On the thirtieth day of March one thousand nine hundred and sixteen, before me Cyrille Renaud, Public Notary residing at Loretteville, undersigned, personally appeared Julia Fitzsimmons, widow of the late Patrick Murphy, residing at St. Gabriel of Valcartier, who being of sound and disposing mind, memory and understanding hath requested me the said Notary to write down and receive in due form of law her last will and testament which she has declared in manner and form following:

1º I most willingly resign my soul in the hands of Almighty God in the humble hope that he will receive it to his favor through the sole merits and intercession of Jesus Christ, my Saviour.

2º I desire that all my just debts, testamentary and funeral expenses be paid by my Executor hereinafter named as soon as possible after my death.

3º I give and bequeath to my son John Murphy all my moveable and immoveable properties wherever the same may be found and at whatever the same shall amount hereby constituting my said son my universal legatee and the Executor of this my will and testament.

4º I revoke all wills I may have heretofore made and I declare the present to be my only true last will and testament.

Done and passed at Valcartier at the residence of John Murphy under notarial number six thousand eight hundred and sixty one.

After the reading of the present will to the Testatrix by the Notary in the presence of Patrick John Davidson and David Michael Davidson, Farmers, both of St. Gabriel of Valcartier witnesses requested for the present will, the Testatrix having declared her inability to sign her name by sickness, has made her mark in presence of the Notary and witnesses who have signed in the presence of the Testatrix and in the presence of each other.

Notes by Patricia Balkcom: Julia died six years later on September 6, 1922 at 79 years of age. She had at least five children but at least three of them died as children.2

From a relative: " I remember my grandmother telling me that she remembered my grandpa sitting on a bench in the kitchen sharpening a scythe for the next day's work in the fields as Marjorie lay dying in the adjacent room and from time to time he would look up at her little cot and tears would stream down his cheeks as he sharpened and prayed. She passed away that evening. Since the funeral directors were inundated with death from the S.F. there was no way to have her embalmed so Grandma just laid her out in a whitle little dress on a table in the living room and there was one night of viewing for the neighbors. A couple of days after, they took her body down to St. Gabriel's Church where a funeral Director met them and he transferred her body into a casket for burial."4

On this day the twenty seventh of January in the year of our Lord one thousand eight hundred and sixty,

Before us the undersigned Notaries Public for Lower Canada, residing in the City of Quebec, personally came and appeared John Murphy, of St. Dunstan in the County of Quebec, who being apparently in good bodily health and particularly of sound mind, memory and understanding and enjoying his mental faculties, requested us the said notaries to receive and write down his last will and testament which he instantly made, published, dictated and named unto us the said notaries in manner and form following, viz.:

I recommend my soul to Almighty God for remission of all my sins through the intercession of my Blessed Saviour Jesus Christ.

I will and direct that all my just debts be fully paid and satisfied out of my property by my executors hereinafter named.

I give and bequeath to my daughter Mary Murphy, wife of James Redman, and to Rose Murphy, wife of Barney McClory, to each of them the sum of ten pounds currency, to be once paid in full for all pretensions to my estate.

I give and bequeath a similar sum of ten pounds currency to each of my grandchildren, Mary McLean and John McLean, issue of the marriage of my late daughter Peggy Ann Murphy with Patrick McLean, to be paid to them and each of them if they ever come to this country but not otherwise.

To my daughter Catherine Murphy, wife of John Delaney, I give nothing, considering that she has already had her share in my future succession.

I give and bequeath unto my son Barney Murphy a certain lot or piece of land situate in the Fief Grand Pré, being part of my purchase from the Honorable Francis Ward Primrose, consisting of two arpents in front by the depth there may be from the concession line to the land by me sold to Bernard Loughren, bounded in front to said concession line in rear by the said Bernard Loughren, on one side by land formerly held by the Seminary of Quebec, and on the other side by the remainder of the land so purchased from the said Honorable Francis Ward Primrose, circumstances and appurtenances, to be held, enjoyed and possessed by the said Barney Murphy in full and absolute property from the day of my decease, forever, free from all charges except the seigniorial rent.

I give and bequeath unto my son Thomas Murphy, my farm called the Brewery farm, consisting of an irregular piece of land containing about two hundred and twenty arpents in superficies, bounded in front by the Boulé road, in rear by land by me sold to Bernard Loughren, on one side towards the west by the Grand Line of the Seigniory of Notre Dame des Anges, and on the other side towards the east by the line of the Fief Grand Pré, but I will and direct that the said Thomas Murphy shall not be put in possession of the said land, circumstances and dependencies, until a house similar in every respect to that which now exists on the Brewery farm above mentioned (with the only exception that said house so to be built shall be a frame house whilst that on the Brewery farm is of square timber) shall have been built and completed with barn and stables equal to those now existing on the said Brewery farm, for his brother John Murphy on the lot of land herein after bequeathed to him; said house, barn, stables and dependencies to be so built and erected by the said Thomas Murphy and John Murphy jointly and at common expense for the use of the said John Murphy his heirs and assigns.

