Proud “Momma” to 26 grandchildren and 28 great-grandchildren. Caring sister-in-law of Maureen Maher. Melita held a special place in her heart for the Hamilton family and was the surviving matriarch of the O’Neill and Booth families. She will be deeply missed by many nieces, nephews and extended family.

Special thanks to the excellent staff at the Grace Manor for their kind and compassionate care. On the thirteenth day of October one thousand eight hundred and forty one, I, John O’Neil undersigned being sick and weak in body but of sound mind, memory, and understanding and not knowing when it may please God to call me out of this world do make constituted and ordain this my last will and Testament in manner and form following to wit:

1st I bequeath my soul to Almighty God hoping that he will receive in his great mercy and forgive me my sins.

2nd I leave my body to the earth from whence it was taken hoping that my loving wife and children will give me a Christian burial.

3rd I leave all my immoveable property to my two sons Thomas and James O’Neil to be enjoyed together by them in common as long as they shall live together and if it happens that they separate, the landed property will be divided equally between them according to its value by two or three arbitrators; provided that my dear wife Judith Duffy be decently kept and supported by them as long as she shall choose to live with them, or if she wishes to live by herself, they will provide the following support for her as long as she lives, viz:

They will give her two acres of land upon which they will build a house and a stable; provide her with a cow which must be replaced in case of death and furnish fother or forage for her cow and cultivate her piece of ground. Moreover they will give her each of them yearly the sum of three pounds currency.

4th I leave all my stock of cattle and all my moveable property to my said two sons equally, on conditions that they will give to my daughter Sera O’Neil two cows and the foal I have at present at the time of her marriage and likewise two cows to each of my other daughters, Margaret and Catharine O’Neil at the time of their marriage; and if any of them do not marry I hope they will live in peace with their Brothers who will be obliged to furnish them with a home in case of sickness and take care of them accordingly.

5th My will is that the eight pounds which are due to John Wilson shall be paid on demand. I recommend all my children to be obedient and loving to their mother and agreeable among themselves and my eldest son Thomas is to be considered the conductor of affairs after my death and I recommend my other children to be submissive to him.

The above, I do declare to be my last will and testament which I have heard read and have signed in presence of the witness viz the Reverend H. Paisley, Ferdinand Murphy and James Donohoe who have also signed with me.

Done and passed in my dwelling home at Valcartier on the day and year aforesaid two words raized are null, two words in the margin are good.

My notes: Burial records, three weeks after the will was written, state that John was 48 years old. It appears that he was ill for sometime – since he had written the will three weeks before he died and at a relatively young age. Did he have consumption (tuberculosis)? When he died he left Julia, his wife, and seven surviving children, aged 11 through 27. The two eldest children, Elizabeth (married to John Wilson), and Bridget (married to Thomas Cassin) are not mentioned in the will presumably because they had already married and had husbands to care for them. The two boys, Thomas and James, who were left the land, were 21 and 18 when their father died. James sold his portion of the land to Thomas, five years later, in 1846. We have found James in Guelph, Ontario records by 1855. It is possible that he left Quebec after the land sale to find another type of work. Thomas, kept the land until 1864, he, his wife (Bridget Martin) and children and his mother, Julia, had relocated to Little River in 1863.

Before me, the Honorable John Buckworth Parkin, one of the Assistant Judges of the Superior Court for Lower Canada, personally came and appeared Ferdinand Murphy and James Donohoe, both of the Seigniory of St. Gabriel de Valcartier, farmers, who being severally and respectively duly sworn upon the Holy Evangelists of Almighty God do respectively make oath and say that they were personally present as witnesses to the execution of the Last Will and Testament of the late John O’Neill, hereunto annexed (sic), in his lifetime of St. Gabriel de Valcartier aforesaid, farmer, bearing date the thirteenth day of October in the year of our Lord one thousand eight hundred and forty one, and beginning with the words “on the thirteenth day of October, one thousand eight hundred and forty one” and concluding with the words “Done and passed in my dwelling home at Valcartier on the day and year aforesaid, two words raized are nul, two works in the margin are good”.

