Will* | 27 June 1903 | St-Gabriel-de-Valcartier, Quebec County, Quebec, Canada; 27th June 1903 Last Will of Robert Clark (Husband of Dorothy Rourke) From records of Cyrille Renaud No. 2506 Quebec Archives – Translated from the Original On this twenty seventh day of June, one thousand nine hundred and three, before me Cyrille Renaud, Public Notary residing in the parish of St. Ambroise, personally appeared Robert Clark, Farmer, residing in the Parish of St. Gabriel of Valcartier who being of sound and disposing mind, memory and understanding hath requested us, the said Notary and witnesses, to write down and receive in due form of law his last will and testament which he has declared in manner and form following: 1º I desire that all my just debts, funeral and testamentary expenses be paid by my Executor hereinafter named as soon as possible after my death. 2º I give and bequeath to my son James Clark, residing in said parish of St. Gabriel of Valcartier all my moveable and immoveable properties wherever the same may be and to whatever the same shall amount hereby constituting my said son James Clark my universal legatee. I. This legacy is made by the Testator to the charge to support his mother, Dorothy Rourke, during her life, to procure to her every thing necessary to the life, and to take good care of his mother as a good son and these conditions sont de rigueur. II. To the charge to pay the sum of one hundred dollars to my daughter Margaret Clark one year after my death. III. To pay the sum of fifty dollars to his other sisters, Elizabeth, wife of David Hornby & Agnes, wife of Armand Harris, two years after my death. I commute, constitute and appoint my said son James Clark as Executor of this my will and testament. I revoke all will and testament I may have heretofore made and I declare the present to be my only true last will and testament. I will and bequeath unto my son, Samuel Clark, the lot of land I now reside on which is number nineteen of the first range of River aux Pins St. Gabriel West, together with all the moveable effects, horses, cows and stock which I may die possessed of subject to the payment by the said Samuel Clark to his mother Bridget McCabe of the sum of two hundred and forty dollars currency in case of his said mother not residing or wishing to reside with my said son and as soon as she may demand payment thereof. And in case the said Bridget McCabe residing with my said son then I will and direct that he shall clothe, board and lodge during her life his said mother and also the use of a said milk cow, the fencing and housing of said cow to be at cost of my said son and also to pay his brother William Clark the sum of eighty dollars when he comes the age of twenty one years. I also will and bequeath unto my said son Samuel number eight of the first range of the North West side of the River aux Pins, Parish of Valcartier, and the right of cutting and using to my son William of one half of the timber which may be on the said lot, and Samuel shall pay to my said son William the sum of two hundred dollars when he shall attain the age of majority. I will and bequeath unto my said son William whatever money or moneys I may die possessed of to be his own property to do as he may deem fit as soon as he becomes of age, my said wife Bridget McCabe to have the enjoyment thereof until such time as he attains the age of majority. And the said Bridget McCabe, wife of the said Samuel Clark, being present also doth will and direct that the present will be carried out according to its true intent and meaning. Will* | 24 January 1884 | Ste-Catherine-de-la-Jacques-Cartier, Portneuf County, Quebec, Canada; 24th January 1884 Will of Denis Clear Widower of Catherine Fitzgerald From the Notary Records of Edouard Antill Panet Record #2496 Transcribed from the Original Will at the Quebec Archives On this twenty fourth day of January in the year of our Lord one thousand eight hundred and eighty four at the hour of eleven of the clock in the forenoon, at the special request of Denis Clear, of the Parish of Sainte Catherine, Farmer, I, Édouard Antill Panet the undersigned Notary Public duly commissioned and sworn in and residing and practising in the Parish of Saint Raymond in the County of Portneuf and Province of Quebec, accompanied by Malachy Landrigan and John Powell, farmers and both residing in the said Parish of Sainte Catherine, the witnesses called by the said Denis Clear and required by law, personally reported to the residence of the said Denis Clear in said Parish of Sainte Catherine, and there finding him in bed but of sound and disposing mind, memory, judgment, and understanding as it appeared unto us, Notary and witnesses, from his words and actions, yet knowing and considering the certainty of death and the uncertainty of the time thereof and being desirous of regulating his worldly affairs whilst yet he had the strength so to do, hath named, dictated and nominated a fait dicté et nommé unto the said Notary in the presence of said witnesses his last will and testament in the manner and form following: 1º I recommend my soul to Almighty God my Creator in the humble hope that he will receive the same to his favor through the merits and intercession of Jesus Christ our Lord and Saviour. 