Note*Jane O'Meara; Through a Guardianship Document filed November 12, 1889, whereas Elizabeth McKeown is requesting a guardian be appointed for her stepchildren (children of Michael Birmingham and his first wife), the relationship between Jane O'Meara and Elizabeth O'Meara is established. The Document states that Thomas Martin is a cousin (to Michael Birmingham). This would be because Michael's aunt is Jane O'Meara who married Thomas Martin, therefore, Elizabeth and Jane O'Meara would be sisters.
There is also a 2nd document that establishes this relationship - "The Interdiction of Elizabeth Birmingham."2,3

On this day the second day of April in the year of our Lord one thousand eight hundred and seventy three,

Before us the undersigned Notary Public for the Province of Quebec in the Dominion of Canada residing in the parish of St. Ambroise de la Jeune Lorette and the witnesses hereinafter named and subscribed,

Personally came and appeared and was present Jane O'Neil, wife of Henry Patton of the parish of St. Gabriel of Valcartier in the County of Quebec, farmer, who being in weak bodily health, but of sound mind, memory, and understanding as to us appeared by her manner and conversation hath requested of us the said Notary to receive & reduce into writing this her Last Will and Testament which we the said Notary in the presence of the said witnesses, have taken down as dictated to us by the said Jane O'Neil word for word and as follows, that is to say:

I do hereby give, devise, and bequeath unto James, Catherine, and Mary Jane Patton my three children all and every my property real & personal moveable and immoveable without any exception or reserve whatsoever, which I may did possess of hereafter instituting them my said three children above (named) my universal legatee.

And for the execution of the present my Last Will and Testament I do hereby nominate and appoint the Reverend Andrew Balfour of St. Gabriel of Valcartier in the County of Quebec, Minister of the Church of England and James Patton, my son, in favor of whom I do in conformity to the Law & Custom of this Province, hereby disseize & divest myself of all my property for the ends hereof, hereby revoking all other wills and testaments and codicils that I may have made prior to the present to which alone I do adhere as containing my true instructions and last will.

Thus done and dictated word for word and published and declared by the said Jane O'Neil Testatrix for and as her Last Will and Testament to and in the presence of the said Notary and the Reverend Andrew Balfour aforesaid and William McBain of the said parish of St. Gabriel of Valcartier, farmer, in the bed room of the house and residence of the said Henry Patton at St. Gabriel of Valcartier aforesaid the day and year first above written under number ninety two between the hour of twelve and one o'clock in the afternoon.

In faith and testimony whereof the said Testatrix having declared not to know how to write or sign her name when requested so to do as to the presents first duly read set and made her ordinary mark of cross in the presence of us the said Notary & of the said witnesses who have here unto set & subscribed their respective names & signatures,

Notes by Patricia Balkcom: Jane died 8 days after writing her will. She was about 65 years of age. My records show that she had an additional three sons that were not mentioned in the will (Henry, John and Francis).5

January 1852 she is 34 which would be 1817.
April 1861 she is 43 which is 1817-1818.

April 1891 she is 73 which is 1817-1818.
Her marriage record indicates that she was a minor (under 21), which would mean she would have been born after 04 Feb. 1818, however, it was not unusual for people to not accurately know their age.
According to land records, the O'Neills arrived in Canada in the spring of 1818, so I would think that she was likely born between Feb. and April of 1818.
There is a baptism for a "Bridget of John & Judith O'Neill, (sponsors) Chis O'Neill and Bridget Kelly" in St. James Catholic Church in Dublin on February 1, 1814, however, there is not currently anyway of knowing if this is the family of John O'Neill and Judith Duffy."

Baptism10 December 1817Dunlavin Catholic Church, Dunlavin, County Wicklow, Leinster Province, Ireland; A baptismal record states that Bridget Neal, daughter of John and Judith Neale of Milltown was baptized on 10 December 1817 with the witnesses as Sarah Duffe and Bartlet Buckly. The baptism occured in the Dunlavin Roman Catholic Church which is in the diocese of Dublin and is now called Saint Nicholas of Myra (original church was built in 1815). Dunlavin is located in County Wicklow and it borders County Kildare. There is evidence of a Duff family living in Miltown. Is Sarah Duffe, the godmother, the sister of Judith Duffy?
Given the location (close to Kildare) and the godmother's name, it is strongly suggestive that this is the daughter of our John and Judith.
There is a baptismal record for a Judith Duffy in 1786 in Kilcullen which would likely have been the church used by people from Milltown before the church was built in Dunlavin.
There is a Neale family that had children baptized in Kilcullen - one of them being a John Neal, baptized in 1788 so it seems possible that this area was the place where the O'Neill and Duffy families lived.

