On this day the fourteenth of January in the year of our Lord one thousand eight hundred and sixty two, I the undersigned Notary Public duly commissioned and sworn for Lower Canada residing in the District of Quebec at the request of Ellen Donovan, wife of Patrick Maher, residing in the Parish of St. Catherine, Seigniory of Fossambault went to the residence of the said Ellen Donovan situate and being in the Parish of St. Catherine aforesaid.

Where being in the presence of John Sullivan, Esquire, Land Surveyor and James Buggy, farmer, both residing in St. Catherine aforesaid, farmers, witnesses called upon and present for the purposes hereof the said witnesses signing with me the said Notary . I found the said Ellen Donovan sick in bed, nevertheless sound of mind, memory, judgment and understanding as appeared to me the said Notary and to the said above named and undersigned witnesses by her actions, words and discourse.

And the said Ellen Donovan considering the certainty of death and the uncertainty of the hour thereof, doth hereby make, publish, dictate, and declare to Benjamin Lelievre, the said undersigned Notary in the presence of the said above named witnesses, her last will and testament in manner following. That is to say, the said Ellen Donovan recommends her soul to God, her Creator, when it shall please Him to dissolve her mortal body hoping for a free remission and pardon of her sins through the intercession of his blessed Son and Savior.

The said Ellen Donovan doth hereby give and bequeath unto Michael Maher, her son, that is to say the east half of a lot of land situate, lying and being in the Parish of St. Catherine aforesaid in the said Seigniory of Fossambault in the fourth range thereof number seventy-nine containing one half-lot of one arpent and a half in front by fifty-five arpents more or less in depth, bounded in front by the river Jacques Cartier and in the rear by the Seigniory line between Guardaville and Fossambault, bounded on one side to the east by lot number eight, the property of Thomas Henderson and on the west side to the west half of said lot number seventy-nine, the property of the said Patrick Maher, and such as the said each half now stands without any reserve whatsoever.

This present bequest is thus made at the charge by the said Michael Maher here said son of paying unto Ellen Maher, Catherine Maher, and Ann Maher, three of his sisters the sum of forty dollars to each of them, which the said Michael Maher will be bound and obliged to pay to his said sisters six months after the decease of the said Ellen Donovan, his mother, without interest. Further, of the charge by the said Michael Maher of paying unto Mary Maher, another of his sisters, a minor, a like sum of forty dollars, as soon as she shall have attained the full age of twenty-one, without interest.

The said Ellen Donovan doth hereby given and bequeath unto the said, Patrick Maher, her husband, all her moveable property, debts and effects, sum and sums of money
whether due by notes of hand, obligations or otherwise, said moveable property consisting of household furniture, farming utensil and cattle and generally all moveable effects whatever. This present bequest is thus made at the charge by the said Patrick Maher of paying unto Ellen Maher, Catherine Maher, and Ann Maher his daughters to each of them the sum of twelve dollars, which the said Patrick Maher will be bound and obliged to pay to his said daughters six months after the decease of the said Ellen Donovan, his said wife without interest. Further at the charge b the said Patrick Maher of paying unto Mary Maher, his daughter, a minor, a like sum of twelve dollars, as soon as she shall have attained the full age of twenty-one, without interest.

The said Ellen Donovan desires that her body be buried at the discretion of her executor, hereinafter named.

The said Ellen Donovan directs that all her just and lawful debts be paid if any there be by her executor herein after named.

The said Ellen Donovan doth hereby nominate and appoint as Executor of this her last will and testament the person of Owen O’Sullivan, Esquire, of the Parish of St. Catherine, whom she doth hereby request to render this last act of kindness.

The said Ellen Donovan hereby annulling, cancelling, objurgating, and making void all former wills which may have been heretofore made and executed by the said Ellen Donovan.