That the said late John O’Neill declared and acknowledged to deponents respectively that the signature “John O’Neill” at the foot of the said last will and Testament was his signature and the said signature was by the said John O’Neill signed in presence of deponents; that the signature “H. Paisley, Priest” is the signature of the Reverend H. Paisley since deceased and by him signed in presence of deponents and that the signatures “Ferdinand Murphy and James Donohoe” appended to the said last will and testament are in the respective handwriting of deponents, and by them signed in the presence of the said testator, of each other and of the said Reverend H. Paisley whose signatures were also appended in presence of deponents, to the said last will.

This is somewhat confusing because in previous and future documents, there is no evidence that he lived in the 4th Concession, only in the 5th. The Census goes on to say that John has 1 male child, 2 female children, and 3 male servants. These servants are likely men that he has hired to help him clear the land. He owns a horse, 4 oxen, 6 cows and 4 cows and he has now cleared 30 acres on the 4th Concession and 2o acres on the 5th Concession.4

He produced 100 minots of wheat, 400 minots of potatoes, 200 minots of turnips, 1000 bundles of hay and clover, 4 minots of carrots, and 500 lbs. of butter. He has peas in production but they are still green and have not been harvested.5

On the thirteenth day of October one thousand eight hundred and forty one, I, John O’Neil undersigned being sick and weak in body but of sound mind, memory, and understanding and not knowing when it may please God to call me out of this world do make constituted and ordain this my last will and Testament in manner and form following to wit:

1st I bequeath my soul to Almighty God hoping that he will receive in his great mercy and forgive me my sins.

2nd I leave my body to the earth from whence it was taken hoping that my loving wife and children will give me a Christian burial.

3rd I leave all my immoveable property to my two sons Thomas and James O’Neil to be enjoyed together by them in common as long as they shall live together and if it happens that they separate, the landed property will be divided equally between them according to its value by two or three arbitrators; provided that my dear wife Judith Duffy be decently kept and supported by them as long as she shall choose to live with them, or if she wishes to live by herself, they will provide the following support for her as long as she lives, viz:

They will give her two acres of land upon which they will build a house and a stable; provide her with a cow which must be replaced in case of death and furnish fother or forage for her cow and cultivate her piece of ground. Moreover they will give her each of them yearly the sum of three pounds currency.

4th I leave all my stock of cattle and all my moveable property to my said two sons equally, on conditions that they will give to my daughter Sera O’Neil two cows and the foal I have at present at the time of her marriage and likewise two cows to each of my other daughters, Margaret and Catharine O’Neil at the time of their marriage; and if any of them do not marry I hope they will live in peace with their Brothers who will be obliged to furnish them with a home in case of sickness and take care of them accordingly.

5th My will is that the eight pounds which are due to John Wilson shall be paid on demand. I recommend all my children to be obedient and loving to their mother and agreeable among themselves and my eldest son Thomas is to be considered the conductor of affairs after my death and I recommend my other children to be submissive to him.

The above, I do declare to be my last will and testament which I have heard read and have signed in presence of the witness viz the Reverend H. Paisley, Ferdinand Murphy and James Donohoe who have also signed with me.

Done and passed in my dwelling home at Valcartier on the day and year aforesaid two words raized are null, two words in the margin are good.

My notes: Burial records, three weeks after the will was written, state that John was 48 years old. It appears that he was ill for sometime – since he had written the will three weeks before he died and at a relatively young age. Did he have consumption (tuberculosis)? When he died he left Julia, his wife, and seven surviving children, aged 11 through 27. The two eldest children, Elizabeth (married to John Wilson), and Bridget (married to Thomas Cassin) are not mentioned in the will presumably because they had already married and had husbands to care for them. The two boys, Thomas and James, who were left the land, were 21 and 18 when their father died. James sold his portion of the land to Thomas, five years later, in 1846. We have found James in Guelph, Ontario records by 1855. It is possible that he left Quebec after the land sale to find another type of work. Thomas, kept the land until 1864, he, his wife (Bridget Martin) and children and his mother, Julia, had relocated to Little River in 1863.

That the said late John O’Neill declared and acknowledged to deponents respectively that the signature “John O’Neill” at the foot of the said last will and Testament was his signature and the said signature was by the said John O’Neill signed in presence of deponents; that the signature “H. Paisley, Priest” is the signature of the Reverend H. Paisley since deceased and by him signed in presence of deponents and that the signatures “Ferdinand Murphy and James Donohoe” appended to the said last will and testament are in the respective handwriting of deponents, and by them signed in the presence of the said testator, of each other and of the said Reverend H. Paisley whose signatures were also appended in presence of deponents, to the said last will.

