Secondly, I do hereby give and bequeath unto Ann Calback, my beloved wife, all the property moveable and immoveable, real & personal generally whatsoever which I may be possessed of or which I may be entitled to, at the time of my decease, of what nature, quality the same may be or wheresoever situated, to have, hold, and enjoy my said property unto the said Ann Calback, my said wife, in full and absolute property from the day of my decease subject to the following legacy. Thirdly, I give and bequeath unto Andrew Holliday, of the Parish of Beauport, Farmer, for the good service which he has rendered to me, the sum of twelve hundred dollars payable to him after the death of my said wife, is she survives me, by her heirs and out of my estate, providing the said Andrew Holliday lives with me and my said wife until our death. Fourthly, I do hereby nominate and appoint the said Ann Calback the Executrix of my present last will & testament unto whose hands I divest and disseize myself of all my said property. George Jack, of the Parish of Charlesbourg and Grant Ireland of Beauport, Farmers, witnesses purposely called and with me undersigned, personally came and appeared Mr. Edward Brown, Farmer, of the Parish of Beauport who being of sound mind, will, memory and understanding hath made, dictated and named his last will and testament unto me the said Notary in the presence of the said witnesses as follows, that is to say: I recommend my soul to Almighty God my Creator entreating him through the merits of his Blessed Son my Saviour Jesus Christ for a free pardon and a remission of all my sins and offenses. And as to the property thereof I give, devise and bequeath the same to my two daughters Mrs. Rachel Brown, wife of Mr. James Roark, Farmer residing at Little River at Maloville, and Ann Brown, wife of Mr. Thomas Dacres, Farmer of Beauport to be divided between my said daughters share and share alike after the death of their said mother. To have and to hold the same in full and entire property from and after the death of my said wife, instituting my said wife my usufructory legatee and my said daughters my universal and residuary legatees. But my said wife shall have the right to collect the capital as well as the interest due to me by Leonidas Poulin as the price of sale of the property sold to him. But my said wife shall invest that capital for my said daughters using only the interest. I nominate and appoint my said wife the Executrix of this my last will and testament hereby revoking all former wills and codicils I may have made before this present will to which alone I adhere as containing my true intentions and last will. Will* | 3 August 1860 | St-Gabriel-de-Valcartier, Quebec County, Quebec, Canada; 3rd August 1860 Last Will of Helen Brown Widow of Thomas McGill From Notary Records of Benjamin Lelievre Record #1224 Quebec Archives Film #4M01-4421 On this day the third of August in the year of our Lord, one thousand eight hundred and sixty, before me the undersigned Notary Public duly commissioned and sworn for Lower Canada, residing in the District of Quebec, and in the presence of William Knox, Farmer, and John Robertson, Tailor, both residing in the Seigniory of Saint Gabriel at the place called Valcartier, both witnesses called upon and present for the purposes hereof, the said witnesses signing with me the said Notary, personally came and appeared Helen Brown, widow of the late Thomas McGill, in his life time Mill Wright of Valcartier aforesaid, the said Helen Brown residing in the Seigniory of Saint Gabriel at Valcartier aforesaid, which said Helen Brown being in good health and sound of mind, memory, judgment and understanding as appeared to the said Notary and to said above named and undersigned witnesses by her actions, discourse and words, and for the purpose hereof came in the office of Benjamin Lelièvre, the undersigned Notary, and the said Helen Brown considering the certainty of death and the uncertainty of the hour thereof doth make, publish, declare and dictate to the said Benjamin Lelièvre, in the presence of the above named and undersigned witnesses her last will and testament in manner following, that is to say: The said Helen Brown recommends her soul to God, her Creator, when it shall please him to dissolve her mortal body, hoping for a full pardon of all her sins, through the intercession of his Blessed Son her Saviour. The said Helen Brown desires that her body be buried at the discretion of her Executor hereinafter named. The said Helen Brown doth hereby give and bequeath all, each and every her lands, goods, merchandise, real and personal estates, sum and sums of money, of money notes of hand, and obligations or otherwise which she is now possessed of or may hereafter be possessed of, without any reserve, restriction or limitation whatsoever and wherever the same may be found whether in Canada or elsewhere unto Isabel McGill, James McGill, Margaret McGill, Charlotte Jane McGill, William McGill, John McGill and Wilhelmina McGill all her children issue of her marriage with the said Thomas McGill, her husband. The said Isabel McGill, James McGill, Margaret McGill, Charlotte Jane McGill, William McGill, John McGill and Wilhelmina McGill her said children to have and to hold, use and enjoy the said lands, goods, merchandise, real and personal estates, sum and sums or as otherwise as aforesaid, of which she is now possessed of or may hereafter be possessed of, in full property and forever from and after the day of her decease and to be equally by them share and share alike. And in the event of