On this twenty ninth day of the month of January in the year of our Lord one thousand eight hundred and eighty, I, Édouard Antill Panet, the undersigned Notary Public duly commissioned and sworn in and residing and practising in the Province of Quebec, Parish of St. Raymond, personally went and repaired, at the request of Robert Livingston residing in the said Parish of Saint Raymond, Farmer, to his residence where finding him in sound bodily health and of sound and disposing mind, memory, judgment and understanding as it appeared unto the said Notary and the Reverend Samuel Maudsley, Priest, and Alexander Woods, Farmer, both residing in the said Parish of Saint Raymond, witnesses required for the effect of these presents, but considering the certainty of death and the uncertainty of the hour thereof, and being desirous of regulating his worldly affairs, whilst yet he hath the strength so to do, hath made, named and dictated à fait nommé et dicté unto me the said Notary and the said witnesses his last will and testament in the manner and form following:
Firstly, I most willingly resign my soul into the hands of Almighty God in the humble hope that he will receive the same to his favor through the merits of Jesus Christ our Lord, and that my body be committed to the grave to be interred in a manner suitable to my condition in life, I leaving it however with my Executrix hereinafter named to fix and arrange the manner and expense of my funeral.
2º I will and order that all my just debts and funeral expenses be paid by my said Executrix hereinafter named.
3º I give, devise and bequeath to my well beloved son, William Livingston, issue of my marriage with Dame Rachel McComb, my wife, the following immoveable property, to wit:
-1- A lot of land situated in the North East half of the Seigniory of Bourg Louis being lot number sixteen of the Range called West Range, containing three arpents in front, ten arpents and eight perches in depth, bounded in front to the North East by the Public Road, in rear by the purchaser, towards the North by Alexander Woods, and to the South by Lot number fifteen, with the buildings thereon erected, circumstances and dependencies.
-2- A lot of land situate and being in the said Seigniory of Bourg Louis called New Guernsey being lot number sixteen in the First Concession of the South West half of the said Seigniory of Bourg Louis containing three arpents in front by twenty one and a half arpents in depth, together with a house, barn, stable and other buildings thereon erected. Said two lots of land known and distinguished upon the official plan and book of reference for the County of Portneuf, Parish of Saint Raymond as lot number six hundred and forty (No. 640).
To be by him my said son William Livingston, used, enjoyed and disposed of as his absolute property, à titre de legs particulier, under title of a particular legacy, from the day of the death of the survivor of my beloved wife Dame Rachel McComb and myself, wishing, willing and desiring that in the event of my death taking place previous to my said wife, that the said William Livingston take good care of her, and supply her with all the necessities of life and the comforts which old age and sickness requires as long as she lives.
And for the execution of this my present will and testament, according to law, I do hereby nominate, constitute and appoint my said beloved wife, Rachel McComb, Executrix of this my present last will and testament.
And I do hereby revoke all former last wills and codicils by me heretofore made, willing and desiring that these presents shall alone take place and be executed as and being my last will and testament and as such I do publish and declare the same.
It was thus made, dictated and nominated fait dicté et nommé unto me the said Notary in the presence of the said witnesses by the said Testator, and was read to the said Testator by the said Notary in the presence of the said undersigned witnesses, the Testator persisting herein as being his last will and testament.
Thus done and passed at the said residence of the said Testator in the said Parish of Saint Raymond on the day, month and year first above written about four of the clock in the afternoon.
In testimony whereof the said Testator declaring his inability to sign his name hath made his usual mark of a cross in the presence of the said undersigned Notary and the said witnesses who have also all signed with and in the actual presence of the said Testator and in the presence of each other. These presents having been first duly read as aforesaid and filed of record in the office of the said Notary under the number 1677.
