On this twentieth day of April one thousand eight hundred and thirty five,
before us the undersigned Curate of St. Catherine and Missionary of Valcartier was present Edward Sweeney born in the Parish of Monasterevin, County of Kildare, Ireland and now residing in the Settlement of Valcartier, who being sick but at the same time enjoying his perfect senses and reason as it appeared to me and to the undersigned witnesses, has declared to me his desire of making his last will and testament; and has consequently dictated to me the following articles viz.:

1º He desires that he will die in the communion of the Holy Catholic and Apostolic Roman church.

2º He bequeaths his soul to the most holy and adorable Trinity, Father, Son, and Holy Ghost hoping that God will receive it in his great mercy and forgive him his sins.

3º He leaves his body to the earth from whence it was taken, and hopes that his family will give him a Christian burial.

4º He leaves to his wife, Rose Broughal [Brougham], the use of all his cattle, except one horse, and likewise all his house furniture until her death hoping that his sons, or any of them will take proper care of their mother but if she finds herself not well treated she will be at liberty to live with whomever she may please and in that case the chattels will be equally divided between his two sons, Bernard and John Sweeney and he binds them to give and pay to her yearly the sum of six pounds currency each one half as long as she lives.

5º He leaves and bequeaths to his two sons Bernard and John Sweeney his Lot of land situated in the fifth concession of Valcartier, Seigniory St. Gabriel, to each of them one half, but his son Bernard will have the liberty to take his choice of either of the said halves, and likewise he shall have the new house which is nearly to be raised and the present old house for a barn under condition that he will help his brother John when required to build twelve feet in addition to the little house and raise the whole two feet higher.

6º He reserves on his Lot one acre upon which the buildings are erected to belong to his two said sons in common (en communauté) so that they may have no difference about the site of these buildings.

7º He leaves and bequeaths exclusively to his son Bernard the grey horse, harness, cart and camisole in full property.

8º He leaves and bequeaths to his sons Bernard and John Sweeney his said Lot of land under the following conditions: That neither of them will have the liberty to sell his part to any stranger without the free consent of the other, but if he wishes to leave the place, he will offer and give it up to the remaining brother at a yearly rent or at a fair price according to the advice and judgment of any three decent men known by them.

9º He leaves and bequeaths to his daughter Mary the sum of seven pounds currency and to his daughter Rose the sum of ten pounds currency and to his daughter Ellen the sum of seven pounds currency to be paid at the time of their marriage in three equal installments in equal proportion by the two brothers, or if they do not marry and wish not to live together in the family they will be paid by installments as aforesaid.

10º If any of his afore named children do behave badly according to the judgment of the officiating Priest of this Parish and of the present witnesses Ferdinand Murphy and Michael Mooney, his will is that they or any of them be deprived of all and every thing left to them by this his will, and their part shall be divided among his dutiful children.

This he has declared to me to be his last will and testament after having been now read according to law (lu et relu) in presence of Ferdinand Murphy and Michael Mooney present and who have signed with us.

Done and passed in the dwelling house of the said Edward Sweeney on the day aforesaid and have signed with us.

P.S. The said testator Edward Sweeney has further declared that his will is that he leaves nothing to any of his other children Patrick and James except one shilling British to be paid by his son Bernard when deceased.

Notes by Patricia Balkcom: Edward died 3 months later, on the 12th of July, at the age of about 56. Since this was not an advanced age, it might be assumed that he had a chronic illness such as tuberculosis. This is one of the few wills that we have found that actually mention the place of birth in Ireland. Edward had 4 sons and 4 daughters. Three of the daughters are named in the will – a fourth daughter, Catherine, is not. She married (to Michael Mooney) before the will was written, so Edward may have felt that she was “taken care of”. It is not known why he specifically mentioned Patrick and James as not being heirs.2

Bernard and John Sweeney, both farmers of Valcartier, sell to Pierre Bedard, farmer living in the Parish Saint Ambroise, Lot 19 in the Seigniory of St. Gabriel and all animals, buildings and moveable effects on the property, inherited from their father Edward’s will, for £150 currency (£75 currency for the land; £75 currency for the moveable effects, etc.). The sellers acknowledge receipt of £125 pounds currency from the purchaser with an obligation by the purchaser to pay the sellers the remaining £25 in the next 3 years without interest.

