Angers in the presence of Jean Baptiste Hamel, Notaries Public duly commissioned and sworn in and for the Province of Quebec, Dominion of Canada, and residing in the said City of Quebec, went to the house and residence of the said Richard Carroll situated in the said Parish of St. Sauveur of Quebec, where being, we found the said Richard Carroll in a bed room of the said house, on St. Joseph Street, sick of body, but of disposing mind, memory, judgment, hearing and understanding as it appears to the undersigned Notaries by his demeanour, who did declare unto the said Notaries, that he was desirous of making his will, requesting the said Edouard J. Angers Notary in the presence of the said Jean Baptiste Hamel, his colleague, Notary, to reduce it into writing in manner following, that is to say: Firstly: I recommend my soul to the Almighty God, praying him to have mercy upon me. Secondly: I will, devise and ordain that all my just and lawful debts and funeral expenses be paid forthwith after my decease by my Testamentary executors hereinafter named. Thirdly: I give, devise and bequeath unto Julia McKenna my wife all my Estate real and personal moveable and immoveable and of all kind and description and wherever they may be due owing and payable and wherever situated of which I may die possessed of, with the exception of a house number one hundred and ninety five, Ninth Street South Boston, because my intention is to give, devise and bequeath all the share and shares and pretensions that I may have and possess in the said building and dependencies to my brother John Carroll as hereinafter more fully explained. Fourthly: I give, devise and bequeath unto my brother John Carroll the aforesaid property and dependencies situated in the said Ninth Street South Boston and known as the number one hundred and ninety five of the said Street; to have and to hold unto the said John Carroll his heirs and assigns the aforesaid property and all and every the share and shares therein that I may die possessed of in full and absolute property from the day of my deceased on the charge of providing for Ellen Carroll my mother as I should have done myself, if living. Fifthly: As to a certain note dated at Boston the seventh September last, for four hundred and fifty dollars, payable to my order, and signed by James Carroll, my brother, it will become the property of my wife as aforesaid but it is my will and intention that my said brother shall have six years from the date of my decease to pay the said amount, and it will be at his option to pay it by installments every year or all in one payment at the end of the said six years. Sixthly: And now as to the residue of all and every the property of which I may die possessed of, I give, devise and bequeath the same to the said Julia McKenna, my said wife, as provided in the third article of my said will. To have and to hold unto the said Julia McKenna my said wife in full and absolute property from the day of the date of my decease, naming and appointing her the said Julia McKenna my universal residuary legatee of all and every the estate and properties I may die possessed of after fulfillment of the present will. And to execute this my last will and testament I hereby name and appoint the said Julia McKenna, my said wife, my Testamentary Executrix, in whose hands I divest and dispossess myself of all my estate and properties according to Laws and Customs in the country. And I revoke all other wills and codicils that I may have made before these presents hereby declaring this to be my last Will and Testament. Thus done, passed and received in the said Parish of St. Sauveur by the said Edouard J. Angers, Notary in the actual presence of the said Jean Baptiste Hamel his confrere, Notary, on the day and month and year first aforesaid at six o'clock in the afternoon under the number nine hundred and sixty of the minutes of the said Notary Edouard J. Angers, Notary. And the present will and Testament having been read to the said Richard Carroll by the said Edouard J. Angers, the said Jean Baptiste Hamel being present, the said testator did declare to understand the same and persist therein as being his last will and wishes, and hath signed his name and signature in the aforesaid presence of the said Notaries, who have signed these presents in his presence and in the presence of each of them after these presents has been read as aforesaid and in testimony of the premises. His 6 month son, Richard, had died 10 days earlier, so it is possible that they both had a contagious illness. Although they were living in Quebec City at the time of their deaths according to the will, they were both buried in Ste-Catherine-d-Jacques-Cartier. Richard was the son of the late James Carroll and Ellen Aylward. 4 |

Catherine. witnesses for the effect of these presents, personally appeared Robert Carroll of the Parish of Ste. Catherine, Farmer, who being of sound and disposing mind, memory and understanding hath requested us the said Notary and witnesses to write down and receive in due form of law his last will and testament which he has declared in manner and form following, that is to say: Firstly and principally, I most willingly resign my soul into the hands of Almighty God my Creator in the humble hope that he will receive it to his favor through the sole merits and intercession of Jesus Christ my Saviour. Secondly, I desire that all my just debts, funeral and testamentary expenses, with one service on my body and an anniversary service the first year after my death be paid by my Executors hereinafter named as soon as possible after my death. Thirdly, I give and