On twenty sixth day of the month of December in the year of our Lord one thousand eight hundred and ninety nine, before me Joseph Désiré Marcoux the undersigned Notary Public for the Province of Quebec residing and practising in the Parish of Beauport, personally came and appeared Mr. Matthew Brown, farmer, of the said Parish of Beauport.

Who in view of death has requested me the said Notary to receive his present last will which he did and doth hereby name and dictate to one the said Notary, in the presence of the two undersigned witnesses as follows, to wit:

Firstly, I do hereby give and bequeath to Mrs. Mary Ireland my beloved wife, all the property moveable and immoveable which I will die possessed of in whatsoever place it may be situated and of whatever value and nature it may be, to hold and begin to enjoy the same at the time of my decease, and I give my said wife the right and power to give the property of the said moveables and immoveables to one or two or all my children born of my marriage with her the said Mary Ireland at her discretion and the way she will see fit and proper and by share alike or not as she will judge and decide.

And I institute the said Mary Ireland my universal legatee in usufruct and I appoint and name her the Executrix of my present last will.

I revoke all former wills and codicils which I may have done previously to this one which contains my true and last will and intent.

It was thus made, named and dictated to me the said Notary by the said Mr. Matthew Brown, the Testator, in the presence in the presence of Mr. Antoine Grégoire Chalifour, Farmer, and Mr. James Gurry, Insurance agent, both of the said Parish of Beauport, witnesses and his present last will having been read to him by the said Notary in the presence of the said witnesses, the said Testator declared to well hear and understand the same in his residence in the said Parish of Beauport, on the day, month and year first above written, under the number three thousand seven hundred and eighty eight.

And the said Testator has signed with and in presence of us the said Notary and witnesses who have signed in the presence of the said Testator and in the presence of each other,after all the formalities required by law for the execution of the authentic last wills have been accomplished & fulfilled.

Five marginal notes approved are good. Eighteen words erased are null.

On this day the twenty eighth day of February in the year of our Lord One Thousand nine hundred and twenty one, before me Cyrille Renauld, notary, residing at Loretteville, undersigned, personally appeared Mrs Suzann Brown, wife of John McBain, Farmer, residing in the parish of St. Gabriel of Valcartier, who being of sound and disposing mind, memory and under-standing hath requested us the said notary to write down and received in due form of law her last will and testament which he has declared in manner and form following that is to say.
1.- I most willingly resign my soul into the hands of almighty God, my creator in the humble hope that he will receive it to his favor through the sole merits and intercession of Jesus Christ my savior.
2.-I desire that all my just debts, funeral and testamentary expenses be paid by my executor herein after named as soon as possible after my death.
3.-I give and bequeath unto my husband John McBain all my moveable and immoveable properties wherever the same may be found and to whatever the same shall amount hereby constituting my said husband my universal legatee and the executrix of this my will and testament.
4.-I revoke all wills and testaments I may have heretofore made and I declare the present to be my only true last will and testament.
     DONE and Passed at Loretteville under notarial number eight thousand seven hundred and thirty. After the reading of the present will to the testator by the notary in the presence of Jules Falalardeau, merchant, Albert Fournier, carriage maker, both of Loretteville witnesses requested, the testator, the notary and the witnesses have signed in the presence of each others.

On this day the sixth of August, one thousand eight hundred and ninety four, before us the undersigned Notary and witnesses hereinafter named, personally came and appeared Dame Susan Brown, now residing in Quebec, widow of the late Henry Ward in his life time a farmer residing in Beauport, who requested the said Notary to write down and receive in due form of law, her last will and testament which she instantly dictated and named as follows, to wit:

I will and direct that all my past debts be fully paid and satisfied out of my estate by my Executrix hereinafter named.

I give and bequeath all my property moveable and immoveable, real and personal, which I may die possessed of at the time of my decease unto my daughter Suzan Ward living with me in muneration of all the services she may have rendered me.