I give and bequeath unto my said son John Murphy my farm commonly called the Budeneck farm, consisting of eighty arpents in superficies more or less; bounded in front by the concession of La Montagne des Ormes, in rear by the concession of Neigette, on one side by William Paradis and on the other side by Barney Murphy, my son.

I give and bequeath unto my said sons Thomas and John the remainder of my farm bought from the Honorable Francis Ward Primrose to be equally divided between them. And I positively declare that the preceding legacies are made to my said sons Thomas and John upon the express condition neither the one nor the other shall lay any claims against my estate for wages, salary or otherwise or any other pretense whatsoever.

To Rose McClory, my dear wife, I give and grant the right of her lodgings in either of my sons Thomas or John's houses at her option, charging the said Thomas and John Murphy to pay her jointly during her natural life an alimentary rent of fifteen pounds currency per annum, to be paid to her in quarterly payments, besides her lodgings as aforesaid; and it is my further will and direction that my said sons Thomas and John shall find and furnish her with all the necessary fire wood that she may require, cut and sawn and brought at her door so long as she shall live and at her death the said life rent or alimentary pension and the other charges herein before mentioned shall be and remain extinct in favor of my said sons Thomas and John.

I give and bequeath to my daughter Suzan the sum of ten dollars a year during ten years consecutive after my decease after which this charge shall cease in favor of my said son Thomas who shall then be and remain the lawful proprietor of my other farm or piece of land known as Elstab's farm.

I recommend to my dear wife and to my daughter Suzan to live together and in common as long as my said daughter Susan shall be unprovided for by marriage or otherwise.

I give and bequeath the whole of my moveable property unto my said wife, my said daughter Suzan and my sons Thomas and John to be equally divided between them share and share alike.

And as to the rest and residue of my immoveable property, I give and bequeath the same unto my said two sons Thomas and John whom I appoint my universal and residuary legatees, subject to the disposition and upon the conditions herein before stated.

And lastly I hereby name and appoint John Smith, Mayor of St. Dunstan, and John Delaney, my son in law, to be jointly and severally Executors of this my present will and testament, hereby revoking and cancelling all former wills and codicils at any time heretofore by me made and declaring the present to be my only true last will and testament.

It was thus made, published, dictated and named word for word by the said John Murphy, Testator, unto us the said Notaries; and afterwards, the present, his last will, having been read over and over lu et relu to the said John Murphy, Testator, by one of us the said Notaries in the presence of his subscribing confrere who was present all the time, the said John Murphy, Testator, declared that he had perfectly heard and understood the whole and persisted in the contents thereof as containing his true last will and intentions.

Done and passed at the aforesaid City of Quebec in the office of Louis Panet one of us the said Notaries on the day and year above written, under number fourteen thousand two hundred and forty six of the minutes of the said Louis Panet. And the said Testator having been requested to sign his name after these presents had been twice read over to him as aforesaid, declared that he was unable to write since he had the misfortune to loose the fingers of his right hand which had to be cut having been frozen some years ago, but requested us the said Notaries to sign in faith and testimony of the promises.

It was     on the     sixth of October, nineteen hundred and one,     
The chilly wind blew from     the north; dark clouds concealed the sun,     
The snow was falling thick     and fast, the     winds     were howling wild,     
All governed     by the     unseen hand     of the     pure and undefiled.     
     
That morn they left     Fred Flint’s hotel to climb the winding hills     
To Carl Wright’s camp, twenty-one miles north     of Wilson’s Mills,     
With a     supply     of horses that had lately come that way,     
And, by an accident     were drowned, in the big Magalloway.     
     
Win York, the foreman of the camp – that camp they ne’er did reach     
He did intend, so I was told, to meet them by the beach,     
And at the crossing,      just above the lower Metalluc Pond,     
That takes its     rise in     Parmachenee     Lake, twelve miles beyond.     

Now     at     the     crossing     place     the     river     runs     both     deep     and     wide,     
The     ferry     boat     you     see     was     lying     on     the     north     side.     
When     they     would     reach     the     south-west     shore,     there     they     would     have     to     wait,          
Till     Win     York     brought     the     boat     across,     who     was     twenty     minutes     late.     
     
