On this day the eighteenth of November in the year of our Lord one thousand eight hundred and sixty four, I the undersigned Notary Public duly commissioned and sworn for Lower Canada residing in the District of Quebec at the request of Laughlan Henry Coughlan, residing in the Seigniory of St. Gabriel at the place called ValCartier, cabinetmaker, went to the residence of the said Laughlan Henry Coughlan situate at ValCartier aforesaid.

Where being in the presence of John Sullivan, Esquire, Land Surveyor and Michael Maher, farmer, both residing in the Parish of St. Catherine, County of Portneuf, witnesses hereunto required for the purposes hereof, the said witnesses signing with me the said Notary . I found the said Laughlan Henry Coughlan, attending to his household affairs, being sound of mind, memory, judgment and understanding as appeared to me the said Notary and to the said above named and undersigned witnesses by his actions, discourse and words.

And the said Laughlan Henry Coughlan considering the certainty of death and the uncertainty of the hour thereof, doth hereby make, publish, dictate, and declare to Benjamin Lelievre, the said undersigned Notary in the presence of the said above named witnesses, her last will and testament in manner following. That is to say, the said Laughlan Henry Coughlan recommends his soul to God, his Creator, when it shall please Him to dissolve his mortal body hoping for a free remission and pardon of her sins through the intercession of his blessed Son and Savior.

The said Laughlan Henry Coughlan doth hereby give and bequeath unto Margaret Mary Loughran, his wife, all his moveable and immoveable property generally sum and sums of money whether by bond, note of hand, obligation, deed or otherwise, save except and reserving all his Cabinet Maker tools which he doth hereby give and bequeath unto James Coughlan, his infant, son, in full property and this at the charge by the said Margaret Mary Loughran, his said wife, of keeping the same safe, until the said James Coughlan shall attaint the age of fifteen, at which age he shall have the use of them, without however having the right of selling or otherwise disposing of the said tools until he shall have attained the full age of twenty one. And in the event of the said James Coughlan deceasing before attaining the full age of twenty one or without leaving any legitimate heirs, then and in that case the said Cabinet Maker’s tools shall be the property and belong to the said Margaret Mary Loughran.

The said Margaret Mary Loughran to have, hold, use, possess and enjoy the said moveable and immoveable property sum and sums of money, in full property and after the day of the decease of the said Laughlan Henry Coughlan.

The said Laughlan Henry Coughlan directs that all her just and lawful debts be paid.

The said Laughlan Henry Coughlan doth hereby nominate, constitute and appoint the person of the said Margaret Mary Loughran, his said wife, as Executrix of this his last will and testament whom he doth hereby request to render him this last act of kindness.

The said Laughlan Henry Coughlan doth hereby annul, cancel, objurgate, and make void all former will or wills which may have been heretofore made and executed by him the said Laughlan Henry Coughlan.

Thus done, made and dictated word by word by the said Laughlan Henry Coughlan to the said Benjamin Lelievre, the said undersigned Notary in the presence of the said undersigned, on the day and year, first above written, under the number one thousand three hundred and nine and after having read and re-read the present last will and Testament to the said Laughlan Henry Coughlan, in the presence of the said above and named and undersigned witnesses, which he declared well to understand, the said Laughlan Henry Coughlan, hath persisted therein as being his last will and meaning, and the said Laughlan Henry Coughlan and the said above named and undersigned witnesses have signed with me the said Notary in faith and testimony of the promises.

My Notes: Laughlan died five months later on the 13th of April 1865 at the age of thirty. I would suspect that he had an illness such as consumption (tuberculosis) since he was aware of his impending death at an early age. A second son, Arthur, was born to his wife three months following his death. They also had a daughter, Mary Ellen, who had been born in 1860.

On this day the twenty ninth day of July in the year of our Lord one thousand eight hundred and sixty one, I the undersigned Notary Public duly admitted, commissioned and sworn in and for the Province of Lower Canada, residing in the Parish of St. Augustin, County of Portneuf, in the said Province, and the witnesses hereinafter named and denominated, went to the residence of Mr. Patrick Coughlin, farmer, residing in the Parish of Ste. Catherine, where being we found the said Patrick Coughlin in his bed being bodily sick but of sound mind, memory, judgment and understanding, who declared unto us the said Notary and witnesses, that considering the certainty of death & the uncertainty of the hour thereof and in order to be better prepared to leave this world whenever it will please God Almighty to call him hence, he desired us to make out his last will and testament which he dictated unto the said Notary, in manner and form following:

Firstly, I recommend my soul to God Almighty, My Creator, begging forgiveness of all my sins, and the enjoyment of eternal happiness in the world to come.

Secondly, I do will and ordain that all my just debts be paid and any wrongs by me done, if any there are, repaired as soon as possible after my decease by my Testamentary Executor herein after named and appointed.

