On this twenty fifth day of February in the year of our Lord one thousand eight hundred and ninety six, before me Cyrille Renaud Public Notary residing in the parish of St. Ambroise of Jeune Lorette undersigned and Francis Smith and William Hamilton, both farmers of the parish of St. Gabriel of Valcartier, personally appeared Mr. Patrick Cullerton of the Parish of St. Gabriel of Valcartier, Farmer, who being of sound & disposing mind, memory and understanding hath requested us, the said Notary and witnesses, to write down and receive in due form of law his last will and testament which he has declared in manner and form following, that is to say:

Firstly and principally, I most willingly resign my soul into the hands of Almighty God my Creator in the humble hope that he will receive it to his favour through the sole merits and intercession of Jesus Christ my Saviour.

Secondly, I desire that all my just debts, funeral and testamentary expenses be paid by my Executor hereinafter named as soon as possible after my death.

Thirdly, I give and bequeath to my son Lawrence Cullerton all my moveable and immoveable properties wherever the same may be found and to whatever the same shall amount, hereby constituting my said son my universal legatee, to the charge by the said Lawrence Cullerton as following -

1º To keep with him my wife, Ann Corrigan, during her life and if they cannot agree, the said Lawrence Cullerton shall be obliged to pay to his mother the sum of fifty dollars each year.
2º To the charge to pay to Denis Cullerton the sum of twenty five dollars; to Patrick Cullerton the sum of twenty five dollars; to Mary Jane Cullerton, my daughter, wife of Joseph McGrory, the sum of fifty dollars; to Margaret Ann Cullerton, my daughter, the sum of one hundred dollars; to Ellen Cullerton the sum of a hundred dollars; to Thomas Cullerton, my son, the sum of a hundred dollars; At last to the charge by the said Lawrence Cullerton to keep with him my daughter, Isabella Cullerton, during all the time of her life. These sums of money will be paid by installments thirty dollars each year and which the first installment will be made to Denis and shall continue in the order above mentioned.

I nominate, constitute and appoint my son Lawrence Cullerton as Executor of this my will.

I revoke all wills and codicils I may have heretofore made and I declare the present to be my only true last will and testament.

Patrick Cullerton was the son of Denis Cullerton and Mary Corcoran and the grandson of Patrick Cullerton and Johanna Murphy. He married Ann Corrigan in Valcartier on 13 May 1862.

On the fifteenth day of April one thousand nine hundred and thirteen, at the request of Mr. Thomas Cullerton of St. Jacques de Tewkesbury in the Province of Quebec, Canada, Farmer, I, John B. Parkin, of the City of Quebec, in the said Province went to the Hotel Dieu Hospital situate on Palais Street in the said City, where being he requested me to receive his last will and testament, which in the presence of the witnesses hereinafter named, he instantly made, named and dictated, and which I have reduced to writing, in manner and form following:

I direct that all my just debts, funeral expenses and charges be paid out of my estate as soon as possible after my decease.

I give and bequeath to Mr. Joseph McGrory of Valcartier, Farmer, the sum of fifty dollars.

I direct that the sum of fifty dollars be expended in stipends for masses for the repose of my soul.

I give, devise and bequeath to my nephews Lawrence Cullerton & Thomas Cullerton & to my niece Margaret Cullerton all and every the residue of my estate and property, real and personal, moveable and immoveable, constituting them hereby my universal residuary legatees.

And I do hereby name and appoint my said nephew Lawrence Cullerton of Valcartier, Farmer, to be the Executor of my present will into whose hands I divest myself of my estate & property from and after my decease, with power to sell real estate & whose powers as such shall extend beyond the time limited by law for the execution of wills until the final execution hereof.

I revoke all wills by me at any time heretofore made and declare the present to contain my only true last wishes and intentions.

It was thus made, named and dictated by the said Testator to the said Notary in the presence of Reverend Hugh McGratty, Priest, & Edward Power, Policeman, both of the said City of Quebec, as witnesses for the effect, and after his present will had been read over to him the said Testator by the said Notary in their presence, he declared to have perfectly heard and understood the same and persisted therein.

It was thus done and executed at the said City of Quebec in the Hotel Dieu Hospital aforesaid to remain of record as one of the minutes of the said Notary, under the number six thousand four hundred and three, the said Testator having declared not to know how to write his name, requested to do so by the said Notary, has made his mark of a cross in the presence of the said Notary and witnesses, who have signed in his & in the presence of each other, according to law.

Notes by Patricia Balkcom: I have not found a burial record for Thomas. He would have been 77 years old when he wrote this will. His nephews and niece mentioned in the will were children of his brother, Patrick.2
