BEFORE ME, the undersigned, one of the Justices of our Sovereign Lady the Queen assigned to keep the Peace within the District of Quebec, this seventeenth day of September in the year of our Lord Christ, one thousand eight hundred and forty nine personally came and appeared James Cullen of the place called Stoneham, farmer.
 
Who being duly sworn upon the Holy Evangelists of Almighty God, doth declare, depose, and say, as follows: - to wit, on Sunday the ninth instant I was in Thomas Wright’s house at Stoneham when we perceived James Duffy and Thomas Duffy and John Duffy chasing James Cowan and his family in Mr. Cowan’s own field. I perceived that Mr. James Cowan was running toward Mr. Wright’s house pursued by James, John and Thomas Duffy. I went out of the home with Mr. Thomas Wright and I saw James Duffy strike James Cowan with an iron hay fork over the head. Cowan fell on his knees, then James Duffy jostled him down again and John Duffy lifted a wrightly (?) hand stick with a big lump at the end of it and struck him twice over the head when he was down. I came down to Mr. Cowan and lifted him up. His face was all covered with blood flowing from the cuts that were inflicted by the blows he had received from James and John Duffy and Mr. Wright brought him into his house.

Before us the undersigned Notaries Public duly admitted, commissioned, and sworn in and for that part of the Province of Canada heretofore called Lower Canada, and residing at the City of Quebec in the said Province came and appeared Mr. James Cullen, Farmer, residing in the Township of Stoneham, in the County and District of Quebec, and who being in perfect good health and perfectly sound in his mind, memory, and understanding as appeared unto us the said Notaries by his discourse and proposals declared unto us the said Notaries that considering the certainty of death and the uncertainty of the hour thereof he was desirous of making his solemn will and testament which he requested us the said Notaries to write down and which he dictated unto us and for and in manner following, to wit:

1º I recommend my soul to Almighty God and commit my body to the earth to be interred after my decease in a manner suitable to my condition.

2º I do will and ordain that all my just debts be paid and my Owings repaid by Executrix Testamentary hereinafter named.

3º I do hereby give and bequeath unto Helen Cranny, my beloved wife, all and every the property moveable and immoveable real and personal whereof I may die possessed ensuing and intending that the said Helen Cranny may enjoy and dispose of all my said property after my decease in full property and forever hereby naming her my universal Legatee and the Executrix of my present Will and Testament.

4º I hereby revoke all other testaments and codicils by me made before these presents which alone I consider contents my true intention and last will and desire.

It was thus dictated and named by the said Testator unto us the said Notaries and these presents having been duly read and read over again to the said Testator by Jean-Baptiste Pruneau one of the said undersigned Notaries in the presence of his colleague Notary, he the said Testator declared that he well understood and heard the same and persisted herein.

Done and executed at Quebec at the office of the said J.-B. Preneau on the ninth day of September in the year one thousand eight hundred and fifty two under the number two thousand and five, and the said Testator being requested to sign declared that he cannot sign nor write his name and these presents having been fully read and read over again according to law.

On this day the fourteenth of the month of October in the year of our Lord one thousand eight hundred and ninety one, before me Léonidas-Praxède Bernard, the undersigned Notary Public, residing in the Parish of Cap Santé, in the District and Province of Quebec, personally came, appeared and was present Mr. David Cullen of the Parish of Ste. Catherine, Farmer, which said Mr. David Cullen being sick of body and of sound and disposing mind, memory and understanding as appeared unto the undersigned Notary and witnesses, and desirous of settling his worldly affairs hath requested the said Notary to receive his present last will or testament in the manner and form following, to wit:

Firstly, I recommend my soul to Almighty God my Creator, the father of all mercies, humbly imploring at His Hands forgiveness of my sins through the gracious intercession of my Divine Redeemer, Jesus Christ.

Secondly, I will and ordain to bury my body in the cemetery of the Parish when I shall decease, with an ordinary service and another anniversary service.

Thirdly, I will and direct that all my debts and funeral expenses be paid and satisfied by my Executor hereinafter named.

Fourthly, I will and bequeath unto my son, Mr. James Cullen, of the said Parish of Ste. Catherine, Farmer, all and singular the property real and personal, moveable and immoveable whatsoever of which I may be seized and possessed and wherever situate and being without any exception or reserve whatsoever.
     To have and to hold all and singular the said property real and personal, moveable and immoveable above bequeathed unto my said son, his heirs and assigns to the only proper use of the said James Cullen from and after my decease from thenceforth for ever, at the charge of my said son to board, lodge, wash, mind, and maintain as well in sickness as in health, in a proper and befitting manner, my beloved wife Mary Gurry [Gorrie], she the said Mary Gurry working for the profit of my said son when thereto inclined.
     And further at the charge by my said son to board, lodge, wash, mind and maintain each of his brothers and sisters, my said children as long as they will not be provided in any manner whatsoever, they my said children working for the profit of my said son Mr. James Cullen.

