On this eighth day of November one thousand eight hundred and ninety nine, before me Cyrille Renaud, Public Notary, residing in the Parish of St. Ambroise of Jeune Lorette, undersigned, and George Todd and John Todd, both farmers residing in the Parish of St. Gabriel of Valcartier, witnesses wanted for the purposes of these presents, personally appeared Mary Jane Brooks, wife of George Neil, Farmer, residing in the Parish of St. Gabriel of Valcartier, Farmer, which has requested us to write down and receive in due form of law her last will and testament which she has declared in manner and form following, that is to say:

1º I desire that all my just debts, funeral and testamentary expenses be paid by my executor hereinafter named as soon as possible after my death.

2º I give and bequeath to my two sons Herbert Neil and Frederic Neil my share in all my lands, moveable and immoveable properties and buildings whatsoever, which said properties will be divided in two equal shares between my two sons Herbert and Frederic Neil, that I constitute and appoint my sole heirs.

3º I nominate, constitute and appoint my husband George Neil as Executor of this my will.

4º I revoke all wills and testament that I may heretofore [have] made and I declare the present to be my only true last will and testament.

Done and passed in the Parish of St. Gabriel of Valcartier under Notarial Number sixteen hundred and eighty three. And after the reading of these presents to the said Testatrix by Notary in presence of said witnesses, the Testatrix, the Notary and the witnesses have signed in the presence of each other.

Note by Patricia Balkcom: Mary Jane died 10 years later (01 Nov. 1909) at the age of 72 years. The two children mentioned in the will were the two youngest of her known 18 children.5

On this day, the eighteenth of February one thousand eight hundred and seventy eight, before us the undersigned Notaries Public for the Province of Quebec, residing at the City of Quebec, personally came and appeared Mr. Thomas Brooks, farmer, residing in the Parish of St. Ambroise de la Jeune Lorette, who being in good bodily health and of sound and perfect mind, memory and understanding requested us the said Notaries to write down and receive in due form of law his last will and testament which he instantly made and dictated unto us the said Notaries as follows, to wit:

I give and bequeath unto my wife Mary Miller all the property real & personal moveable and immoveable without any exception nor reserve whatsoever which I may die possessed and disposed of in full & absolute property forever from the day of my death hereby making her my universal legatee and appointing her the executrix of this my present last will and testament, hereby revoking all former wills and codicils heretofore by me made, declaring the present to be my only true last will & testament.

Thus done, made and executed at Quebec in the office of Philippe Huot, one of the said Notaries, in the presence of Edward George Cannon the other Notary also was present during the whole time of the execution thereof, on the day & year first above written under the number seven thousand eight hundred and thirty eight, the said Thomas Brooks having signed with & in the presence of the said Notaries, who have also both signed with and in the presence of each other and of the said Testator, these presents having been duly read according to law and the said Testator persisting therein, as containing his last wishes & intentions.

On this twenty ninth day of October, one thousand eight hundred and ninety six, before me Cyrille Renaud Public Notary residing in the parish of St. Ambroise of Jeune Lorette, personally appeared Mr. William Broom, Farmer, residing in the Parish of St. Gabriel who being of sound and disposing mind, memory and understanding hath requested me, the said Notary and witnesses, to write down and receive in due form of law his last will and testament which he has declared in manner and form following, that is to say:

1º I desire that all my just debts, funeral and testamentary expenses be paid by my Executor hereinafter named as soon as possible after my death.

2º I give and bequeath to Samuel Shanks and his wife Helen Broom, my sister, Farmer of Valcartier the use and usufruct during the term of their natural lives of all my moveable and immoveable properties.

3º I give and I bequeath one cow to my said sister Helen Broom.

4º I give and bequeath to my nephew James Johnson, Farmer residing in the said Parish of Valcartier the vue propriété of all my said moveable and immoveable properties and the use and usufruct after the death of Samuel Shanks and Helen Broom, father and mother-in-law of James Johnson, that I constitute my universal legatee and the sum of sixty dollars due to Joseph Fournier of St. Ambroise will be paid half by Samuel Shanks and his wife and the other half by James Johnson.

5º I nominate, constitute and appoint the said James Johnson as Executor of this my will.

6º I revoke all will and codicils I may have heretofore made and I declare the present to be my only true last will and testament.

The present will was thus declared by the said Testator to the said Notary in presence of Thomas Holton and Michael Holton both farmers of St. Gabriel of Valcartier, witnesses requested for the effects of these presents, read to the said Testator by said Notary in presence of said witnesses, who declared to understand it fully and persist therein.

