On his day the third of April in the year of our Lord one thousand eight hundred and thirty four before us the undersigned Notaries Public duly admitted and sworn of and for the Province of Lower Canada residing in the city of Quebec personally came and appeared David McBain, of the Parish of St. Ambroise, farmer.

Which said David McBain being in good health and sound of mind, memory, and understanding as appeared to us said notaries by his actions and words, and for the purpose of these presents came in the office of Benjamin Lelièvre, one of the undersigned notaries, where his colleague was duly called. And the said David McBain considering the certainty of death and the uncertainty of the hour thereof doth make, publish, declare, and dictate to the said Benjamin Lelièvre and his colleague notaries being present, his last Will and Testament in manner following, That is to say, the said David McBain recommends his soul to God, his Creator, hoping for a free pardon and remission of all his sins through the intercession of his blessed son, our Saviour. And desires that his body be buried at the discretion of his executor hereinafter named.

The said David McBain directs that all his just and lawful debts be paid by his executor hereinafter named.

The said David McBain doth hereby give and bequeath the enjoyment or usufruct of all, each, and every said lands, goods, merchandise real and personal estates, sum or sums of money or otherwise of which he is now possessed of or may be possessed of at the day of his decease, without any reserve, restriction, limitation and whatever and wherever the same may be found whether in this Province of Lower Canada or elsewhere, unto the said Mary Arthurson, his dearly and beloved wife.

The said David McBain doth hereby give and bequeath unto the said Mary Mc[no number specified] in the third concession of Valcartier, containing three arpents in front by thirty in depth, bounded in front by the King's Road and in the rear to the property of Mr. Plante, joining on one side to John Neilson Esquire and on the other side to William Brown, together with the house, barn, stable, and other buildings thereon erected and such as the whole, may be after the decease of the said Mary Arthurson his said wife, now stands without any reserve whatever. The said David McBain doth further bequeath and give unto the said Mary and John McBain all the household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, with the exception of his share in a crank mahogany clock which he doth hereby bequeath unto the said Elizabeth McBain, after the decease of the said Mary Arthurson his said wife, to whom he doth give and bequeath the enjoyment or usufruct as aforesaid.-

The said hereby given and bequeathed lot of land and dependencies, household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, to be equally and fairly divided between the said Mary and John McBain after the decease of the said Mary Arthurson his said wife as aforesaid.-

And in the event of the said Mary Arthurson his said wife selling or in any other manner alienating the property or any part thereof, either moveable or immoveable, solely belonging to her according to the Law of the Country or according to the Law of any Country, then said and in that case, it is the express wish and intention of the said David McBain, that the bequeath of the enjoyment or usufruct made to her by this his present will, doth become null and void, and that the said children do respectively after such alienation, take possession of the premises given and bequeathed to them by his last will and testament.

The said David McBain hereby annulling, cancelling, abrogating, and making void all former will or wills which may have been heretofore made and executed by him the said David McBain.

And the said David McBain doth hereby nominate and appoint the said Mary Arthurson his said wife his executor to this his last will and testament.

Thus done, made, dictated and named by the said David McBain to the said Benjamin Lelièvre in the presence of his colleague notaries in the office of the said Benjamin Lelièvre at Quebec, on the day and year first above written and the present last will and testament having been read and re-read to the said David McBain, which he declared well to understand as being his last will and meaning, he hath together with us said Notaries set and subscribed his name and signature, after reading and re-reading thereof as aforesaid.

The said Mary Arthurson doth hereby give and bequeath the enjoyment or usufruct of all, each, and every said lands, goods, merchandise real and personal estates, sum or sums of money or otherwise of which she is now possessed of or may be possessed of at the day of her decease, without any reserve, restriction, limitation and whatever and wherever the same may be found whether in this Province of Lower Canada or elsewhere, unto the said David McBain, her beloved husband.