On the seventh day of October in the year of our Lord one thousand eight hundred and forty-six, before us the undersigned Notaries Public duly commissioned and sworn in for that part of Canada heretofore Lower Canada and residing in the City of Quebec in the said province personally came and appeared and were present James O’Neill of the Parish of St. Gabriel de Valcartier, farmer of the one part; and Thomas O’Neill of the said parish of St. Gabriel de Valcartier, farmer of the other part. Which said James O’Neill for the price or consideration herein after mentioned did and doth hereby grant, bargain and sell, transfer, assign, convey and (?) ever with warranty against all debts, troubles, and encumbrances whatsoever unto the said Thomas O’Neill hereof accepting as follows That is to say, The undivided half or just motive of those certain lots or pieces of land situate and being in the Seigniory of St. Ignace in the environs of the River Jacques Cartier, containing six arpents in front more or less, by the line thus separating the Seigniory of St. Gabriel from that of St Ignace, by forty two arpents in depth more or less, towards the east forming all the depth of the said Seigniory St. Ignace bound on one side and to the north by unceded lands and on the other side to the south by Lawrence Mooney who did not take out any deed of concession, also another lot of land situate and being in the Seigniory of Saint Gabriel in the fifth concession being lot number twenty-two containing three arpents in front and thirty seven and a half thereabouts in depth more or less bounded on one side to the southwest in front by the line between the fourth and fifth concessions and to the northeast to the depth by the seigniorial line joining on one side to the southwest to lot number twenty one and on the other side to the northwest to lot number twenty three. And all the estate, right, title, interest, property claims and demand whatsoever both in law and in equity of himself the said James O’Neill in to and out of the said undivided half or Just Motive and premises above described being bargained and sold or intended so to be as to the whole now are without any exceptions of reserve and with all which the said Thomas O’Neill doth hereby declared himself as acquainted and satisfied having viewed and examined the same. The said undivided half lot of land and premises above described and bargained being in the environs of the Seigniory of St. Ignace and towards the same charged with the payment of the (cens et rents?) for which it may be held and warranted free and clear of all arrears of the said cens et rents to the current years and of all (?) to this day. To the said James O’Neill the said undivided half or just motive of the said land and premises above described, bargained and sold belonged unto said by virtue of a certain last will and testament of the late John O’Neill made and received before Hugh Paisley, priest, witnessed the thirteenth day of October in the year of our Lord one thousand eight hundred and forty one and the two described lots of land in virtue of two certain deeds of concession to him made and granted by the Honorable John Stewart both bearing the date the third day of April which was in the they year of our Lord one thousand eight hundred and twenty eight and passed before Notary R. Lelievre and other notaries.

To have and to hold the said undivided half of just motive of the said lots or pieces of land above described, bargained and sold as aforesaid or understood so to be together with all and singular the rights, members and appurtenances whatsoever there unto belonging or in any way appertaining unto the said Thomas O’Neill, his heirs and assigns to the only proper use and behold of the said Thomas O’Neill, his heirs and assigns hence forth for ever.

The present sale and conveyance is thus made and granted for and in consideration of the price or sum of sixty pounds current money of this province for and on account and in past payment whereof the said James O’Neill did and doth hereby acknowledge and confess to have received at and before the execution hereof the sum of fifteen pounds current money of this province receipt whereof is hereby acknowledged et dent quittance … and as to the sum or balance of forty five pounds current money aforesaid the said Thomas O’Neill did and doth hereby promise, bind and oblige himself to pay unto the said James O’Neill in two equal and yearly payments of twenty two pounds ten shillings said current money with the first payment whereof shall begin and be made on the first day of May which will be in the year of our Lord one thousand eight hundred and forty eight and the second and last payment in one year after this.