Thus done, made and dictated word by word by the said Ellen Donovan to the said Benjamin Lelievre, the said undersigned Notary in the presence of the said above named and undersigned witnesses at the residence of the said Ellen Donovan, situated as before mentioned, on the day and year, first above written, under the number one thousand one hundred and ninety-four and after having been read and re-read to the said Ellen Donovan, which she declared well to understand, as being her last will and meaning and the said Ellen Donovan hath declared that she cannot write nor sign her name. Having the said John Sullivan, as witness signed with me the undersigned notary. The said James Buggy having declared that he could not write or sign his name made his ordinary mark by a cross.

My Notes: Ellen died three days after she made this will. Although, she and Patrick had twelve children, five of them predeceased her. Five of the seven surviving children are mentioned in the will. I believe the other two daughters who were not mentioned were probably already married and that Ellen decided they were already cared for.

On this day the first of May in the year of our Lord one thousand eight hundred and thirty seven at the request of Jeremiah Donovan of the Parish of St. Catherine at the place called Jacques Cartier, farmer, We the undersigned Notaries public duly admitted and sworn of and for the Province of Lower Canada residing in the City of Quebec, went to the residence of him the said Jeremiah Donovan at the Hotel Dieu of Quebec in the Ward of the Patients, where being we found the said Jeremiah Donovan in the said ward being sick in bed, nevertheless sound of mind, memory, and understanding as appeared to us said notaries by his actions and words and the same Jeremiah Donovan considering the certainty of death and the uncertainty of the hour thereof, did make, publish, declare and dictate word for word to the said notaries this last will and testament in manner following, That is to say, the said Jeremiah Donovan recommends his soul to God, his Creator, and desires that his body be buried at the direction of his executors herein after named.-

The said Testator directs that all his just and lawful debts be paid.

The said Testator doth give and bequeath all, each and every his movables, goods, wares and chattels, sum or sums of money or otherwise, which he may now possess and become possessed of in future without any reserve whatsoever, the same may be found in the Province of Lower Canada or elsewhere unto Mary Saurin, his beloved wife.

The property of his land and tenements which he may now possess and become possessed in the future, without and reserve, restriction, or limitation wheresoever the same may be found in the Province of Lower Canada or elsewhere, the said Testator doth give and bequeath unto his children which the said Testator doth hereby make and constitute his universal legatees. The said legatees of the said immoveable property to have, hold, use and enjoy the said lands and tenements & real estate in full property from the day of his decease and the said Testator doth bequeath unto Michael Donovan, his son, his watch.

And the Testator doth hereby nominate and appoint executors to his Last Will and Testament Denys Donovan and Thomas [Donovan], hereby annulling, cancelling, abrogating, and making void all former will or wills by him the said Testator heretofore made and executed and the said Testator authorizes his said executors to sell the immoveable property bequeathed to said children should they find a reasonable price and to leave in the hands of the purchaser of the said land the purchase money to their majority of said children with interest, which interest shall be payable yearly to his said wife on account of supporting his said children and of the said executors think proper to place the purchase money at the Savings Bank, the said Testator leaving all that to their discretion.

Thus done, made, dictated, and named word by word by the said Testator to Roger Lelièvre in the presence of his confrere notary and the said Last Will and Testament having been read and reread to the said Testator, which he declared well to understand as being his Last Will and meaning, being willing and ordering that his said last will be executed according its full form and tenor and the said Testator has to these presents duly read and reread according to Law set and subscribed his name and signature together with us said notaries in faith and testimony of the premises.

Three marginal notes approved and one hundred eighteen words erased as null.

