said parties hereto, under number four hundred and five of the minutes of the said Notary. In faith and testimony whereof the said Thomas Hartery has to these presents first duly read set and subscribed his name and signature in presence of the said notary, the said Dame Bridget Boyle and Miss Catherine Hartery having declared unto one the said Notary do not know how to write nor sign their name but have made a mark of a cross in the presence of the said Notary subscribing.

Notes by Patricia Balkcom: Thomas died 12 days later. It appears that Thomas never married and had no children as heirs. He had four siblings but they all predeceased him, and so he left his estate to Francis McLaughlin, son of his sister, Mary.4
