Before us the undersigned Notaries Public duly commissioned and sworn in and for the Province of Lower Canada and residing in the City of Quebec in the said province, personally came and appeared Timothy McCarthy of Ste. Catherine de Fossambault, farmer, who being apparently in good bodily health and of sound and perfect mind, memory and understanding requested us the said Notaries to write down and receive in due form of law, his last will and testament which he instantly made, published, dictated and named unto us the said Notaries in manner and form following:

I recommend my soul to Almighty God, hoping for a free pardon and remission of all my sins through the intersession of my Blessed Saviour Jesus Christ.

I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my Executor hereinafter named.

I give and bequeath unto my sons Denis McCarthy and Michael McCarthy my land and farm situated in the Parish of St. Catherine de Fossambault and known by lot Number sissy six in the Fourth Range and purchased by me from William Russell together with all and every other property moveable and immoveable, real and personal which I may die possessed of without any exception or reserve hereby instituting them the said Denis and Michael McCarthy my universal and residuary legatees, provided always that they the said Denis and Michael McCarthy shall allow Jane Mahony my wife if she should survive me, the undisturbed usufruct and enjoyment during her life only of all my said lands and property moveable and immoveable.

I appoint my said sons Denis and Michael McCarthy Executors of my present will and testament hereby revoking and making null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true last will and testament.

It was thus made, published, dictated and named word for word, dicté et nommé mot pour mot, by the said Timothy McCarthy, Testator, unto us the said Notaries and afterwards the said will and testament having been twice read, lu et relu, to the said Timothy McCarthy, Testator, by one of us the said Notaries, the other being present, he the said Testator declared that he had perfectly heard and understood the said will and testament and persisted therein conformable to his last will and intention.

Thus done and passed at Quebec in the office of Louis Panet one of us the said Notaries in Upper Town, St. Louis Street, where Jean Baptiste Trudelle, his confrere was called in for the purpose and assisted and was present all the time on the nineteenth day of October one thousand eight hundred and forty at two o'clock in the afternoon. The said Testator having signed these presents together with us the said Notaries after reading thereof as aforesaid in faith and testimony of the premises.

Four words erased are null. One marginal note approved is good.

On this thirteenth day of June in the year of our Lord One thousand eight hundred and eighty eight at the special insistence and request of Timothy McCarthy, a farmer residing in the Parish of Sainte Catherine, I, Édouard Antill Panet, the undersigned Notary Public duly commissioned and sworn in and residing and practicing in the Parish of Saint Raymond, in the Province of Quebec and Dominion of Canada accompanied by Michael Shea and Thomas Shea, both farmers residing in the said Parish of Ste. Catherine, the witnesses required by law, and expressly demanded by the said Timothy McCarthy for the purposes of witnessing these presents personally went and reported to the residence in the said Parish of Sainte Catherine of the said Timothy McCarthy, and there finding him ill in bed but of sound and disposing mind, memory, judgment and understanding as it appeared unto us Notary and witnesses from his words and actions, yet knowing and considering the certainty of death and the uncertainty of the time thereof, and being desirous of regulating his worldly affairs whilst yet he hath the strength left to do so, hath made, named and dictated unto us Notary in the presence of said witnesses, his last will and testament in the manner and form following:

1º I recommend my soul to Almighty God my Creator in the humble hope that he will receive the same to his favor through the merits and mediation of Jesus Christ our Lord and Saviour.

2º I will and order that all my just debts, funeral and testamentary expenses be first paid by my Executrix hereinafter named.

3º I will and order that my body be committed to the grave to be interred in a manner suitable to my station in life and according to the rites and solemnities of the Holy Roman Catholic Church and faith of which I am a member. I leaving it to by testamentary Executrix to fix and arrange the manner and expenses of my funeral.

4º I give, devise and bequeath to my well beloved wife Emily Falconbridge the whole of my property, moveable and immoveable real and personal, ready money, rights and actions, and other claims and pretensions which I may now have or which I may hereafter have without exception or reserve, wherever the same may be situate, to be by my said wife, used, enjoyed and disposed of in full property and ownership from and after the moment of my decease, hereby instituting her my universal residuary legatee and devisee in full ownership and Executrix of this my present last will and testament, hereby extending her power and authority as such Executrix beyond the day and year allowed by law and revoking all other wills and codicils by me heretofore made.

I hereby declare that the following immoveable properties form part of my estate -
Two lots of land situate, lying and being in the said Parish of Ste. Catherine in the Seigniory of Fossambault in the Fifth Range of the said Seigniory and now known and distinguished upon the official plan and Book of reference for the County of Portneuf and Parish of Sainte Catherine as lots official numbers three hundred and ninety five and four hundred (Nos. 395 & 400) with the buildings thereon erected.