Addendum - 29 August 1839
Lawrence Mooney of Valcartier, acting as agent for Bernard and John Sweeney, now residents of the County of Wayne in the State of Michigan, United States of America, accepts £25 currency for Bernard and John Sweeney from Pierre Bedard.
Note by Patricia Balkcom: It appears that Bernard, John and Rose (Edward's wife) moved to Michigan shortly after Edward's death. See my notes under each individual's listing (Bernard, John & Rose). Also, at this time I do not know if the sale was to Pierre Bedard, Sr. or his son.7

Land*10 April 1837"Barnard Sweeney" deposited a Patent certificate #14759 to the Detroit office that he had made full payment for the following land grant - for the West half of the South East quarter, and the West half of the North West Quarter of section thirty one, in Township two north of Range thirteen East ... containing 160 acres. (This was in the southwest corner of Clinton township, Macomb County.)8

Note: This is confusing as it appears that Daniel had received a grant of land six months earlier - in Riviere aux Pins. It's possible there are two Daniel Sweeneys or that he specifically wanted land in Valcartier proper - not Riviere aux Pins.6

The first part of the document is in French. It states that Lawrence Money owes Daniel Sweeney seven pounds and Sweeney is demanding payment. It does not state what the debt was for.

The deposition of William Bethel of the place called ValCartier, cordwainer, taken at the city of Quebec the first day of December 1824 before me John Thompson, Esquire, of His Majesty’s Justice of the Peace for the District of Quebec.
Thus said William Bethel being duly sworn maketh oath -
That on the 29th day of November last this deponent being in company with one John Emery the elder, and John Emery the younger, on the road in the Settlement of Valcartier, one Edward Swiney (sic) one, and John Swiney (sic) two also settlers of that place, did violently threaten to hurt the deponent, and called upon him to fight them - using at the same time much violent and opprobrious language against the Peace. And the deponent further states that at several times before the 29th day of November above mentioned, the said John Swiney and the said Edward Swiney have behaved to the the deponent with similar violence having called upon him to fight and threatened to beat him. And the deponent further saieth that on Sunday the 21st of November last one Daniel Swiney, brother of the said Edward and John, meeting the deponent on the road in or near (?) did in like manner violently threaten to do some bodily hurt to the deponent and that ...? the deponent is in fer that the said Edward Swiney and the said John Swiney and the said Daniel Swiney will do unto him this deponent some bodily hurt against the Peace.

BE IT REMEMBERED that on the fourteenth day of December in the fifth year of the Reign of our Sovereign Lord George The Fourth, by the Grace of God of the United Kingdom of Great Britain and Ireland King, Defender of the Faith, came before me Robert J. Entimawille Esquire, one of the Justices of our said Sovereign Lord the King, assigned to keep the Peace within the Said District. Edward Sweeney of Valcartier, yeoman, and William McCloughty of the same place, yeoman, and Owen McKenna of Quebec, shopkeeper and acknowledged themselves to owe to our said Sovereign Lord the King, to wit: the said Edward Sweeney the sum of twenty Pounds sterling and the said William McCloughty and Owen McKenna the sum of ten pounds sterling each, to be respectively made and levied of their several goods and chattels, lands and tenements to the use of our said Sovereign Lord the King, his Heirs and Successors, if the said Edward Sweeney shall fail in performing the condition underwritten.

THE CONDITION of this Recognizance is such, that if the above bounden Edward Sweeney shall keep the Peace and be of good behaviour towards Our Lord the King and all his liege people, and especially towards William Bethel of Valcartier, yeoman, for the space of six calendar months next ensuing; then the said Recognizance shall be void, but otherwise shall remain in full force and virture.

On this twentieth day of April one thousand eight hundred and thirty five,
before us the undersigned Curate of St. Catherine and Missionary of Valcartier was present Edward Sweeney born in the Parish of Monasterevin, County of Kildare, Ireland and now residing in the Settlement of Valcartier, who being sick but at the same time enjoying his perfect senses and reason as it appeared to me and to the undersigned witnesses, has declared to me his desire of making his last will and testament; and has consequently dictated to me the following articles viz.:

1º He desires that he will die in the communion of the Holy Catholic and Apostolic Roman church.

2º He bequeaths his soul to the most holy and adorable Trinity, Father, Son, and Holy Ghost hoping that God will receive it in his great mercy and forgive him his sins.

3º He leaves his body to the earth from whence it was taken, and hopes that his family will give him a Christian burial.

