Which said David McBain being in good health and sound of mind, memory, and understanding as appeared to us said notaries by his actions and words, and for the purpose of these presents came in the office of Benjamin Lelièvre, one of the undersigned notaries, where his colleague was duly called. And the said David McBain considering the certainty of death and the uncertainty of the hour thereof doth make, publish, declare, and dictate to the said Benjamin Lelièvre and his colleague notaries being present, his last Will and Testament in manner following, That is to say, the said David McBain recommends his soul to God, his Creator, hoping for a free pardon and remission of all his sins through the intercession of his blessed son, our Saviour. And desires that his body be buried at the discretion of his executor hereinafter named. The said David McBain directs that all his just and lawful debts be paid by his executor hereinafter named. The said David McBain doth further bequeath and give unto the said Mary and John McBain all the household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, with the exception of his share in a crank mahogany clock which he doth hereby bequeath unto the said Elizabeth McBain, after the decease of the said Mary Arthurson his said wife, to whom he doth give and bequeath the enjoyment or usufruct as aforesaid.- The said hereby given and bequeathed lot of land and dependencies, household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, to be equally and fairly divided between the said Mary and John McBain after the decease of the said Mary Arthurson his said wife as aforesaid.- And in the event of the said Mary Arthurson his said wife selling or in any other manner alienating the property or any part thereof, either moveable or immoveable, solely belonging to her according to the Law of the Country or according to the Law of any Country, then said and in that case, it is the express wish and intention of the said David McBain, that the bequeath of the enjoyment or usufruct made to her by this his present will, doth become null and void, and that the said children do respectively after such alienation, take possession of the premises given and bequeathed to them by his last will and testament. The said David McBain hereby annulling, cancelling, abrogating, and making void all former will or wills which may have been heretofore made and executed by him the said David McBain. And the said David McBain doth hereby nominate and appoint the said Mary Arthurson his said wife his executor to this his last will and testament. The said David McBain, her said husband, to have, use, and enjoy the said lands, goods, merchandise, real and personal estates, sum and sums of money as aforesaid, during his natural life time only, whom she doth make and constitute her universal legatee during his natural life time as aforesaid.- As to the full property of all, each, and every her lands, goods, merchandise, real and personal estates, sum and sums of money or otherwise of which is now possessed or may be possessed of at the day of her decease, the said Mary Arthurson doth hereby give and bequeath them (saving and rendering the bequeath hereinafter mentioned, made to Mary McBain and John McBain, two of her children, who are deaf and dumb and issue of her marriage with the said David McBain her said husband) unto said David McBain, Elizabeth McBain, wife of Louis David Dubord, Esquire, Doctor, William McBain, James McBain, and Arthur McBain, her children issue of her marriage with the said David McBain, her said husband. The said goods, lands, merchandise, real and personal estates, sum and sums of money or otherwise to be by the said David, Elizabeth, William, James, and Arthur McBain, equally and fairly divided between them share and share alike and that after the decease of the said David McBain, her said hus[no number specified] in the third concession of Valcartier, containing three arpents in front by thirty in depth, bounded in front by the King's Road and in the rear to the property of Mr. Plante, joining on one side to John Neilson Esquire and on the other side to William Brown, together with the house, barn, stable, and other buildings thereon erected and such as the whole, may be after the decease of the said David McBain her said husband, now stands without any reserve whatever. The said Mary Arthurson doth further bequeath and give unto the said Mary and John McBain all the household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, with the exception of her share in a crank mahogany clock which she doth hereby bequeath unto the said Elizabeth McBain, after the decease of the said David McBain her said husband, to whom she doth give and bequeath the enjoyment or usufruct as aforesaid. The said hereby given and bequeathed lot of land and dependencies, household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, to be equally and fairly divided between the said Mary and John McBain after the decease of the said David McBain her said husband as aforesaid.