On the twenty first day of June in the year of our Lord one thousand eight hundred and sixty one, at the request of Honoria McDonough of the Township of Stoneham, widow of the late Christopher Flanagan in his lifetime of the Settlement of Stoneham in the County of Quebec, Farmer, we, the undersigned Notary Public and witnesses hereinafter named went to the house and residence of Matthew Aylward Hearn of the City of Quebec, Esquire, Advocate, situate in St. Lewis Street in the Upper Town of Quebec, where being we found the said Honoria McDonaugh in good bodily health and of sound and disposing mind, memory, judgment, and understanding as appeared to us the said Notary and witnesses, who did declare and say, that considering the certainty of death and the uncertainty of the hour thereof, she was desirous of making her last will and testament, which she accordingly dictated and named word for word to the Mtre. John Doyle the undersigned Notary in the presence and hearing of Francis O'Brien of the City of Quebec, student at Law, and James O'Brien, also of the City of Quebec, student at Law, witnesses expressly called for the execution of this present will, in manner & form following, that is to say: -

I recommend my soul to Almighty God supplicating forgiveness for my sins.

I direct and order that all my just and lawful debts and funeral expenses be paid and satisfied out of my estate as soon as possible after my decease as convenient by my Executor hereinafter named.

I will devise and bequeath unto my son Richard Flanagan thirty acres of land to be taken from a larger portion of land situate in the above mentioned Settlement of Stoneham and being lot number three in the third range, commencing the head of the said lot, bounded by the lot owned by one McCarthy and running across the same which is bounded by the lot owned by Mr. Shadgate, together with all the clearances within the limits of the said thirty acres.

I will devise and bequeath unto my son Christopher Flanagan thirty acres of land to be taken from a larger portion of land, in the above mentioned Settlement of Stoneham and being lot number three in the third range, the said thirty acres bounded by the above mentioned thirty given to my son Richard Flanagan, with what clearances and buildings there may be thereon.

I will, devise, and bequeath unto my daughter Ellen Flanagan, widow of the late Patrick Whelan in his lifetime of Quebec, thirty acres of land to be taken from the said lot number three, the said thirty acres, bounded by the said thirty acres given to the said Christopher Flanagan.

I will, devise, and bequeath to my son Henry Flanagan fifty acres of land to be taken from the said lot number three, the said fifty acres bounded by the portion bequeathed to my daughter Ellen Flanagan.

I will, devise, and bequeath to my son George Flanagan thirty acres of land to be taken from the said lot number three, the said thirty acres bounded by the portion bequeathed to my son Henry Flanagan.

I will, devise, and bequeath unto Christopher Flanagan, son of John Flanagan, thirty acres of land to be taken from the said lot number three adjoining the portion bequeathed to George Flanagan.

I further will, devise, bequeath unto my son Henry Flanagan forty acres of land to be taken from a larger portion of land to me belonging and forming lot number two in the Third Range of the Township of Stoneham, in the District of Quebec abutting the fifty acres herein before bequeathed.

I further will, devise & bequeath unto my son George Flanagan forty acres of land to be taken from lot number two & adjoining the portion bequeathed to the said Henry Flanagan abutting the thirty acres herein before bequeathed to the said George Flanagan.

I further will, devise & bequeath unto the said Christopher Flanagan, my grandson, son of John Flanagan, twenty acres of land to be taken from the said lot number two, and adjoining the portion bequeathed to the said George Flanagan and abutting the thirty acres hereinafter bequeathed to the said Christopher Flanagan.

I further will, devise & bequeath unto my said son Richard Flanagan one hundred acres of land to be taken from the said lot number two, and adjoining the thirty acres above bequeathed to him.

To have and to hold the said parts & portions of land so given unto the said, Richard Flanagan, Christopher Flanagan, Ellen Flanagan, Henry Flanagan, George Flanagan & Christopher Flanagan, son of John Flanagan from the day of my decease forever, to this only proper use benefit and hold of for ever.

As for the execution of this my last will and testament I hereby nominate and appoint Richard Coady of Stoneham, Farmer, to be my Executor into whose hands I divest myself of all my property according to law, hereby revoking all other wills & codicils by me made previous hereto, declaring this to be my last will and testament.

Thus done, dictated and named by the said Testatrix to the undersigned Notary in the presence and hearing of the above named witnesses, word for word, the said Testatrix hath declared the same to be conformable to her last will & intentions, these presents first read and read over again lu et relu to the said Testatrix by the undersigned Notary in the presence and hearing of the said above mentioned witnesses, the said Honoria McDonough having to these presents first duly read, set & subscribed her name and signature in the presence of us the said Notary & witnesses who have also signed in the presence of the said Testatrix & in the presence of each other, these presents remaining of record in the Office of the said John Doyle under the number five hundred & sixteen.

Twelve words erased are null; Six marginal notes are good.

Notes by Patricia Balkcom: Honora lived another nine years (until Feb. 20, 1870) after this will was written. In that time, at least two of her children mentioned in the will predeceased her - Richard (1864) and Henry (1862). Mathew Aylward Hearn, in whose house the will was written, was her son-in-law, husband of Margaret Flanagan. Three of her children - William, Bridget, and Thomas were not mentioned in her will.4

Some time in 1895, he moved his stevedoring business to Port Arthur, Texas. In his obituary, printed in a Houston, TX, newspaper, it described him as one of the founding fathers of the city of Port Arthur, TX.5

I hereby devise and bequeath unto my daughter Mary Elizabeth Flanagan the sum of one hundred and fifty dollars currency, to be taken and paid out of the obligation for the sum of two hundred and forty dollars and thirty two cents granted to me by Matthew Aylward Hearn, of said City of Quebec, Esquire, Advocate, by deed before J.B. Parkin, Notary at Quebec on the sixth day of February eighteen hundred and seventy nine.

