Birth*between 1780 and 1785County Wexford, Leinster Province, Ireland; Although his burial record, the 1824 and the 1851 Census imply that he would have been born about 1889, this does not appear accurate. In histories of Ireland, Nicholas is extolled as a hero of the Battle of 1798 and this would indicate an earlier birth. His gravestone states he was born in 1786 and the 1825 Census would indicate that he was at least 40 years of age by then, so I am using that date.2,3,4 
Military*1798County Wexford, Leinster Province, Ireland; History of the Battle of 1798 in Ireland: The insurgents soon quitted Monaseed, and, pursuing their march, had the good fortune to encounter at the White Heaps the division of their army with which they desired to effect a union. The chiefs of this division were Garret Byrne, Esmond Kyan, Edward Roche, and Nicholas Murphy."* Many others, however, had fallen in the different combats that had taken place since their departure from Wexford. This united force bivouacked for the night at Ballyfad, where their number was augumented by the arrival of many who had quitted them to visit their families. Having now to narrate the history of that division of the insurgent force which quitted Wexford on the 21st to proceed in the direction of Wicklow, we must go back to the day of their departure. This division, as well as that which left the town about the same time under the com- * It may interest our readers to learn that Nicholas Murphy, a nephew of Father Michael, escaped to Canada, where he settled and prospered. He had several children born to him there, all of whom succeeded in life. The same sterling qualities which drove their father into rebellion and made him an exile, conducted them to wealth and honour. Such is the difference between life in a free and in an enslaved country. One of his sons was not many years ago elected Mayor of Montreal, and came to London an invited guest of the Chief Magistrate of the great city. Nicholas Murphy, the exile, visited his native land some twenty years ago. The writer saw him at the house of a common relative. (Since Nicholas died in 1864, the book must have had earlier drafts than the edition written for the 100 hundred year anniversary in 1898 as this would have been 34 years after his death).4

On the twenty fifth day of August in the year of our Lord one thousand eight hundred and fifty nine, before us the undersigned Notaries Public duly commissioned & sworn residing at the City of Quebec in the Province of Canada personally came & appeared Mr. Nicholas Murphy the Elder of the Township of Stoneham in the District of Quebec, Yeoman, who being in good bodily health and of sound mind, memory and understanding as appeared to us the said Notaries did declare that considering the certitude of death & the uncertainty of the hour thereof he was desirous of making his last Will and Testament which he requested of Peter Arnold Shaw one of us his colleagues present to receive and reduce into writing & which we have accordingly taken down as dictated to us word for word as follows, that is to say,

I will and direct that all my just and lawful debts be paid & satisfied out of my estate by my Executors hereinafter named as soon as the same can be done after my decease.

1st I give, devise & bequeath unto Nicholas Murphy the [Agent & Engineer] of Batiscan, my son the sum of twenty five pounds currency.

2. I give, devise and bequeath unto Owen Murphy and Matthew Murphy both of Quebec my sons the sum of twenty five pounds each.

3. I give, devise and bequeath unto Maria Murphy of Quebec, my daughter, the sum of twenty five pounds currency the same to be paid to her together with the bequests herein before mentioned & specified out of monies due me by my son Michael Murphy of Stoneham, Farmer, under a certain deed of Sale passed before us the undersigned Notaries at Quebec the eighteenth day of June last.

I give, devise and bequeath unto my dearly beloved wife, Ellen O'Brien, the whole of my household furniture, books & wearing apparel to be used, enjoyed & disposed of by her as she may see fit & proper.

I further give, devise & bequeath unto my dearly beloved wife Ellen O'Brien all & singular my other property real & personal, moveable & immoveable of what nature or kind whatsoever & wherever situate, being or to be found to be enjoyed by her during her natural life and after her decease I give, devise & bequeath the same in property unto the said Michael Murphy of Stoneham aforesaid, Farmer, my son, subject to the following conditions, viz. that is to say,

1st That he shall pay unto my daughter Judith Murphy, wife of Bartholomew Mooney of Stoneham aforesaid, Farmer, the sum of thirty pounds currency.

That he shall keep my grandson John Murphy at school in Stoneham aforesaid up to the first of May next and after that date give him twelve months schooling in Quebec and afterwise pay unto him the sum of twenty pounds currency on his attaining twenty one years of age, also that he the said Michael Murphy shall pay unto my daughter Julia the sum of thirty pounds, and shall further pay all debts and liabilities due by me at the time of my decease, for which purpose the request to the said Michael Murphy shall remain charged & subject to the payments of such debts & liabilities besides the special charges aforesaid to have and to hold the said several bequests unto the said legatees respectively their heirs & assigns for ever.

