Will* | 12 December 1890 | Stoneham, Quebec County, Quebec, Canada; 12th December 1890 Will of Robert Johnson Husband of Ellen Shea From records of Notary Philippe Huot No. 9555 Transcribed from Quebec Archives Microfilm #4M01-5213 On this day, the twelfth of December one thousand eight hundred and ninety, before us the undersigned Notaries Public for the Province of Quebec, residing at Quebec, personally came and appeared Mr. Robert Johnson, Farmer, of Stoneham, who being in tolerably good health but of sound mind, memory & understanding requested us the said Notaries to write down & receive his last will and testament which he dictated & made as follows, that is to say: I give and bequeath unto my son Joseph Johnson, Farmer, now residing with me all and every the property real and personal, moveable and immoveable generally whatsoever without any exception or reserve and of which I may die possessed of, on condition however & subject by him to allow his mother if she survives me to enjoy the same & have the usufruct thereof during her life time, subject also by my said son to pay unto his sister Barbara Helen Johnson a sum of fifty dollars without interest two years after she will have left the house and residence of her parents. I hereby appoint my said wife Executrix of the present will & I revoke all wills and codicils at any time heretofore by me made. It was thus made and dictated by the said Robert Johnson unto us the said Notaries, on the day and year first above written and the present will having been read over in full to the said Testator by Mtre. Philippe Huot, one of us, in the presence of Mtre. George alias Gustave F.C. De Léry, who was present during the execution hereof, he the said Testator declared to well understand the same & persisted therein as containing his true last will & testament. Done and executed at the said City of Quebec, in the office of the said Philippe Huot on the day and year first above written, under the number nine thousand five hundred and fifty five of deeds recorded in the office of the said Philippe Huot, in testimony whereof the said Testator hath signed with and in the presence of the said Notaries who have also signed in the presence of the said Testator and in the presence of each other, after the reading hereof according to law and the observance of all the formalities required for the validity of wills. Words erased are null. One marginal note approved is good. Robert Johnston, his signature; G.F.C. de Léry, N.P, his signature; P. Huot, N.P., his signature _______________ NOTE: The spelling Johnston is used throughout the will and Robert signed his name “Johnston”. However, all the church records use the spelling Johnson which I have taken the liberty to use here. Robert Johnson and Ellen Shea were married on 5 April 1842 (Quebec Wesleyan Methodist Church). If Daniel my son will not agree to these arrangements, viz. to take good care of me until I die the present Will will be null and void and my last anterior Will will be good and valid. 4º I choose as Executor of my will the parish priest who will be in this parish of Valcartier after my death. These presents are the true conditions of this my will that my son Daniel and daughter-in-law takes good care of me until death, if I have complaints to make and am obliged to leave them because of neglects or ill treatment by them before death, then this last will which I make will be null and void. But if they are kind to me until death and I die with them then this my last Will will be good and valid and I revoke all other wills and codicils I may have heretofore made. Done and passed at Valcartier in the residence of Daniel Kack under Notarial Number two thousand nine hundred and ninety four. And after the reading of the said will by the Notary to the Testator in presence of William Montgomery and Lawrence Laughren, both of the Parish of Valcartier, Farmers, witnesses requested for these presents, the Testator having declared his inability to sign his name by sickness has made his mark in presence of witnesses and Notary and the Notary and witnesses have signed in presence of Testator and in presence of each other. (Witness) Will | 19 May 1907 | Mary Kack; St-Gabriel-de-Valcartier, Quebec County, Quebec, Canada; 19th May 1907 Will of Esther Kack Widow of Patrick Brophy From the Notary Records of Cyrille Renaud Record #3597 Transcribed from the Original Will at the Quebec Archives On this nineteenth day of May, one thousand nine hundred and seven, before me Cyrille Renaud Public Notary residing in the parish of St. Ambroise of Jeune Lorette undersigned, personally appeared Esther Kack, widow of Patrick Brophy, residing in the Parish of St. Gabriel who has requested me the said Notary to write down and receive in due form of law her last will and testament which she has declared in manner and form following, that is to say: 1º I desire that the sum of about fifty dollars be expenses for my funeral and the anniversary service. 2º I desire that the sum of fifty dollars be expended for a head stone for me and my late husband Patrick Brophy. 3º I give and bequeath the sum of fifty dollars to Mary Ann Kiely as payment of her trouble during my sickness. 4º I give and bequeath to Daniel Kack all my house furniture and the sum of ten dollars which he owes to me. 5º I desire that the remainder of my money be employed for the payment of masses for my soul and the soul of my late husband Patrick Brophy after the payment of my debts. 6º I nominate and appoint the Reverend Hugh McGratty, Priest of St. Gabriel of Valcartier, as Executor of this my will and testament. 7º I revoke all wills I may have heretofore made and I declare the present to be my only true last will and testament. Done and passed at St. Gabriel of Valcartier at the Presbytery, under Notarial Number three thousand five hundred and ninety seven. And after the reading of the said will to the said Testatrix by the Notary in presence of Alexandre Boucher, Doctor residing at St. Ambroise and Charles Wolff, Farmer residing at Valcartier, the Testatrix having declared her inability to sign her name has made her mark in presence of the Notary and witnesses and the Notary and witnesses have signed in presence of the Testatrix and in the presence of each other. Esther was 68 years old and she did not have any children. Her husband, Patrick, had died seven months earlier. She left her estate to Daniel Kack, her nephew.3 |