I also give and bequeath to my daughter Mary Elizabeth Flanagan all mourning dresses and apparel and also a pair of silver candlesticks. And I bequeath to my grand-daughter Henrietta Ousler my silver cake basket. It is my earnest wish and desire that the sum of sixty dollars currency be paid as soon after my decease as possible, to Mr. Alexander Grant of said City of Quebec, Grocer, being the amount due by me to him for groceries supplied to myself and family when said sum of sixty dollars shall be taken out of the obligation granted in my favor by Matthew Aylward Hearn herein above mentioned.

And the balance of said obligation being the sum of thirty four dollars, I hereby will and bequeath the same to my sister Ann Aylward, wife of Patrick Hearn of said City of Quebec, & yeoman.

And for the execution of this my Last Will and Testament, I hereby appoint Mr. Daniel McSweeney of the said City of Quebec, Teacher, to be my Testamentary Executor, into whose hands I hereby divest myself of all my said property according to law hereby revoking all former Wills and Codicils by me heretofore made declaring the present to be my Last Will and Testament.

It was thus done on the day and year first above written and recorded under the number twelve hundred and thirty seven of the minutes of James Walsh, one of us said Notaries, in presence of our said colleague, she declared that the same contained her last wishes and hath signed theses presents after due reading hereof as aforesaid in presence of us said Notaries who also have signed the same in presence of said Testator and in presence of each other, these presents first duly read as aforesaid.

On the twenty first day of June in the year of our Lord one thousand eight hundred and sixty one, at the request of Honoria McDonough of the Township of Stoneham, widow of the late Christopher Flanagan in his lifetime of the Settlement of Stoneham in the County of Quebec, Farmer, we, the undersigned Notary Public and witnesses hereinafter named went to the house and residence of Matthew Aylward Hearn of the City of Quebec, Esquire, Advocate, situate in St. Lewis Street in the Upper Town of Quebec, where being we found the said Honoria McDonaugh in good bodily health and of sound and disposing mind, memory, judgment, and understanding as appeared to us the said Notary and witnesses, who did declare and say, that considering the certainty of death and the uncertainty of the hour thereof, she was desirous of making her last will and testament, which she accordingly dictated and named word for word to the Mtre. John Doyle the undersigned Notary in the presence and hearing of Francis O'Brien of the City of Quebec, student at Law, and James O'Brien, also of the City of Quebec, student at Law, witnesses expressly called for the execution of this present will, in manner & form following, that is to say: -

I recommend my soul to Almighty God supplicating forgiveness for my sins.

I direct and order that all my just and lawful debts and funeral expenses be paid and satisfied out of my estate as soon as possible after my decease as convenient by my Executor hereinafter named.

I will devise and bequeath unto my son Richard Flanagan thirty acres of land to be taken from a larger portion of land situate in the above mentioned Settlement of Stoneham and being lot number three in the third range, commencing the head of the said lot, bounded by the lot owned by one McCarthy and running across the same which is bounded by the lot owned by Mr. Shadgate, together with all the clearances within the limits of the said thirty acres.

I will devise and bequeath unto my son Christopher Flanagan thirty acres of land to be taken from a larger portion of land, in the above mentioned Settlement of Stoneham and being lot number three in the third range, the said thirty acres bounded by the above mentioned thirty given to my son Richard Flanagan, with what clearances and buildings there may be thereon.

I will, devise, and bequeath unto my daughter Ellen Flanagan, widow of the late Patrick Whelan in his lifetime of Quebec, thirty acres of land to be taken from the said lot number three, the said thirty acres, bounded by the said thirty acres given to the said Christopher Flanagan.

I will, devise, and bequeath to my son Henry Flanagan fifty acres of land to be taken from the said lot number three, the said fifty acres bounded by the portion bequeathed to my daughter Ellen Flanagan.

I will, devise, and bequeath to my son George Flanagan thirty acres of land to be taken from the said lot number three, the said thirty acres bounded by the portion bequeathed to my son Henry Flanagan.

I will, devise, and bequeath unto Christopher Flanagan, son of John Flanagan, thirty acres of land to be taken from the said lot number three adjoining the portion bequeathed to George Flanagan.

I further will, devise, bequeath unto my son Henry Flanagan forty acres of land to be taken from a larger portion of land to me belonging and forming lot number two in the Third Range of the Township of Stoneham, in the District of Quebec abutting the fifty acres herein before bequeathed.

I further will, devise & bequeath unto my son George Flanagan forty acres of land to be taken from lot number two & adjoining the portion bequeathed to the said Henry Flanagan abutting the thirty acres herein before bequeathed to the said George Flanagan.

I further will, devise & bequeath unto the said Christopher Flanagan, my grandson, son of John Flanagan, twenty acres of land to be taken from the said lot number two, and adjoining the portion bequeathed to the said George Flanagan and abutting the thirty acres hereinafter bequeathed to the said Christopher Flanagan.

I further will, devise & bequeath unto my said son Richard Flanagan one hundred acres of land to be taken from the said lot number two, and adjoining the thirty acres above bequeathed to him.