And for the execution of this my last Will & Testament I hereby name & appoint the said Nicholas Murphy of Batiscan aforesaid & the said Owen Murphy of Quebec aforesaid Merchant into whose hands I divest myself of all my property pursuant to the Law of this Province by whose powers under this my last will shall remain in force and not cease after the expiration of a year and a day as by Law provided but shall continue until the final execution of these presents.

Thus done, dictated & named word for word by the said Nicholas Murphy the Elder unto us the said Notaries on the day & year first above written in the Office of Peter Arnold Shaw one of us in presence of Louis Prevost, his colleague, called for the purpose under the number six hundred & forty seven and then & after these presents had been read over to the said Nicholas Murphy the Elder who declared that he understood the same perfectly & that the whole was conformable to his Last Will & intention and hath signed in faith & testimony of the premises together with us the said Notaries these presents having been read over again a second time according to Law.

Notes by Patricia Balkcom: I have found records of nine children of Nicholas and Ellen – five sons and one daughter. One daughter pre-deceased Nicholas. Two children, James and Ellen, are not mentioned in the will. It is apparent from the will that education was important to Nicholas. Records show that several of his children were highly successful – including Owen, who went on to be the mayor of Quebec City in the 1870s. Nicholas died, reportedly at the age of seventy-four, four and a half years after he wrote this will.12

John Cullen, late of the Parish of Tewkesbury, farmer
Defendant, is convicted before the undersigned Judge of the Sessions of the Peace in and for the City of Quebec, for that he the said Defendant on the 24th day of January last at the Parish of Tewkesbury, within the District of Quebec, unlawfully did assault and beat one Nicholas Murphy of the Parish of Stoneham, farmer without any cause or provocation and against the form of the Statue in such case made and provided.

This is my last will & testament, the conditions of
which, I beg my Executors hereinafter named, to carry
out, as soon after my death as possible :-
     I die at peace with all Mankind, bearing
no ill will or animosity against any person and pray-
ing all whom I have in any way injured during my life
time to exercise a merciful forviveness in my regard-
My Faith in the Mercy of my Divine Creator is very
great, and I pray for, hope and trust in a merciful
exercise of Divine Mercy, when I appear at the tribunal
of the Last Judgment Seat, MAY GOD THEN HAVE
MERCY ON MY SOUL.-
     My funeral expenses, which my Executor herein-
after named will determine;
     I wish that any small debts, I may owe, to be
paid at once, out of the cash on my Estate at my
death, whether such cash may be in the Office or at
my Credit in any of the Banks in the City.
     I will and bequeath to my good and faithful
house maid Kate Dumphy, the sum of One thousand Dollars
as recognition of her sterling qualities, and as a
small measure of reward for her never failing efforts
in promoting domestic happiness under my roof during
the many years which she has held central both before
and since my wife’s death –
     I will and bequeath to my dear friend Mary or
Minnie LSE, widow of the late Col. Lamontagne the
sum of One Thousand Dollars to aid her in her struggles
with an unsympathetic world. These bequests are to
be paid free of all Government or other Tax and out
of the amount oy my life Policy immediately after the
Collection from the New York Life Insurance Co of the
amount of said Policy.
I will and bequeath to my brother Michael Murphy of
Stoneham, the sum of Five Hundred Dollars to be paid
free of Government Tax, should it appear that I have
by Deed of Sale to me or by Mortgages or indeed in my
Other way, any right, title or interest in the Home-
stead property at Stoneham.- I hereby abandon all such
In favor of my brother Michael Murphy who lives on the
property and who is as far I am concerned the sole
and only owner.
     I desire that Five Hundred Dollars be applied
to having Masses said for the repose of the soul of my
dear Wife and myself; this sum may be divided, as
follows :-
     $ 100.00 to St Patrick’s Church.
100.00 to St Bridget’s Asylum.-
      100.00 to Convent of the Good Shepard
      100.00 to the Jesuit Order; Father Desy.
      100.00 to the Parish Priest of Stoneham.
I Will and bequeath to my nephew John- E.- Murphy
all the Furniture and effects in our office on St. Peter’s
street : such as desks, tables, chairs, book-cases and
books, safes, Oil-Cloth, stoves, maps, etc.- all such
being my property and having been paid for by me.-
I will and bequeath to my said nephew John- E.- Murphy
The following assets, namely :-