On this day the twenty eight day of December in the year of our Lord one thousand eight hundred and forty four at one o'clock in the afternoon, We the undersigned Notary Public duly admitted and sworn in and for the Province of Canada hereintofore called Province of Lower Canada and residing in the Parish of Sainte Catherine Fossambault District of Quebec in the said Province and before Mr. John Johnson, Merchant of the said Parish of Sainte Catherine and Patrick Keyhoe, Farmer of the said Parish of Sainte Catherine of Fossambault witnesses having been called and requested mandés et requis by Mr. John Donovan, Farmer of the said Parish of Sainte Catherine went to his residence situate and being in the six range of the said Parish of Sainte Catherine of Fossambault and then and there being we found the said John Donovan sitting in a room apparently in good health of body and in a sound and perfect mind, memory, and understanding who desired us the said us the said Notary in the presence of the said witnesses to write down and receive in due form of Law, his last Will and Testament which he instantly published, dictated, word by word unto us the said Notary and witnesses in manner and form following, that is to say,

First, I resign my soul into the hands of Almighty God hoping and believing a remission of my sins by the merits and mediations of Jesus Christ my blessed Saviour, and my body I commit to the earth to be buried according to the rights of the Church with a grand Mass for the repose of my soul.

2º I give and bequeath to my sons to William Donovan the half lot of the Number 15 of the six range in the Parish of Sainte Catherine on condition that the said William Donovan will pay the half of all my debts that there will be at the time of my decease and further will give to his sister Judy Donovan two pairs of blankets, a counterpane, a pair of sheets and a bedstick at her majority.

3º thereby the remainder of all my property moveable and immoveable leave and bequeath to my son Michael Donovan on condition that he shall prove a kind son to my wife, his mother, as long as she will live and when she dies he will bury her as myself with one Grand Mass for the repose of her soul. And also the said give to his sister Eliza Donovan at her majority a pair of blankets, a counterpane, a pair of sheets, and a bedstick.

It was thus published, made, dictated, and named word by word by the said John Donovan, Testator, unto us the said Notary at the said Parish of Sainte Catherine of Fossambault on the day and year first above written; and the said present Will and Testament having been afterwards read in full over and over again lu et relus to the said Testator by the said Notary in the presence of the undersigned witnesses, the said Testator declared that he had perfectly heard and understood, the same found it to contain his true and last will and intention that therefore persisted therein and signed the same together with us the said Notary, and the witnesses in faith and testimony of the premises signed.

On this day the thirtieth day of January in the year of our Lord one thousand eight hundred & seventy one,

Before us the undersigned Notary Public residing in the Parish of St. Ambroise de la Jeune Lorette and the witnesses hereinafter named & subscribed,

Personally came & was present John Donovan of the Parish of St. Catherine’s of Fossambault in the County of Portneuf, who being in weak bodily health, but of sound mind, memory and understanding as to us appeared by his manner & conversation hath requested of us the said Notary to receive & reduce into writing this his Last Will & Testament which we the said Notary in the presence of the said witnesses have taken down as dictated to us by the said John Donovan word for word and as follows, that is to say:

I recommend my soul to God asking him to give me the everlasting Beatitude by the merits of Jesus Christ my Savior.

I wish & direct that my interment & the manner thereof shall be according to the direction of Executors hereinafter named.

I wish that after all my just & lawful debts shall have been paid & satisfied with which I hereby charge my said Executors that a sufficient sum of money be paid to the Curé of the Parish of St. Catherine aforesaid to be by him employed for the saying of four grand masses for the repose of my soul in the course of the year of my decease with a grand mass on my body the day of my funeral.

I do hereby give & bequeath unto Mary O'Neil my wife the sum forty pounds, cy [currency], that my son John Donovan owes me.

I give & bequeath and devise unto my said wife Mary O'Neil and my son James Donovan the sum of one hundred & sixty five pounds, cy, that Michael Henchey owes me, in the manner following, that is to say: sixty five pounds, cy, to my said wife & one hundred pounds, cy, to the said James Donovan, my son.

I give & bequeath unto my said son James Donovan the further sum of one hundred pounds, cy, that is in the Bank to be paid to him by my Executors when and so soon as he shall have obtained the age of majority.