To have and to hold the said parts & portions of land so given unto the said, Richard Flanagan, Christopher Flanagan, Ellen Flanagan, Henry Flanagan, George Flanagan & Christopher Flanagan, son of John Flanagan from the day of my decease forever, to this only proper use benefit and hold of for ever.

As for the execution of this my last will and testament I hereby nominate and appoint Richard Coady of Stoneham, Farmer, to be my Executor into whose hands I divest myself of all my property according to law, hereby revoking all other wills & codicils by me made previous hereto, declaring this to be my last will and testament.

Thus done, dictated and named by the said Testatrix to the undersigned Notary in the presence and hearing of the above named witnesses, word for word, the said Testatrix hath declared the same to be conformable to her last will & intentions, these presents first read and read over again lu et relu to the said Testatrix by the undersigned Notary in the presence and hearing of the said above mentioned witnesses, the said Honoria McDonough having to these presents first duly read, set & subscribed her name and signature in the presence of us the said Notary & witnesses who have also signed in the presence of the said Testatrix & in the presence of each other, these presents remaining of record in the Office of the said John Doyle under the number five hundred & sixteen.

Notes by Patricia Balkcom: Honora lived another nine years (until Feb. 20, 1870) after this will was written. In that time, at least two of her children mentioned in the will predeceased her - Richard (1864) and Henry (1862). Mathew Aylward Hearn, in whose house the will was written, was her son-in-law, husband of Margaret Flanagan. Three of her children - William, Bridget, and Thomas were not mentioned in her will.8

The last Will and Testament of Bridget Flanagan, wife of Richard Coady, Farmer of the Township of Stoneham, in the District and County of Quebec, Lower Canada.

On the first day of October, one thousand eight hundred and sixty six:

In the name of the Holy and Undivided Trinity, before us the undersigned Patrick Kelly, Priest, Curé of the parish of St. Gabriel of Valcartier and Missionary charged with the Missions of the Roman Catholic inhabitants of St. Edmond of Stoneham, and of St. Jacques of Tewkesbury, both places in the Township of Stoneham, and David Craig, John McDonnell and Robert Paterson, Farmers, witnesses for this purpose attending, also of Stoneham, I Bridget Flanagan of the Township of Stoneham, in the District of Quebec, in the County of Quebec, now residing in the said Township of Stoneham, in the district and county aforesaid, considering the certainty of death and the uncertainty of the moment thereof do declare in the presence of the above named persons the following as my last Will and Testament.

Firstly, I bequeath my soul to God and enjoin that after my decease my body shall be interred in a decent and becoming manner according to the rites of the Roman Catholic Church and that a solemn Mass of Requiem be celebrated for the repose of my soul on the day of the interment of my body.

Secondly, I do will and bequeath unto my well beloved mother, Honorah McDonough, widow of the late Christopher Flanagan, the sum of Ten Pounds or Forty Dollars currency, each year, dating from the day of my interment; it being well understood that the said sums shall be deducted from the sum of Two Hundred Pounds or Eight Hundred Dollars which, I hereby declare that I accept as my share in the properties both moveable and immovable which I now and heretofore have enjoyed in common with my husband Richard Coady, and I also declare that I do hereby accept the said sum of Eight Hundred Dollars in lieu of whatever claims I may have to and in the said properties. Furthermore, I desire to specify that my heirs shall have no further claims upon the aforesaid properties, and for this purpose do hereby annul any other claims than those herein stated.

Thirdly, I hereby bequeath unto my sister Ellen Flanagan, now residing in the aforesaid Township of Stoneham, widow of the late Patrick Whelan, the sum of Ten Pounds or Forty Dollars, the said amount to be paid to her yearly after the decease of my mother, Honorah McDonough, widow of the late Christopher Flanagan, the said sum to be deducted also from the sum of Eight Hundred Dollars or Two Hundred Pounds currency; provided always that the payment of Two Hundred Pounds or Eight Hundred Dollars has not all been made and and acquitted by the said Richard Coady.

Fourthly, I also will unto my niece, Ellen Whelan, now residing in the City of Quebec, Lower Canada, the sum of Forty Dollars, which sum shall be paid within three years aftwr my decease, once only.

Fifthly, Unto William Whelan, my nephew, now residing in the aforesaid Township of Stoneham, I bequeath the sum of Forty Dollars which sum shall be paid yearly dating from the decease of my mother, Honorah McDonough, in case any part of the sum of Eight Hundred Dollars shall still remain.

And sixthly should any portion of the sum of Eight Hundred Dollars still remain unpaid to the above named persons, then the remainder shall be distributed equally to my nearest relatives surviving.

And for execution of the foregoing bequests I appoint Messiers William Corrigan and Patrick McKeoEllen Flanagann, both Farmers, residing in the Township of Stoneham to be my executors and request of them to render this last service.

Thus done and executed in the presence of the above named witnesses, the said Will and Testament having been read to the said Bridget Flanagan who has signed with us in the presence of Reverend Patrick Kelly, Priest, Curé, David Craig and John McDonnell and Robert Paterson undersigned. John McDonnell has made his mark over his name. I this the first day of October, in the year of our Lord one thousand eight hundred and sixty six.