- And in the event of the said David McBain her said husband selling or in any other manner alienating the property or any part thereof, either moveable or immoveable, solely belonging to him according to the Law of the Country or according to the Law of any Country, then said and in that case, it is the express wish and intention of the said Mary Arthurson, that the bequeath of the enjoyment or usufruct made to him by this her present will, doth become null and void, and that the said children do respectively after such alienation, take possession of the premises given and bequeathed to them by her last will and testament. The said Mary Arthurson hereby annulling, cancelling, abrogating, and making void all former will or wills which may have been heretofore made and executed by her the said Mary Arthurson. And the said Mary Arthurson doth hereby nominate and appoint the said David McBain her said husband her executor to this her last will and testament. Thus done, made, dictated and named by the said Mary Arthurson to the said Benjamin Lelièvre in the presence of his colleague notaries in the office of the said Benjamin Lelièvre at Quebec, on the day and year first above written and the present last will and testament having been read and re-read to the said Mary Arthurson, which she declared well to understand as being her last will and meaning, she doth after the reading and re-reading thereof as aforesaid, declared that she can not sign. Sixthly, after the death of the said Susan Brown I desire that all my said property moveable & immoveable shall be divided between all my children which shall have remained at my home and shall have worked to the profit of said home and family until their age of majority. I nominate, constitute and appoint Thomas Brown and William Brown McBain, farmers of Valcartier, as Executors of this my will with power to them alone to collect the amount of my policy, pay the mortgage & collect all sum of money due to me. Picard No. 341 Quebec Archives Online On this day the fifth of July in the year of our Lord one thousand eight hundred and seventy eight, Before the undersigned Notary Public, for the Province of Quebec, in the Dominion of Canada, residing at the parish of St. Ambroise of la Jeune Lorette and the witnesses herein after named and subscribed, Personally came and appeared Mr. Arthur McBain Senior, of the parish of St. Gabriel of Valcartier, in the County of Quebec, farmer, who being in weak bodily health, but of sound mind, memory, and understanding as to us appeared by his manner & conversation, hath requested of us the said Notary to receive and reduce into writing this his Last Will and Testament which the said Notary in the presence of the said witnesses have taken down as dictated to us the said Arthur McBain word for word and as follows, that is to say: Iº I recommend my soul to God asking him the everlasting beatitude by the merits of Jesus Christ, my Saviour. IIº I wish & direct that my internment & the manner thereof shall be according to the direction of Executors herein after named. IIIº I wish that my just and lawful debts shall be paid & satisfied with my property moveable and immoveable with which I hereby charge my said Executors herein after named. IVº I do hereby give and bequeath unto Elizabeth Billings, my wife, all and every my property moveable and immoveable, all sum and sums of money that I may possess of the day of my decease instituting her, my said wife, my universal "legatee en propriété" and to be completed from the day of my decease as the condition that my wife never get married again in the case of that said marriage of my said wife Elizabeth Billing, all my said property, moveable and immoveable will be equally divided between my children named as follows: Mary Ann, John Joseph, Agnes, Arthur, Thomas and nothing to David and Curtis McBain on account of having received their shares already. And for the execution of the present my Last Will and Testament I do hereby nominate and appoint Messr. Thomas Brown and Curtis Billings, both of the Parish of Valcartier, farmers, in favor of whom I do in conformity to the law & custom of this Province disseize and divest myself of all my property for the ends hereof, hereby revoking all other wills and codicils and testaments that I may have made prior to the present my Last Will and Testament to which alone I do adhere as my true instructions and last will. Thus done and dictated word for word & published & declared by the said Testator, Arthur McBain, for & as his Last Will and Testament to and in the presence of the said Notary and Frederic Logie Tweddle and Frederic Lainez, witnesses expressly called and required for the effect hereof, in the day and year as above written under the number three hundred and forty one of the Minutes of the said Notary. In faith and testimony whereof the said Testator, Arthur McBain, has signed his name when requested so to do in the presence of the said Notary & the said witnesses who have hereunto set & subscribed their respective names & signatures after due reading of these presents.
