I will and direct that all my just debts be paid and satisfied as soon as possible after my decease. 1stly I give and bequeath the whole of my property moveable and immoveable, real and personal debts and obligations ready money or wearing apparel which I may die possessed of without any exception or reserve whatsoever unto my beloved wife, Mary Rae whom I do hereby institute my universal and residuary legatee of all my said property moveable and immoveable real and personal to have and to hold the same, after my decease in full and absolute property. 2ndly I do hereby will and direct that after my decease and the decease of my beloved wife that out of any and all of said estate and property then remaining I give and bequeath unto my daughter Agnes the sum of two hundred dollars, that is unless she having married previous to my decease and that of my said wife and she having received at the time of such marriage the sum of two hundred dollars. 3rdly I will and direct and give and bequeath a similar sum of two hundred dollars to my daughter Mary under similar and same conditions. 4thly I hereby will and direct that after my decease and the decease of my said wife that after paying the two aforementioned legacies the balance of my estate and property then remaining both real and personal of the cash proceeds thereof shall be divided into six equal shares or proportions and that my son, Robert, and daughters Hannah, Margaret and Agnes do each of them have and take one share and my daughter Mary do have and take two shares, the same to be over and above the legacies to the aforementioned Agnes and Mary. And I do hereby nominate and appoint David McBain, Merchant, and Robert Ross, Farmer, both of the Parish of St. Gabriel of Valcartier to be the Executors of this my last will and testament in whole hands I desire and divest myself of all my said property, moveable and immoveable giving them power to act jointly and separately and to carry and prolong the execution of this my said last will beyond the term allowed by law and until my views and intentions shall have been fully executed but whose duties shall not commence until the decease of my said wife hereby revoking all former wills and codicils at any time heretofore by me made and declaring the present to be my only true last will and testament. It was thus made, dictated and named by the said Testator unto me the said Notary in the presence of my colleague Notary the present will having been read to the said Robert Ross, the elder, in the presence aforesaid the said Robert Ross having declared to have perfectly heard and understood the same and persisted therein declaring it contained his last will and testament. I will and direct that all my just debts be paid and satisfied as soon as possible after my decease. 1stly I give and bequeath the whole of my property moveable and immoveable, real and personal debts and obligations ready money or wearing apparel which I may die possessed of without any exception or reserve whatsoever unto my beloved wife, Mary Rae whom I do hereby institute my universal and residuary legatee of all my said property moveable and immoveable real and personal to have and to hold the same, after my decease in full and absolute property. 2ndly I do hereby will and direct that after my decease and the decease of my beloved wife that out of any and all of said estate and property then remaining I give and bequeath unto my daughter Agnes the sum of two hundred dollars, that is unless she having married previous to my decease and that of my said wife and she having received at the time of such marriage the sum of two hundred dollars. 3rdly I will and direct and give and bequeath a similar sum of two hundred dollars to my daughter Mary under similar and same conditions. 4thly I hereby will and direct that after my decease and the decease of my said wife that after paying the two aforementioned legacies the balance of my estate and property then remaining both real and personal of the cash proceeds thereof shall be divided into six equal shares or proportions and that my son, Robert, and daughters Hannah, Margaret and Agnes do each of them have and take one share and my daughter Mary do have and take two shares, the same to be over and above the legacies to the aforementioned Agnes and Mary. And I do hereby nominate and appoint David McBain, Merchant, and Robert Ross, Farmer, both of the Parish of St. Gabriel of Valcartier to be the Executors of this my last will and testament in whole hands I desire and divest myself of all my said property, moveable and immoveable giving them power to act jointly and separately and to carry and prolong the execution of this my said last will beyond the term allowed by law and until my views and intentions shall have been fully executed but whose duties shall not commence until the decease of my said wife hereby revoking all former wills and codicils at any time heretofore by me made and declaring the present to be my only true last will and testament. It was thus made, dictated and named by the said Testator unto me the said Notary in the presence of my colleague Notary the present will having been read to the said Robert Ross, the elder, in the presence aforesaid the said Robert Ross having declared to have perfectly heard and understood the same and persisted therein declaring it contained his last will and testament. | Will* | 16 November 1886 | St-Gabriel-de-Valcartier, Quebec County, Quebec, Canada; 16th December 1886 Last Will of James Rourke[:BOLD] Husband of Martha Calback From records of Cyrille Tessier Record No. 7148 Transcribed from the original at the Quebec Archives On this day the sixteenth of December one thousand eight hundred and eight six, before the undersigned Notaries Public for the Province of Quebec, Canada, residing in the City of Quebec, personally came and appeared Mr. James Rourke, of the Parish of St. Gabriel of Valcartier, Farmer, who has made as follows his last will and testament: 1st I give, devise and bequeath to Martha Calback, my beloved wife, the usufruct and enjoyment during her life time of all property, real and personal, moveable and immoveable, which I may die possessed of without exception, exempting her from the obligation of making an inventory and of giving security. 2nd I give, devise and bequeath to my son Henry four acres in front by thirty acres in depth or thereabouts, or whatever right I may have thereon being the north part or portion of my land which is composed of numbers twelve and thirteen of the Fourth Range of St. Gabriel West; also two sheep, two cows, and a horse, to have and to hold the same in full ownership from the day of the decease of my said wife. 3rd I give, devise and bequeath to my four daughters, Ellen, Margaret, Sarah and Mary Ann, the two remaining acres of my said land, being the south part of the same with buildings, as well as all my other property, real and personal, moveable and immoveable, which I may die possessed of, instituting them my universal or residuary legatees, to have, use and enjoy the whole in full ownership and by equal shares from the day of the decease of my said wife. And I do nominate and appoint my said wife Martha Calback the sole executrix of this will, revoking all former wills and codicils I may have made before this. This last will received by Cyrille Tessier, Notary, in the presence of G.F.C. de Léry, his colleague, having been read to the Testator by the first named Notary in the presence of his said colleague, he has declared well to understand the same and has persisted in the same as containing his last intention. At Quebec, Office of the said Cyrille Tessier, under the number seven thousand one hundred and forty eight of his records. In testimony whereof the said Notaries have signed in the presence of the Testator and of one another, the Testator having declared not to know how to write or sign his name, after the reading done. Parkin, one of the said Notaries, have at her request reduced to writing in manner and form following: First, I direct that all my just debts and funeral expenses be paid by my Executor hereinafter named as soon as possible after my decease. Secondly, I direct that a monument with suitable inscription be erected over my family lot in the Valcartier Cemetery to the memory of my husband, my father & mother, my sister & myself, to cost about four hundred dollars. Thirdly, I give and bequeath to my friend Miss Isabella Goodfellow of Valcartier, the rest or residue of my estate and property real and personal, moveables, money in bank or otherwise, and I constitute her hereby my universal legatee. Fourthly, I name and appoint the said Miss Isabella Goodfellow to be sole Executrix of my present last will & testament, into whose hands I divest myself of all my estate and property from and after my decease, and of fifty dollars for her services as such. Fifthly, I revoke all wills by me at any time heretofore made and declare the present to contain my only true last wishes and intentions. It was thus made, named, and dictated by the said Testatrix to the said John B. Parkin, in the presence of Felix A. LaRue, also of the City of Quebec, Notary Public, and after her present will has been read over to her by the said John B. Parkin, in presence of his said colleague, she declared to have perfectly heard and understood the same and persisted therein.