I appoint my said daughter my universal legatee and Executrix of my present will, revoking all former wills at any time heretofore by me made declaring the present to contain my only true will and intentions.

It was thus made, dictated and named by the said Testatrix unto us the said Notary and the said will having been read over to the said Testatrix by the said Notary in the presence of Etienne Gauvin of Quebec, Bookseller, and Alfred Leclerc of Quebec, Druggist, two witnesses expressly called for that purpose, she declared to have perfectly understood the same and persisted in the contents therein.

Thus done and passed before L. Leclerc, the undersigned Notary, on the day and year above written under the number sixteen thousand five hundred and fifteen the said Testatrix having signed her name wit us the said Notary and witnesses who have also signed these presents in the presence of the Testatrix and of one another after due reading according to law.

On this day, the fifth of February one thousand eight hundred and seventy nine, before the undersigned Notary Public for the Province of Quebec in the Dominion of Canada, residing in the City of Quebec, and William McBain, Senior, and William Hornby, Farmers of the Parish of St. Gabriel of Valcartier, witnesses to the effects hereof personally came and appeared Thomas Brown of said Parish of St. Gabriel of Valcartier, County of Quebec, Farmer, who made as follows his last will and testament:

1st I give, devise and bequeath to John and Thomas Brown, my sons, to each of them four hundred dollars.

2nd I give, devise and bequeath to James Brown, my other son, a sum of two hundred dollars.

3rd I give, devise and bequeath to Mary Jane Brown, my daughter, wife of Adam Wright, and Margaret Brown, my other daughter, wife of James Montgomery, to each of them a sum of one hundred and fifty dollars.

4th I give, devise and bequeath to my said daughters Mary Jane and Margaret, the balance of the money I may die possessed of after the payment of my debts & funeral expenses.

5th Those legacies are made in favor of my said children on the express condition they will renounce in favor of my universal legatee hereinafter named to the dower or right to a dower they may or might claim in or on my immoveable properties & sign gratis a deed to that effect.

6th I give & bequeath to Curtis Brown my other son the right of cutting fire wood & such other timber he may require on my lot of ground situate in the Seigniory of St. Ignace.

7th I give, devise and bequeath to Mary Billing my beloved wife all furniture, cattle, horses, agricultural implements and every other effect of any kind & nature I may die possessed of in full ownership.

8th I further give & bequeath to my said wife during her life time the usufruct of my immoveable properties and the vue propriété of the same to Andrew and Benjamin Brown, my youngest sons, instituting them my universal legatees in full ownership to have & to hold the same from the day of the death of their mother.

The present last will and testament received by Jean Baptiste Delage, the undersigned Notary in the presence of said witnesses, having been read to the Testator by the said Notary in the presence of said witnesses, he declared well to understand the same and has persisted in the same as containing his last intentions.

Thus done and executed at St. Gabriel of Valcartier aforesaid, dwelling of the Testator, under the number five thousand and sixty eight of the records of said Notary.

In witness whereof the said Testator hath signed with and in the presence of the said Notary and witnesses who have also signed with and in the presence of said Testator and in the presence of one another after the reading done.

One marginal note good & thirty three words erased are null.

On this seventeenth day of March one thousand nine hundred and fourteen, before me Cyrille Renaud, Public Notary residing at Loretteville, undersigned, personally appeared Thomas Brown, Farmer, residing in the Parish of St. Gabriel of Valcartier, who being of sound and disposing mind, memory and understanding hath requested me the said Notary to write down and receive in due form of law his last will and testament which he has declared in manner and form following, that is to say:

1º I most willingly resign my soul into the hands of Almighty God, my Creator, in the humble hope that he will receive it to his favor through the sole merits and intercession of Jesus Christ, my Saviour.

2º I desire that all my just debts, funeral and testamentary expenses be paid by my Executor hereinafter named.

3º I give and bequeath to my beloved wife Agnes Ireland, all my moveable and immoveable properties whatsoever, wherever the same may be found and to whatever the same shall amount, hereby constituting my said wife my universal legatee.