My Notes:
John had two surviving sons, Thomas, aged 26 and James, aged 23 at the time this document was written. Why is James selling his part of the inheritance? We know that in the early 1850s James moved to Guelph, Ontario and bought a hotel. It’s possible that he did not want to farm and hoped to live in a more populated area. It’s also possible that he left Quebec shortly after this document was written. There is a note on the document that states “Expedie a Mr. James O’Neill, 21st January 1850”. The first word is difficult to read but it is possible this was a French term for “sent to”.
Although the first piece of land mentioned in the document is not numbered, I believe it to be Lot #23, the lot that was supposed to be for John’s brother James, who it appears never made it from Ireland. The other piece of land was Lot #22 given to John when he arrived about 1819.6

Residence*1863Loretteville, Quebec County, Quebec, Canada; Thomas built this house (see pictures) and raised his family on the surrounding farm. The land was on the Charles River and is near the present day city of Quebec City. William Patrick, son of Thomas, inherited the house and he in turn willed the house to his son Jack, and he to his children. Four generations of the family lived in the house until 1991 when the house was bought by the city and is being restored as a historical site. The pictures include a recent photograph of the house and artist, Paul Giroux's rendering of the house in earlier times.
This information is from a translation of a Quebec City website: “Along the Saint-Charles River, stands the the O'Neill House, an old farmhouse that borders the Saint-Charles River, is a patrimonial jewel of the Les Saules district. One reaches it by a long alley bordered by tall American ash trees. It is located between motel establishments on Wilfrid-Hamel Boulevard West, just east of O'Neill Avenue.

As of the 18th century, on the northeastern part of the seigneurie of Sillery, farms were established along Little River Road, which connected Quebec to Ancienne-Lorette. The inhabitants would go to sell their products at the Quebec market. After the Conquest of 1739, several of these farms passed to Anglophones. In 1863, Thomas O'Neill, of Irish origin, acquired from Bridget Doblin and John Hearn, a farm on which there was a house, a barn and a stable. His new property extended from the river to the foot of the Sainte-Foy plateau.

O'Neill would have built the current house about 1863. It is a wooden Québécois house, similar to many of the country homes built in the Quebec City surrounding area, with a double-sloped roof and gables.

In the first half of the 20th century, the O’Neill’s become famous horse-trainers. At the south end of their property, Canadian Pacific trains regularly unloaded wild horses from the West. From 1863 to 1991, four generations of O'Neill’s lived on this farm. The property ceased to be a working farm upon the death of William Patrick O’Neill in 1947. As for the Little River Road, it became the national route #2 during the 1920’s and later, in the 1960’s, it became the current Wilfrid-Hamel Boulevard .

The City of Quebec acquired the O'Neill house and property in 1991 and turned it into a recreational park along the Saint-Charles River. The property remains a beautiful reminder of the past, where the farmers and the local village folk shared the many meandering river banks of the St. Charles.”

On this day the sixteenth of November in the year of our Lord one thousand eight hundred and sixty four, before us the undersigned Notaries Public duly commissioned and sworn for Lower Canada residing in the District of Quebec personally came and appeared Thomas O’Neill, farmer and Bridget Martin, his wife, by him duly authorized for the effect hereof, both residing in the Seigniory of Saint Gabriel, at the place called ValCartier, of the one part;

     And Joseph Harriet, of the same place, farmer, of the other part.

     Which said parties have covenanted and declared, promised and agreed to and with each other in manner following. That is to say; the said Thomas O’Neill and his said wife, authorized as aforesaid have and by these presents do sell, transfer, convey, assign and make over from henceforth and forever with warranty jointly solidairement one for the other and one of them for the whole, from all encumbrances, mortgages, dowers, debts, claims and demands whatsoever unto the said Joseph Harriet, accepting hereof purchased for himself, his heirs and assigns, that is to say. Firstly, a certain lot of land situate and being in the Seigniory of Saint Gabriel aforesaid in the fifth concession, being lot number twenty two, containing three arpents in front by thirty seven and a half arpents more or less in depth, bounded on one side to the southwest in front by the line between the fourth and firth concession and to the northeast, the depth of the Seigniorial line, joining on one side to the southwest to lot number twenty one and on the other side to the northwest to lot number twenty three. Secondly, another lot of land situate in the Seigniory of Saint Gabriel aforesaid in the fifth concession, being lot number twenty three, containing three arpents in front, by thirty seven arpents and a half more or less in depth, bounded to the southeast, in front by the line between the fourth and firth concession, to the northeast in depth to the Seigniorial line to the southeast by lot number twenty two herein first above described and to the southwest to a triangle, together with the house, barn and other buildings thereon erected and such as the whole now stands without any reserve whatsoever, the said purchaser declaring himself therewith satisfied, having viewed and examined the same.