Before the undersigned Notary Public for that part of the Province of Canada hereafter called Lower Canada and now the Province of Quebec residing in the City of Quebec in the said Province personally came and appeared Dame Honoria McDonough, widow of the late Christopher Flanagan, residing in the Township of Stoneham, in the County and District of Quebec, who being bodily sick in her bed, but perfectly sound in her mind, memory and understanding, as appeared unto the said Notary and the two witnesses hereinafter named, by her discourse and proposals declared unto the said notary and witnesses that considering the certainty of death and the uncertainty of the hour thereof, she was desirous of making her solemn will and testament which she requested the said notary to write down and while she dictated unto the said Notary in the presence of the said two witnesses in the manner following, to wit:

1º Firstly, I recommend my soul to Almighty God and commit my body to the earth to be interred after my decease in a manner suitable to my condition.

2º Secondly, I do will and ordain that all my debts be paid and my wrongs satisfied by my Executor Testamentary hereinafter named.

3º Thirdly, I do hereby give and bequeath unto Dame Margaret Whelan, my granddaughter, wife of Matthew A. Hearn, Esquire, Advocate a good milk cow to be delivered immediately after my decease by my universal legatee hereinafter named.

4º Fourthly, I do hereby give and bequeath to Miss Ellen Whelan, my other granddaughter, the sum of forty dollars and a feather bed and a quilt, the same to be paid and delivered as soon as possible after my decease.

5º Fifthly, I hereby give and bequeath to Misses Ellen Flanagan, widow of the late Patrick Whelan, my daughter, the sum of one hundred and twenty dollars, to be paid to her by equal payments of the sum of forty dollars a year till full payment but under the understanding that my Executor Testamentary hereinafter named shall be at liberty to pay the forty dollars a year to the said widow Whelan according to her wants by small payments as he the said Executor Testamentary may think proper for the best advantage of her the said widow Whelan.

6º Sixthly, I do give and bequeath to Richard Flanagan, my grand son, thirty acres of land to be taken in the Lot No. Three in the Third Range of the said Township of Stoneham along side & next to Lot No. Two in the said Third Range and also fifty acres of land in the said Lot No. 2 in the said Third Range along side and next to the one above thirty acres above given and bequeathed and intending that the said Richard Flanagan, my grand son, may enjoy and dispose of the said two parts in the said Lots No. Two and Three above mentioned in full property and for ever.

7º Seventhly, I do give and bequeath to George Flanagan, my son, in order to reward him for the good care he took of me since so many years, all and every my true properties moveable and immoveable, real and personal, whereof I may die possessed, for and by him the said George Flanagan to enjoy of all my said properties without any exception as he may think proper for ever, hereby naming him the said George Flanagan my universal legatee of all my said properties & revoking all other wills.

8º Eightly, I do hereby name and appoint the person of the said George Flanagan my said universal legatee to be the Executor Testamentary of my present Will & Testament.

It was thus dictated by the said Honoria McDonough unto J.-B. Pruneau, Notary, in the presence of James Adams and John Bleaks, both of the said Township of Stoneham, Farmers, and these presents having been duly read and read over again by the said J.-B. Pruneau in the presence of the said two witnesses to the said Honoria McDonough she declared that she well heard and understood the same and persisted therein.

Thus done and passed at the residence of the said Honoria McDonough in the said Township of Stoneham, on the twenty seventh day of September in the year of our Lord one thousand eight hundred and sixty eight under the No. nine thousand and fifty one.

And the said Honoria McDonough has signed with the said Notary and witnesses these presents having been duly read & read over again according to the law.

On the twenty first day of June in the year of our Lord one thousand eight hundred and sixty one, at the request of Honoria McDonough of the Township of Stoneham, widow of the late Christopher Flanagan in his lifetime of the Settlement of Stoneham in the County of Quebec, Farmer, we, the undersigned Notary Public and witnesses hereinafter named went to the house and residence of Matthew Aylward Hearn of the City of Quebec, Esquire, Advocate, situate in St. Lewis Street in the Upper Town of Quebec, where being we found the said Honoria McDonaugh in good bodily health and of sound and disposing mind, memory, judgment, and understanding as appeared to us the said Notary and witnesses, who did declare and say, that considering the certainty of death and the uncertainty of the hour thereof, she was desirous of making her last will and testament, which she accordingly dictated and named word for word to the Mtre. John Doyle the undersigned Notary in the presence and hearing of Francis O'Brien of the City of Quebec, student at Law, and James O'Brien, also of the City of Quebec, student at Law, witnesses expressly called for the execution of this present will, in manner & form following, that is to say: -

I recommend my soul to Almighty God supplicating forgiveness for my sins.

I direct and order that all my just and lawful debts and funeral expenses be paid and satisfied out of my estate as soon as possible after my decease as convenient by my Executor hereinafter named.

I will devise and bequeath unto my son Richard Flanagan thirty acres of land to be taken from a larger portion of land situate in the above mentioned Settlement of Stoneham and being lot number three in the third range, commencing the head of the said lot, bounded by the lot owned by one McCarthy and running across the same which is bounded by the lot owned by Mr. Shadgate, together with all the clearances within the limits of the said thirty acres.

I will devise and bequeath unto my son Christopher Flanagan thirty acres of land to be taken from a larger portion of land, in the above mentioned Settlement of Stoneham and being lot number three in the third range, the said thirty acres bounded by the above mentioned thirty given to my son Richard Flanagan, with what clearances and buildings there may be thereon.

I will, devise, and bequeath unto my daughter Ellen Flanagan, widow of the late Patrick Whelan in his lifetime of Quebec, thirty acres of land to be taken from the said lot number three, the said thirty acres, bounded by the said thirty acres given to the said Christopher Flanagan.

I will, devise, and bequeath to my son Henry Flanagan fifty acres of land to be taken from the said lot number three, the said fifty acres bounded by the portion bequeathed to my daughter Ellen Flanagan.