4º I nominate and appoint my said wife as Executrix of this my will and testament and I revoke all will and testament I may have heretofore made and I declare the present to be my only true last will and testament.

Done and passed at Loretteville under Notarial Number six thousand and eighty eight. After the reading of the said will by the Notary to the Testator in presence of Jules Falardeau, Merchant, and Alphonse Alain, both of the Parish of St. Ambroise of Jeune Lorette, the Testator, the Notary and the witnesses have signed in the presence of each other.

As a young man he rode over the ranch on horseback, superintending the shepherds, who watched over great flocks of sheep. In a Quebec paper of June 1st about 1835 a small news item credited him with bringing the first new potatoes into Quebec that summer.
The Minister of Lands for lower Canada arranged for him to buy a second property close to his own, which he did and then owned two farms in Valcartier Township."3

What are the inconveniences to which Agricultural Emigrants are subject here? What are the advantages and disadvantages of the situation of the Emigrant when compared with his previous situation in Europe? What from your experience is the best mode of surmounting the disadvantages to which he is exposed?

The great inconveniency to which the Emigrant is subject to, is the general want of Roads; With good Roads the Emigrant would be better off. For my own part I think I am as well off as I would be at home. Perseverance is the main object, and by that alone can the Emigrant thrive.

What course of agriculture have you found from your own experience, best adapted to this country?
As far as my experience goes, I find that green cropping is the most advantageous.

When you first arrived in this country did you obtain any land, and with what means did you begin upon it?
I got a farm on halves from Mr. Wilson; it was partly cleared; I remained a year upon it. I then took a lot of ground from Mr. Neilson, at a rent of £5 per annum: - there were about 20 acres of land cleared upon it. I brought with me about £300 from Scotland, which I laid out in purchasing land. I have about 500 acres of land of my own at this time, of which about 130 are cleared. The expense of clearing the land fit to put in a crop, was from 10 to 12 dollars.

How many days labour do you find that it requires to cut down and clear off one acre of land?
I think that it takes, for one man to cut and cross cut an acre of land, about a week, and another week for piling, burning and clearing it off ready for seed.

Are you acquainted with any poor settler near you who went on wild land without possessing any capital; and state his proceedings as far as you are acquainted with them?
I know of many industrious men who began without means, and who, by working upon hire, during their spare days in the summer, and during winter, felling down, and in spring cropping it as fast as possible, and then returning to town till harvest time; and by these means procure a cow, and so on gradually, are now tolerably well off.

If any poor settler were to obtain land within two miles of your house, would you be able to employ him on the spare days, between the time of getting his seed into the ground, and the harvest season, and what wages could you afford him besides his board?-
During summer I could give employment to many hands, and especially during harvest, I could employ perhaps twenty hands. During the harvest and generally in summer, I give these men one shilling and three pence per day, besides their victuals, and for women, one shilling per day. I keep one servant man to whom I pay, besides his board, nine pounds a year. I have a large family, consisting of myself and seven children, the oldest a man of 24 years of age, and the youngest 9 years old; of these 4 are boys and 3 girls. With the aid of my family, and this servant, the whole business of the farm is carried on till the approach of the harvest, when I require extra hands.

What is the smallest sum with which an Emigrant can venture upon a farm?-
Many go upon farms without any means but their own industry.

How do they manage to live?-
Just by working for other people for a day or two, now and then, to procure a loaf of bread or a few bushels of potatoes. With the exception of two families I do not know of any who are not tolerably comfortable in our Settlement.5

Before us the undersigned Notaries Public for the Province of Lower Canada and residing in the City of Quebec in the said province personally came and appeared William Brown of Valcartier, Farmer, who being apparently in good bodily health and of sound and perfect mind, memory and understanding requested us the said Notaries to write down and receive in due form of law, his last will and testament which he instantly made, published, dictated and named unto us the said Notaries in manner and form following:

I recommend my soul to Almighty God hoping for a free pardon and remission of all my sins through the intercession of my Blessed Saviour Jesus Christ.