I also give & bequeath unto my said son James Donovan the sum of six pounds, cy, that Joseph Goodwin owes me.

I hereby give & bequeath unto my said son James Donovan two lots of land adjoining each other, known and distinguished as lots Nos. seventy one and seventy two situated & being in the Fifth Range of St. Catherine’s of Fossambault bounded on the one side towards the South by lot No. seventy, on the other side towards the East by River Jacques Cartier on the other side towards the North by Patrick Kennedy and towards the West side by the Sixth Range.

I do hereby give & bequeath unto my said son James Donovan all my property moveable & immoveable of whatever description it may consist of which I may die seized & possessed of at the time of my decease with the exception of a cow, which I do hereby give to my said wife, which said cow shall be grazed during the summer time by my said son James Donovan and to properly house & feed the said cow during the winter months; & also I do hereby order & direct that my said son James Donovan shall & will find & provide for my said wife a room in the house that I now occupy if she wishes, and also to maintain, clothe & support my said wife Mary O'Neil during her natural life in sickness as well as in health; she will take care of the milk & butter if she wishes & will dispose of it between the children for the benefit of the house until such times as the children can better themselves by marriage or otherwise; my said wife shall have no control over the said James Donovan my son whatsoever & the said James Donovan shall have no control over my wife in alike manner.

I do hereby give & bequeath unto Michael Donovan my son a lot of land known & distinguished as No. seventy (70) situated & being also in the Fifth Range aforesaid of St. Catherine’s of Fossambault bounded on one side towards the North by No. seventy one, on the other side towards the South by John Donovan, Jr., on the other side towards the East by the River Jacques Cartier and towards the West side by the Sixth Range, and as for the wood that is on the rear of the lot No. seventy above mentioned (from the brook back to the rear on a straight line) is to belong to lot No. seventy one (71) and who ever lives on lot seventy one (71) & seventy two (72) will have the privilege of passing and repassing both summer & winter through lot No. seventy (70) to the main road. My said son Michael Donovan shall never have the right to sell, mortgage or hypothecate the said No. seventy (70) herein above described. My said son Michael Donovan binds & obliges himself to pay to his brother James Donovan my son a sum of fifty founds, cy (£50.00) in ten yearly payments of five pounds, cy, each the first payment becoming due in two years after my decease & then to continue from year to year until the said sum of fifty pounds , cy, shall have been fully paid & satisfied without interest.

I hereby give & bequeath unto Johanna & Elizabeth Donovan my two daughters the sum of fifty pounds, cy, each to be to them once paid & satisfied by my Executors hereinafter named.

And for the execution of the present my Last Will & Testament I do hereby nominate & appoint (as my Executors) Thomas Crotty & Patrick Farrell, farmers of the Parish of St. Catherine's of Fossambault in favor of whom I do in conformity to the Law & Custom of this Province hereby disseize & divest myself of all my property for the ends hereof, hereby revoking all other wills & testaments & codicils that I may have made prior to the present to which alone I do adhere as containing my true intentions & last will.

Thus done & dictated word for word & published & declared by the said Testator John Donovan for & as his Last Will & Testament to & in the presence of the said Notary & James Barry & Patrick Kennedy of the parish of St. Catherine’s, farmers, in the sitting room of the house of the said John Donovan at St. Catherine’s aforesaid the day & year first above written under the number sixteen between the hours four & five in the afternoon.

In faith & testimony whereof the said Testator having declared not to know how to write or sign his name when requested so to do at these presents first twice duly read set & made his ordinary mark or cross in the presence of the said Notary & of the said witnesses who have hereunto set & subscribed their respective names & signatures.

The oldest son, John, is not mentioned in the will, however, it may have been that he was already well-established in his own right by this time. I do give & bequeath & devise unto my said wife Mary O'Neil & James Donovan, my son, the sum of one hundred & sixty five pounds, cy, that Michael Henchey owes me by deed of sale granted to the said Michael Henchey by John Donovan, and passed by Lelievre Notary, between them the division shall be the manner following, that is to say: sixty five pounds, cy, to my said wife & one hundred pounds, cy, to James Donovan, my son, aforesaid, to be paid to him by executors when he shall have attained full age of majority without interest.