I will, devise, and bequeath to my son George Flanagan thirty acres of land to be taken from the said lot number three, the said thirty acres bounded by the portion bequeathed to my son Henry Flanagan.

I will, devise, and bequeath unto Christopher Flanagan, son of John Flanagan, thirty acres of land to be taken from the said lot number three adjoining the portion bequeathed to George Flanagan.

I further will, devise, bequeath unto my son Henry Flanagan forty acres of land to be taken from a larger portion of land to me belonging and forming lot number two in the Third Range of the Township of Stoneham, in the District of Quebec abutting the fifty acres herein before bequeathed.

I further will, devise & bequeath unto my son George Flanagan forty acres of land to be taken from lot number two & adjoining the portion bequeathed to the said Henry Flanagan abutting the thirty acres herein before bequeathed to the said George Flanagan.

I further will, devise & bequeath unto the said Christopher Flanagan, my grandson, son of John Flanagan, twenty acres of land to be taken from the said lot number two, and adjoining the portion bequeathed to the said George Flanagan and abutting the thirty acres hereinafter bequeathed to the said Christopher Flanagan.

I further will, devise & bequeath unto my said son Richard Flanagan one hundred acres of land to be taken from the said lot number two, and adjoining the thirty acres above bequeathed to him.

To have and to hold the said parts & portions of land so given unto the said, Richard Flanagan, Christopher Flanagan, Ellen Flanagan, Henry Flanagan, George Flanagan & Christopher Flanagan, son of John Flanagan from the day of my decease forever, to this only proper use benefit and hold of for ever.

As for the execution of this my last will and testament I hereby nominate and appoint Richard Coady of Stoneham, Farmer, to be my Executor into whose hands I divest myself of all my property according to law, hereby revoking all other wills & codicils by me made previous hereto, declaring this to be my last will and testament.

Notes by Patricia Balkcom: Honora lived another nine years (until Feb. 20, 1870) after this will was written. In that time, at least two of her children mentioned in the will predeceased her - Richard (1864) and Henry (1862). Mathew Aylward Hearn, in whose house the will was written, was her son-in-law, husband of Margaret Flanagan. Three of her children - William, Bridget, and Thomas were not mentioned in her will.3

Before the undersigned Notary Public for that part of the Province of Canada hereafter called Lower Canada and now the Province of Quebec residing in the City of Quebec in the said Province personally came and appeared Dame Honoria McDonough, widow of the late Christopher Flanagan, residing in the Township of Stoneham, in the County and District of Quebec, who being bodily sick in her bed, but perfectly sound in her mind, memory and understanding, as appeared unto the said Notary and the two witnesses hereinafter named, by her discourse and proposals declared unto the said notary and witnesses that considering the certainty of death and the uncertainty of the hour thereof, she was desirous of making her solemn will and testament which she requested the said notary to write down and while she dictated unto the said Notary in the presence of the said two witnesses in the manner following, to wit:

1º Firstly, I recommend my soul to Almighty God and commit my body to the earth to be interred after my decease in a manner suitable to my condition.

2º Secondly, I do will and ordain that all my debts be paid and my wrongs satisfied by my Executor Testamentary hereinafter named.

3º Thirdly, I do hereby give and bequeath unto Dame Margaret Whelan, my granddaughter, wife of Matthew A. Hearn, Esquire, Advocate a good milk cow to be delivered immediately after my decease by my universal legatee hereinafter named.

4º Fourthly, I do hereby give and bequeath to Miss Ellen Whelan, my other granddaughter, the sum of forty dollars and a feather bed and a quilt, the same to be paid and delivered as soon as possible after my decease.

5º Fifthly, I hereby give and bequeath to Misses Ellen Flanagan, widow of the late Patrick Whelan, my daughter, the sum of one hundred and twenty dollars, to be paid to her by equal payments of the sum of forty dollars a year till full payment but under the understanding that my Executor Testamentary hereinafter named shall be at liberty to pay the forty dollars a year to the said widow Whelan according to her wants by small payments as he the said Executor Testamentary may think proper for the best advantage of her the said widow Whelan.

6º Sixthly, I do give and bequeath to Richard Flanagan, my grand son, thirty acres of land to be taken in the Lot No. Three in the Third Range of the said Township of Stoneham along side & next to Lot No. Two in the said Third Range and also fifty acres of land in the said Lot No. 2 in the said Third Range along side and next to the one above thirty acres above given and bequeathed and intending that the said Richard Flanagan, my grand son, may enjoy and dispose of the said two parts in the said Lots No. Two and Three above mentioned in full property and for ever.

7º Seventhly, I do give and bequeath to George Flanagan, my son, in order to reward him for the good care he took of me since so many years, all and every my true properties moveable and immoveable, real and personal, whereof I may die possessed, for and by him the said George Flanagan to enjoy of all my said properties without any exception as he may think proper for ever, hereby naming him the said George Flanagan my universal legatee of all my said properties & revoking all other wills.

8º Eightly, I do hereby name and appoint the person of the said George Flanagan my said universal legatee to be the Executor Testamentary of my present Will & Testament.

It was thus dictated by the said Honoria McDonough unto J.-B. Pruneau, Notary, in the presence of James Adams and John Bleaks, both of the said Township of Stoneham, Farmers, and these presents having been duly read and read over again by the said J.-B. Pruneau in the presence of the said two witnesses to the said Honoria McDonough she declared that she well heard and understood the same and persisted therein.

