On the twenty fourth day of February in the year one thousand eight hundred and seventy eight,

At the request of Henry Hicks, the elder, Boiler Maker, at present residing in the City of Quebec, I Charles Henry Andrews, Public Notary, duly commissioned and sworn and residing in the Parish of St. Sauveur near the City of Quebec and in my office in the Victoria Chambers in the City of Quebec, the said Henry Hicks being in good bodily health and of sound and perfect mind and understanding requested me the said Notary in the presence of John Redmond, Book Keeper, and Charles Fitzpatrick, Advocate with the City of Quebec witnesses to write down and receive his last will and testament which he dictated and named in manner and form following,

I will and direct that all my just debts and funeral expenses be paid after my decease that my funeral be conducted with as little expense as possible and that I be placed in the burying ground belonging to the Church of Scotland in the Parish of St. Gabriel of Valcartier.

I give and bequeath the proceeds of a certain policy of life insurance in the Canada Life office on my life and known under the number eleven hundred and ten to be divided in equal proportions before my children born in lawful wedlock with my deceased wife and also an equal share to my grand daughter Caroline Hicks, daughter of my son Henry; and also in equal shares to my children born and to be born of my present marriage with Malvina Mecteau, and should any of my said children at the time of my decease be under the age of twenty one years then I will and direct that their share or shares be paid to their mother, and should my aforementioned grand daughter not be of the age of twenty one years then I direct that her share be paid to her father Henry Hicks, the younger.

And to the rest and residue of my estate moveable and immoveable I give and bequeath the same to my wife Malvina Mecteau with the exception of my books which I desire divided among my sons of my first marriage and a portion of lot number two hundred and ninety three in the Parish of Valcartier on which a sawmill is built and containing the high way and one acre in depth and bounded in front to the south by the main road in rear to the north and to the east by the lot aforementioned the said portion of land together with the mill and its appurtances I give and bequeath the same to my sons Henry, Edward, and Samuel in equal shares.

And I hereby nominate and appoint Henry Joseph Hicks, my son, and James Hicks, my nephew, all of the Parish of Valcartier to be Executors of this my present last will and testament whose term of office shall continue beyond the term allowed by law hereby revoking and making null and void all former wills by me at any time previously made.

It was thus made, dictated, and named by the said Testator unto me the said Notary in the present will having been read to the said Testator who declared the same to contain his last wishes and hath signed.

Done and executed at the said City of Quebec on the day and year first above written and recorded in the office of Charles H. Andrews, the undersigned Notary, under the number two thousand six hundred and forty six the said Testator having signed the present last will together with the said witnesses and Notary.

Notes by Patricia Balkcom: Henry lived another 13 years (1891) after this will was made so it is possible that there is a later will. Henry had 5 known sons and 3 daughters with his first wife, Mary Ann Rolph. He then had three known daughters with his second wife, Malvina Mecteau.

On this day the eleventh of November nineteen hundred and two, before me the undersigned Notary Public for the Province of Quebec, residing and practicing in the City of Quebec, personally came an appeared Mr. John Hicks, farmer, residing in the parish of St. Gabriel of Valcartier, son of full age of majority of Mr. Joseph Hicks, farmer of the parish of St. Gabriel of Valcartier with Mrs. Alice Hill, his father and mother of the first part.-

And Miss Margaret Ann Corrigan, of the same parish, daughter of full age of majority of the marriage of the late Michael Corrigan, in his lifetime of the said parish of St. Gabriel of Valcartier, with Mary Jane Shea, of the second part.-

Which said parties have agreed as follows upon the civil clauses and conditions of the marriage which they intend to be solemnized between them, viz.:

There shall be no community property (communauté des biens) by and between the said parties, any law, usage or custom to the contrary notwithstanding.

The said parties shall be separated as to property to all intents and purposes, and shall not be in any way liable to or responsible for the debts of each other already contracted or which may be hereafter contracted by them respectively.

The said Margaret Ann Corrigan shall have the full & entire management & administration of all her property real & personal, moveable or immoveable, of which she is now possessed or may be possessed of thereafter, the said John Hicks hereby fully & irrevocably authorizing her to that effect.

The moveable effects at present possessed by the said Margaret Ann Corrigan consist of her wearing apparel, of all effects and jewelery to her personal use, a bedroom set in walnut, mattress, feather bed, pillows, one pair of blankets, one dozen of sheets, eight quilts, one dozen of pillow cases, five table cloths, one dinner set, a tea set, two chamber sets, one parlour table, one parlour lamp, one rocking chair, two pairs of curtains, half a dozen of knives & forks, one dozen of spoons, four window blinds, six plates, cups, and saucers, one side dish, one dozen glasses and one glass pitcher & tray, one water jug, two sets of cream jugs, butter dish & sugar bowls, kitchen utensils, and of the sum of four hundred dollars being the amount of her share & rights in the estate succession of her late father, the said Michael Corrigan.

The said John Hicks shall of himself bear and pay all the necessary personal expenses of the said Margaret Ann Corrigan and of the child or children who may be born of the present intended marriage as well as all the household expenses.

