On this day the fifth of July in the year of our Lord one thousand eight hundred and seventy eight,

Before the undersigned Notary Public, for the Province of Quebec, in the Dominion of Canada, residing at the parish of St. Ambroise of la Jeune Lorette and the witnesses herein after named and subscribed,

Personally came and appeared Mr. Arthur McBain Senior, of the parish of St. Gabriel of Valcartier, in the County of Quebec, farmer, who being in weak bodily health, but of sound mind, memory, and understanding as to us appeared by his manner & conversation, hath requested of us the said Notary to receive and reduce into writing this his Last Will and Testament which the said Notary in the presence of the said witnesses have taken down as dictated to us the said Arthur McBain word for word and as follows, that is to say:

Iº I recommend my soul to God asking him the everlasting beatitude by the merits of Jesus Christ, my Saviour.

IIº I wish & direct that my internment & the manner thereof shall be according to the direction of Executors herein after named.

IIIº I wish that my just and lawful debts shall be paid & satisfied with my property moveable and immoveable with which I hereby charge my said Executors herein after named.

IVº I do hereby give and bequeath unto Elizabeth Billings, my wife, all and every my property moveable and immoveable, all sum and sums of money that I may possess of the day of my decease instituting her, my said wife, my universal "legatee en propriété" and to be completed from the day of my decease as the condition that my wife never get married again in the case of that said marriage of my said wife Elizabeth Billing, all my said property, moveable and immoveable will be equally divided between my children named as follows: Mary Ann, John Joseph, Agnes, Arthur, Thomas and nothing to David and Curtis McBain on account of having received their shares already.

And for the execution of the present my Last Will and Testament I do hereby nominate and appoint Messr. Thomas Brown and Curtis Billings, both of the Parish of Valcartier, farmers, in favor of whom I do in conformity to the law & custom of this Province disseize and divest myself of all my property for the ends hereof, hereby revoking all other wills and codicils and testaments that I may have made prior to the present my Last Will and Testament to which alone I do adhere as my true instructions and last will.

Thus done and dictated word for word & published & declared by the said Testator, Arthur McBain, for & as his Last Will and Testament to and in the presence of the said Notary and Frederic Logie Tweddle and Frederic Lainez, witnesses expressly called and required for the effect hereof, in the day and year as above written under the number three hundred and forty one of the Minutes of the said Notary.

In faith and testimony whereof the said Testator, Arthur McBain, has signed his name when requested so to do in the presence of the said Notary & the said witnesses who have hereunto set & subscribed their respective names & signatures after due reading of these presents.

On his day the third of April in the year of our Lord one thousand eight hundred and thirty four before us the undersigned Notaries Public duly admitted and sworn of and for the Province of Lower Canada residing in the city of Quebec personally came and appeared David McBain, of the Parish of St. Ambroise, farmer.

Which said David McBain being in good health and sound of mind, memory, and understanding as appeared to us said notaries by his actions and words, and for the purpose of these presents came in the office of Benjamin Lelièvre, one of the undersigned notaries, where his colleague was duly called. And the said David McBain considering the certainty of death and the uncertainty of the hour thereof doth make, publish, declare, and dictate to the said Benjamin Lelièvre and his colleague notaries being present, his last Will and Testament in manner following, That is to say, the said David McBain recommends his soul to God, his Creator, hoping for a free pardon and remission of all his sins through the intercession of his blessed son, our Saviour. And desires that his body be buried at the discretion of his executor hereinafter named.

The said David McBain directs that all his just and lawful debts be paid by his executor hereinafter named.

The said David McBain doth hereby give and bequeath the enjoyment or usufruct of all, each, and every said lands, goods, merchandise real and personal estates, sum or sums of money or otherwise of which he is now possessed of or may be possessed of at the day of his decease, without any reserve, restriction, limitation and whatever and wherever the same may be found whether in this Province of Lower Canada or elsewhere, unto the said Mary Arthurson, his dearly and beloved wife.

The said Mary Arthurson, his said wife, to have, use, and enjoy the said lands, goods, merchandise, real and personal estates, sum and sums of money as aforesaid, during his natural life time only, whom he doth make and constitute his universal legatee during his natural life time as aforesaid.