Thus done and passed at the residence of the said Honoria McDonough in the said Township of Stoneham, on the twenty seventh day of September in the year of our Lord one thousand eight hundred and sixty eight under the No. nine thousand and fifty one.

And the said Honoria McDonough has signed with the said Notary and witnesses these presents having been duly read & read over again according to the law.

Notes by Patricia Balkcom: This is a second will - two of her children, Henry and Bridget, had passed away since she wrote the first will. Also, it appears that she changed her mind about who she would leave her assets to in some cases. The will states that she was sick in bed, however, she lived for another year and a half.4

Anecdote*18 August 1847Stoneham, Quebec County, Quebec, Canada; A "John Flanagan of Stoneham" is listed as taking in two "orphans" named Maria Madden, aged 11, and Patrick Madden, aged 17, children of James Madden and Mary Kenny. They had arrived from Ireland aboard the Virginius and were from Lissinoufy in County Roscommon. They were first placed in the Catholic orphanage in Quebec City. It is not clear how long they stayed with the family, however, John died a couple of months after the children came to live with them and they are not found living with the Flanagan family in the 1851 Census.4

On the seventeenth day of the month of November in the year of our Lord eighteen hundred and seventy six, at the request of Mrs. Mary Flanagan, wife of Patrick Kennedy, of the Parish of St. Catherine, I the Public Notary undersigned went to the residence of the said Mary Flanagan in the said Parish of St. Catherine, where I found her the said Mary Flanagan being apparently sound of body and of mind, memory and understanding who requested me the undersigned Public Notary to write down and receive, in due form of law, her last will and testament which she instantly made and dictated unto me the undersigned Public Notary in the manner and form following, viz.:

1º I recommend my soul to the Almighty God, hoping for a free pardon and remission for all my sins and my body I commit to the earth to be buried in the cemetery, leaving the care of my funeral to my Executor.

2º I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my Executor hereinafter named.

3º I give and bequeath to my son, Patrick Kennedy, living with me, all my properties, possessions and effects real and personal of whatever kind and wherever situated, and all sums of money, which I may leave, at the time of my death, and I institute the said Patrick Kennedy my universal legatee in full property, en pleine propriété.

At the charge by the said Patrick Kennedy, my universal legatee, to pay to my daughter, Anne Kennedy, twenty pounds currency, after my death.

And lastly, I do hereby nominate and appoint my son my sole Executor, and in hands of whom I divest and disseize myself of all my estate and property according to law.

And I hereby revoke and make null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true and last will and testament.

It was thus made, dictated and named by the said Testatrix to Mtre. Jos. Laurin, Notary, at the place aforesaid, in presence of Mr. James Shea, Labourer, and Michael Donovan, Farmer, both of the aforesaid Parish of St. Catherine, especially demanded for and to the effect of these presents, and the present last will and testament having been read in full to the said Testatrix by the said Jos. Laurin, Public Notary, in the presence of the aforesaid witnesses, she the said Testatrix declared that she had perfectly heard and understood the same and found it to contain her true last will and intentions, therefore persisted therein, at the place aforesaid, on the day, month and year first above written under the number seven thousand four hundred and twenty one.

And in faith and testimony of the premises, the said Testator has declared that she could not write nor sign her name, in presence of the above witnesses and the said Public Notary who have signed these presents in the presence of the said Testatrix and in the presence the ones of the others, these presents having been first duly read according to law.

Note by Patricia Balkcom: Both Patrick and Mary wrote the same Will on the same day so they must have made an agreement that their son, Patrick, would care for them and then inherit their property. They had eight known children, two of whom had predeceased them. Mary lived for twelve years after this Will. She died on June 13, 1890 at about 84 years of age. It’s possible she wrote a later Will.3

On the twenty fourth day of September in the year of our Lord one thousand eight hundred and eight one, at the request of Dame Bridget Aylward of the City of Quebec, Province of Quebec, Canada, widow of the late John Flanagan in his lifetime of the Parish of Charlesbourg, Quebec, Farmer, We the undersigned Notaries Public duly commissioned and sworn, residing in the City of Quebec aforesaid went to the residence of the said Bridget Aylward, situate in St. Stanislaus Street in the Upper Town of the City of Quebec where we found the said Bridget Aylward, sick of body but of good sound mind, memory, judgment, and understanding as appeared to us said Notaries who did declare and say that she was desirous of making her Last Will and Testament and which she accordingly made, named, and dictated to us said Notaries in the manner and form following, and which I James Walsh one of said undersigned Notaries have herein reduced to writing in presence of our colleague Edouard Bégin, the other of said Notaries, as dictated to us by the said Bridget Aylward, that is to say:

I hereby will, devise, and bequeath unto my son, Christopher Michael Flanagan, of said City of Quebec, Stevedore, the parcel or tract of land situate in the Parish or place called Stoneham in the County of Quebec consisting of forty acres, and bearing the Number 3 d (no. 3 d) of the Official Plan and Book of Reference for the Parish of St. Edmond de Stoneham to have and to hold the same unto my said son Christopher Michael Flanagan in full and absolute property from the day of my decease.

I hereby give, devise, and bequeath unto my daughter-in-law, Margaret Gracey, of said City of Quebec, widow of my son, the late Richard Flanagan in his lifetime of the same place, Inspector of Fuel on the Quebec, Montreal, Ottawa and Occidental Railway, all my right, title, interest, and claim into or from that certain parcel or tract of la nd situate in Charlesbourg in the County of Quebec being the lot designated under the number four hundred and fifty four on the Official Plan and Book of Reference for the Parish of Charlesbourg, to have and hold the same unto the said Margaret Gracey in full and absolute property from the day of my decease.