The said David McBain, her said husband, to have, use, and enjoy the said lands, goods, merchandise, real and personal estates, sum and sums of money as aforesaid, during his natural life time only, whom she doth make and constitute her universal legatee during his natural life time as aforesaid.-

As to the full property of all, each, and every her lands, goods, merchandise, real and personal estates, sum and sums of money or otherwise of which is now possessed or may be possessed of at the day of her decease, the said Mary Arthurson doth hereby give and bequeath them (saving and rendering the bequeath hereinafter mentioned, made to Mary McBain and John McBain, two of her children, who are deaf and dumb and issue of her marriage with the said David McBain her said husband) unto said David McBain, Elizabeth McBain, wife of Louis David Dubord, Esquire, Doctor, William McBain, James McBain, and Arthur McBain, her children issue of her marriage with the said David McBain, her said husband.

The said goods, lands, merchandise, real and personal estates, sum and sums of money or otherwise to be by the said David, Elizabeth, William, James, and Arthur McBain, equally and fairly divided between them share and share alike and that after the decease of the said David McBain, her said hus[no number specified] in the third concession of Valcartier, containing three arpents in front by thirty in depth, bounded in front by the King's Road and in the rear to the property of Mr. Plante, joining on one side to John Neilson Esquire and on the other side to William Brown, together with the house, barn, stable, and other buildings thereon erected and such as the whole, may be after the decease of the said David McBain her said husband, now stands without any reserve whatever. The said Mary Arthurson doth further bequeath and give unto the said Mary and John McBain all the household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, with the exception of her share in a crank mahogany clock which she doth hereby bequeath unto the said Elizabeth McBain, after the decease of the said David McBain her said husband, to whom she doth give and bequeath the enjoyment or usufruct as aforesaid.

The said hereby given and bequeathed lot of land and dependencies, household furniture, implements of agriculture, live stock, and generally all the moveable effects which may be on the said lot of land, to be equally and fairly divided between the said Mary and John McBain after the decease of the said David McBain her said husband as aforesaid.-

And in the event of the said David McBain her said husband selling or in any other manner alienating the property or any part thereof, either moveable or immoveable, solely belonging to him according to the Law of the Country or according to the Law of any Country, then said and in that case, it is the express wish and intention of the said Mary Arthurson, that the bequeath of the enjoyment or usufruct made to him by this her present will, doth become null and void, and that the said children do respectively after such alienation, take possession of the premises given and bequeathed to them by her last will and testament.

The said Mary Arthurson hereby annulling, cancelling, abrogating, and making void all former will or wills which may have been heretofore made and executed by her the said Mary Arthurson.

And the said Mary Arthurson doth hereby nominate and appoint the said David McBain her said husband her executor to this her last will and testament.

Thus done, made, dictated and named by the said Mary Arthurson to the said Benjamin Lelièvre in the presence of his colleague notaries in the office of the said Benjamin Lelièvre at Quebec, on the day and year first above written and the present last will and testament having been read and re-read to the said Mary Arthurson, which she declared well to understand as being her last will and meaning, she doth after the reading and re-reading thereof as aforesaid, declared that she can not sign.

Notes by Patricia Balkcom: Mary and her husband, David McBain, both wrote a will on the same day. David died seven months later, Mary lived another twenty-one years and remarried. I imagine that they wanted to make sure that two of their children who were “deaf and dumb” were taken care of.5

On the eight day of April in the year of our Lord one thousand eight hundred and forty, before us the undersigned Notaries Public duly admitted and sworn in and for the Province of Lower Canada, residing in the City of Quebec, personally came and appeared in the office of William de Léry, one of us the undersigned Notaries, Mary Arthurson of Valcartier, widow by a first marriage of the late David McBain, and now wife of William Knox of same place, Farmer, apparently in good health of body and of sound and perfect mind, memory and understanding who did make, publish, dictate and name this her last will and testament in the words following, that is to say:

Firstly and principally, the Testatrix doth recommend her soul into the hands of Almighty God, her Creator, hoping for a free pardon and remission of all her sins thro the intercession of his Blessed Son our Saviour, and the body she commits to the earth to be interred in a manner suitable to her situation in life at the time of her decease.

Secondly, the Testatrix doth will and direct that at the time of her decease all her just debts, funeral expenses and wrongs (if any there are) be fully paid and satisfied by her Executor hereinafter named.