     To the vendor belonging, the said above said and described two lots of land, part as having acquired by and in virtue of a certain deed of sale, consented to the said Vendor by James O’Neill, his brother, as appeareth by the deed thereof, executed at Quebec, before A.G. Cannon and colleague notaries, bearing date the seventh of October one thousand eight hundred and forty six and partly and in virtue of the last will and testament of the late John O’Neill, made and received before the Reverend Hugh Paisley and witnesses, bearing date the thirteenth day of October one thousand eight hundred and forty one and proved on the twenty seventh of November, one thousand eight hundred and fifty five.

     Being the said lots of land in the … of the domain of the Representatives of the late Order of Jesuits in Canada and toward them charged with such seigniorial rents, the exact amount whereof the parties could not ascertain.

     This present sale and conveyance is thus made subject to the payment by the said purchaser of such seigniorial rents which are now due and those which will become due, in future and for and in consideration of the price or sum of fourteen hundred dollars on account of which said sum the said Vendors, so hereby acknowledge and confess to have received from the said purchaser previous to the execution hereof the sum of seventy five dollars, in consequence whereof they hereby give and grant the said purchaser a receipt for so much, don’t Quittance d’ cuitant, and to the sum of thirty hundred and twenty five dollars, remaining due, the said purchaser doth hereby bind and oblige himself, his heirs and assigns at the following terms to wit; two hundred dollars in one year from the first of May next ensuing, two hundred dollars in two years from the said first of May next, two hundred dollars in three years from the first of May next, two hundred dollars in four years from the said first of May next, two hundred dollars in five years from the said first of May next, two hundred dollars in six years from the said first of May next, and one hundred and twenty five dollars for the full and perfect payment in seven years from the said first of May next and with interest thereon at the rate of six per centum per annum; said interest to be computed from the said first of May next and payable yearly, said interest to diminish in proportion to each payment.

     And for the security of the said sum of thirteen hundred and twenty five dollars remaining due and of the interest which will thereon accrue and become due the said purchaser doth hereby – Firstly, specially bind, oblige, mortgage and hypothecate the said above sold and described lots of land, the sum understood hereby expressly reserving all their rights and privileges of Bailleur de fondo.

     Secondly, the said purchaser doth hereby specially, bind, oblige, mortgage and hypothecate two certain lots of land being number five and six situation lying and being in the Seigniory of St. Gabriel aforesaid in the fifth concession, northwest of River Jacques Cartier, containing the said two lots together six arpents in front by thirty arpents more or less in depth, bounded in front by the River Jacques Cartier, and in the rear by ungranted land, on one side to the west by the property of Edward Brown on the other side to the east by Laurence Corrigan.

     And by these presents the two – Bridget Martin authored as aforesaid hath of her own free will and accord renounced as well for herself as for the children born or to be born of her marriage with the said Thomas O’Neill to all dowers and to all right of dowers whatsoever whether … or conventional or in virtue of any title whatever which she may or might have on the said above sold and described lots of land.

     To those presents personally came and appeared Judith Duffy, widow of the late John O’Neill, residing at ValCartier aforesaid which said Judith Duffy, after having taken communication and lecture was made to her, by Benjamin Lelievre, one of the undersigned notaries, of the foregoing deed of sale, which she declared well to understand, hath and doth hereby ratify, allow and confirm the same, being willing and agreeing that it be executed according to its full form, tenor and meaning, freely renouncing to all claims, pretentions and demands whatsoever she may or might have hand on the premises, therein described and sold and in consideration of the premises, the said Vendors do further cede, transfer, convey assign and make over all their right, title, interest, property, right of property claims and demands, whatsoever which they may or might have in to and over the said above sold and described lots of land and to and over every part and parcel thereof being willing and agreeing that the said purchaser his heirs and assigns do hold, use, occupy, possess and enjoy the same in full property from henceforth and forever and that he or they be put in good and lawful possession and investiture by and in virtue of these present. And for the due execution of these present the parties have made … of Domiciles at their actual residences at which place, thus promising, obliging, renouncing and ratifying.

     This done and executed in the District of Quebec aforesaid at ValCartier aforesaid, at the residence of the said vendors on the day and year first above written, under the number one thousand three hundred and six and the said vendors and purchaser have after the due reading, have signed with the said notaries having the said Judith Duffy declared that she could not write nor sign her name, but made her ordinary mark by a cross in faith and testimony of the promises.