There is a Neale family that had children baptized in Kilcullen - one of them being a John Neal, baptized in 1788 so it seems possible that this area was the place where the O'Neill and Duffy families lived.
John Navin, who married Judith's sister, Sarah, was also from County Kildare according to his gravestone. There are several Nevin (sic) families in the Kilkullen church records.4

This is somewhat confusing because in previous and future documents, there is no evidence that he lived in the 4th Concession, only in the 5th. The Census goes on to say that John has 1 male child, 2 female children, and 3 male servants. These servants are likely men that he has hired to help him clear the land. He owns a horse, 4 oxen, 6 cows and 4 cows and he has now cleared 30 acres on the 4th Concession and 2o acres on the 5th Concession.5

Includes: 30 minots of oats, 4 minots of peas, 60 minots of potatoes, 2 arpents sown in turnips, 16 arpents in timothy, 1/2 arpent each in hemp and flax. He has 3 cows, 2 pigs, and 1 gelding. He produced 100 minots of wheat, 400 minots of potatoes, 200 minots of turnips, 1000 bundles of hay and clover, 4 minots of carrots, and 500 lbs. of butter. He has peas in production but they are still green and have not been harvested.6

He was listed as a "outside limits" which indicated that on the night of the Census which was ordered to be taken on January 11th, he spent the night in St. Edmond.8,9

On the thirteenth day of October one thousand eight hundred and forty one, I, John O’Neil undersigned being sick and weak in body but of sound mind, memory, and understanding and not knowing when it may please God to call me out of this world do make constituted and ordain this my last will and Testament in manner and form following to wit:

1st I bequeath my soul to Almighty God hoping that he will receive in his great mercy and forgive me my sins.

2nd I leave my body to the earth from whence it was taken hoping that my loving wife and children will give me a Christian burial.

3rd I leave all my immoveable property to my two sons Thomas and James O’Neil to be enjoyed together by them in common as long as they shall live together and if it happens that they separate, the landed property will be divided equally between them according to its value by two or three arbitrators; provided that my dear wife Judith Duffy be decently kept and supported by them as long as she shall choose to live with them, or if she wishes to live by herself, they will provide the following support for her as long as she lives, viz:

They will give her two acres of land upon which they will build a house and a stable; provide her with a cow which must be replaced in case of death and furnish fother or forage for her cow and cultivate her piece of ground. Moreover they will give her each of them yearly the sum of three pounds currency.

4th I leave all my stock of cattle and all my moveable property to my said two sons equally, on conditions that they will give to my daughter Sera O’Neil two cows and the foal I have at present at the time of her marriage and likewise two cows to each of my other daughters, Margaret and Catharine O’Neil at the time of their marriage; and if any of them do not marry I hope they will live in peace with their Brothers who will be obliged to furnish them with a home in case of sickness and take care of them accordingly.

5th My will is that the eight pounds which are due to John Wilson shall be paid on demand. I recommend all my children to be obedient and loving to their mother and agreeable among themselves and my eldest son Thomas is to be considered the conductor of affairs after my death and I recommend my other children to be submissive to him.

The above, I do declare to be my last will and testament which I have heard read and have signed in presence of the witness viz the Reverend H. Paisley, Ferdinand Murphy and James Donohoe who have also signed with me.

Done and passed in my dwelling home at Valcartier on the day and year aforesaid two words raized are null, two words in the margin are good.