4º He leaves to his wife, Rose Broughal [Brougham], the use of all his cattle, except one horse, and likewise all his house furniture until her death hoping that his sons, or any of them will take proper care of their mother but if she finds herself not well treated she will be at liberty to live with whomever she may please and in that case the chattels will be equally divided between his two sons, Bernard and John Sweeney and he binds them to give and pay to her yearly the sum of six pounds currency each one half as long as she lives.

5º He leaves and bequeaths to his two sons Bernard and John Sweeney his Lot of land situated in the fifth concession of Valcartier, Seigniory St. Gabriel, to each of them one half, but his son Bernard will have the liberty to take his choice of either of the said halves, and likewise he shall have the new house which is nearly to be raised and the present old house for a barn under condition that he will help his brother John when required to build twelve feet in addition to the little house and raise the whole two feet higher.

6º He reserves on his Lot one acre upon which the buildings are erected to belong to his two said sons in common (en communauté) so that they may have no difference about the site of these buildings.

7º He leaves and bequeaths exclusively to his son Bernard the grey horse, harness, cart and camisole in full property.

8º He leaves and bequeaths to his sons Bernard and John Sweeney his said Lot of land under the following conditions: That neither of them will have the liberty to sell his part to any stranger without the free consent of the other, but if he wishes to leave the place, he will offer and give it up to the remaining brother at a yearly rent or at a fair price according to the advice and judgment of any three decent men known by them.

9º He leaves and bequeaths to his daughter Mary the sum of seven pounds currency and to his daughter Rose the sum of ten pounds currency and to his daughter Ellen the sum of seven pounds currency to be paid at the time of their marriage in three equal installments in equal proportion by the two brothers, or if they do not marry and wish not to live together in the family they will be paid by installments as aforesaid.

10º If any of his afore named children do behave badly according to the judgment of the officiating Priest of this Parish and of the present witnesses Ferdinand Murphy and Michael Mooney, his will is that they or any of them be deprived of all and every thing left to them by this his will, and their part shall be divided among his dutiful children.

This he has declared to me to be his last will and testament after having been now read according to law (lu et relu) in presence of Ferdinand Murphy and Michael Mooney present and who have signed with us.

Done and passed in the dwelling house of the said Edward Sweeney on the day aforesaid and have signed with us.

P.S. The said testator Edward Sweeney has further declared that his will is that he leaves nothing to any of his other children Patrick and James except one shilling British to be paid by his son Bernard when deceased.

Notes by Patricia Balkcom: Edward died 3 months later, on the 12th of July, at the age of about 56. Since this was not an advanced age, it might be assumed that he had a chronic illness such as tuberculosis. This is one of the few wills that we have found that actually mention the place of birth in Ireland. Edward had 4 sons and 4 daughters. Three of the daughters are named in the will – a fourth daughter, Catherine, is not. She married (to Michael Mooney) before the will was written, so Edward may have felt that she was “taken care of”. It is not known why he specifically mentioned Patrick and James as not being heirs.4

Bernard and John Sweeney, both farmers of Valcartier, sell to Pierre Bedard, farmer living in the Parish Saint Ambroise, Lot 19 in the Seigniory of St. Gabriel and all animals, buildings and moveable effects on the property, inherited from their father Edward’s will, for £150 currency (£75 currency for the land; £75 currency for the moveable effects, etc.). The sellers acknowledge receipt of £125 pounds currency from the purchaser with an obligation by the purchaser to pay the sellers the remaining £25 in the next 3 years without interest.

Addendum - 29 August 1839
Lawrence Mooney of Valcartier, acting as agent for Bernard and John Sweeney, now residents of the County of Wayne in the State of Michigan, United States of America, accepts £25 currency for Bernard and John Sweeney from Pierre Bedard.
Note by Patricia Balkcom: It appears that Bernard, John and Rose (Edward's wife) moved to Michigan shortly after Edward's death. See my notes under each individual's listing (Bernard, John & Rose). Also, at this time I do not know if the sale was to Pierre Bedard, Sr. or his son.18

10º If any of his afore named children do behave badly according to the judgment of the officiating Priest of this Parish and of the present witnesses Ferdinand Murphy and Michael Mooney, his will is that they or any of them be deprived of all and every thing left to them by this his will, and their part shall be divided among his dutiful children.

This he has declared to me to be his last will and testament after having been now read according to law (lu et relu) in presence of Ferdinand Murphy and Michael Mooney present and who have signed with us.

