On this day the second day of April in the year of our Lord one thousand eight hundred and seventy three,

Before us the undersigned Notary Public for the Province of Quebec in the Dominion of Canada residing in the parish of St. Ambroise de la Jeune Lorette and the witnesses hereinafter named and subscribed,

Personally came and appeared and was present Jane O'Neil, wife of Henry Patton of the parish of St. Gabriel of Valcartier in the County of Quebec, farmer, who being in weak bodily health, but of sound mind, memory, and understanding as to us appeared by her manner and conversation hath requested of us the said Notary to receive & reduce into writing this her Last Will and Testament which we the said Notary in the presence of the said witnesses, have taken down as dictated to us by the said Jane O'Neil word for word and as follows, that is to say:

I do hereby give, devise, and bequeath unto James, Catherine, and Mary Jane Patton my three children all and every my property real & personal moveable and immoveable without any exception or reserve whatsoever, which I may did possess of hereafter instituting them my said three children above (named) my universal legatee.

And for the execution of the present my Last Will and Testament I do hereby nominate and appoint the Reverend Andrew Balfour of St. Gabriel of Valcartier in the County of Quebec, Minister of the Church of England and James Patton, my son, in favor of whom I do in conformity to the Law & Custom of this Province, hereby disseize & divest myself of all my property for the ends hereof, hereby revoking all other wills and testaments and codicils that I may have made prior to the present to which alone I do adhere as containing my true instructions and last will.

Thus done and dictated word for word and published and declared by the said Jane O'Neil Testatrix for and as her Last Will and Testament to and in the presence of the said Notary and the Reverend Andrew Balfour aforesaid and William McBain of the said parish of St. Gabriel of Valcartier, farmer, in the bed room of the house and residence of the said Henry Patton at St. Gabriel of Valcartier aforesaid the day and year first above written under number ninety two between the hour of twelve and one o'clock in the afternoon.

In faith and testimony whereof the said Testatrix having declared not to know how to write or sign her name when requested so to do as to the presents first duly read set and made her ordinary mark of cross in the presence of us the said Notary & of the said witnesses who have here unto set & subscribed their respective names & signatures,

Notes by Patricia Balkcom: Jane died 8 days after writing her will. She was about 65 years of age. My records show that she had an additional three sons that were not mentioned in the will (Henry, John and Francis).1

On the twenty second day of September in the year one thousand eight hundred and seventy three at the request of Henry Patton, the elder, of the Parish of St. Gabriel of Valcartier, Farmer, and in the office of Charles H. Andrews, Public Notary, situate in the Victoria Chambers in the Lower Town of the City of Quebec in the presence of John Fraser of the City of Quebec, Public Notary, I the said Charles H. Andrews duly commissioned and residing at the City of Quebec in the Province of Quebec did write down and receive his last will and testament which he made and dictated in manner and form following, that is to say:

I give, devise, and bequeath unto my beloved wife, Elizabeth Harriat, all my property of which I may die possessed of both moveable and immoveable and of any kind whatever to have, hold, and enjoy the same after my decease as her own absolute property and I desire and request that my said wife should by her last will bequeath to my grand daughter, Jane Patton, daughter of Francis Patton, the sum of one hundred dollars.

It was thus made, dictated, and named by the said Testator unto me the said Notary in the presence of my colleague the present will having been read to said Henry Patton in the presence aforesaid the said Henry Patton having declared to have perfectly heard and understood the same and persisted therein declaring it contained entirely his last will and testament.

Done and executed at the said City of Quebec in the office of Charles H. Andrews one of the undersigned Notaries on the day and year first above written under the number one thousand seven hundred and fifty three the said Henry Patton having signed.

Notes by Patricia Balkcom: Henry was first married to Jane Catherine O’Neill in 1835 and they had eight known children. She died in March of 1873 and Henry remarried in 1873. I have not found a burial record for him. He wrote this will on the day of his marriage to Elizabeth.5

On this day the second day of April in the year of our Lord one thousand eight hundred and seventy three,

Before us the undersigned Notary Public for the Province of Quebec in the Dominion of Canada residing in the parish of St. Ambroise de la Jeune Lorette and the witnesses hereinafter named and subscribed,

Personally came and appeared and was present Jane O'Neil, wife of Henry Patton of the parish of St. Gabriel of Valcartier in the County of Quebec, farmer, who being in weak bodily health, but of sound mind, memory, and understanding as to us appeared by her manner and conversation hath requested of us the said Notary to receive & reduce into writing this her Last Will and Testament which we the said Notary in the presence of the said witnesses, have taken down as dictated to us by the said Jane O'Neil word for word and as follows, that is to say:

I do hereby give, devise, and bequeath unto James, Catherine, and Mary Jane Patton my three children all and every my property real & personal moveable and immoveable without any exception or reserve whatsoever, which I may did possess of hereafter instituting them my said three children above (named) my universal legatee.

And for the execution of the present my Last Will and Testament I do hereby nominate and appoint the Reverend Andrew Balfour of St. Gabriel of Valcartier in the County of Quebec, Minister of the Church of England and James Patton, my son, in favor of whom I do in conformity to the Law & Custom of this Province, hereby disseize & divest myself of all my property for the ends hereof, hereby revoking all other wills and testaments and codicils that I may have made prior to the present to which alone I do adhere as containing my true instructions and last will.

Thus done and dictated word for word and published and declared by the said Jane O'Neil Testatrix for and as her Last Will and Testament to and in the presence of the said Notary and the Reverend Andrew Balfour aforesaid and William McBain of the said parish of St. Gabriel of Valcartier, farmer, in the bed room of the house and residence of the said Henry Patton at St. Gabriel of Valcartier aforesaid the day and year first above written under number ninety two between the hour of twelve and one o'clock in the afternoon.

In faith and testimony whereof the said Testatrix having declared not to know how to write or sign her name when requested so to do as to the presents first duly read set and made her ordinary mark of cross in the presence of us the said Notary & of the said witnesses who have here unto set & subscribed their respective names & signatures,

Notes by Patricia Balkcom: Jane died 8 days after writing her will. She was about 65 years of age. My records show that she had an additional three sons that were not mentioned in the will (Henry, John and Francis).2

Mother was Honora Cassin, born Canada, father was John LeBrum, born Canada who is a Milk Dealer. Deceased was the wife Paul Paulette and she was buried in W. Claremont in St. Mary's Cemetery on October 23, 1935 by E.P. Marcotte, Undertaker of Claremont, NH.2

BEFORE ME, the undersigned, one of the Justices of our Sovereign Lady the Queen, assigned to keep the Peace, within the District of Quebec, this thirteenth day of July in the year of our Lord Christ, one thousand eight hundred and fifty two. Personally came and appeared Edward Payne of Stoneham, in the County of Quebec, farmer,

Who being duly sworn upon the Holy Evangelists of Almighty God, doth declare, depose, and say, as follows: - to wit, that on the twelfth day of July instant, at Stoneham, at about three or four o’clock in the afternoon, I was going along the high way when I came up to John Duffy and James Duffy who were arguing together, and James Whelan. James Duffy there said to me are you coming to take this man past, meaning Whelan, he then struck me with his fist on the mouth and knocked out one of my teeth, I then got away from James Duffy, and was going when he followed me, and took hold of an adze and attempted to strike me with it, but was prevented of so doing by Benjamin McKee. I then got in a house on the way.
