Will* | 7 May 1901 | St-Gabriel-de-Valcartier, Quebec County, Quebec, Canada; 7th May 1901 Last Will of John Boyd (Husband of Agnes Montgomery) From records of Notary Cyrille Renaud No. 1987 Transcribed from the original at the Quebec Archives On this seventh day of May one thousand nine hundred and one, before me Cyrille Renaud, Public Notary, residing in the Parish of St. Ambroise of Jeune Lorette and George McNicoll and David McNicoll, both farmers residing in the said Parish of St. Gabriel of Valcartier, witnesses requested for the effects of these presents, personally appeared John Boyd, Farmer residing in the Parish of St. Gabriel of Valcartier, who being of sound and disposing mind, memory and understanding hath requested us the said Notary and witnesses to write down and receive in due form of law his last will and testament which he has declared in manner and form following, that is to say: 1º I desire that all my just debts, funeral and testamentary expenses be paid by my executor hereinafter mentioned as soon as possible after my death. 2º I give and bequeath to my son William Boyd, Farmer, residing in the Parish of St. Gabriel of Valcartier all my moveable and immoveable properties wherever the same may be found and to whatever the same shall amount hereby constituting my said son my universal legatee to the charge to pay to his sister Marguerite Ann Boyd the sum of one hundred dollars with interest in this summer. I nominate, constitute and appoint my said son William Boyd as Executor of this said will and testament. I revoke all wills and testaments & codicils I may have heretofore made and I declare the present to be my only true last will and testament. The present will was declared by the said Testator to the said Notary in presence of said witnesses and read by the Notary to the Testator in presence of said witnesses, who declared to understand it fully and persist therein. Done and passed at St. Gabriel of Valcartier in the residence of the said Testator under Notarial Number one thousand nine hundred and eighty seven. And signed by the Testator in presence of Notary and witnesses and by the Notary and witnesses in presence of the Testator and in presence of each other. That your Petitioner left Ireland in the year of Our Lord 1825 in the month of April and arrived in this Country in the month of June with a view of obtaining Land and settling as a farmer to which he had been brought up in his native Country. That your Petitioner is informed that there are a considerable tract of Land which is ungranted in the Seigneury of St. Gabriel lying on the North-East bank of the River Jacques Cartier contiguous to Counsellor Black’s land in the 5th or 6th Concession. That if your Honours will be pleased to grant unto your Petitioner a lot of said land, your Petitioner would immediately remove thereto and make a Settlement thereon, Your Petitioner therefore humbly requests that your Honours will be pleased to grant him a lot within the said Tract and your Petitioner as in duty bound will ever pray. IIº I wish that after all my just and lawful debts shall have been paid and satisfied with codicil, I hereby charge my executors that a sum of money shall be paid to the Curé of the Parish of St. Gabriel of Valcartier to be by him employed for the saying of two High Masses and the quantity of six low masses as soon as possible after my decease. His wife, Ann Boyle lived 42 years longer to the age of 100. Three of Patrick’s children predeceased him. His surviving five daughters are mentioned in the will. Patrick was a very involved member of St. Gabriel’s Church in Valcartier and was often mentioned in the minutes of the church’s meetings.13 |

Of the third part: Which said parties have covenanted and agreed together in manner following that is to say: The Said part of the first part did doth hereby give, grant and make over unto the said Thomas Hartery, her son, party of the third part, present and accepting hereof, for himself, his heirs and assigns that is to say: the whole of her property moveable and immoveable which she is now possessed, together with all the rights that she may have or may become entitled to in and to the communante de biens which has existed between her and her said husband, capital interest and revenue of every nature and kind whatsoever, whatever situation and to whatever the same may amount. The said party of the second part did and doth hereby also by these presents, give, grant and make over unto the said Thomas Hartery, her brother, party of the third part, present and accepting hereof, for himself his heirs and assigns that is to say: all and singular the successive rights which she has or may become entitled to in and to the estate of the late Michael Hartery, her father deceased, moveable and immoveable, capital interest and revenue, due and to become due of every nature and kind whatsoever, whatever situate and to whatever the same may increase, that may ultimately come or be acquired by the renunciation of one or more of the co-heirs of the Said Succession, the whole without any exception or reserve. The said parties of the first and second part do hereby moreover give, grant and make over unto the said Thomas Hartery all and singular their rights which they have or may become entitles to in and to that certain lot of land being known as number seventy-four on the official plan and in the book of Reference thereto for the said parish of St. Gabriel of Valcartier, and described as follows in a deed of sale by Widow John Neilson and others to Michael Hartery and passed before Mr. Aut. A. Parant, Notary at Quebec and bearing date at Quebec the seventeenth of June one thousand eight hundred and fifty one, that is to say: “A lot of land situate and lying in the Parish of St. Ambroise, Fief of St. Gabriel, in the first concession of Valcartier, on the northwest side of River Jacques Cartier, containing ten arpents in front by fifteen arpents in depth bounded in front by the Queen’s Highway, in rear by a lot occupied by James and William Finlay, on one side by the Fossambault Seigniory line and on the other side Martin Moylen.” To have, hold use and dispose of the said hereby donated goods unto the said Thomas Hartery from this day forth, they the said donors, substituting and subrogating the said Thomas Hartery in and to all their rights claims and privileges in the above gived and granted goods. The present gift is thus made at the charge by the said done, who herself binds and obliges himself – 1st – To pay and acquit to the exoneration of the said donors the share for which they may be held liable of the debts and charges of the said communante de biens and Succession in such wise that they, the said donors shall not be hereafter troubled for on account thereof. 2nd – To pay all the rents, due, taxes, school taxes and assessments which might now affect or may I future affect the hereby granted immoveable property. 3rd – To pay all and singular the capital sums and interests mortgaged in the said hereby granted immoveable property. 4th – To pay on demand to the said Catherine Hartery a sum of one hundred dollars without interest. 5th – To keep with him and in his own house the said Dame Bridget Boyle and to provide her with all what is necessary for life and clothing. And for securing the due execution of the above charges and conditions the said Thomas Hartery do hereby mortgage and hypothecate the hereby gived and granted immoveable property number twenty-four (sic – should be seventy-four) of the official cadastral plan aforesaid, thus done and passed at the said parish of St. Gabriel of Valcartier at the residence of the said parties hereto, under number four hundred and five of the minutes of the said Notary. In faith and testimony whereof the said Thomas Hartery has to these presents first duly read set and subscribed his name and signature in presence of the said notary, the said Dame Bridget Boyle and Miss Catherine Hartery having declared unto one the said Notary do not know how to write nor sign their name but have made a mark of a cross in the presence of the said Notary subscribing.