And as for the execution of this my present last will, I do hereby nominate and appoint my said son, into whose hands I do in conformity to the law and custom in that behalf, hereby disseize and divest my self for the ends hereof and hereby instituting him my sole universal legatee, hereby revoking all other wills which I may have made prior or before the present to which alone I do adhere as maintaining my true intentions and last will.

Thus done, dictated and declared by the said Testator as and for his last will to and in the presence of us the said Notary and M.M. James Sheehan & James Coughlin, both Farmers, residing at the said Parish of Ste. Catherine, witnesses hereto requested, on the day, month and year first above written, under the number five thousand seven hundred and fifty four. And the said foregoing will having been read to the said Testator by the said Notary in the presence of the said witnesses he hath persisted therein. In faith and testimony whereof the said witnesses have set and subscribed their names and signatures in the presence of the said Notary also hereunto subscribing, the Testator declared to be illiterate, these presents having been first duly read.

This is an attempt to summarize information on the Cullen family in Valcartier in an effort to facilitate future research into the current dilemma of whether or not this family is related to the Cullen family of Ste-Catherine.

Michael Cullen (most frequently spelled as Cullin) first appears in a Quebec Census in 1831 in Valcartier. He is not listed in either the 1824 or 1825 Valcartier Census. Also, it is stated in the 1831 Census that his family of six were born in the United Kingdom and that they arrived in Canada after May 1, 1825. This census also lists the family of six as – three children aged under 6 years, one child aged between 6 and 13, one adult married male between the ages of 30 and 59 (this would be Michael) and one female adult between the ages of 14 and 45 (this would be his wife, Bridget Moran). Michael died on the 5th April 1842; no age was given in the burial record. The death was recorded in Ste-Bridget-de-Laval Church, however, the record states that he was buried in St. Edmond Cemetery of Stoneham.

I have not been able to find any land records for Michael Cullen.

Following, the death of Michael, Bridget “Culen” is listed in the 1851 Census (taken in January 1852) as turning 61 years old in 1852 (birthdate would be 1791). Living with her are three single men – Lawrence Culen, born Ireland, will be 27 in 1852 (birthdate would be 1825); James Culen, born Ireland, will be 25 in 1852 (birthdate would be 1827), and John Culen, born Ireland, will be 21 in 1852 (birthdate would be 1831). These three males would account for three of the four children listed in the 1831 census – one is missing and it would appear to be a child that could be older or younger than Lawrence. In later Censuses (1861 and 1871) Lawrence’s birthdate would have been 1826 and 1824. Regardless, it appears that the fourth child of Michael and Bridget died, married or moved away before 1851. I have not found any death or marriage records to support this.

If John Culen, listed above with Bridget in the 1851 Census, was indeed born in 1830 in Ireland, then this would indicate that Michael and Bridget came to Canada in 1830 or early 1831. (John’s burial record indicates he was 48 when he died in 1879, but the tombstone states he was 47). Bridget and Michael had a son, Nicholas, born December 6, 1832 in Quebec who was baptized at Ste-Catherine.

The confusion arises when John Cullen marries Elizabeth Cassin in Valcartier in 1857. His parents are listed as the late Lawrence and Mary Cullen. I have recently re-looked at this marriage record and it does not state the maiden name of Mary – states she is Mary Cullen. I had assumed in the past that this must be Mary McCarty because her husband, Lawrence, died in 1856. Could this be a mistake by the priest in the marriage record when he listed Lawrence and Mary as the parents, instead of Michael Cullen and Bridget Moran? In Bridget Moran’s will written in 1868, she states “I give, devise, and bequeath to Nicholas Cullen, my son, and to James Cullen, son of John Cullen, my other son, …”
John Cullen, who is living in Valcartier and who married Elizabeth Cassin, named his oldest son, James – which would fit with the statement in the will.
Problems that remain to be solved:

1. Is John the son of Lawrence or the son of Michael? It appears that the priest either made a mistake in the marriage record or it appears that John grew up with Michael and Bridget but was not their biological son.

Who are Lawrence Cullen and Mary McCarty? I only find them mentioned in the burial record of Lawrence in Ste-Catherine in 1856. I don’t see them in the 1851 or 1861 censuses for Ste-Catherine. I also can’t find a burial record for Mary McCarty. Also of note is that the burial record for Lawrence is out of order – he died in October, but is listed as the last entry in the record book, after those in December. Did Lawrence and Mary have any children?

It appears that Michael and Bridget had a son named Lawrence – possibly their oldest son. Does this indicate a relationship between Michael Cullen of Valcartier and one of the Lawrence Cullens of Ste-Catherine (either Lawrence who married Ellen Murphy or Lawrence who married Mary McCarty).