My notes: Burial records, three weeks after the will was written, state that John was 48 years old. It appears that he was ill for sometime – since he had written the will three weeks before he died and at a relatively young age. Did he have consumption (tuberculosis)? When he died he left Julia, his wife, and seven surviving children, aged 11 through 27. The two eldest children, Elizabeth (married to John Wilson), and Bridget (married to Thomas Cassin) are not mentioned in the will presumably because they had already married and had husbands to care for them. The two boys, Thomas and James, who were left the land, were 21 and 18 when their father died. James sold his portion of the land to Thomas, five years later, in 1846. We have found James in Guelph, Ontario records by 1855. It is possible that he left Quebec after the land sale to find another type of work. Thomas, kept the land until 1864, he, his wife (Bridget Martin) and children and his mother, Julia, had relocated to Little River in 1863.

Before me, the Honorable John Buckworth Parkin, one of the Assistant Judges of the Superior Court for Lower Canada, personally came and appeared Ferdinand Murphy and James Donohoe, both of the Seigniory of St. Gabriel de Valcartier, farmers, who being severally and respectively duly sworn upon the Holy Evangelists of Almighty God do respectively make oath and say that they were personally present as witnesses to the execution of the Last Will and Testament of the late John O’Neill, hereunto annexed (sic), in his lifetime of St. Gabriel de Valcartier aforesaid, farmer, bearing date the thirteenth day of October in the year of our Lord one thousand eight hundred and forty one, and beginning with the words “on the thirteenth day of October, one thousand eight hundred and forty one” and concluding with the words “Done and passed in my dwelling home at Valcartier on the day and year aforesaid, two words raized are nul, two works in the margin are good”.

That the said late John O’Neill declared and acknowledged to deponents respectively that the signature “John O’Neill” at the foot of the said last will and Testament was his signature and the said signature was by the said John O’Neill signed in presence of deponents; that the signature “H. Paisley, Priest” is the signature of the Reverend H. Paisley since deceased and by him signed in presence of deponents and that the signatures “Ferdinand Murphy and James Donohoe” appended to the said last will and testament are in the respective handwriting of deponents, and by them signed in the presence of the said testator, of each other and of the said Reverend H. Paisley whose signatures were also appended in presence of deponents, to the said last will.

On this day, the twenty eight of October in the year of our Lord one thousand eight hundred and eighty two (1882), Before me the undersigned Notary Public for the Province of Quebec in the Dominion of Canada, residing in the parish of St. Ambroise of La Jeune Lorette and the witnesses hereinafter named and subscribed,

Personally came and appeared Sarah Duffy, widow of the late John Navin, residing at the residence of James Rolph, farmer of the parish of St. Gabriel of Valcartier, the said Sarah Duffy being in weak bodily health but of sound mind, memory, and understanding as to us appeared by her manner and conversation hath requested of the said Notary to receive and reduce into writing this, her Last Will and Testament which I, the said Notary, in the presence of the said witnesses have taken down as dictated to us by the said Sarah Duffy as aforesaid word for word and as follows, that is to say,

Iº I recommend my soul to God asking him to give me the everlasting beatitude by the merits of Jesus Christ my Saviour.

IIº I wish that after my lawful and just debts shall have been paid and satisfied with which I hereby charge my Executor hereinafter named a sum of money be paid to the Curé of the parish of St. Gabriel of Valcartier to be by him employed for the saying of one hundred low masses of "requiem" for the repose of my soul.

IIIº I give and bequeath unto Bridget Margaret Corrigan, daughter of James B. Corrigan, of the town Cedarburg, County of Ozaukee in the State of Wisconsin the sum of one hundred dollars if she remains in the convent of the Good Shepherd and not otherwise.

IVº I do hereby give and bequeath unto (Kate) Catherine O'Neil, wife of Garret Kindlen, butcher, formerly of the parish of St. Gabriel of Valcartier, now residing in the parish of St. Sauveur of Quebec all the remainder of my real and personal property and all moveables that I may possess of & to have and to hold the said remainder of my property hereby given to the own proper use, behoof, and benefit of her, the said Catherine O'Neil as aforesaid and in full and absolute property from the day of my death.

