On the twenty ninth day of September in the year of our Lord one thousand eight hundred and fifty eight at the Parish of Saint Catherine, in the District of Quebec, before the undersigned Notary Public duly commissioned and sworn in and for the Province of Lower Canada, residing at the City of Quebec, and the witnesses hereinafter named, personally came and appeared James Meehan of the said Parish of Sainte Catherine in the said District of Quebec, farmer, who labouring under bodily sickness but of sound and perfect mind, memory and understanding, requested the said Notary to write down and receive in due form of law his last will and testament which he instantly published, made and dictated word for word unto the said Notary in presence of the said witnesses, in manner and form following, viz.:

Firstly, I recommend my soul to Almighty God, hoping for a free pardon and remission of all my sins through the intercession of his Blessed Son, my Saviour Jesus Christ, and my body I commit to earth to be interred in a suitable manner to my situation in life.

Secondly, I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my testamentary executrix hereinafter named.

Thirdly, I give and bequeath unto Catherine Mulcaire, my wife, all and every my moveable and immoveable property which I may die possessed of at the time of my decease, for and by the said Catherine Mulcaire to do use and dispose of the same in full and entire propriety from the day of my decease, hereby instituting her my universal legatee of my said moveable and immoveable properties, real and personal, provided she shall not contract a second marriage, and if she did do so, she shall be bound to make before the second marriage a faithful inventory of all my said moveable and immoveable property, real and personal and to render a regular and faithful account of the same to the children then issued and to be issue of my present marriage with her the said Catherine Mulcaire to which said children, I (in the case herein before mentioned) give and bequeath my said moveable and immoveable properties, real and personal, for and by them to do, use and dispose of the same by equal shares and portion between them in full propriety and forever.

Fourthly and lastly, I do nominate and appoint by these presents the said Catherine Mulcaire to be executrix of my present last will and testament and I hereby revoke and make null and void all other wills and codicils at any time heretofore by me made declaring the present to be my only true last will and testament.

It was thus made, dictated and named (dicté et nommé) word for word by the said James Meehan to the said Notary in the presence of Patrick Condon and Michael Hickey both of the said Parish of Saint Catherine, farmers, witnesses duly required by the said James Meehan at his residence in the said Parish of Saint Catherine on the day, month and year first above written and the said last will and testament having afterwards been read in full over and over again lu et relu to the said James Meehan by the said Notary, in the presence of the said witnesses, he declared that he had perfectly heard and understood the same and found it to contain his true will & intention, therefore he persisted therein, under the number four thousand eight hundred and fifty one, the said James Meehan hath declared not to know how to write or sign his name in the presence of the said witnesses who have signed with the said Notary, first duly read and read over according to law.

Eight words erased are null and three marginal notes approved are good.

On the fifth day of June in the year of our Lord one thousand eight hundred and forty nine, at the City of Quebec, in the Province of Canada, before the undersigned Notaries duly commissioned and sworn in and for that part of the said Province called Lower Canada and residing in the said City of Quebec personally came and appeared: - Judy Meehan of the Parish of St. Catherine’s in the District of Quebec, the wife of Patrick McKenna of the same place, farmer, who being apparently in good bodily health and of sound and perfect mind, memory and understanding requested us the said Notaries to write down and receive in due form of law her last will and testament which she instantly published, made and dictated word for word unto us the said Notaries in manner and form following, viz. -

I recommend my soul to Almighty God, hoping for a free pardon and remission of all my sins through the intercession of His Blessed Son and Saviour Jesus Christ and my body I commit to earth to be interred in a manner suitable to my situation in life.

I will and direct that all my just debts be fully paid and satisfied out of my estate and property by the Executors hereinafter named.

I give my bed and bedding unto Rose McKenna, my daughter, the wife of John McQuillan of St. Catherine’s aforesaid, Farmer.

I give and bequeath unto the said Rose McKenna the sum of ten pounds lawful current money of the said Province to be paid to her in five equal annual payments of two pounds each.

I give and bequeath the usufruct et jouissance of all my property, moveable and immoveable unto my beloved husband Patrick McKenna: To have and to hold the same undisturbed during his natural life, and neither of my legatees, particular or universal will be entitled to their respective legacies during his life time for such is my will and intention.

And as to the whole of my property moveable and immoveable, I give and bequeath the same subject to the legacies herein contained after the decease of the said Patrick McKenna, unto my son John McKenna, of what nature or kind so ever which I may die possessed of and wherever the same may be at my death, hereby instituting the said John McKenna his heirs and assigns my universal legatee.

