On the seventeenth day of the month of November in the year of our Lord eighteen hundred and seventy six, at the request of Patrick Kennedy, Farmer, of the Parish of St. Catherine, I the Public Notary undersigned went to the residence of the said Patrick Kennedy in the said Parish of St. Catherine, where I found the said Patrick Kennedy being apparently sick of body but sound of mind, memory and understanding who requested me the undersigned Public Notary to write down and receive in due form of law, his last will and testament which he instantly made and dictated unto me the undersigned Public Notary in the manner and form following, viz.:

1º I recommend my soul to the Almighty God, hoping for a free pardon and remission for all my sins and my body I commit to the earth to be buried in the cemetery, leaving the care of my funeral to my Executor.

2º I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my Executor hereinafter named.

3º I give and bequeath to my son, Patrick Kennedy, living with me, all my properties, possessions and effects real and personal of whatever kind and wherever situated, and all sums of money, which I may leave, at the time of my death, and I institute the said Patrick Kennedy my universal legatee in full property, en pleine propriété.

And lastly, I do hereby nominate and appoint my son my sole Executor, and in hands of whom I divest and disseize myself of all my estate and property according to law.

At the charge by the said Patrick Kennedy, my universal legatee, to pay to my daughter, Ann Kennedy, twenty pounds currency, after four years from this day.

And I hereby revoke and make null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true and last will and testament.

It was thus made, dictated and named by the said Testator to Mtre. Jos. Laurin, Notary, at the place aforesaid, in presence of Mr. James Shea, Labourer, and Michael Donovan, Farmer, both of the aforesaid Parish of St. Catherine, especially demanded for and to the effect of these presents, and the present last will and testament having been read in full to the said Testator by the said Jos. Laurin, Public Notary, in the presence of the aforesaid witnesses, he the said Testator declared that he had perfectly heard and understood the same and found it to contain his true last will and intentions, therefore persisted therein, at the place aforesaid, on the day, month and year first above written under the number seven thousand four hundred and twenty.

And in faith and testimony of the premises, the said Testator has signed these presents in the presence of the witnesses above named and of the said Public Notary, who have all signed these presents in the presence of the one and the others, these presents having been first duly read according to law.

Note by Patricia Balkcom: Patrick died about 18 months later on May 29, 1881 at about the age of 81 years. At first this Will sounded to me as if he was specifically disinheriting his wife but she wrote the same Will on the same day so they must have made an agreement that their son, Patrick, would care for them and then inherit their property. They had eight known children, two of whom had predeceased them.3

On this day, the fourth of December one thousand eight hundred and seventy one, before the undersigned Notary Public for the Province of Quebec, residing in the City of Quebec, and William McBain, Esquire, Justice of the Peace, and Joseph Harriot, Farmer of the place called Valcartier, County of Quebec, witnesses to these presents, personally came and appeared Andrew Kerr, of the said place of Valcartier, Yeoman, heretofore of the Township of Warwick, County of Lambton, in the Province of Ontario, Farmer, who being of ill health but of sound and disposing mind, made as follows his last will & testament.

I give, devise and bequeath to Margaret Kerr, of said place of Valcartier, my daughter, wife of James McCartney, of the same place, Farmer, all the property, real and personal, moveable and immoveable that I may die possessed of instituting her the said Margaret Kerr, my universal legatee in full ownership at the charge only, if I have enough money on the day of my death, of putting a headstone in the grave yard of St. Andrew Church of Valcartier where I wish to be buried.

The present last will & testament received by Jean-Baptiste Delage, the undersigned Notary, having been read to the said Testator in the presence of the said witnesses, he declared well to understand the same and has persisted in the same as containing his last intentions.

Thus done and executed at Valcartier aforesaid, dwelling of the said Testator, on the day and year first above written, under the number two thousand six hundred and twenty eight of the records of the said Jean-Baptiste Delage.

In testimony whereof the said Testator has signed in the presence of the said Notary & witnesses who have also signed in the presence of the said testator and in the presence of one another after the reading done according to law.

One marginal note is good & eight words erased are null.