Notes by Patricia Balkcom: Notes by Patricia Balkcom: In her first will, 15 years earlier, Sarah left her estate to her sister-in-law, Ann Navin and Ann’s children. Ann died about 1881 before this second will was written. Sarah now leaves all of her estate to her two nieces (Bridget Margaret Corrigan – daughter of Ann Navin) and Catherine O’Neill Kindelan (daughter of Judith Duffy, sister to Sarah). It is obvious that Sarah was especially close to Bridget and that as a child, Bridget lived with Sarah for a period of time, even though her family had moved to Wisconsin. It is also obvious that Sarah and her husband, the late John Navin, were very religious, as they left money to the church for masses and Sarah stipulated that Bridget must remain in the church to receive her inheritance. Sarah died 2 months after writing this will.7

The law is known as a stern mistress, demanding of her devotees constant and unremitting attention and leading her followers through many mazes and intricacies before she grants them success at her hands. This incessant
devotion frequently precludes the idea of the successful lawyer indulging in activities outside of the
straight path of his profession, especially if his vocational duties are of large and important nature.
Then again, some men have been led into the practice of the law through their connection with some
other interests which necessitated a knowledge of
the law along certain lines, and when this knowledge
was gained, a desire was awakened to study still fur-
ther and make the profession a life work. 'This latter was the case of Charles E. O'Neill, one of the successful attorneys of Butte, who became a lawyer
through his initial studies with reference to banking law.

Charles E. O'Neill was born at Marshall, Missouri,
on February 22, 1889, a son of William P. O'Neill.
The latter was born in Canada in 1860, and is now
residing at Miles City, Montana. While still a child
he was brought to Missouri by his parents, and
there he was reared, educated and married, and
became a farmer of Marshall, Missouri. In 1907
he came to Montana and has since been a resident
of Miles City, having extensive farming interests in its vicinity. He is a republican in politics and a
Roman Catholc in religious faith. William P.
O'Neill married Julia Devaney, born in Missouri in 1865, a daughter of John Devaney, born in Ireland
in 1814. His wife was also born in Ireland and they
were married in Missouri, where both died, he in
1900 and she in 1901. They were farming people.
The children born to William P. O'Neill and his wife were as follows: Stella, who married Dr. F P Mahon of St. Louis, Missouri, a dental surgeon-
Charles E., who was second in order of birth; Ray
Francis, who is a railroad employe of St. Louis
Missouri; and Florence, who married George Ach-
maker, formerly an importer of New York City
but now a resident of St. Louis, Missouri.

Charles E. O'Neill was reared at St. Louis and
attended its schools, and in 1906 came to Miles City,
Montana, and spent a year on a ranch in its vicinity.
He then took a commercial course at the Butte
Business College, specializing in stenography and bookkeeping, and in August, 1907, entered the Butte Commercial Bank, with which he learned the banking business, remaining with that concern until January 1, 1909, when he entered the First National
Bank of Butte and continued with it until January
1, 1919, a period of ten years. During this time he
became thoroughly posted with reference to banking of all kinds and banking law, and was admitted
to the bar on June 11, 1919. He at once entered
upon a general practice, and his offices are at Nos.
71-72 Owsley Building. Mr. O'Neill is independent
m his political views. He belongs to the Roman
Catholic Church. Fraternally he is connected with
Butte Council No. 668, Knights of Columbus, in
which he has been made a third degree knight, and
the Knights and Ladies of Security. At one time
he belonged to the Butte Country Club.

In 1911, Mr. O'Neill was married at Butte to Miss
Kathryn C. Sullivan, a daughter of Mr. and Mrs
John J. Sullivan, both of whom are deceased, he
having been a miner of Butte and a member of the
police force, and came to the city during its pioneer
epoch. Mr. and Mrs. O'Neill have three children,
namely : Edalene Frances, who was born on Novem-
ber 6, 1913 ; Helen, who was born January 22, 1915
and Jack Charles, who was born on November 8,
1916. Although one of the recent additions to his
profession, Mr. O'Neill has already proved his abil-
ity and is looked upon as one who will rise high
in it, for he possesses the characteristics necessary
for such advancement, being bold, independent and fearless, scorning petty tricks, fighting in the open
for what he believes to be right. A man of sound
judgment who weighs carefully both sides, he is
certain of rendering impartial justice.6

Edward J. O’Neill the Victim of a Woman’s Duplicity and a Man with a Cocked Revolver.