I give & bequeath unto my two daughters, Johanna and Elizabeth Donovan, the sum of one hundred pounds, cy, each which said sum I possess in the Quebec Provident Banks to be paid to them once paid & satisfied with all the interest from the day of my death. I give & bequeath unto James Donovan, my son, two lots of land situated & being in the Fifth Range of St. Catherine's of Fossambault named & distinguished as lots Number seventy one & seventy two (71 & 72) adjoining each other and bounded No. seventy one (71) towards the North by the Sixth Range, on the South side by the River Jacques Cartier and on the East side by lot seventy and on the West by lot Number seventy two and Number seventy two bounded towards the North by the Sixth Range, on the South side by the River Jacques Cartier, on the East side by Patrick Kennedy, and on the West side by Lot Number seventy one, with all the buildings thereon erected and countenances & dependencies.

I give & bequeath unto my said son James Donovan all & every the property real & personal moveable and immoveable, which I may be possessed of hereafter, instituting him the said James Donovan my son my universal legatee with the exception of the different legatees above & hereafter named & mentioned with the exception of a cow which my said wife shall take for herself at her choice, said cow shall be grazed on the premises in the summer time, properly fed & stabled in the winter months. My said wife shall have no control over my said son & my said son James Donovan whom I have appointed my universal and residuary shall have no control over her.

I give & bequeath unto my son Michael Donovan a lot of land being & situated in the Fifth Range of St. Catherine of Fossambault named & distinguished as lot Number seventy (70) bounded towards the North by the Sixth Range, on the South by the River Jacques Cartier, on the West by Lot sixty nine, and on the East by seventy one. And what wood that is is on the rear of lot No. seventy (70) from the little Brook back to the rear in a straight line is to belong to lot seventy one (71) and who ever lives on lots No. seventy one & seventy two shall have the right & privilege of passing & repassing both summer & winter through lot seventy down to the main road. My said son Michael Donovan shall take on two premises twenty bushels of potatoes & twenty bushels of oats at any time he likes for seed.

And for the execution of the present, my said Will & Testament I do hereby nominate & appoint Thomas Crotty & Patrick Farrell of the Parish of St. Catherine's, farmers, in favor of whom I do in conformity to the law & custom of the Province deseize & divest myself of all my property for the ends hereof, herby revoking all other wills, testaments, & codicils that I may have made prior to the present to which alone I do adhere as containing my true instructions & last will.

This last will and testament of Michael Fitzgerald in the name of God, Amen.

I bequeath my lot of land Number Fifty Nine in the Sixth Range of the Seigniory of Fossambault in the parish of Sainte Catherine to Mary Donovan, my beloved wife, together with all the buildings thereon erected and the hay that is in the same buildings.

I bequeath to my said wife two cows known as Bessy and Sally, two sheep and one double stove.

I bequeath to my son, Michael Fitzgerald the remainder of my moveable effects without reserve.

I bequeath unto my son Michael Fitzgerald the enjoyment of lot Number Sixty Four in the Seventh Range of the Seigniory of Fossambault in the parish of Sainte Catherines in the District of Quebec on condition that he will support Mary Donovan, my beloved wife, his mother, during her life in a suitable and dutiful manner but should my said wife prefer it, my said son shall be bound to pay unto her the sum of six pounds currency each and every year during her life instead of supporting her with his family and after my said son's death, my wish is that the said lot Number Sixty Four in the Seventh Range of the said Seigniory of Fossambault shall belong to my said son's children.