The said David McBain doth hereby give and bequeath unto the said Mary Mc[no number specified] in the third concession of Valcartier, containing three arpents in front by thirty in depth, bounded in front by the King's Road and in the rear to the property of Mr. Plante, joining on one side to John Neilson Esquire and on the other side to William Brown, together with the house, barn, stable, and other buildings thereon erected and such as the whole, may be after the decease of the said Mary Arthurson his said wife, now stands without any reserve whatever. The said David McBain doth further bequeath and give unto the said Mary and John McBain all the household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, with the exception of his share in a crank mahogany clock which he doth hereby bequeath unto the said Elizabeth McBain, after the decease of the said Mary Arthurson his said wife, to whom he doth give and bequeath the enjoyment or usufruct as aforesaid.-

The said hereby given and bequeathed lot of land and dependencies, household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, to be equally and fairly divided between the said Mary and John McBain after the decease of the said Mary Arthurson his said wife as aforesaid.-

And in the event of the said Mary Arthurson his said wife selling or in any other manner alienating the property or any part thereof, either moveable or immoveable, solely belonging to her according to the Law of the Country or according to the Law of any Country, then said and in that case, it is the express wish and intention of the said David McBain, that the bequeath of the enjoyment or usufruct made to her by this his present will, doth become null and void, and that the said children do respectively after such alienation, take possession of the premises given and bequeathed to them by his last will and testament.

The said David McBain hereby annulling, cancelling, abrogating, and making void all former will or wills which may have been heretofore made and executed by him the said David McBain.

And the said David McBain doth hereby nominate and appoint the said Mary Arthurson his said wife his executor to this his last will and testament.

Thus done, made, dictated and named by the said David McBain to the said Benjamin Lelièvre in the presence of his colleague notaries in the office of the said Benjamin Lelièvre at Quebec, on the day and year first above written and the present last will and testament having been read and re-read to the said David McBain, which he declared well to understand as being his last will and meaning, he hath together with us said Notaries set and subscribed his name and signature, after reading and re-reading thereof as aforesaid.

Notes by Patricia Balkcom: Mary and her husband, David McBain, both wrote a will on the same day. David died seven months later, Mary lived another twenty-one years and remarried. I imagine that they wanted to make sure that two of their children who were “deaf and dumb” were taken care of.5

On this day the fifth of March one thousand eight hundred and ninety, before the undersigned Public Notary for the Province of Quebec, Canada, residing in the City of Quebec, and Ambroise Derouin and Joseph Durand, of the Parish of St. Ambroise, County of Quebec, witnesses to these presents, personally came and appeared William McBain, Senior, Esquire, of the Parish of St. Gabriel of Valcartier, in the County of Quebec, Farmer, who has made his last will and testament as follows:

1st I give, devise and bequeath unto my son, Arthur McBain, all and every share I have in a certain lot of ground situate in the said Parish of St. Gabriel of Valcartier, Seigniory of St. Gabriel, Third Concession of St. Gabriel East, which lot is now known and designated upon the Plan and Book of Reference thereto for the said Parish of St. Gabriel of Valcartier under number (126) one hundred and twenty-six, subject to the paying to his brother, John McBain, the sum of twenty five dollars when he becomes in possession of said lot of ground above mentioned.

2nd I give, devise and bequeath to my other son, Lewis David Dubord McBain, all and every share I have in other lots of ground situate in the said Parish of St. Gabriel of Valcartier, said Seigniory, Fifth Concession, which lots being now known and designated upon the official Plan and Book of reference thereto for said Parish of St. Gabriel of Valcartier, under the numbers (332 & 337) three hundred and thirty two and three hundred and thirty seven, with also my share in all moveable property, stock, farming utensils & implements I may on the day of my death, instituting him my universal legatee, subject however to the charge of paying my funeral expenses and the costs of a good grave stone, which he will be bound to be erected to my memory within six months after my death, and also subject to pay to his brothers, Thomas Scott McBain and Benjamin McBain, and to his sister, Mary Margaret McBain, twenty five dollars each; the first sum to be paid to Thomas Scott McBain twelve months after my death, second following year to his brother, Benjamin, and third year to his sister, Mary Margaret McBain.

3rd I revoke all other wills and testaments I may have made before this day.

This last will and testament received by Jean-Baptiste Delage, in the presence of said witnesses having been read to the said Testator by the said Notary in the presence of the said witnesses, he declared to well understand the same and has persisted in the same as containing his last intentions.