BUTTE, Aug. 4.—That section of the city which runs along the west border of Missoula gulch has been in a state of great excitement during the past few days, and the gossips have been in clover. This interesting condition of things was owing to happenings in a comfortable brick house at the southwest corner of West Granite and Alabama streets, formerly occupied by Mr. and Mrs. Edward J. O’Neill and their infant daughter, but now tenanted by Edward J. O’Neill alone.

The O’Neills took up their residence in the little brick house a little more than a year ago. They were good neighbors and to all appearances lived happily together, and the people in the vicinity did not suspect any more than did Mr. O’Neill himself that Mrs. O’Neill was an adventurous rather than an honest woman, and for several months had been plotting to return to another husband, to whom she was united in wedlock at the same time that she was married to Mr. O’Neill.

The maiden name of the young woman who figured in the sensation of the past few days was Emma Lena Ohl. She is a German by descent, and very prepossessing in appearance. In fact, she is known as one of the prettiest women in Butte. She is of a pronounced brunette, small in stature, with voluptuous eyes and raven-black hair. She was very lively, too. Her parents live at Lake View, Nev., and there she was brought up. When not quite 15 years of age she met a railroad man there named Humphrey Desmond. At about that time her parents decided to place her in a convent to make a nun out her. So to the convent she went.

But she didn’t like that kind of life, and one dark night Desmond scaled the convent walls and stole her out of it. At the tender age of 15 she became Mrs. Desmond and presently came to this city, and took up their residence at South Butte, Mr. Desmond being employed on the Montana Union road.

All went well for a year or two, but three years ago Mr. Desmond left his wife to go to El Paso, Texas, to better his fortunes. Mrs. Desmond expected to be sent for as soon as her husband got a foothold, but she wasn’t. She waited a year in Butte and then went back to the home of her parents in Nevada, considering herself deserted.

While in Butte Mrs. Desmond casually made the acquaintance of Edward J. O’Neill, a respectable and honest agent of a San Francisco tea house, who for several years has been established in Butte and done business with the merchants here.

Mrs. Desmond was above all things else a very affecting and capable letter writer. She could write a love letter that would cause any man’s soul to creep up and down a man’s back. She corresponded with Mr. O’Neill and it was finally arranged that they should get married, provided she could get a divorce from Desmond. She finally wrote that she had had the marriage annulled through her mother, the laws of Nevada not permitting a girl to marry at the age of 15 years without her mother's consent which had not been obtained. She was therefore, she wrote, at liberty to marry O'Neill and would meet him at Ogden.

On April 24, 1893, Mr. O'Neill landed at Ogden in company with A. F. Bray, Mr. Bray going there to attend the trans-Mississippi conference, and Mr. O'Neill to get married. Early on the moring of April 25, the woman arrived and at 10 o'clock that moring she was made Mrs. O'Neill by A. C. Bishop, probate judge of Weber County, Utah.

The couple came to Butte a few days later and took up their residence in the brick house at the southwest corner of Granite and Alabama streets.

Mr. O’Neill thought a great deal of his wife and gratified her every wish, except that he objected to her running around as much as she desired and objected very properly to her keeping company with parties of whom he did not approve. She complained sometimes of this censureship, and said that Desmond used to let her do as she pleased, but O'Neill insisted that she couldn't do it as his wife.

Six months ago a very pretty girl baby was born to which Mr. O’Neill became very strongly attached. He hired a girl to keep house so his wife would have nothing to do but take care of the baby. Mrs. O’Neill expressed herself as greatly taken with chicken incubators, and so Mr. O’Neill bought two incubators for her and they went to raising chickens. She soon tired of this, however, and Mr. O’Neill had to take care of the chickens himself. She occasionally asked him what kind of a place El Paso was, but Mr. O’Neill didn’t tumble.

A week ago yesterday Humphrey Desmond landed in Butte and proceeded to the brick house, where Mr. and Mrs. O’Neill were living. As soon as he gained admittance to the house he drew a revolver and kept it cocked straight at Mr. O’Neill. Mrs. O’Neill took the part of her first husband. She sat down on the edge of the bed, Mr. O’Neill sat in a chair opposite him with the gun pointed at him.