2º I will and order that all my just debts, funeral and testamentary expenses be first paid by my Executrix hereinafter named. 3º I will and order that my body be committed to the grave to be interred in a manner suitable to my station in life and according to the rites and solemnities of the Holy Roman Catholic Church and faith of which I am a member, and that a funeral mass be sung over my remains the day of my funeral and that ten low masses be said for the repose of my soul as soon as possible after my decease. 4º I give, devise and bequeath to Dame Ellen Clear, my daughter and widow of the late James Neville, the sum of one hundred dollars to be paid her by my Executor hereinafter named, out of the monies coming to me by virtue of the Deed of Sale executed by me in favor of John Fitzgerald. 5º And as to the rest and residue of the money, due, owing and payable to me by the said John Fitzgerald, by virtue of the said deed of sale, after the payment of my funeral expenses, and my support and board, and the above mentioned legacy, I give, devise and bequeath the same to my four remaining children, Michael, Patrick, Catherine, and Mary Clear to be divided between them in equal shares or portions, share and share alike, to be by them and each of them used, enjoyed and disposed of as they may see fit and proper and hereby instituting and naming the said John Fitzgerald, my son-in-law, at present residing in the Parish of Saint Basile, Executor of this my present last will and testament hereby revoking and repealing all other and former last wills and codicils by me heretofore made wishing and desiring that the present alone be followed. It was thus named, dictated and nominated fait dicté et nommé by the said Testator of his own free will and accord to the said Notary, in presence of said witnesses, at the residence of the said Testator in the Parish of Sainte Catherine, on the day, month, and year first above written. And the said Testator persisted therein after the reading thereof by the said Notary to the said Testator, in the presence of the said witnesses, as fully to embody and contain his last will and intentions. Thus done and passed at Sainte Catherine aforesaid on the day, month and year aforesaid under the number two thousand four hundred and ninety six of the original deed remaining of record in the office of the undersigned Notary. In testimony whereof the said Testator hath signed these presents with and in the presence of the said Notary and witnesses, who have also signed in the presence of the said Testator and in the presence of each other. Will* | 15 September 1898 | Ste-Catherine-de-la-Jacques-Cartier, Portneuf County, Quebec, Canada; 15th September 1898 Will of Ellen Clear (widow of James Neville) From records of Notary Cyrille Renaud No. 1840 Transcribed from the original at the Quebec Archives On this fifteenth day of September, one thousand eight hundred and ninety eight, before me Cyrille Renaud, Public Notary, residing in the Parish of St. Ambroise and Peter Murphy and John McLaughlin, both of the Parish of Ste. Catherine, Farmers, witnesses requested for the effects of these presents, personally came and appeared Ellen Clean, widow of the late James Neville, of Ste. Catherine, Farmer, who being of sound and disposing mind, memory and understanding hath requested us the said Notary and witnesses to write down and receive in due form of law her last will and testament which she has declared in manner and form following, that is to say: 1º I desire that all my just debts, funeral and testamentary expenses be paid by my Executor hereinafter named as soon as possible after my death. 2º I give and bequeath to my son Patrick Neville all my moveable and immoveable properties wherever the same may be found and to whatever the same may shall amount, hereby constituting my said son Patrick my universal legatee, to the charge to pay the sum of one hundred dollars that I owe Michael Clear and to the charge to pay Michael Neville, Farmer, Kate Neville and Mary Neville to each of them the sum of twenty five dollars. I nominate, constitute and appoint my said son Patrick Neville as Executor of this my will and testament. I revoke all wills and testament & codicils I may have heretofore made, and I declare the present to be my only true last will and testament. The present will was thus declared by the said Testatrix to the said Notary in the presence of witnesses aforesaid, read by the said Notary to the said Testatrix in presence of aforesaid witnesses, who declared to understand fully and persist therein. Done and passed in Ste. Catherine at the residence of the said Testatrix under Notarial Number fourteen hundred and seventy. The Testatrix having declared her inability to sign her name has made her mark in presence of Notary and witnesses and the Notary and witnesses have signed in the presence of the Testatrix and in the presence of each other.