And the said John Hicks in consideration that there will be no community property between himself and the said Margaret Ann Corrigan did and by these presents doth give, grant, and make over by way of donation à titre de donation, pure, simple et irrevocable unto the said Margaret Ann Corrigan, hereof accepting in case one should survive the said John Hicks, the use, usufruct and enjoyment during her lifetime of all the property real & personal, moveable & immoveable generally whatsoever which the said John Hicks may die possessed of at the time of his death, the whole without the said Margaret Ann Corrigan being in any way & for any reason or cause, obliged to give bail or security of any kind for said usufruct from which obligation she is fully exempted and discharged as well as the obligation of causing our inventory of the same to be made and taken by express condition between the said parties hereto. On this day the eleventh of November nineteen hundred and two, before me the undersigned Notary Public for the Province of Quebec, residing and practicing in the City of Quebec, personally came an appeared Mr. John Hicks, farmer, residing in the parish of St. Gabriel of Valcartier, son of full age of majority of Mr. Joseph Hicks, farmer of the parish of St. Gabriel of Valcartier with Mrs. Alice Hill, his father and mother of the first part.-

And Miss Margaret Ann Corrigan, of the same parish, daughter of full age of majority of the marriage of the late Michael Corrigan, in his lifetime of the said parish of St. Gabriel of Valcartier, with Mary Jane Shea, of the second part.-

Which said parties have agreed as follows upon the civil clauses and conditions of the marriage which they intend to be solemnized between them, viz.:

There shall be no community property (communauté des biens) by and between the said parties, any law, usage or custom to the contrary notwithstanding.

The said parties shall be separated as to property to all intents and purposes, and shall not be in any way liable to or responsible for the debts of each other already contracted or which may be hereafter contracted by them respectively.

The said Margaret Ann Corrigan shall have the full & entire management & administration of all her property real & personal, moveable or immoveable, of which she is now possessed or may be possessed of thereafter, the said John Hicks hereby fully & irrevocably authorizing her to that effect.

The moveable effects at present possessed by the said Margaret Ann Corrigan consist of her wearing apparel, of all effects and jewelery to her personal use, a bedroom set in walnut, mattress, feather bed, pillows, one pair of blankets, one dozen of sheets, eight quilts, one dozen of pillow cases, five table cloths, one dinner set, a tea set, two chamber sets, one parlour table, one parlour lamp, one rocking chair, two pairs of curtains, half a dozen of knives & forks, one dozen of spoons, four window blinds, six plates, cups, and saucers, one side dish, one dozen glasses and one glass pitcher & tray, one water jug, two sets of cream jugs, butter dish & sugar bowls, kitchen utensils, and of the sum of four hundred dollars being the amount of her share & rights in the estate succession of her late father, the said Michael Corrigan.

The said John Hicks shall of himself bear and pay all the necessary personal expenses of the said Margaret Ann Corrigan and of the child or children who may be born of the present intended marriage as well as all the household expenses.

And the said John Hicks in consideration that there will be no community property between himself and the said Margaret Ann Corrigan did and by these presents doth give, grant, and make over by way of donation à titre de donation, pure, simple et irrevocable unto the said Margaret Ann Corrigan, hereof accepting in case one should survive the said John Hicks, the use, usufruct and enjoyment during her lifetime of all the property real & personal, moveable & immoveable generally whatsoever which the said John Hicks may die possessed of at the time of his death, the whole without the said Margaret Ann Corrigan being in any way & for any reason or cause, obliged to give bail or security of any kind for said usufruct from which obligation she is fully exempted and discharged as well as the obligation of causing our inventory of the same to be made and taken by express condition between the said parties hereto. On this day the ninth of July one thousand nine hundred and two, before the undersigned Notary Public for the Province of Quebec, Canada, residing and practising in the City of Quebec and before François Augustin Bedard, shoe maker, and Michel Boutet, Farmer, of the Parish of St. Gabriel of Valcartier, said County, wife of Joseph Hicks, Farmer, who has made as follows her last will and testament:

I give, devise and bequeath unto Alfred James Hicks, my son, all the property moveable and immoveable, real and personal which I may die possessed of, instituting him my universal legatee in full ownership, at the charge of paying his sister, Mary Ann, a sum of fifty dollars but on condition she doth renounce to all rights she may have on the immoveable property of my husband.

I do nominate my husband my Testamentary Executor and in default my said son. I do revoke all wills and testament I may have done before this day.

This last will and testament received by Jean Baptiste Delage, the undersigned Notary, in the presence of said witnesses, having been read to the Testatrix by the said Notary, in the presence of said witnesses, she has declared well to understand the same and has persisted in the same as containing her last intentions.

Thus done and executed at St. Ambroise, office of said Notary, under the number fourteen thousand two hundred & ninety four of his records.

In witness whereof the said Testatrix has signed with and in the presence of said Notary and witnesses, who have also signed with and in the presence of said Testatrix and in the presence of one another, these presents being first duly read.

Notes by Patricia Balkcom: Two of three known children are mentioned in this will. Son, John, married to Margaret Corrigan is not. Alice did 32 years (14 June 1934) after this will was written so it is possible there is a later will.