Mr. O’Neill’s shot gun was under the bed in plain sight and Mr. O’Neill eyed it wistfully, but couldn’t get to it. He suggested to Mr. Desmond that he could talk better if he could get hold of the shot gun, but Mr. Desmond had the drop on husband No. 2, and didn't propose to give up any advantage. Mr. Desmond insited that the wife and the baby should be surrendered to him. He also insisted that Mr. O'Neill should give the woman $250 to go to El Paso, and that he should give $50 each week for the support of the baby.

The alternative was that he must go to the penitentiary.

Mr. O’Neill replied that he had committed no offense, that he was regularly married to the woman, and that her marriage with Desmond had been annulled. Mr. O'Neill produced the marriage certificate.

Then Mrs. O'Neill, alias Mrs. Desmond, chipped in and said she had deceived O'Neill and that she had never been divorced from Desmond at all, was still his wife and intended to go with him. So Mr. O'Neill couldn’t do anything else but consent to the departure of his wife and baby. After learning what he had, he didn’t care so much about the woman, but he hated to part with the baby. The baby, however, was not yet weaned and so had to stay with its mother. The money propositions Mr. O'Neill would not consent to.

Last Sunday afternoon Mrs. O'Neill or Mrs. Desmond started on the Union Pacific train south with a ticket for Salt Lake City. Mr. Desmond started Monday morning for the same point on a freight, on which he could ride without cost, beign a railroad man. Undoubtedly they met in Salt Lake City and will go on to El Paso.

Since the departure of his wife and baby, Mr. O'Neill has learned that his wife for months had been keeping up a steady correspondence with Desmond, and the sensational arrival of Husband No. 1 was all carefuly planned. He also has learned that his wife had been consistently holding out money from him, and he estimates that she had saved up $700 for her elopement with her first husband.

Mr. O'Neill has evidently been the victim of a woman's duplicity, and is to be congratulated on getting well rid of the woman. The unfortunate part of the affair is that there is an infant daughter who may have to suffer in years to come for her mother's sin."

Burial record states she died in Hull 29 Oct. 1892 at age of 83. This would put birthdate at 1809. I believe this age at death is probably incorrect. This would make John O’Neill quite young when she was born. Also, it would make her 51 when she had her last child which is quite old. Once we find her gravestone in Hull, it may clear this up. Census records indicate a later birthdate.
January 1852 she will be 37 on her next birthday which would be 1816.
April 1861 she will be 44 on her next birthday which would be 1818.
April 1871 she will be 58 which would be 1814. The 1881 census is unreadable for age and I can’t find her in any 1891 census (looked through all of Hull, etc.).
My best guess is that she was born between 1814 and 1817 in Ireland.

Parents were John and Judith Neal of Gilbinstown (County Wicklow on the Kildare border) Significantly Wm. Duff was listed as the godfather along with Catherine Bagmer as godmother.
It appears that Anne and Bridget Neale are of the same family, and very possibly our family. Gilbinstown is only a few kilometers from Milltown where Bridget was baptized. Later records in Quebec list a child born about 1814 in Ireland as Elizabeth, not Anne. Could this be a clerical error by the priest or could she have been named Anne Elizabeth? No other children were baptized in this parish or in Dunlavin after 1817 with these parents listed and this lends credence that this is the family that then migrated to Quebec.4

This is somewhat confusing because in previous and future documents, there is no evidence that he lived in the 4th Concession, only in the 5th. The Census goes on to say that John has 1 male child, 2 female children, and 3 male servants. These servants are likely men that he has hired to help him clear the land. He owns a horse, 4 oxen, 6 cows and 4 cows and he has now cleared 30 acres on the 4th Concession and 2o acres on the 5th Concession.5

Includes: 30 minots of oats, 4 minots of peas, 60 minots of potatoes, 2 arpents sown in turnips, 16 arpents in timothy, 1/2 arpent each in hemp and flax. He has 3 cows, 2 pigs, and 1 gelding. He produced 100 minots of wheat, 400 minots of potatoes, 200 minots of turnips, 1000 bundles of hay and clover, 4 minots of carrots, and 500 lbs. of butter. He has peas in production but they are still green and have not been harvested.6