Notes by Patricia Balkcom: Edward died 3 months later, on the 12th of July, at the age of about 56. Since this was not an advanced age, it might be assumed that he had a chronic illness such as tuberculosis. This is one of the few wills that we have found that actually mention the place of birth in Ireland. Edward had 4 sons and 4 daughters. Three of the daughters are named in the will – a fourth daughter, Catherine, is not. She married (to Michael Mooney) before the will was written, so Edward may have felt that she was “taken care of”. It is not known why he specifically mentioned Patrick and James as not being heirs.1

Research NoteThomas Sweeney; Dundas, Wentworth County, Ontario, Canada; The information on Thomas Sweeney of Dundas, and his wife, Bridget Crofton, sister, Mary, and son, Anthony is all from an unknown author who typed index cards named, Sweeneys of Dundas. He claims that Thomas is the brother of Francis Sweeney of West Flamborough but I have been unable to find any information on Thomas or his family. However, I have found that Francis had a sister, Mary, as she was a witness to his marriage.3

(Witness) Death27 July 1863Michael Francis Sweeney; West Flamborough, Wentworth County, Ontario, Canada; Drowned in Sanderson's Creek. On a historical map of West Flamboro Township for 1875, there is a Joseph Sanderson, living in Concession 6 and there is a creek running through the property. This was in the general vicinity as to where Francis Sweeney was living.

The church record states that Michael Sweeney, died July 27, 1863 at the age of 16. He was born in Canada and was buried in Dundas on Jly 29, 1863. Cause of death was drowning. Witnesses were Michael Brown and Maurice Deneen and the priest was Fr. John O'Reilly.9,10

Owen McLaughlin sold to Francis Sweeney part of Concession 6, Lot 7 (1 acre) originally in Instrument #597, in West Flamborough by B/S for $300 on 25 November 1882 and registered on November 29 (Instrument #3873). on 25 November 1882. This same piece of land was then sold on April 26 1894 (Instrument #6097).
Note: This land was resold after Francis Sweeney's death. The Grantor was Margaret Sweeney et al (administrators of probate for Francis Sweeney - Georgina D. and Alf. Squibb) and the Grantee was Morris (Maurice) M. Dineen. One Acre by B/S for $250 on 26 Apri 1894 and registered on June 5th in Instrument #6097.16

"John Sweeney, (who I believe is his half-brother,) is listed as a freeholder in West Flamboro, (Hayesland Post Office, Concession 5, Lot 7."
Note: They did not have the whole lot.
The corner of the 5th concession had a functioning post office named Hayesland after the Hayes family, who I assume Elizabeth Hayes was a member of.
Although John Sweeney is listed as a freeholder, from his probate records, which state that he does not own any land, and a sale of the land by his widow, Elizabeth, in 1901, it appears that the land was actually owned by Elizabeth and not John. It appears that the land was originally bought in 1865, by Edward Kelly before 1865 and that it was then owned by Elizabeth when Edward died in 1881.18

That the said deceased died intestate leaving your Petitioner his widow and two grandchildren his only heiress and heir at law. All his children having predeceased him and having died intestate and without having left any Will, Codicil or Testamentary paper whatever, and that the Petitioner is his widow and next of kin of the said deceased That the value of the whole Property of the said deceased which he in any way died possessed of or entitled to, is under two hundred and fifty five dollars. That the value of the Real Estate is under two hundred and fifty five dollars and that full particulars and an appraisement of all said property are exhibited herewith and verified upon oath. "Be it Known that on the seventeenth day of April in the year of Our Lord one Thousand eight hundred and ninety-four, Letters of administration of all and singular the property of Francis Sweeney, late of the Township of West Flamboro in the county of Wentworth, deceased, who died on or about the fourteenth day of February in the year of Our Lord One Thousand eight hundred and ninety at the Township of West Flamboro in the county of Wentworth intestate and had at the time of his death a fixed place of abode at the township of West Flamboro in the said county of Wentworth were granted by Her Majesty's Surrogate court of the County of Wentworth to Margaret Sweeney of the Township of West Flamboro in the county of Wentworth, widow, the widow of the said intestate, she having been first sworn faithfully to administer the same by paying his just debts and distributing the residue (if any) of his property according to law and to exhibit under oath a true and perfect Inventory of all and singular the said property and to render a just and true account of her administration within eighteen months or sooner if thereunto required.

Father O'Reilly was the priest from Dundas and was also the travelling missionary priest to this area. There was a mission church in Morriston, north of Freelton but it appears the baptism did not occur there).3