Thirdly, I do will and ordain that my body shall be interred in a manner suitable to my condition, relying in the discretion of my said Testamentary Executor hereinafter named.

Fourthly, I give and bequeath unto Mary Coughlin, Julia Coughlin and Ellen Coughlin, my daughters, and to Arthur Coughlin, one of my sons, each of them, the sum of three pounds currency, and moreover to the said Mary Coughlin my bed and bedding. The whole to take lieu & being payment to them of all heredity claims in my estate & succession.

And lastly, as to all and singular the remainder and residue of my property, real and personal, moveable and immoveable, that I may die possessed of and whatever kind and nature the same may consist, and in what place soever the same may be situated, I do give and bequeath the same unto Cornelius Coughlin, the other of my sons, for by him to enjoy, use and dispose thereof from the day of my decease as he may think proper, hereby instituting him my universal legatee in property.

And for the execution of the present will, I name for my Executor, the said Cornelius Coughlin, my beloved son, into the hands of whom I do hereby divest and disseize and dispossess my self of all the said property according to the meaning of the law actually in force concerning wills.

And finally, I do hereby revoke all other wills and testaments that I may have heretofore made desiring this present one may have its full effect for such is my last will and desires.

Thus done and dictated by the said Testator unto the said Notary on the day and year first above written, in the house and residence aforesaid, in the said Parish of Sainte Catherine, under the number three thousand seven hundred and twenty nine, in the presence of Messrs. Patrick White and Patrick Walsh, both farmers of the said Parish of Sainte Catherine, witnesses, called for the effect hereof, and these presents having been read over by the said Notary unto the said Testator, in the presence of the said witnesses he declared that he well understood the same in all its contents and persisted therein, the said Testator having been requested to sign, declared that he could not sign nor write his name sign, the said witnesses signed these presents together with the said Notary, first duly read over according to law.

BEFORE ME, the undersigned, one of the Justices of our Sovereign Lady the Queen assigned to keep the Peace within the District of Quebec, this seventeenth day of September in the year of our Lord Christ, one thousand eight hundred and forty nine personally came and appeared James Cullen of the place called Stoneham, farmer.
 
Who being duly sworn upon the Holy Evangelists of Almighty God, doth declare, depose, and say, as follows: - to wit, on Sunday the ninth instant I was in Thomas Wright’s house at Stoneham when we perceived James Duffy and Thomas Duffy and John Duffy chasing James Cowan and his family in Mr. Cowan’s own field. I perceived that Mr. James Cowan was running toward Mr. Wright’s house pursued by James, John and Thomas Duffy. I went out of the home with Mr. Thomas Wright and I saw James Duffy strike James Cowan with an iron hay fork over the head. Cowan fell on his knees, then James Duffy jostled him down again and John Duffy lifted a wrightly (?) hand stick with a big lump at the end of it and struck him twice over the head when he was down. I came down to Mr. Cowan and lifted him up. His face was all covered with blood flowing from the cuts that were inflicted by the blows he had received from James and John Duffy and Mr. Wright brought him into his house.

BEFORE ME, the undersigned, one of the Justices of our Sovereign Lady the Queen assigned to keep the Peace within the District of Quebec, this seventeenth day of September in the year of our Lord Christ, one thousand eight hundred and forty nine, Personally came and appeared James Cowan of the place called Stoneham, farmer.

Who being duly sworn upon the Holy Evangelists of Almighty God, doth declare, depose, and say, as follows: - wit, I reside in the extra parochial place called Stoneham in the County and District of Quebec and am neighbor to one James Duffy. On Sunday the ninth instant Margaret Flinn came running into my house and told me that James Duffy was beating my two sons whom I had sent to turn off his cattle from my grain. I perceived that my eldest son had his face covered with blood and was running away pursued by Duffy. As soon as Duffy saw me he stopped and turned towards his house. I was going toward my house when I saw James Duffy with his two brothers John Duffy and Thomas Duffy running towards me and shouting. Being in fear of my life and perceiving John Wright with others standing in Mr. Thomas Wright’s fields I made towards them calling on them to protect me. I had picked up an iron hay fork which I believe Margaret Flinn had thrown to me. I jumped over a fence and told the two brothers James and Thomas Duffy who were pursuing me to stand back. XXXX then making over the fence I ran on towards John Wright. They overtook me, here James Duffy seized hold of the fork I had in my hand and struck me with it on the left side of the head; the blow completely severed the skin, I was stunned and fell on my knees. I was struck again and fell down. When down I was again struck on the head but cannot say by whom. Marg Flinn then came up and with the help of James Cullen , I believe, took me into Mr. Thomas Wright’s house. I received three severe cuts on my head from which I bled profusely. I have since that time been confined to my house and under the care of Doctor Joseph Painchaud who examined my wounds.