And I do hereby mortgage and hypothecate for the yearly payment in case my said wife demands it instead of her support in my son's family, of the said sum of six pounds currency, the said lot of land called lot Number Sixty Four situate in the Seventh Range of the Seigniory of Fossambault in the said parish of Sainte Catherine, the said lot containing three arpents in front by thirty in depth bounded in front by the Sixth Range of the said Seigniory in the rear by ungranted lands on one side by the representatives of the late Patrick Farrell and on the other side by Lawrence Connors.

My said son shall be obliged to drive my said wife to Church in a suitable and decent manner when she will require it. I also annul all my former wills.

Date at Ste. Catherine this twenty fifth day of November one thousand eight hundred and fifty seven in the presence of the under signed witnesses. I reserve also the use of my bed room for my said wife during her life.

On this day, the nineteenth day of November in the year of our Lord one thousand eight hundred & seventy,

Before us, the undersigned Notary Public residing in the Parish of St. Ambroise of la Jeune Lorette and the witnesses hereinafter named & subscribed.

Personally came & appeared & was present Mary Donovan of the Parish of St. Catherine's de Fossambault in the County of Portneuf, widow of the late Michael Fitzgerald in his life time of the said Parish of St. Catherine, farmer, deceased; who being of weak bodily health, but of sound mind, memory and understanding as to us appeared by her manner & conversation hath requested of us the said Notary to receive & reduce into writing this her Last Will & Testament, which we the said Notary in the presence of the said witnesses, have taken down as dictated to us by the said Mary Donovan word for word and as follows, that is to say:

I recommend my soul to God Almighty [asking] him to give me the everlasting Beatitude by the mercies of Jesus Christ my Saviour.

I wish & direct that my interment & the manner thereof shall be according to the discretion of my Executor hereinafter named.

I wish that after all my just & lawful debts shall have been paid & satisfied with which I hereby charge my said Executor, that the sum of wight pounds, cy [currency] which I possess in the Quebec Provident & Savings Banks be paid to the Curé of the Parish of St. Catherine aforesaid to be by him employed for the saying of twenty two masses for the repose of my soul in the course of this year, with a grand mass on my body, the day of my funeral.

I do hereby give, devise & bequeath unto Mary, Catherine & Helen Clear, issued of the marriage of Denis Clear of the said Parish of St. Catherine, farmer, and the late Catherine Fitzgerald, his wife deceased, my grand-children, the sum of thirty three pounds & ten shillings, cy, that William Guilfoyle owes one and all & every the property real & personal, moveable and immoveable (without any exception or reserve) which I may die possessed of hereafter instituting them my said grandchildren my universal legatees.

And for the execution of the present my Last Will & testament I do hereby nominate & appoint Denis Clear of the Parish of St. Catherine, farmer, in favor of whom I do in conformity of the law & custom of this Province, hereby deseize & divest myself of all my property for the ends hereof, hereby revoking all other wills & testaments & codicils that I may have made prior to the present to which alone I do adhere as containing my true intentions & last will.

I wish that the sum of six pounds, cy, that John Keily owes me, on a promissory note be equally divided between Mary, Catherine & Helen Clear, my grandchildren as aforesaid.

Thus done & dictated word for word & published & declared by the said Testatrix for & as her Last Will & Testament to & in the presence of the said Notary and James Pool & Michael Neville of the Parish of St. Catherine farmers, in the sitting room of the house & residence of the said Denis Clear at St. Catherine aforesaid, the day & year first above written and as the number fourteen, between the hours of six & seven in the afternoon.

In faith & testimony whereof the said Testatrix having declared not to know how to write or sign her name when requested so to do as to these presents set and made her ordinary mark or cross, first & twice duly read in the presence of us the said Notary & of the said witnesses who have hereunto set & subscribed their respective names & signatures.

Note by Patricia Balkcom: Mary died four days later at the reported age of 76. Her daughter, Catherine, who died in childbirth in 1853, had seven children – four boys and three girls. Mary left her money to her three granddaughters.