I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my executor hereinafter named.

I will and direct that Jane Kirkhope my present wife be allowed and have during her life and so long as she shall remain and continue to be my widow the free use and enjoyment of a dwelling house, a double stove, and of a superficial part of land for a garden and also a milch cow to be chosen by her from among any other cows - and the cow shall be properly fed, kept and maintained during summer and winter and at all times, at the cost and expense of my estate and succession, and that the yearly rent or sum of five pounds currency be paid to her out of my estate and succession in half yearly payments on and during her life time and so long as she shall be and remain my widow as aforesaid and I further will and direct that the following articles and effects be paid to my said wife during her life time yearly in half annual installments, to wit: two quintals of oat meal, two quintals of flour, twenty bushels of potatoes and ten cords of wood laid down at her door, the payment and delivery of all which articles and effects to cease and discontinue at the death of the said Jane Kirkhope or from the moment that she shall remarry for such is my intention. And I further give and bequeath unto my said wife Jane Kirkhope another sum of twenty five pounds cy, once paid only provided that she shall not remarry as aforesaid.

I give and bequeath unto my children, sons and daughters, hereinafter named, viz.:

It being my will also that the said Elizabeth Ann Brown be schooled, educated and maintained with lodging, clothing and other necessities of life at the expense of my said estate until she shall have attained the full age of twenty one years. All the above several legacies thus made to the said James Brown, Margaret Brown, John Brown, Helen Brown, Janet Brown, Marion Brown and Elizabeth Ann Brown for and in lieu of all the rights and for and in my estate and succession.

I give and bequeath unto my nephew William Brown the sum of fifteen pounds currency,

I give and bequeath unto my son William Brown my land situate at Valcartier purchased from the Sheriff Sewell, with another piece of land to be taken off my land called Wallers Point purchased from Mr. Louis Panet and to contain twenty arpents in superficies to begin at two arpents from the River Jacques Cartier to his own house on the road side provided that the said William Brown his heirs and assigns shall give and allow to his brother Thomas Brown his heirs and assigns a sufficient road through the said William Brown's land to communicate to the main road and I also give and bequeath unto the said William Brown a horse, cart and two cows.

I give and bequeath unto my son Thomas Brown the rest of my land called Waller's Point purchased from Louis Panet as aforesaid with the rest and residue of my stock of cattle and implements of husbandry.

And I will and direct that the rest and residue of my lands be sold and disposed of to pay and discharge the several above particular legacies, which being done I will and direct that the balance , if any there be, be distributed share and share alike between my said two sons, William and Thomas Brown.

Lastly I will and direct that a sum of ten pounds cy be applied towards erecting a headstone and railing around my grave.

And I appoint my friend John Ray of Valcartier, blacksmith to be Executor of this my present will and testament hereby revoking and making null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true last will and testament.

It was thus made, published, dictated and named word for word, dicté et nommé mot pour mot, by the said William Brown, Testator, unto us the said Notaries and afterwards the said last will and testament having been twice read, lu et relu, to the said William Brown, Testator, by one of us the said Notaries, the other being present, he the said Testator declared that he had perfectly heard and understood the said will and testament and persisted therein as conformable to his last will and intention.

Thus done and passed at Quebec, in the office of Louis Panet one of the said Notaries in the Upper Town St. Denis Street where Jean Baptiste Trudelle his confrere was called in for the purpose and assisted and was present all the time, on the sixteenth day of September one thousand eight hundred and forty at ten o'clock before noon. The said Testator having signed these presents together with us the said Notaries after reading thereof aforesaid in faith and testimony of the premises.

Three words are erased are null, and four marginal notes approved are good.