Thirdly, the Testatrix gives, devises, and bequeaths unto William Knox of said Valcartier, Farmer, her second husband as aforesaid, the whole of her property, moveable and immoveable, goods, monies, chattels, effects and things of whatever description and value or wherever found or situated which the said Testatrix may be entitled to or die possessed of, the said Testatrix hereby instituting him the said William Knox her dear and beloved husband, her universal and residuary legatee.

The said William Knox to have and to hold the said property moveable and immoveable, goods, monies, plates, chattels, effects and things as aforesaid from the time of the decease of said Testatrix in full property forever.

And lastly, the said Testatrix doth nominate and appoint the said William Knox, her husband, Executor of this her true last will and testament in the hands of whom she doth hereby divest herself of all her said property hereby revoking all other and former wills, testaments & codicils she might have made.

Thus done, dictated and named word for word by the said Testatrix unto the said William de Léry, Notary, aforesaid his colleague Mtre. A. Lemoine present, read the last will and testament having been read over and over again to the said Testatrix, she did declare the same to contain her true last will and mind and did make her usual mark hereby declaring not to know how to sign or write her name. receiving signatures of Notaries.

"A lot of ground situate in St. Gabriel, seventh range, containing five arpents in front by eighteen arpents in depth, bounded to the south by the sixth range, to the North by the first concession, N.E. Riviere aux Pins, to the West by George Atkins and to the East by the lot of ground being now designated upon the plan and in the Book of Reference thereto under the number 397.
Another lot of ground situate in the same parish, same seignory and said concession, containing five arpents in front by eighteen arpents in depth, more or less, bounded to the North by said concession of Riviere aux Pins, to the South by the sixth range, to the West by the lot above described, and to the East by James Ross(?), with the buildings, this lot of ground being described on said plan and book of reference under Number 398.
Said properties belonging to the said donor as being in possession os the same for thirty years and over.
The donor doth moreover give to the donee all moveable furniture, cattle, agricultural implements and generally all other moveable effects which are now in his possession.

Hence, George Atkins was the only person with a right to claim any money in banks
in the name of George Atkins or Sarah Bedard. (Notarial Record No. 7544)

Note*22 October 1884John Patrick Flynn; The French version of the Marriage record in the Drouin Collection, states that Patrick is the son of John Flynn and Marie Callaghan. The translated version by Monaghan lists the parents as Patrick Flynn and Ellen Hurson. (Ellen married a Maurice Flynn in 1865 - this appears to be after the birth of Patrick - thought to be about 1862). Was he the son of Maurice and his first wife and who was Marie Callaghan? Also the French version states that Mary Jane Atkins is the daughter of Thomas Atkins and Marie McLeod. The translated Monaghan version states mother was Jane McCoubrey. The French version which was kept in Quebec City at the Bishop's Palace was often filled in at a later date - so it's hard to tell which version is correct.3

On this twenty seventh day of April one thousand nine hundred and seventeen, before me, Cyrille Renaud, Public Notary residing at Loretteville, undersigned, personally appeared John Atkins, Farmer, residing in the parish of St. Gabriel of Valcartier, who being of sound and disposing mind, memory and understanding hath requested me the said Notary to write down and receive in due form of law his last will and testament which he has declared in manner and form following, that is to say:

1º I will and resign my soul into the hands of Almighty God in the humble hope that he will receive it to his favor through the sole merits and intercession of Jesus Christ my Saviour.

2º I desire that all my just debts, funeral an testamentary expenses be paid by my Executor hereinafter named as soon as possible after my death.

3º I give and bequeath to my daughter Mable Atkins the black horse.

4º I give and bequeath to my wife Catherine Smart Brooks all my other moveable and immoveable properties wherever the same may be found and to whatever the same shall amount hereby instituting my said wife my universal legatee and the Executrix of this my will and testament.

Done and passed at Valcartier in the residence of the said Testator under Notarial Number seven thousand two hundred and ninety nine. After the reading of the present will to the Testator by the Notary in presence of William Smith and John Corrigan, both of the Parish of St. Gabriel of Valcartier, Farmers, the Testator having declared his inability to sign his name has made his mark in the presence of the witnesses and Notary and the witnesses and Notary have signed in presence of the Testator and in the presence of each other.
