In the name of God, Amen, I James White, lately of the 4th Range of the Parish of Ste. Catherine de Fossambault, Cultivator, being weak in body, but of sound & perfect mind, memory & understanding, thanks be to Almighty God for the same, do make this my last will & testament in manner & form following, that is to say,

First, I bequeath my soul to God who gave it to me, and my body to the earth from whence it came to be buried in a decent Christian like manner at the discretion of my Executors hereafter to b mentioned.

Then, I will & bequeath to my dearly beloved wife Bridget Lynagh, whatever property I am or may be possessed of, the hour of my death, both real & personal of whatever nature forever.

On this day, the thirtieth of April in the year of our Lord one thousand eight hundred and seventy four, I the undersigned Notary Public for the Province of Quebec in the Dominion of Canada residing in the Parish of St. Ambroise de la Jeune Lorette, accompanied by the witnesses hereinafter named and subscribed,

Personally went to the residence of Mr. James White of the Parish of St. Gabriel of Valcartier, farmer, in the County of Quebec, who being in weak bodily health, but of sound mind, memory, and understanding as to us appeared by his manner and conversation hath requested of us the said Notary to receive and reduce into writing this his Last Will and Testament which we the said Notary in the presence of the said witnesses have taken down as dictated to us by the said James White word for word and as follows that is to say:

I. I wish that after all my just and lawful debts shall have been paid and satisfied with which I hereby charge my Executor of this my present Last Will and Testament hereinafter named and mentioned that a sum of money shall be paid for the saying of fifteen low masses (messes basses de requiem) after my decease for the repose of my soul with a grand mass on my body the day of my funeral.

II. I do hereby give, bequeath and devise unto my two sons, John White and Charles White, issued of my marriage with Mary Maher all and every the property real and personal, moveable and immoveable (without any exception whatsoever) which I may possess of hereafter instituting them my said two children, my universal legatees.

III. I wish that after my death the Tutor of my two children be my wife, Mary Maher, and Charles White, my brother, substitute Tutor.

IV. It is my wish also that my wife Mary Maher, shall have the power of settling and disposing of the property or renting the same in any way that suits her interests so to do.

V. And for the execution of the present, my Last Will and Testament, I nominate and appoint Charles White, my brother of the Parish of Ste. Catherine, farmer, and my wife, Mary Maher, as Executors of my present Will & Testament in favor of whom I do in conformity to the law and custom of this Province hereby deseize and divest myself of all my property for the ends hereof; hereby revoking all other wills, testaments, or codicils that I may have made prior to this present will to which alone I adhere as containing my instructions and last will.

Thus done and executed and dictated word for word & published and declared by the said James White, Testator, for and as his Last Will and Testament to and in the presence of the said Notary and Mr. John Thompson of the parish of St. Gabriel of Valcartier, farmer, and Mr. Mr. Pierre Stuart of the parish of St. Ambroise de la Jeune Lorette, baker, in the residence of the said James White aforesaid the day and year first above written under the number one hundred and fifty-four of the original deeds of the said Notary.

In faith and testimony whereof the said James White, Testator, hath signed these presents in the presence of the said witnesses the said, he same witnesses having also hereunto set and subscribed their names and signatures first duly read according to the law.

Three words erased are null. Three marginal notes approved are good.

On the fourth day of the month of September in the year of our Lord one thousand eight hundred and seventy nine, at the request of Mrs. Mary White, wife of Richard Hayes, of the Parish of St. Gabriel of Valcartier, I the undersigned Public Notary went to the residence of the said Mary White in the said Parish of St. Gabriel of Valcartier where I found her in good health, and apparently sound of mind, memory and understanding who requested me the undersigned Public Notary to write down and receive in the form of law her last will and testament which she instantly made and dictated unto me the undersigned Public Notary in the manner and form following, viz.:

1º I recommend my soul to the Almighty God, hoping for a free pardon and remission for all my sins and my body I commit to the earth to be buried in the cemetery, leaving the care of my funeral to my Executor.

2º I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my Executor hereinafter named.

3º I give and bequeath to my son Patrick Hayes my share of the land occupied now by him in the said Parish of St. Gabriel of Valcartier in full property, en pleine propriété.

4º I give and bequeath to my son Edward Hayes the remainder of all my properties, possessions and effects real and personal of whatever kind and wherever situated, and all sums of money, which I may leave, at the time of my death, and I institute the said Edward Hayes and Jane Hayes my universal legatees in full property, en pleine propriété, at the charge by him to board and clothe his sister Jane Hayes and provide for all other wants until she shall be provided for by marriage or otherwise.

And lastly, I do hereby nominate and appoint my son, the said Edward Hayes, my sole Executor, and in hands of whom I divest and disseize myself of all my estate and property according to law.

And I hereby revoke and make null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true and last will and testament.

It was thus made, dictated and named by the said Testatrix to Mtre. Jos. Laurin, Notary, at the place aforesaid, in presence of the Reverend John O’Farrell, Priest and Curate of the said Parish, and of Mr. James O’Connor, Farmer, of the same place, especially demanded for and to the effect of these presents, and the present last will and testament having been read in full to the said Testatrix by the said Jos. Laurin, Notary, in the presence of the aforesaid witnesses, she declared that she had perfectly heard and understood the same and found it to contain her true last will and intentions, therefore persisted therein, at the place aforesaid, on the day, month and year first above written under the number seven thousand nine hundred and thirty.

And in faith and testimony of the premises, the said Testatrix has declared being unable to sign and write her name in the presence of the said witnesses, who have signed these presents in the presence of the said Testatrix and of the said Notary, and in the presence the one of the other, the said Notary having signed these presents in the presence of the said Testatrix and witnesses, these presents having been first duly read according to law.

Note by Patricia Balkcom: Mary died about a year and a half later on April 28, 1881 at the age of about 66 years. Richard had died in 1879. Although she and Richard Hayes had 11 known children (at least two had died in infancy), only three children are mentioned in the Will.3
