George Jack, of the Parish of Charlesbourg and Grant Ireland of Beauport, Farmers, witnesses purposely called, all three undersigned, personally came and appeared Ann Calback, wife of Mr. Edward Brown, Farmer, of the Parish of Beauport who being of sound mind, will, memory and understanding as appeared unto us said Notary and witnesses. I recommend my soul to Almighty God my Creator entreating him through the merits of his Blessed Son my Saviour Jesus Christ for a free pardon and remission of all my sins and offenses. My body I commit to earth to be interred in a manner suitable to my condition. I give, devise and bequeath to each of my daughters, Mrs. Rachel Brown, wife of James Rourke, Farmer, residing at Little River at Maloville, and Ann Brown, wife of Thomas Dacres, Farmer of Beauport, the sum of twenty five dollars to be paid to them as soon as possible after my death. As to the residue of all the property either moveable or immoveable that I may die possessed of on the day of my decease I give, devise and bequeath the usufruct and enjoyment thereof to my husband Mr. Edward Brown to be enjoyed by him during the period of his natural life only. For I give, devise and bequeath the said property moveable and immoveable that I may be possessed of to my two daughters above named in full and entire property to be divided between them share and share alike after the death of their father the said Edward Brown instituting the said Edward Brown my usufructory legatee and my said daughters my universal and residuary legatees. My husband the said Edward Brown shall have the right to draw the money due to us as capital and interest by Leonidas Poulin for the land we sold to him and to give receipts therefore. The capital shall then be placed or interest for my said daughters, but the interest to be paid to my husband during his lifetime. I nominate my said husband the Executor of this my last will and testament hereby revoking all former wills and codicils I may have made before the present will to which alone I adhere as containing my true intentions and last will. It was thus done, dictated and named by the said Testatrix to me the said Notary in presence of the said witnesses all the time present at her domicile in the Parish of Beauport under the number seven thousand five hundred and eighty eight. And after due reading hereof the said Testatrix hath declared not to know how to write or sign her name when requested so to do in presence of said witnesses who hath signed with me the said Notary. All three signing in presence of the said Testatrix and of each other after the said reading and after the due performance of all the formalities required by law. Will* | 11 January 1882 | Beauport, Quebec County, Quebec, Canada; 11th January 1882 Last Will and Testament of Ellen Calback (wife of Henry Brown) From the records of Notary Elzéar-Louis-Joseph Giroux, Record Number 1338 Quebec Archives Online On this eleventh day of January in the year of our Lord one thousand eight hundred and eighty two, at the request of Mrs. Ellen Calback, wife of Henry Brown, Farmer residing at the Parish of Beauport, I the undersigned Notary Public duly admitted in and for the Province of Quebec and residing in the Parish of Beauport went to the residence of the said Henry Brown situate at the place called Petit Village in the Parish of Beauport, County of Quebec, and then and there being found the said Ellen Calback wife of the said Henry Brown, lying on a bed sick of body, but of sound and perfect mind, memory and understanding as it appeared to me the said Notary, who after having recommended her soul to God, hath in view of death, made, dictated and named her present last will and testament unto me the said Notary in the presence of Edward Brown of the Parish of Beauport, Farmer, and the Reverend Matthew Monkhouse Fothergill of Quebec, Rector of St. Peter's Church, both witnesses expressly called for the purpose of witnessing this present Last Will & Testament in the manner and form following, that is to say: Firstly, I will and direct that my lawful debts be paid and my wrongs if any there be, be fully satisfied by the Executor of my present last will and testament hereinafter named, to the discretion of whom I leave the case of my funeral. Secondly. I do hereby give and bequeath to my dear and beloved husband, Henry Brown, all the property moveable and immoveable, real and personal, generally whatsoever which I may be possessed of or which I may be entitled to at the time of my decease of what nature and quality the same may be or wherever situated; To have, hold and enjoy unto the said henry Brown, my said husband, from the day of my decease hereby instituting my said husband my universal legatee. Thirdly, I do hereby nominate and appoint as Executor of my present last will and testament the said Henry Brown, my husband, into whose hands I divest and dissieze myself of all my said property according to the custom. Fourthly, I do hereby revoke all other wills and codicils which I may have made previously to this one which I consider as containing my last will and desire. It was thus done, dictated and nominated by the said Ellen Calback, wife of the said Henry Brown, Testatrix unto me the said Notary in the presence of the witnesses herein above named and expressly called for this purpose; And her present last will and testament having been duly read over and read over again by the undersigned Notary in the presence of the said witnesses for that purpose called, she declared to understand well the same and persisted in the said dispositions at the place called Petit Village in the Parish of Beauport at her residence on the day, month and year first above written under the number one thousand three hundred and thirty eight of the minutes of Mtre. Will* | 16 December 1886 | St-Gabriel-de-Valcartier, Quebec County, Quebec, Canada; 16th December 1886 Last Will of Martha Calback[:BOLD] Wife of James Rourke From records of Cyrille Tessier Record No. 7149 Transcribed from the original at the Quebec Archives On this day the sixteenth of December one thousand eight hundred and eight six, before the undersigned Notaries Public for the Province of Quebec, Canada, residing in the City of Quebec, personally came and appeared, Mrs. Martha Calback, of the Parish of St. Gabriel of Valcartier, wife of Mr. James Rourke, of the same place, Farmer, who has made as follows her last will and testament: 1st I give, devise and bequeath to James Rourke, my beloved husband, the usufruct and enjoyment, during his life time, of all the property, real and personal, moveable and immoveable, which I may die possessed of, without exception, exempting him from the obligation of making an inventory and of giving security. 2nd I give, devise and bequeath to my son Henry, four acres in front by thirty in depth, or thereabouts, or whatever rights I may have thereon, being the north part or portion of the land which is composed of numbers twelve and thirteen of the Fourth Range of St. Gabriel West, also two sheep, two cows, and a horse, to have and to hold the same in full ownership from the day of the decease of my said husband. 3rd I give, devise and bequeath to my four daughters, Ellen, Margaret, Sarah, and Mary Ann the two remaining acres of said land, being the south part of the same, with buildings, as well as all my other property, real and personal, moveable and immoveable which I may die possessed of, instituting them my universal or residuary legatees, to have use, and enjoy the whole in full ownership and by equal shares, from the day of the decease of my said husband. And I do nominate and appoint my said husband James Rourke the sole Executor of this will, revoking all former wills and codicils I may have made before this. This last will received by Cyrille Tessier Notary in the presence of G.F.C. de Léry, his colleague, having been read to the Testatrix by the first named Notary in the presence of his said colleague she has declared well to understand the same and has persisted in the same as containing her last intentions. At Quebec, Office of the said Cyrille Tessier under the number seven thousand one hundred and forty nine of his records. In testimony whereof the said Notaries have signed in the presence of one another and of the Testatrix who has declared not to know how to write her name, after reading done. Five words erased null.