And on the twenty sixth day of September one thousand eight hundred and forty four, before us the undersigned Notaries Public residing at Quebec, personally came and appeared William Brown, the Testator named and described in the foregoing and annexed will and testament who being apparently in good bodily health and of sound and perfect mind, memory and understanding after reading of his said foregoing and annexed will and testament requested us the said Notaries to write down and receive in due form of law following disposition in the form of codicil to his said last will and testament, which he dictated and named unto us word for word as follows:

I revoke that part of the legacy made by me to my son William Brown, by which it is stated that besides the land purchased from the Sheriff Sewell, I give him another piece of land to be taken off my land called Waller's Point and to contain twenty arpents in superficie my present will and intention being that the whole of my land called Waller's Point be held and possessed by my other son Thomas Brown to whom I bequeath and give the same, and that my said son William Brown have the whole of the land purchased from the Sheriff Sewell. And I hereby confirm my said will and testament in in every other particular thereof that is not hereby altered or revoked.

It was thus made, dictated and named, dicté et nommé, by the said William Brown unto us the said Notaries on the day and year above written, and the present codicil having been read over and over again, lu et relu to the said William Brown by one of us the said Notaries in the presence of the other Notary he declared that he had perfectly heard and understood the same, persisted in the contents thereof and signed together with us the said Notaries in faith and testimony of the premises .

Note by Patricia Balkcom: All of William’s nine children are mentioned in his will. All of the children, except Elizabeth Ann, were born in Scotland with his first wife, Marion Graham. Elizabeth Ann is the daughter of William’s marriage with Jane Kirkhope. William died in 1848 after being thrown from his horse, he was about 67 years of age.

He was on his way to a party at the Honourable John Neilson’s home when his horse ran away, throwing him out of his rig and fatally injuring him. He died a few days later on January 9, 1848 and was buried in Valcartier Cemetery. A tombstone marks his resting place and on it may be seen the date and place of his birth and date of his death."7

This was for Lot 27 Con. 8 of Howick Township. The grant was dated August 1st. 1865. It is presumed that William Brown and Agnes Clark came from Lower Canada at that time. In 1872 the railway came to Howick. A right-of-way across the property of William Brown is also registered on the same document.2

On this day the thirtieth of September, one thousand eight hundred and seventy six, before the undersigned Notaries Public for the Province of Quebec, residing in the City of Quebec, personally came and appeared Mrs. Ellen Buckley of the parish of St. Catherine, County of Portneuf, wife of Pierce Mulroney, Farmer, of the same place, who being of sound and disposing mind has made as follows her last will and testament:

I give, devise and bequeath to Jeremiah Mulroney, my son, all property, real and personal, moveable and immoveable, which I may die possessed of, without exception to have have and to hold the same in full ownership from the day of the decease of Pierce Mulroney, my beloved husband to whom I give and bequeath the usufruct and enjoyment of the same, during his life time, dispensing him from giving security and from making an inventory of my estate.

I charge my said son Jeremiah with the payment, at the extinction of the above usufruct, of the following sums of money, i.e., two hundred dollars to my son James and one hundred & sixty dollars to my daughter Elizabeth. These sums to be paid in the event only of my said husband surviving me and also if the said sums have not been paid by me or my husband to my said children before my death.

And I revoke all former wills and codicils that I may have made before this.

This last will and testament received by Cy. Tessier, Notary, in the presence of J.B. Delage, his colleague, having been read to the testatrix by the first-named Notary in the presence of his said colleague, she has declared well to understand the same and has persisted in the same as containing her last intentions.

At Quebec, office of the said Cy. Tessier, under the number five thousand and seventy five of his records.

In testimony whereof the said Notaries have signed in the presence of one another and of the testatrix who has declared not to know how to write or sign her name after the reading done.

Notes by Patricia Balkcom: Ellen died seven years after writing this will (15 March 1883). She had twelve children, nine of whom survived into adulthood. Only three are mentioned in the will. Pierce was the great-grandmother of Brian Mulroney, PM of Canada.7