It was thus named, dictated and nominated unto us said Notary in presence of said witnesses by the said Testator of his own free will and accord on the day, month and year first above written in the said Parish of Sainte Catherine in the residence of the said testator, who persisted herein after the reading thereof by the said Notary in his presence and in the presence of the said witnesses, as fully to embody and contain his last will and intentions.

Thus done and passed at Ste. Catherine aforesaid in the residence of the said Testator. In testimony whereof the said Testator both signed these presents with and in the presence of the said Notary and witnesses who have each signed with and in the presence of the said Testator and in the presence of each other, these presents bearing the number three thousand two hundred and sixty one of the official deed remaining of record in the office of the undersigned Notary.

Before me the undersigned Notary Public duly admitted, commissioned and sworn, residing at the parish of St. Ambroise de la Jeune Lorette in the Dominion of Canada in the Province of Quebec personally came and appeared Dame Agnes McCartney, spouse to the late Alexander Wright in his lifetime Farmer of the Parish of St. Gabriel of Valcartier, which said Agnes McCartney enjoying her mental faculties, memory, judgment, and understanding as it appeared to me the said Notary and the witnesses hereinafter mentioned by her discussion and proposals, and considering the certainty of death and the uncertainty of the moment thereof, has requested me the said Notary to receive her solemn will and testament which she has dictated to me word by word as follows, namely,

1º I recommend my soul to God Almighty and pray his Divine Mercy to forgive my sins and receive my soul in his heavenly kingdom.

2º I give and bequeath unto my son Robert Wright all my goods moveable and immoveable of which I may die possessed, whatever may be their nature and amount and in whatever place they may be situated, to have and to hold, after my decease, my said goods, moveable and immoveable as of them to him appertaining as as he thinks proper after my said decease, instituting him my universal legatee, at the charge of my said legatee to pay all my funeral expenses.

3º At the charge moreover to pay to Miss Janet Wright, my daughter, and to Mr. Alexander Wright, one of my sons, each the sum of two hundred dollars, in the course of the year after my said decease and without interest, and to feed and clothe them as long as they like to stay with him and no longer.

4º I name and appoint to execute my present will and testament, the person of my son Robert Wright, in the hands of whom I remit my said goods according to law.


For thus be dine and passed at St. Gabriel of Valcartier at the residence of the said Testatrix, under the number fifty two in the year of our Lord one thousand eight hundred and seventy four, the twenty first of August in the afternoon, and the present will and testament having been read to the said Testatrix, in the actual presence of Mr. Henry Ward and John Neil, both of the said Parish of St. Gabriel of Valcartier, farmers, witnesses to these presents, she declared to understand it ewell, comprehend and persisted and the said Testatrix being requested to sign, she did sign these presents with the witnesses and me the Notary according to the Law.

Four marginal notes are approved, fifteen words erased are null.

On the fourth day of February in the year of our Lord one thousand eight hundred and ninety two, at the request of Andrew McCartney of the Parish of St. Gabriel of Valcartier, farmer, I Cyrille Renaud Public Notary residing in the parish of St. Ambroise undersigned and Carl Nathanial Wolff, Farmer, and Curtis McBain, Grocer, of the Parish of St. Gabriel of Valcartier, witnesses requested for the validity of this last will we [went to] the house of Andrew McCartney which said Andrew McCartney being of sound and disposing mind, memory and understanding hath requested us, the said Notary and witnesses, to write down and receive in due form of law his last will and testament which he has declared in manner and form following, that is to say:

Firstly and principally, I most willingly resign my soul into the hands of Almighty God my Creator in the humble hope that he will receive it to his favour through the sole merits and intercession of Jesus Christ my Saviour.

Secondly, I desire that all my just debts, funeral and testamentary expenses be paid by my Executors hereinafter named as soon as possible after my death.

Thirdly, I give and bequeath all my moveables and immoveable properties to my wife Jeannet Wolff during her life time at the charge to return at the moment of her death the remainder of my properties to James Mingies Alexander McCartney my son and my wife will not be obliged to give security and I dispense her to make inventory. My said wife will have the power to sell and mortgage my properties but with the consent of Charles Jack and James McCartney, Farmers in the Parish of St. Gabriel of Valcartier.

Fourthly, I nominate, constitute and appoint the said Charles Jack and James McCartney and the survivor of them executors of this my will with power to sell and hypothecate with my wife my immoveable properties in the interest of my estate.

Fifthly, I revoke all wills and codicils I may have heretofore made and I declare the present to be my only true last will and testament. The present will was thus read by the said Notary to the said Testator in the presence of said witnesses who declared to understand it fully and persist therein.