I hereby devise and bequeath unto my daughter Mary Elizabeth Flanagan the sum of one hundred and fifty dollars currency, to be taken and paid out of the obligation for the sum of two hundred and forty dollars and thirty two cents granted to me by Matthew Aylward Hearn, of said City of Quebec, Esquire, Advocate, by deed before J.B. Parkin, Notary at Quebec on the sixth day of February eighteen hundred and seventy nine.

I also give and bequeath to my daughter Mary Elizabeth Flanagan all mourning dresses and apparel and also a pair of silver candlesticks. And I bequeath to my grand-daughter Henrietta Ousler my silver cake basket. It is my earnest wish and desire that the sum of sixty dollars currency be paid as soon after my decease as possible, to Mr. Alexander Grant of said City of Quebec, Grocer, being the amount due by me to him for groceries supplied to myself and family when said sum of sixty dollars shall be taken out of the obligation granted in my favor by Matthew Aylward Hearn herein above mentioned.

And the balance of said obligation being the sum of thirty four dollars, I hereby will and bequeath the same to my sister Ann Aylward, wife of Patrick Hearn of said City of Quebec, & yeoman.

And for the execution of this my Last Will and Testament, I hereby appoint Mr. Daniel McSweeney of the said City of Quebec, Teacher, to be my Testamentary Executor, into whose hands I hereby divest myself of all my said property according to law hereby revoking all former Wills and Codicils by me heretofore made declaring the present to be my Last Will and Testament.

It was thus done on the day and year first above written and recorded under the number twelve hundred and thirty seven of the minutes of James Walsh, one of us said Notaries, in presence of our said colleague, she declared that the same contained her last wishes and hath signed theses presents after due reading hereof as aforesaid in presence of us said Notaries who also have signed the same in presence of said Testator and in presence of each other, these presents first duly read as aforesaid.

On the twenty first day of June in the year of our Lord one thousand eight hundred and sixty one, at the request of Honoria McDonough of the Township of Stoneham, widow of the late Christopher Flanagan in his lifetime of the Settlement of Stoneham in the County of Quebec, Farmer, we, the undersigned Notary Public and witnesses hereinafter named went to the house and residence of Matthew Aylward Hearn of the City of Quebec, Esquire, Advocate, situate in St. Lewis Street in the Upper Town of Quebec, where being we found the said Honoria McDonaugh in good bodily health and of sound and disposing mind, memory, judgment, and understanding as appeared to us the said Notary and witnesses, who did declare and say, that considering the certainty of death and the uncertainty of the hour thereof, she was desirous of making her last will and testament, which she accordingly dictated and named word for word to the Mtre. John Doyle the undersigned Notary in the presence and hearing of Francis O'Brien of the City of Quebec, student at Law, and James O'Brien, also of the City of Quebec, student at Law, witnesses expressly called for the execution of this present will, in manner & form following, that is to say: -

I recommend my soul to Almighty God supplicating forgiveness for my sins.

I direct and order that all my just and lawful debts and funeral expenses be paid and satisfied out of my estate as soon as possible after my decease as convenient by my Executor hereinafter named.

I will devise and bequeath unto my son Richard Flanagan thirty acres of land to be taken from a larger portion of land situate in the above mentioned Settlement of Stoneham and being lot number three in the third range, commencing the head of the said lot, bounded by the lot owned by one McCarthy and running across the same which is bounded by the lot owned by Mr. Shadgate, together with all the clearances within the limits of the said thirty acres.

I will devise and bequeath unto my son Christopher Flanagan thirty acres of land to be taken from a larger portion of land, in the above mentioned Settlement of Stoneham and being lot number three in the third range, the said thirty acres bounded by the above mentioned thirty given to my son Richard Flanagan, with what clearances and buildings there may be thereon.

I will, devise, and bequeath unto my daughter Ellen Flanagan, widow of the late Patrick Whelan in his lifetime of Quebec, thirty acres of land to be taken from the said lot number three, the said thirty acres, bounded by the said thirty acres given to the said Christopher Flanagan.

I will, devise, and bequeath to my son Henry Flanagan fifty acres of land to be taken from the said lot number three, the said fifty acres bounded by the portion bequeathed to my daughter Ellen Flanagan.

I will, devise, and bequeath to my son George Flanagan thirty acres of land to be taken from the said lot number three, the said thirty acres bounded by the portion bequeathed to my son Henry Flanagan.

I will, devise, and bequeath unto Christopher Flanagan, son of John Flanagan, thirty acres of land to be taken from the said lot number three adjoining the portion bequeathed to George Flanagan.

I further will, devise, bequeath unto my son Henry Flanagan forty acres of land to be taken from a larger portion of land to me belonging and forming lot number two in the Third Range of the Township of Stoneham, in the District of Quebec abutting the fifty acres herein before bequeathed.

I further will, devise & bequeath unto my son George Flanagan forty acres of land to be taken from lot number two & adjoining the portion bequeathed to the said Henry Flanagan abutting the thirty acres herein before bequeathed to the said George Flanagan.

I further will, devise & bequeath unto the said Christopher Flanagan, my grandson, son of John Flanagan, twenty acres of land to be taken from the said lot number two, and adjoining the portion bequeathed to the said George Flanagan and abutting the thirty acres hereinafter bequeathed to the said Christopher Flanagan.