Done and passed at Valcartier in the residence of said Testator, under Notarial Number eleven hundred & seventy two. And after the reading of these presents as aforesaid the Testator having declared his inability to sign his name has made his mark in the presence of Notary and witnesses and the Notary and witnesses have signed in presence of Testator and in presence of each other.

Notes by Patricia Balkcom: William died a year later on the 13th of September 1897 at the reported age of 80 years. Although he names James Johnson as his nephew and heir, it is confusing as to what relationship existed. James was the husband of Miriam Broom, whose parents were Robert and Helen Broom. Helen Broom, William’s sister, is listed as a spinster in her marriage record to Samuel Shanks. (So who were Robert and Helen Broom?)1

On this twentieth day of April one thousand eight hundred and thirty five,
before us the undersigned Curate of St. Catherine and Missionary of Valcartier was present Edward Sweeney born in the Parish of Monasterevin, County of Kildare, Ireland and now residing in the Settlement of Valcartier, who being sick but at the same time enjoying his perfect senses and reason as it appeared to me and to the undersigned witnesses, has declared to me his desire of making his last will and testament; and has consequently dictated to me the following articles viz.:

1º He desires that he will die in the communion of the Holy Catholic and Apostolic Roman church.

2º He bequeaths his soul to the most holy and adorable Trinity, Father, Son, and Holy Ghost hoping that God will receive it in his great mercy and forgive him his sins.

3º He leaves his body to the earth from whence it was taken, and hopes that his family will give him a Christian burial.

4º He leaves to his wife, Rose Broughal [Brougham], the use of all his cattle, except one horse, and likewise all his house furniture until her death hoping that his sons, or any of them will take proper care of their mother but if she finds herself not well treated she will be at liberty to live with whomever she may please and in that case the chattels will be equally divided between his two sons, Bernard and John Sweeney and he binds them to give and pay to her yearly the sum of six pounds currency each one half as long as she lives.

5º He leaves and bequeaths to his two sons Bernard and John Sweeney his Lot of land situated in the fifth concession of Valcartier, Seigniory St. Gabriel, to each of them one half, but his son Bernard will have the liberty to take his choice of either of the said halves, and likewise he shall have the new house which is nearly to be raised and the present old house for a barn under condition that he will help his brother John when required to build twelve feet in addition to the little house and raise the whole two feet higher.

6º He reserves on his Lot one acre upon which the buildings are erected to belong to his two said sons in common (en communauté) so that they may have no difference about the site of these buildings.

7º He leaves and bequeaths exclusively to his son Bernard the grey horse, harness, cart and camisole in full property.

8º He leaves and bequeaths to his sons Bernard and John Sweeney his said Lot of land under the following conditions: That neither of them will have the liberty to sell his part to any stranger without the free consent of the other, but if he wishes to leave the place, he will offer and give it up to the remaining brother at a yearly rent or at a fair price according to the advice and judgment of any three decent men known by them.

9º He leaves and bequeaths to his daughter Mary the sum of seven pounds currency and to his daughter Rose the sum of ten pounds currency and to his daughter Ellen the sum of seven pounds currency to be paid at the time of their marriage in three equal installments in equal proportion by the two brothers, or if they do not marry and wish not to live together in the family they will be paid by installments as aforesaid.

10º If any of his afore named children do behave badly according to the judgment of the officiating Priest of this Parish and of the present witnesses Ferdinand Murphy and Michael Mooney, his will is that they or any of them be deprived of all and every thing left to them by this his will, and their part shall be divided among his dutiful children.

This he has declared to me to be his last will and testament after having been now read according to law (lu et relu) in presence of Ferdinand Murphy and Michael Mooney present and who have signed with us.

Done and passed in the dwelling house of the said Edward Sweeney on the day aforesaid and have signed with us.

P.S. The said testator Edward Sweeney has further declared that his will is that he leaves nothing to any of his other children Patrick and James except one shilling British to be paid by his son Bernard when deceased.

Notes by Patricia Balkcom: Edward died 3 months later, on the 12th of July, at the age of about 56. Since this was not an advanced age, it might be assumed that he had a chronic illness such as tuberculosis. This is one of the few wills that we have found that actually mention the place of birth in Ireland. Edward had 4 sons and 4 daughters. Three of the daughters are named in the will – a fourth daughter, Catherine, is not. She married (to Michael Mooney) before the will was written, so Edward may have felt that she was “taken care of”. It is not known why he specifically mentioned Patrick and James as not being heirs.4

Agricultural census states that he has 200 acres of improved land, and 100 acres of unimproved. Land is not valued, but implements are worth $80. He has 10 horses, 8 milk cows, 23 other cattle, and 5 pigs. His livestock is values at $700 (highest amount on the census sheet). He produced 50 bushels of wheat, 700 bushels of Indian corn and 200 bushels of oats.5,6