Done and passed at the residence of said Andrew McCartney at St. Gabriel of Valcartier under the number five hundred & three of the minutes of the undersigned Notary and after the said reading the Testator, witnesses and Notary have signed in the presence of each other.

On the twenty sixth day of the month of September in the year of our Lord one thousand eight hundred and seventy seven, at the request of Mrs. Elizabeth McCartney, wife of Mr. John Hornby, of the Parish of St. Sauveur, I, the Public Notary went to the residence of the said Elizabeth McCartney, in the Parish of St. Sauveur, where I found her the said Elizabeth McCartney being sick of body but apparently sound of mind, memory and understanding who requested me the undersigned Public Notary to write down and receive in due form of law, her last will and testament which she instantly made and dictated unto me the undersigned Public Notary in the manner and form following, viz.,

1º I recommend my soul to the Almighty God, hoping for a free pardon and remission for all my sins and my body I commit to the earth to be buried in the cemetery, leaving the care of my funeral to my Executor.

2º I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my Executor hereinafter named.

3º I give and bequeath to my husband John Hornby, all my properties, possessions and effects, real and personal of whatever kind and wherever situated and all sums of money which I may leave at the time of my death and I institute the said John Hornby my universal legatee in full property, en pleine propriété, if he remains widower, but if the said John Hornby, my husband, is contracting a second marriage, then and in that case I give and bequeath to my children issued from my marriage with my said husband all my properties, possessions and effects real and personal which I may leave at the time of my death and I institute them, in that case, my universal legatees in full property, en pleine propriété.

And lastly, I do hereby nominate and appoint my husband, the said John Hornby, my sole Executor, and in hands of whom I divest and disseize myself of all my estate and property according to law.

And I hereby revoke and make null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true and last will and testament.

It was thus made, dictated and named by the said Testatrix to Mtre. Jos. Laurin, Public Notary, at the place aforesaid, in presence of Mr. Thomas O’Neill and Mr. Joseph Harris, both farmers of the Parish of Ancienne Lorette, especially demanded for and to the effect of these presents, and the present last will and testament having been read in full to the said Testatrix by the said Jos. Laurin, Public Notary, in the presence of the aforesaid witnesses, she the said Testatrix declared that she had perfectly heard and understood the same and found it to contain her true last will and intentions, therefore persisted therein, at the place aforesaid, on the day, month and year first above written under the number seven thousand five hundred and eighty.

And in faith and testimony of the premises, the said Testatrix has signed these presents in presence of the above witnesses and the said Public Notary, who have signed these presents in the presence of the said Testatrix and in the presence the ones of the others, these presents having been duly read according to law.

On the twenty second day of August in the year of our Lord one thousand nine hundred and two, at the request of Mrs. Ellen McCartney of the Parish of St. Foye, in the Province of Quebec, Canada, wife of Thomas Corrigan of that place, Farmer, I, John B. Parkin, of the City of Quebec, in the said Province, Notary Public, went to the residence of the said Ellen Corrigan, situate on the St. Louis Road in the said Parish, where I found her sick in body, but of sound mind, memory and understanding, when she declared that she was desirous of making her last will and testament, which she requested me to receive, and which I, in the presence of the witnesses hereinafter named, have reduced to writing as dictated by her in manner and form following:

First, I direct that all my just debts be paid and satisfied as soon as possible after my decease.

Secondly, I give, devise and bequeath unto the said Thomas Corrigan, my said husband, the use, usufruct and enjoyment of all the property, moveable and immoveable, real and personal, and of every other nature and kind soever of which I may be possessed at the time of my decease, or which I may be in any manner or way entitled to have clim or receive, to be by him held and enjoyed for and during his lifetime.

Thirdly, as to the ownership of my said property, I give, devise and bequeath the same to my three sons, Thomas, James, and Francis in equal shares between them to be held and enjoyed from and after the decease of their said father, thenceforth forever.

Fourthly, I name and appoint my said husband to be the sole Executor of this my present last will and testament, into whose hands I divest myself of all my said estate and property from and after my decease, whose power as such shall continue beyond the time limited by law.

I revoke all wills by me at any time heretofore made and I declare the present to contain my only true last wishes and intentions.

It was thus made, dictated and published by the said Testatrix to the said Notary in the presence and hearing of Patrick John Egan, Farmer, and Antoine Vezina, Lumber Merchant, both of the said Parish of St. Foye, as witnesses for the effect hereof; and after her present will had been read over to her by the said Notary in their presence, she declared to have perfectly understood the same and persisted therein.

Done and executed at the said Parish of St. Foye, at the residence aforesaid of the said Testatrix, to remain of record among the minutes of the said Notary under the number four thousand four hundred and seventy one, the said Testatrix having signed her present last will and testament in the presence of the said Notary and witnesses who have signed in her presence and in the presence of each other, according to law.