apparel and all my personal effects, all articles having
the family coat of arms thereon or having my name or
that of my wife thereon are not to be sold, but are
to be distributed amongst the family entirely on the
discretion and judgment of my niece Mary- L.- Murphy
of Batiscan Mills.- I desire that five hundred
dollars be paid together to the Pastor of St. Patrick’s
church, and an obligation taken that the interest
on this sum be applied annually to keeping my lot
In St. Patrick’s Cemetery in good order to all
Futurity.-
     I WILL and bequeath to Master Conrad Lamontagne
my gold pocket pencil, my diamond shirt studs and my
shirt cuff fasteners as a mark of esteem and regard.
     There is no partnership relations to settle
between my nephew John- E .- Murphy and myself, his
name was simply brought into the fire branch and he annu-
ally drew all the advantages to which he was entitled.
I am sorry the business did not afford him more.
     I desire that the balance of my Estate, every-
thing having been wound up, be divided in equal shares
share and share alike, between my nephews and
nieces, children of my brothers and sisters, and for
the carrying out of all the conditions of this my
last Will and Testament.- I hereby appoint and name
my nephew Mr John- E.- Murphy as sole Executor, with
all powers to that effect without restriction as to
limitations of time or otherwise.- He may take any
fair amount of the Estate as remuneration for his
services.

Province of Quebec, Insurance Agent, which is written
Entirely in my own handwriting and was signed and exe-
Cuted by me in the presence of witnesses at the said
City of Quebec on the fifty day of the month of July
One thousand eight hundred and ninety-four.
     WHEREAS by my said WILL, I desire that the balance
Of my Estate, every thing having been wound up, be di-
Vided in equal shares, share and share alike, between
My nephews and nieces, children of my brothers and
Sisters.- And for the carrying out of all the conditions
Of my said Last Will and Testament, I thereby appointed
And named my nephew Mr John- E.- Murphy as sole

E.- Murphy, my said Executor shall consult with and

On this fifth day of April one thousand eight hundred and ninety eight at the hour of twelve of the clock in the forenoon, at the special insistence and request of Patrick Murphy of the Parish of Saint-Bernadin-de-Sienne in the County of Portneuf, Laborer, I, Édouard Antill Panet, the undersigned Notary Public duly commissioned and sworn in and residing in the Parish of Saint Raymond and Province of Quebec accompanied by Stephen P. Grogan, Clerk and Manager, and John Power, Laborer, both of the said Parish of Saint-Bernadin-de-Sienne, the witnesses expressly requested by said Testator to witnesses this his present last will and testament, repaired to the residence in the said Parish of Saint-Bernadin-de-Sienne of the said Patrick Murphy and there finding him ill in bed but of sound and disposing mind, memory, judgment and understanding as it appeared unto us Notary and witnesses from his words and actions, and being desirous of regulating his worldly affairs whilst yet he hath the strength left to do so hath named, dictated and nominated unto us, said Notary in presence of said witnesses his last will and testament in the manner and form following:

1º I recommend my soul to Almighty God my Creator.

2º I will and order that my body be committed to the grave to be buried in a manner suitable to my station in life and according to the rites and solemnities of the Holy Roman Catholic Church and faith of which I am a member and that a funeral service be sung over my remains and another funeral service at the end of the year of my death, leaving it to my well beloved wife to have a sufficient quantity of low masses said for the repose of my soul.

3º I will and order that my just debts, funeral and testamentary expenses be first paid by my Executrix hereinafter named.

4º I give, devise and bequeath to my well beloved wife, Julia Fitzsimmons, the whole of my property, moveable and immoveable, ready money, rights and actions and all other property of which I may be possessed of without any exception or reserve to be by my said wife used, enjoyed and disposed of in full property and ownership from and after the moment of my death, hereby instituting her my universal legatee and devisee in full property, and execution of this my present last will and testament, extending her power as such beyond the day and year allowed by law.

It was thus named, dictated and nominated by the said Testator of his own free will and accord to us said Notary in presence of said witnesses at the said Parish of Saint-Bernadin-de-Sienne on the day, month and year and hour first above written and the same was duty read by the said undersigned Notary to the said Testator in presence of said witnesses, the said Testator persisting herein after the reading thereof as fully to embody and contain his last will and intentions.

Thus done and passed at Saint-Bernadin-de-Sienne in the residence of the said Testator, on the day , month and year first above written these presents bearing the number five thousand fur hundred and six of the original deeds remaining of record in the office of the said undersigned Notary.

In testimony whereof the said Testator declaring his inability to write or sign his name but made his usual mark of a cross in the presence of the said witnesses and Notary and in the presence of said witnesses who have each signed with and in the presence of the said Testator and in the presence of each other.