any of the above named children deceasing before attaining the full age of twenty one, and without having any legitimate heirs of their bodies, then and in that case it is the wish and intention of the said Helen Brown that their share be the property and be equally divided amongst the survivors of the said above named children. But in the event of any of the said above named children deceasing before they shall have attained the full age of twenty one or after twenty one as aforesaid, and leaving legitimate heirs of their bodies, then and in that case their share shall be the property and belong to such legitimate heirs. Nevertheless it is the wish and intention of the said Helen Brown that after her decease those of her children who will be twenty one or more, with or without legitimate heirs, do dispose of their share of the present bequeathed property in full property and as they may deem fit and proper. And the said Helen Brown doth hereby nominate and appoint Executor of this her last will and testament the person of Thomas Brown of Valcartier, aforesaid Farmer, of who she doth request this last act of kindness. The said Helen Brown hereby annulling, cancelling, abrogating and making void all former will or wills by her the said Helen Brown which may have been heretofore made and executed. Thus done, made and dictated word by word by the said Helen Brown to the said Benjamin Lelièvre in the presence of the said above named and undersigned witnesses in the office of the said Benjamin Lelièvre at Valcartier aforesaid on the day and year first above written under the number one thousand one hundred and thirty, and the present last will and testament having been read and re-read to the said Helen Brown which she declared well to understand as being her last will and meaning, she hath persisted therein, and hath declared that she could not write or sign but made her ordinary mark of a cross having the said above named witnesses signed with me the said Notary, in faith and testimony of the premises. Will* | 10 March 1892 | Beauport, Quebec County, Quebec, Canada; 10th March 1892 Last Will of Henry Austin Brown Husband of Ellen Calback From records of Elzéar-Louis-Joseph Giroux Record No. 1576 Transcribed from Quebec Archives Online On this day, the tenth of the month of March in the year of Our Lord, one thousand eight hundred & ninety two, before the undersigned Notary Public, duly admitted and sworn in and for the Province of Quebec and residing at the City of Quebec, personally came, appeared and was present Henry Austin Brown, Farmer, of the place called Petit Village in the Parish of Beauport, County of Quebec, being in good bodily health, and perfectly sound of mind, memory and understanding, as it appeared to me the said Notary who after having recommended his soul to the Almighty God, hath in view of death dictated and named his present last will & testament unto me the said Notary, in the presence of Matthew Brown of the Parish of Beauport, Farmer, and John Doddridge of Quebec, Moulder, both witnesses expressly called for the purpose of witnessing this present last will and testament in manner and form following, that is to say: Firstly, I will and direct that my lawful debts be paid and my wrongs if any there be, be fully satisfied, by the Executor of my present last will & testament, hereinafter named to the discretion of whom I leave the case of my funeral. Secondly, I do hereby give and bequeath to James Brown of the Parish of Beauport my beloved son all the property moveable and immoveable, real and personal, generally whatsoever which I may be possessed of or which I may be entitled to at the time of my decease, of what nature and quality the same may be or wheresoever situated to have, hold, use and enjoy unto the said James Brown my said son from the day of my decease hereby instituting him my universal legatee on the following condition: That he shall pay to Elizabeth Brown, of Beauport, my beloved daughter, one hundred dollars which I bequeath to her out of the said property and one hundred dollars to Charlotte Brown, wife of John Taylor, Farmer, of the Parish of Lake Beauport my beloved daughter which I bequeath to her out of my said property payable after all debts are paid. Thirdly, I do hereby nominate and appoint as Executor of my present last will and testament the said James Brown my said son into whose hands I divest and disseize myself of all my said property according to the Custom. Fourthly, I do hereby revoke all other wills and codicils which I may have made previously as the one which I consider as containing my last will and desire. It was thus done, dictated and nominated by the said Henry Austin Brown, Testator unto me the said Notary in the presence of the witnesses herein above named and expressly called for the purpose. And his present last will and testament having been duly read over and read over again in the presence of the said witnesses for that purpose called, he declared to understand well the same and persisted in the said dispositions at my office in the City of Quebec on the day, month and year first above written under the number one thousand five hundred and seventy six of the minutes of Mtre. Elzéar-Louis-Joseph Giroux, the undersigned Notary. And the said Henry Austin Brown hath signed the present last will and testament in the presence of the undersigned Notary and of the undersigned witnesses who have signed the present last will and testament in the presence of each other, the said last will having been first duly read and read over again according to law.