bequeath the sum of twenty five dollars each to my daughters Sarah and Mary Ann to be paid to them by my son Patrick ten years after my death. Fourthly, I give and bequeath all my moveable and immoveable properties to my son Patrick Carroll to the charge by him to take care of his mother Ann Coile [Coyle] and to give to her two beds with bed clothes. Fifthly, I nominate, constitute and appoint my said son as Executor of this my will. Sixthly, I revoke all wills and codicils I may have heretofore made and I declare the present to be my only true last will and testament. The present will was thus declared by the said Testator to the said Notary in the presence of the witnesses aforesaid, read to the said Testator by said Notary in the presence of aforesaid witnesses, and [the] Testator declared to understand it fully and persisted therein. Done and passed at the residence of said Testator at St. Catherine under Notarial number seven hundred and eighty one. And after the reading of these presents as aforesaid the Testator having declared his inability to sign his name has made his mark in the presence of said Notary & witnesses and said Notary & witnesses have signed in the presence of Testator and in the presence of each other. Witnesses herein request for the effect hereof, the said witnesses signing with the said Notary hereby came and appeared Thomas D. O’Carroll, residing in the parish of Saint Gabriel de Valcartier aforesaid esquire land surveyor Which said Thomas D. O’Carroll, being in good health and sound of mind, memory, judgment and understanding as appears to the said Notary and other said above named and undersigned witnesses by his actions, words, and discourse, and for the purpose thereof came in the office of Benjamin Lelievre, the said undersigned Notary. And the said Thomas D. O’Carroll considering of certainty death and the uncertainty of the hour thereof do hereby make, publish, declare and dictate to the said Benjamin Lelievre in the presence of the said above named and undersigned witnesses, his last will and testament in named following, that is to say the said Thomas D. O’Carroll commends his soul to God, his creator, when it shall please Him to dissolve his mortal body hoping for a free pardon and reminder of all his sins through the intercession of his blessed son, our Saviour, Jesus Christ. The said Thomas D. O’Carroll doth holy give and bequeath unto Margaret Green his beloved wife, and Caroline O’Carroll and Helena O’Carroll, two of his daughters, all his moveable and immovable property, sum or sums of money, notes of hand, and obligations or otherwise of which he is now possessor of or may hereafter be possessor without any reserve, restrictions and limitations, whatever and whenever same may be found whether in Canada or elsewhere. Picard No. 655 Quebec Archives Online On this day the fourteenth of December in the year of our Lord one thousand eight hundred and ninety three (1893), At the requisition of Mrs. Mary Magrath, of the parish of St. Gabriel of Valcartier, wife of Mr. Luke Carton alias Doyron of the said parish, farmer; I, the undersigned Notary Public, for the Province of Quebec in the Dominion of Canada residing in the parish of St. Ambroise of La Jeune Lorette, accompanied by the witnesses hereinafter named and subscribed, personally went to the residence of the said Mary Magrath, where we found her being in weak bodily health, but of sound mind, memory & understanding as to us appeared by her manner & conversation, hath requested of us, the said Notary & witnesses to receive and reduce into writing this her Last Will and Testament which I, the said Notary, in the presence of the said witnesses, have taken down as dictated to us by the said Mary Magrath, as aforesaid, word for word and as follows, that is to say: 1º I recommend my soul to God, asking him the everlasting beatitude by the merits of Jesus Christ my Saviour. 2º I wish that after my lawful & just debts shall have been paid & satisfied, with which I hereby charge my Executor hereafter named, a sum of money to be paid to the Curé of the parish of St. Gabriel of Valcartier to be, by him, employed for the saying of ten low masses of requiem for the repose of my soul the soonest as possible my death. 3º I give and bequeath unto my husband Luke Cartin alias Doyron all and every my property moveable and immoveable, all sum and sums that I may possess of on the day & hour of my decease instituting him, my said husband, my legatee universal "en propriété" from the day of my death. 4º And for the execution of the present, my Last Will and Testament, I do here nominate and appoint my said husband in favor of whom I do in conformity to the laws & customs of this Province, disseize to the present to which alone I do adhere as containing my true intentions and Last Will. Thus done & dictated word for word, and published and declared by the said Testatrix, Mary Magrath, aforesaid, for and as her Last Will and Testament to and in the presence of Mr. Patrick King, farmer of the parish of St. Gabriel of Valcartier and Julia Conway, his wife, of the said parish of St, Gabriel of Valcartier, witnesses expressly called for the effect of these presents, at the residence of the said Mary Magrath on the day and year first above written under the number six hundred and fifty five (655) of the original deeds of the said Notary. In faith and testimony whereof the said witnesses have signed these presents before the Notary and the Notary before the said witnesses, the said testatrix having declared not to know how to write or sign her name when requested so to do first duly read according to law.