When     Win     York     was     about     halfway     between     the     camp     and     the     shore,     
He     met     a     horse     all     dripping     wet;     its     breast     was     stained     with     gore,     
He     knew     then     there     was     something     wrong     and     hastened     to     the     shore,     
And     just     across     the     stream     he     spied,     tied     to     a     tree,     three     more.     
     
There     was     no     other     creature     near     that     he     could     hear     or     see,

He is survived by his brother, Majella Murphy. He was the brother of the late Rita (the late Harold Kack), the late Simon (the late Dora Carillon), the late Father Leonard Murphy, CSSR, and the late Margaret. He is survived by several nephews, nieces, great-nieces and nephews and great-grandchildren, nieces and nephews, other relatives and friends.
The sincere thanks to all staff on the first floor of St. Brigid's Home for the exceptional care and to Dr. Sirois for his dedication. Your expressions of sympathy may result in a donation to St. Brigid's Home, 1645 chemin St-Louis, Quebec, G1S 4M3.

On the sixth day of December in the year of our Lord one thousand eight hundred and forty eight, before us the undersigned notaries Public duly commissioned and sworn in and for that part of the Province of Canada heretofore constituting the Province of Lower Canada and residing in the City of Quebec in the said Province personally came, appeared and was present Margaret Murphy of the Parish of St. Catherine de Fossambault in the County of Portneuf in the District of Quebec, wife of Michael O’Shea of the same place, farmer, who being in good bodily health and of sound mind and understanding as to us appeared by her manner and conversation and considering the certainty of death and the uncertainty of its hour hath declared unto us the said Notaries that she desired to make her last will and testament which she hath requested of us the said Notaries to receive and which Mtre. Edward George Cannon, on the the said Notaries, in the presence of Philip Huot, or confrere, have taken down as dictated to us by the said Margaret Murphy word for word and as follows:

First, the said Testatrix doth recommend her soul unto Almighty God and directs that her body be committed to the earth with decent and Christian burial at the discretion of her Executor hereinafter named.

And secondly, as to the worldly estate with which it hath pleased God to bless her and as she hath acquired the same with God’s blessing, the said Testatrix doth hereby give and devise, direct and dispose in respect thereof as follows, that is to say:

1º That all her just and lawful debts and funeral expenses be fully paid and satisfied.

And as to her estate, real and personal, she disposes thereof in manner following, that is to say: She gives, devises and bequeaths unto her loving husband, Michael O’Shea, all and every her property and estate real and personal, moveable and immoveable, stock in trade, farming utensils, live stock, monies, goods and chattels and other property and effects whatsoever kind, nature, value or description soever, wherever the same shall or may be situate that she may be possessed of, or may any way entitled to at the time of her decease, for and during his natural life, and at his decease the said property and estates real and personal, moveable and immoveable stock in trade, farming utensils, live stock, monies, goods and chattels and other property and effects whatsoever kind, nature, value or description soever wherever the same shall or may be situated shall be the full and absolute property of her son, Edmund O’Shea, issue of the marriage with the said Michael O’Shea, his heirs and assigns forever.

To have and to hold unto her said husband for and during his natural life without the least hindrance, molestation or interruption of any person or persons or being liable or subject to render any account thereof or of the amount thereof or any part or portion thereof to any person or persons whomsoever, her will and desire being that her said husband may and do have, possess and enjoy the same, & of every part thereof as his own proper goods and chattels from the day of her decease for and during his life as fully and freely and effectually as she the said Testatrix can or may do to all intents and purposes.

And the said Testatrix doth hereby order and direct the sum of one shilling current money of this Province be once paid to James O’Shea, her son, by my Executor hereinafter named issue of my marriage with the said Michael O’Shea.

And for the execution of the present will and testament the said Testatrix doth hereby nominate and appoint the said Michael O’Shea, her said husband, in favor of whom she doth in conformity to the law and system of the Province hereby disseize and divest herself of all her property for the ends hereof, hereby revoking all other wills, testaments and codicils that she may have made prior to the present to which alone she doth adhere as containing her true intentions and last will.

Thus done and dictated word for word and published and declared by the said Testatrix as and for her last will and testament to and in the presence of us, the said Notaries at the office of E.G. Cannon, six Pasteur Street, in the Upper Town of the said City of Quebec under the number two hundred and ninety six on the day and year first above written in the forenoon.

In faith and testimony whereof the said Testatrix having declared not to know how to write or sign after these presents having been first twice duly read made her ordinary mark or cross in the presence of us the said Notaries hereunto subscribing.
