Hugh McGratty, Priest, and David Lavallée, Farmer, and William Smith, Farmer, both of the Parish of St. Gabriel of Valcartier, witnesses requested for the effects of these presents, personally appeared Mrs. Mary Sullivan, widow of the late Frederick Kack, residing in the said Parish of St. Gabriel of Valcartier, who being of sound and disposing mind, memory and understanding hath requested us the said Notary to write down and receive in due form of law her last will and testament which she has declared in manner and form following, that is to say: 1º I desire that all my just debts, funeral and testamentary expenses be paid by my Executor hereinafter named as soon as possible after my death with an anniversary mass and the sum of eighty dollars for low masses. 2º I give and bequeath to my nephew Charles Kack, son of Charles Kack, the emplacement and houses, buildings & stable belonging to me and situate in the City of Quebec, Parish of St. Roch, corner of the streets King and Dominique to the charge to pay the sum of fifty dollars to his brother Frederick Kack, and the sum of twenty five dollars to his cousin John Kack of Valcartier and Sarah Ann Kack, wife of Richard Douglas, Daniel Kack and Joseph Kack, sons of Joseph Kack, twenty five dollars each; and Elizabeth Kack and Mary Ann Kack the sum of twenty five dollars each and Esther Kack, wife of Patrick Brophy, the said sum of twenty five dollars, payable the said sums in the year following my death. 3º I give and bequeath to my brother John Sullivan the sum of one hundred dollars, to my nieces Julia, Nora and Mary Ann McCarthy, daughters of Timothy McCarthy, my brother-in-law the sum of three hundred dollars each. 4º I give and bequeath to the Fabrique of Valcartier Catholic Church the sum of two hundred dollars. 5º I give and bequeath to Joseph McGrory the sum of five hundred dollars and the sum of one thousand dollars to his four children by equal share, Frederick Edward, Mary Jane, Ann and Catherine McGrory. 6º I give and bequeath to Martin Sullivan the sum of one hundred dollars and to his mother Elizabeth Sullivan the sum of one hundred dollars. 7º I desire that the rest and remainder of my money be divided by equal share between the following persons: Joseph McGrory, Frederick Kack, Charles Kack, Junior, & Esther Kack. My executors hereinafter mentioned will have two years to collect any money and to pay the said legacies but the sum due by Daniel Lavallée cannot be collected before five years. The interest on the sum given my said heirs mentioned will be three percent payable to the said heirs. I nominate, constitute and appoint Joseph McGrory and Charles Kack as Executors of this my will during two years. I revoke all wills and testaments I may have heretofore made and I declare the present to be my only true last will and testament. Done and passed at St. Gabriel of Valcartier under number eighteen hundred and twenty seven. And after the reading of these presents by the Notary to the Testatrix in presence of said witnesses, the Testatrix having declared her inability to sign her name by sickness has made her mark in presence of the witnesses and Notary and the Notary and witnesses have signed in the presence of the Testatrix and in the presence of each other. However, when she married in 1854, it stated she was a minor, which would make her at least 7 years younger (67 years). I have found evidence of only one child of hers and it died shortly after birth. Her husband predeceased her in 1894.5 |