And lastly I do nominate and appoint by these presents the said Patrick McKenna and John McKenna to be executors of this my present Last Will and Testament, hereby empowering them to act jointly or separately in whose hands I hereby divest myself of the whole of my property according to law, hereby willing and directing that their executorship shall not end at the expiration of a year and a day after my decease, but that they shall continue and remain as such executors with all powers and rights thereunto until the full end and complete execution of this my present last will and testament and of the matters and things herein contained. And I hereby revoke and make null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true last will and testament.

It was thus made, dictated and named (dicté et nommé) word for word by the said Patrick McKenna on the day and year above written, in the office of John Greaves Clapham, one of the said undersigned Notaries, situated in the Lower Town of the said City of Quebec. And the said last will and testament having afterwards been read in full over and over again "lu et relu" to the said Judy Meehan, the other being present, she, the said Testatrix declared that she had perfectly heard and understood the same and found it to contain her true will and intention therefore persisted therein and the said Judy Meehan declared unto us the said Notaries that she does not know how to write or sign her name, the said Notaries have hereunto set our hands under the number eleven hundred and ninety [one] in faith and testimony of the promises.

Before us the undersigned Notaries Public duly admitted, commissioned and sworn, residing at the City of Quebec, in the Province of Quebec, in the Dominion of Canada, personally came and appeared Dame Marguerite Mehan, residing at Valcartier, in the County of Quebec, widow of Adam Andrew, being in good bodily health and perfectly sound in her intellectual and mental faculties as appeared unto us the said Notaries by her discourse and proposals, who declared unto us the said Notaries that considering the certainty of death and the uncertainty of the hour thereof, she was desirous of making her present solemn will and testament which she required us the said Notaries to write down & which she named and dictated unto us the said Notaries word by word in manner and form following, viz.,

Firstly and principally, I recommend my soul to Almighty God.

Secondly, I do will and ordain that as soon as possible after my decease, my just debts be paid and wrongs if any repaired by my Testamentary Executor hereinafter named in the discretion and prudence of whom I rely for my burial and funeral ceremonials.

Thirdly, I do hereby give and bequeath unto William Andrew, my son, of Valcartier aforesaid, Farmer, all and every my property of which I may die possessed, moveable and immoveable, and of whatever kind or nature the same may be and wheresoever the same may be situated, for him the said William Andrew to use, enjoy and possess the same from the day of my decease, as he may think proper, hereby instituting him the said William Andrew my universal legatee i property and the Executor of my present will and testament into the hands of whom I do hereby divest and disseize myself of all my property according to law.

Fourthly, I do hereby cancel and revoke all other wills and testaments and codicils by me made before the present one which alone I consider contains my true intentions and last will and desire.

It was thus done, dictated and named unto us the said Notaries by the said Testatrix and these presents having been duly read unto her by John Childs, one of us the said Notaries, in the presence of Alfred St. Jorre, his colleague Notary, she declared that she well heard and understood the same, and persisted therein.

Done and passed at Quebec in the Office of the said John Childs, one of us the said undersigned Notaries, on the twenty second day of March in the year of our Lord one thousand eight hundred and seventy three under the Notarial Number six thousand and twenty eight, and the said Testatrix declared unto us the said Notaries that she could not write nor sign, but made her ordinary mark in our presence and requested us to sign which we have done in her presence, in faith and testimony of the premises first duly read according to law.

One marginal note approved. Three words erased are null.

Note by Patricia Balkcom: Margaret and Adam had 6 known children, William was the second oldest. Adam died almost 25 years before this will was written. I have not found Margaret’s burial record.

Humbly Sheweth.

That your honour Petitioner is desirous of obtaining four lots of the ungranted land in the 5th concession of Valcartier that the 4 lots as in the field as No. 5, 6, 7 & 8, lying near Mr. Wolf's land.

That if your honour grants unto him the late prayed for on the usual conditions he will perform the duties required by law and custom and as in duty bound shall ever pray

I give & bequeath unto my husband Thomas Brooks all the property real & personal moveable & immoveable without any exception nor reserve whatsoever which I may die possessed of, the whole to be by him held, possessed and disposed of and from the day of my death in full & absolute property forever, hereby making him my universal legatee and appointing him the executor of my present last will & testament hereby revoking all former wills & codicils heretofore by me made, declaring the present to be my only true last will & testament.


Thus done, made and executed at Quebec in the office of Philippe Huot, one of the said Notaries, on the day and year first above written under the number seven thousand eight hundred and thirty four, the said Mary Miller having signed with & in the presence of the said Notaries who have also both signed with & in the presence of each other & of the said Testatrix, these presents having been only read according to law & the said Testatrix persisting therein as containing her last will & intentions.