Thus done and executed at St. Ambroise under the number ten thousand one hundred and fifty two of the records of said Notary,

On this day the fourth of July in the year of our Lord one thousand eight hundred and thirty two, We the undersigned Notaries Public duly admitted and sworn of and for the Province of Lower Canada and residing at the City of Quebec at the request of Ann McBride, widow of the late William Bethel, in his life time of Queen's County in the Parish [Barony] of Upperwoods in the Kingdom of Great Britain and Ireland in that part called Ireland, went to the residence of her, the said Ann McBride situate and being at the City of Quebec aforesaid at Nicholas Street there being, we fund the said Ann McBride lying sick in bed nevertheless sound of mind, memory and understanding as appeared to us said Notaries.

And the said Ann McBride considering the certainty of death and the uncertainty of the hour thereof doth make, publish, declare and dictate to us the said Notaries being present her last will and testament in manner and form following, that is to say:

The said Ann McBride recommends her soul to God her Creator and desires that her body be buried at the discretion of her executor hereinafter named.

The said Ann McBride doth give and bequeath all, each and every her lands, goods, merchandise, real or personal estates, sum & sums of money, otherwise without any reserve, restriction or limitation whatever and wherever the same may be whether in the Province of Lower Canada or elsewhere unto John Bethel her son of the said City of Quebec, Master shoemaker.

The said John Bethel to have, hold, use & enjoy the said lands, goods, merchandise, real or personal estates, sum and sums of money as aforesaid in full property and forever.

And the said Ann McBride doth hereby nominate and appoint as Executor of this her last will & Testament the said John Bethel, hereby annulling, cancelling, abrogating and making void all former will or wills by her the said Ann McBride heretofore made and executed.

Thus done, made and dictated word by word by the said Ann McBride to Benjamin Leliévre in the presence of his colleague Notaries at the residence of the said Ann McBride situate as before mentioned, and the said last will and testament having been read and re-read to the said Ann McBride which she declared well to understand as being her last will and meaning she the said Ann McBride persisted therein, and the said Ann McBride hereby declaring that she could not sign the said Notaries having set and subscribed our names and signatures in faith and testimony and subscribe of the premises.

On the fourteenth day of June in the year of our Lord one thousand eight hundred and seventy three, at the request of Samuel Clark of the Parish of St. Gabriel de Valcartier, farmer, at the residence of James Burns, Farmer, of the same place, and in the presence of George Todd and James Burns, both of the same place, Farmers, I the undersigned Notary duly commissioned and sworn and residing at the City of Quebec in the Province of Quebec did receive and write down his his last will and testament which he made and dictated in manner and form following, that is to say:

I will and direct that all my just debts and funeral expenses be paid and satisfied as soon as possible after my decease.

I will and bequeath unto my son, Samuel Clark, the lot of land I now reside on which is number nineteen of the first range of River aux Pins St. Gabriel West, together with all the moveable effects, horses, cows and stock which I may die possessed of subject to the payment by the said Samuel Clark to his mother Bridget McCabe of the sum of two hundred and forty dollars currency in case of his said mother not residing or wishing to reside with my said son and as soon as she may demand payment thereof. And in case the said Bridget McCabe residing with my said son then I will and direct that he shall clothe, board and lodge during her life his said mother and also the use of a said milk cow, the fencing and housing of said cow to be at cost of my said son and also to pay his brother William Clark the sum of eighty dollars when he comes the age of twenty one years. I also will and bequeath unto my said son Samuel number eight of the first range of the North West side of the River aux Pins, Parish of Valcartier, and the right of cutting and using to my son William of one half of the timber which may be on the said lot, and Samuel shall pay to my said son William the sum of two hundred dollars when he shall attain the age of majority.

I will and bequeath unto my said son William whatever money or moneys I may die possessed of to be his own property to do as he may deem fit as soon as he becomes of age, my said wife Bridget McCabe to have the enjoyment thereof until such time as he attains the age of majority.

And the said Bridget McCabe, wife of the said Samuel Clark, being present also doth will and direct that the present will be carried out according to its true intent and meaning.

It was thus made, dictated and named by the said Samuel Clark unto the said Notary in the presence of the said George Todd and James Burns witnesses, after the present will having been read to him the said Testator by me the said Notary he declared to well understand the same and persisted therein declaring it to be his true last will and testament.

Done and executed at the said Parish of St. Gabriel de Valcartier at the residence of the said James Burns on the day and year first above written and recorded in the office of Charles H. Andrews, the undersigned Notary, under the number one thousand seven hundred and nineteen the said Testator & witnesses having signed and the said Bridget McCabe having declared she could not sign.