I further will, devise & bequeath unto my said son Richard Flanagan one hundred acres of land to be taken from the said lot number two, and adjoining the thirty acres above bequeathed to him.

To have and to hold the said parts & portions of land so given unto the said, Richard Flanagan, Christopher Flanagan, Ellen Flanagan, Henry Flanagan, George Flanagan & Christopher Flanagan, son of John Flanagan from the day of my decease forever, to this only proper use benefit and hold of for ever.

As for the execution of this my last will and testament I hereby nominate and appoint Richard Coady of Stoneham, Farmer, to be my Executor into whose hands I divest myself of all my property according to law, hereby revoking all other wills & codicils by me made previous hereto, declaring this to be my last will and testament.

Thus done, dictated and named by the said Testatrix to the undersigned Notary in the presence and hearing of the above named witnesses, word for word, the said Testatrix hath declared the same to be conformable to her last will & intentions, these presents first read and read over again lu et relu to the said Testatrix by the undersigned Notary in the presence and hearing of the said above mentioned witnesses, the said Honoria McDonough having to these presents first duly read, set & subscribed her name and signature in the presence of us the said Notary & witnesses who have also signed in the presence of the said Testatrix & in the presence of each other, these presents remaining of record in the Office of the said John Doyle under the number five hundred & sixteen.

Notes by Patricia Balkcom: Honora lived another nine years (until Feb. 20, 1870) after this will was written. In that time, at least two of her children mentioned in the will predeceased her - Richard (1864) and Henry (1862). Mathew Aylward Hearn, in whose house the will was written, was her son-in-law, husband of Margaret Flanagan. Three of her children - William, Bridget, and Thomas were not mentioned in her will.4

Before the undersigned Notary Public for that part of the Province of Canada hereafter called Lower Canada and now the Province of Quebec residing in the City of Quebec in the said Province personally came and appeared Dame Honoria McDonough, widow of the late Christopher Flanagan, residing in the Township of Stoneham, in the County and District of Quebec, who being bodily sick in her bed, but perfectly sound in her mind, memory and understanding, as appeared unto the said Notary and the two witnesses hereinafter named, by her discourse and proposals declared unto the said notary and witnesses that considering the certainty of death and the uncertainty of the hour thereof, she was desirous of making her solemn will and testament which she requested the said notary to write down and while she dictated unto the said Notary in the presence of the said two witnesses in the manner following, to wit:

1º Firstly, I recommend my soul to Almighty God and commit my body to the earth to be interred after my decease in a manner suitable to my condition.

2º Secondly, I do will and ordain that all my debts be paid and my wrongs satisfied by my Executor Testamentary hereinafter named.

3º Thirdly, I do hereby give and bequeath unto Dame Margaret Whelan, my granddaughter, wife of Matthew A. Hearn, Esquire, Advocate a good milk cow to be delivered immediately after my decease by my universal legatee hereinafter named.

4º Fourthly, I do hereby give and bequeath to Miss Ellen Whelan, my other granddaughter, the sum of forty dollars and a feather bed and a quilt, the same to be paid and delivered as soon as possible after my decease.

5º Fifthly, I hereby give and bequeath to Misses Ellen Flanagan, widow of the late Patrick Whelan, my daughter, the sum of one hundred and twenty dollars, to be paid to her by equal payments of the sum of forty dollars a year till full payment but under the understanding that my Executor Testamentary hereinafter named shall be at liberty to pay the forty dollars a year to the said widow Whelan according to her wants by small payments as he the said Executor Testamentary may think proper for the best advantage of her the said widow Whelan.

6º Sixthly, I do give and bequeath to Richard Flanagan, my grand son, thirty acres of land to be taken in the Lot No. Three in the Third Range of the said Township of Stoneham along side & next to Lot No. Two in the said Third Range and also fifty acres of land in the said Lot No. 2 in the said Third Range along side and next to the one above thirty acres above given and bequeathed and intending that the said Richard Flanagan, my grand son, may enjoy and dispose of the said two parts in the said Lots No. Two and Three above mentioned in full property and for ever.

7º Seventhly, I do give and bequeath to George Flanagan, my son, in order to reward him for the good care he took of me since so many years, all and every my true properties moveable and immoveable, real and personal, whereof I may die possessed, for and by him the said George Flanagan to enjoy of all my said properties without any exception as he may think proper for ever, hereby naming him the said George Flanagan my universal legatee of all my said properties & revoking all other wills.

8º Eightly, I do hereby name and appoint the person of the said George Flanagan my said universal legatee to be the Executor Testamentary of my present Will & Testament.

It was thus dictated by the said Honoria McDonough unto J.-B. Pruneau, Notary, in the presence of James Adams and John Bleaks, both of the said Township of Stoneham, Farmers, and these presents having been duly read and read over again by the said J.-B. Pruneau in the presence of the said two witnesses to the said Honoria McDonough she declared that she well heard and understood the same and persisted therein.

Thus done and passed at the residence of the said Honoria McDonough in the said Township of Stoneham, on the twenty seventh day of September in the year of our Lord one thousand eight hundred and sixty eight under the No. nine thousand and fifty one.

And the said Honoria McDonough has signed with the said Notary and witnesses these presents having been duly read & read over again according to the law.

Notes by Patricia Balkcom: This is a second will - two of her children, Henry and Bridget, had passed away since she wrote the first will. Also, it appears that she changed her mind about who she would leave her assets to in some cases. The will states that she was sick in bed, however, she lived for another year and a half.4
