Where being in the presence of James Murphy, farmer, and Thomas Fitzsimmons, farmer, both residing at the River aux Pins aforesaid, witnesses called upon for the purposes hereof, the said witnesses signing with me the said Notary . I found the said Philip Smith, sick in bed, never the less sound of mind, memory, judgment and understanding as appeared to me the said Notary and the said above named and undersigned witnesses by his actions, discourse and words. And the said Philip Smith considering the certainty of death and the uncertainty of the hour thereof, doth hereby make, publish, dictate, and declare to Benjamin Lelievre, the said undersigned Notary in the presence of the said above named witnesses, his last will and in manner following. That is to say, the said Philip Smith recommends his soul to God, his Creator, when it shall please Him to dissolve his mortal body hoping for a free remission and pardon of her sins through the intercession of his blessed Son and Savior. The said Philip Smith doth hereby give and bequeath unto James Smith, one of his sons, that is to say, a lot of land situate in the Seigniory of Saint Gabriel aforesaid, in the second concession southeast of River aux Pins, being lot number twelve. The said James Smith to have and to hold the said hereby given and bequeathed lot of land in full property, from and after the day of the decease of the said Philip Smith. Thirdly, the said Philip Smith doth hereby give and bequeath unto Thomas Smith, another of his sons, that is to say, a lot of land situate in the Seigniory of Saint Gabriel aforesaid, in the second concession southeast of River aux Pins, being lot number eleven. The said Thomas Smith to have and to hold the said hereby given and bequeathed lot of land in full property, from and after the day of the decease of the said Philip Smith. Fourthly, the said Philip Smith doth hereby give and bequeath unto the said Ellen Herson, his said wife, an unsurveyed lot of land being in the Seigniory of Fossambault. The said Ellen Herson, to have and to hold the said hereby given and bequeathed lot of land in full property, from and after the day of the decease of the said Philip Smith. This present last will and Testament is thus made at the charge of the said James Smith of paying at the day of decease of the said Philip Smith unto John Smith, Bridget Smith, wife of Joseph Verncomb, Catherine Smith, wife of Richard Murphy, Mary Smith, widow Hall, Philip Smith and Barnard Smith, to each and every of the above named the sum of fifty cents. And again for the charge of the said James Smith of paying unto Patrick Smith, one of his brothers now absent, the sum of eighty dollars payable by the said James Smith to the said Patrick Smith, in three years from the day of decease of the said Philip Smith. And also at the charge by the said Thomas Smith of paying unto Patrick Smith, one of his brothers now absent, the sum of forty dollars payable by the said Thomas Smith to the said Patrick Smith, in three years from the day of decease of the said Philip Smith. And in the event of the said Patrick Smith, being deceased or deceasing without leaving any legitimate heirs, then and in that case the said James Smith and Thomas Smith, will be respectively be bound to pay the said sums of eighty and forty dollars, in equal shares unto the said John Smith, Bridget Smith, wife of Joseph Vercomb, Catherine Smith, wife of Richard Murphy, Mary Smith widow Hall, Philip Smith and Barnard Smith as also to the sum to the said Ellen Herson, his said wife. Fifthly, the said Philip Smith doth hereby give and bequeath unto the said Ellen Herson, his said wife, all his moveable property without any reserve whatsoever, including stock of cattle, of which he is now posses or may be possess of at the day of his decease. The said Philip Smith directs that his body be interred in a decent manner and the expensed of the funeral be paid and defrayed by the said Ellen Herson, his said wife. The said Philip Smith directs that all his just and lawful debts be paid by his said executor herein after named. The said Philip Smith doth hereby nominate and appoint the person of Henry Crawford, Esquire and Michael Murphy, farmer both residing at River aux Pins aforesaid, as executors to this his last will and testament whom he doth hereby request to render him this last act of kindness. The said Philip Smith hereby annulling, cancelling, objurgating, and making void all former will or wills which may have been heretofore made and executed by him the said Philip Smith. Thus done, made and dictated word by word by the said Philip Smith to the said Benjamin Lelievre, the said undersigned Notary, in the presence of the said above named and undersigned witnesses, in the District of Quebec aforesaid, in the Seigniory of Saint Gabriel, at the residence of the said Philip Smith, on the day and year, first above written, under the number one thousand two hundred and fifty nine, and after having read and re-read the present last will and Testament to the said Philip Smith, which he declared well to understand as being his last will, the said Philip Smith hath persisted therein as being his last will and meaning, and the said Philip Smith hath declared that he could not write