This is a really difficult proposition – is there any possibility that Lawrence who married Ellen Murphy and Lawrence Cullen who married Mary McCarty are one and the same person. I know this is very unlikely, however, a couple of things point to this. No burial record has been found for Lawrence (married to Murphy) but it appears from census information that he died between 1851 and 1861 – Lawrence (McCarty) died in 1856 at the reported age of 65. This would make both their birthdates within a year of each other. I know this is very far-fetched but it seems unusual to me (unless others have records that I don’t have) that the only mention of Lawrence in all of Ste-Catherine’s censuses or church records is his burial record and that there is no other record for a Mary McCarty either.

Michael Cullen was born about the same time as the “Lawrences”. Since he named his son Lawrence, could Michael and one of the Lawrences of Ste-Catherine be brothers or cousins. It appears that from their children’s baptismal records that Lawrence and Ellen came to Canada about 1826. It appears Michael did not come until 1830.

This may not be significant but when John Cullen died in Valcartier in 1879, his name was listed as Cullin on his tombstone – this is the way Michael Cullin was listed in the 1831 Census. I suspect this is just the difference in the record keeper’s spellings.

Do tombstones for Michael Cullen and Bridget Moran and their sons James and Lawrence and maybe Nicholas remain in Stoneham and if so, could they give us any clues?

In the year of our Lord, one thousand eight hundred and fifty six, on the twenty third day of August, I the undersigned Notary Public duly admitted & commissioned and sworn in and for the Province of Lower Canada, residing in the Parish of St. Augustin, County of Portneuf, in the said Province, and the witnesses hereinafter named and denominated, went to the residence of Mr. Lawrence Cullen, farmer, residing in the Parish of Ste. Catherine, where being we found the said Lawrence Cullen bodily sick but of sound mind, memory, judgment and understanding, who declared unto us the said Notary and witnesses, that considering the certainty of death & the uncertainty of the hour thereof in order to be better prepared to leave this world whenever it will please God Almighty to call him hence, he desired us to make out his last will and testament which he dictated unto the said Notary in the presence of the said witnesses, in manner and form following, to wit:

Firstly, I recommend my soul to God Almighty, My Creator, begging forgiveness of all my sins, and the enjoyment of eternal happiness in the world to come.

Secondly, I do will and ordain that all my just debts be paid and any wrongs by me done, if any there are, repaired as soon as possible after my decease.

Thirdly, I do will and ordain that my body shall be interred in a manner suitable to my condition, relying in the discretion of my said Testamentary Executor hereinafter named.

Fourthly, I do give and bequeath unto my beloved wife, Ellen Murphy, the use and full enjoyment (usufruct) during her natural life of all and every and singular my properties and estate, real and personal, moveable and immoveable of whatever kind and nature the same may consist in, and in what places soever that the same may be situated, that I may be possessed of at the day of my decease.

Fifthly, I do give and bequeath unto James Cullen, my son, all and every the property real and personal, present and future, that I may die possessed of and of whatever kind and nature the same may consist, and in what places soever the same may be situated, for by him to use and dispose thereof on the day of the decease of my said beloved wife in full property and forever by and in virtue of these presents under the express condition nevertheless that the said James Cullen, my son, will keep and maintain from the day of the decease of my said beloved wife, Margaret & Catherine Cullen, his sisters, and to provide for and therewith all and every the necessaries of life: meals, drink, clothing, mending, boarding and lodging and to furnish them all the they want but not beyond his means, until such time as the said Margaret & Catherine Cullen, his sisters, are provided by marriage or otherwise, and under condition that they shall work for the benefit & profit of their said brother according to their bodily health & strength & moreover to pay unto the said Margaret & Catherine Cullen each five pounds currency and to Moses, David, Patrick and Lawrence Cullen and to Johanna Cullen each one shilling currency, the whole to take lieu & be in payment to them of all hereditary claims in the estate & succession of the said Testator, their father.

And for the execution of the present will, I name for the Executor, the said James Cullen, my son, into the hands of whom I do hereby divest and disseize and dispossess my self of all the said property according to the meaning of the law actually in force concerning wills.

And finally, I do hereby revoke all other wills and testaments that I may have heretofore made desiring this present one may have its full effect for such is my last will and desire.

Thus done and dictated by the said Testator unto the said Notary on the day and year first above written under the number two thousand six hundred and forty seven, in the house above said in the said Parish of Sainte Catherine in the presence of Messr. David McCullaugh and John Power, both farmers of the said Parish of Sainte Catherine, witnesses, called for the effect hereof, and these presents having been read over by the said Notary unto the said Testator, in the presence of the said witnesses declared that he well understood the same in all its contents and persisted therein, and declared that he cannot sign owing to his debility, the said John Power declared that he cannot sign or write and the said David McCullaugh, the other witness, signed these presents together with the said Notary first duly read over according to law.

Three marginal notes approved are good and thirty seven words expunged are void.

Note by Patricia Balkcom: Lawrence died five weeks later on September 30th. All of his surviving eight children are mentioned in his will.8