nor sign his name, but made his ordinary mark by a cross, having the said above named and undersigned witnesses signed with me the said Notary in faith and testimony of the premises. I give, devise and bequeath unto my wife Hannah Ireland the usufruct and enjoyment of all my property real and personal, moveable and immoveable that I may be possessed of at the time of my decease, to be by her enjoyed for and during her natural life. And upon the decease of my said wife I will and direct that my property shall belong to and become the property of my son Richard Smith, of Valcartier aforesaid, Farmer, now residing with me, in full and absolute property from thenceforth forever, hereby constituting him my universal legatee, subject to the usufruct aforesaid. I hereby revoke and make void any and all wills and codicils by me at anytime heretofore made, declaring the present to contain my only true last wishes and intentions. I do hereby name and appoint my said wife and the said Richard Smith to be the Executrix and Executor of my present last will and testament, into whose hands I divest myself of all my property from and after my decease. It was thus made, named and dictated word for word by the said Testator to John B. Parkin, the said Notary, on the day and year first above written at the City of Quebec aforesaid, in the presence of Matthew Aylward Hearn, Advocate, and James Cannon, Advocate, both of Quebec, called in as witnesses for the effect hereof, the said testator having signed with and in the presence of the said Notary and witnesses, who have signed in his presence and in the presence of each other, these presents having been duly read to him by the said Notary in the presence and hearing of the said witnesses, and recorded in the office of the said John B. I desire that all my just debts, funeral and testamentary expenses be paid by my Executor hereinafter named as soon as possible after my death. II. I desire that all my properties whatsoever, money, etc., be divided by equal share between my children Alice Smith, wife of Denis Cullerton, Sara Smith, wife of William Boyd, William Parker Smith, and Frank Smith & I authorize William Parker Smith to receive and collect the share of Alice Smith and to send the amount to her in the Montana. She was born September 11, 1963 in Wausau, daughter of Harry C. Spanton III and LuAnn (Opper) Spanton. On August 12, 1995, she married Michael J. Luhtala in Wausau. Cathy was employed at Liberty Mutual Insurance as Director of Product Analysis until her retirement in January 2021. She was a volunteer for Wausau Area Mobile Meals and enjoyed traveling, cooking, watching movies, reading, listening to music and was an avid Green Bay Packer fan. Most of all, she loved to spend time with her family especially during the holidays. She loved making Thanksgiving dinner for her extended family. Survivors include, her loving husband of 26 years, Michael; her parents, Harry III and LuAnn Spanton, Weston; two children, James (Jana) Schneider, Sturgeon Bay and Samantha Schneider, Wausau; four grandchildren, Mckenzie Daoust, Noah and Chimaira Schneider and Liam Yates; three brothers, Luke (Monica) Spanton, Germantown, Mark Spanton, San Francisco, CA and Tom (Carolina) Spanton, Yuma, AZ; her mother-in-law, Sandra (Mike) Volhard, Wausau; and many relatives and friends. She was preceded in death by her father-in-law, Oliver Luhtala. A celebration of Cathy’s life will be held in the Spring of 2022 at Peterson/Kraemer Funeral Home, 1302 Sixth Street, Wausau. The family would like to extend a special thank you to the staff at the Froedtert Center For Advanced Care and the staff at Aspirus Cancer Care for the outstanding care and support for Cathy and her family. In lieu of flowers, memorials may be directed to Leukemia & Lymphoma Society (www.lls.org) in Cathy’s name.4 |

She is survived by her son Larry and his wife Linda and children, as well as her daughter-in-law Carol Holton and family and daughter Janice and husband Ken Mack and family. She will also be missed by her niece Lori (Don), as well as nephew Ross (Kathy). As very special thanks goes to lifelong family friend Joann Lough for the undying love and support she gave to Mom for many years. You are a very special person to our family. There are many friends who took the time to see Mom at Deer Lodge. Thank you so much for your kindness. Mom was blessed to have 10 grandchildren and 11 great-grandchildren. Any time a new picture was made available she showed it with much happiness and pride. Mom was affectionately know as “Gran” to all who loved her.She always had time for a game of cards and a sip or two. Taking a quarter from her in a game of cards was a risky undertaking. After Dad’s passing in 2008, Mom moved into Sturgeon Creek II where she made many great friends. There was a special group known as the “Girls”. Thank you for the special friendships you had. Our family will now keep our faith that there is a better place and Mom is reunited with loved ones. The staff at Deer Lodge 4 west was wonderful. Thanks for your compassion. Mom’s wishes did not include a service. A private family gathering has taken place. In lieu of flowers, please donate to the charity of choice. You were one of the best Mom.2 |
