On this thirteenth day of August in the year of our Lord one thousand eight hundred and ninety six, before me Cyrille Renaud Public Notary residing in the Parish of St. Ambroise of Jeune Lorette and Pierre Savard, Merchant, & Joseph Fournier, Carriage Maker, both of the Parish of St. Ambroise witnesses requested for the effect of these presents, personally appeared Thomas Dacres, Farmer, residing in the Township of Stoneham who being of sound and disposing mind, memory and understanding hath requested us the said Notary and witnesses to write down and receive in due form of law his last will and testament which he has declared in manner & form following, that is to say:

Firstly, I most willingly resign my soul into the hands of Almighty God my Creator in the humble hope that he will receive it to his favor through the sole merits and intercession of Jesus Christ my Saviour.

Secondly, I desire that all my just debts, funeral and testamentary expenses be paid by my Executrix hereinafter named, as soon as possible after my death.

Thirdly, I give and bequeath to my son Robert Conn Dacres my parts of the number (69) sixty nine of the Cadastral Plan of St. Edmond of Stoneham situated to the south of the Huron River, bounded to the north by the said Huron River, to the south by John McCune and to the east by Plamondon, to the charge to pay to my death the half of the hypothec and mortgage remaining due to Mistress John Conn the other half being payable to my other son Albert Thomas Dacres. And to the charge also to pay the sum of fifty dollars to Catherine Dacres wife of William McKee and to Margaret Dacres wife of James McCartney the sum of thirty seven dollars & fifty cents.

Fourthly, I give and bequeath to my beloved wife Mary Jane Conn the use, usufruct and enjoyment during the term of her natural life of the remainder of my moveable and immoveable properties, hereby constituting my said wife my universal usufructuary legatee but if she contract a second marriage she shall lose this usufruct.

Fifthly, I give to my son Albert Thomas Dacres the vue propriété of all my moveable and immoveable properties of which the usufruct is herein granted to his mother to the charge following: to pay half of the hypothec and mortgage remaining due to Mistress John Conn and to pay to his sisters Mary Jane, wife of Samuel Rourke, to Elizabeth Ann, Edith Gertrude, Rhoda Ma, to each the sum of thirty seven dollars and fifty cents. These last sums of money will be payable five years after the death of the Testator and also five years after the death of his wife without interest. The sum due to his two sisters by Robert Conn Dacres will be payable by installment of twenty five dollars by year to each of his sisters after the payment of the hypothec to Mistress John Conn without interest.

I nominate, constitute and appoint my wife Mary Jane Conn as Executrix of this my present will and testament. I revoke all wills and codicils I may have heretofore made and I declare the present to be my only true last will and testament.

The present will was thus declared by the said testator to the said Notary and by the said Notary, in presence of witnesses read to the testator who declared to understand it fully and persist therein.

Done & passed at St. Ambroise under Notarial Number eleven hundred and fifty one, and signed by the said testator and witnesses and the Notary and witnesses also hereunto subscribing in his presence and in the presence of each other.

On this twentieth day of March one thousand nine hundred and twelve, before the undersigned Notaries for the Province of Quebec, Canada, residing & practising in the City of Quebec, personally came & appeared, Mr. Thomas Dacres of the Parish of Beauport, Farmer, who has made as follows his last will and testament:

I give and bequeath to Ann Brown my beloved wife all the property, real and personal, moveable & immoveable which I may die possessed of to have and to hold the same by him in full ownership instituting her my universal legatee and sole Executrix of this my will.

Anything in the above clause to the contrary notwithstanding, my desire and will is that in the event of my said wife contracting a second marriage, then and in that case, she will have to account to my children, I mean that from the date of her second marriage my property will revert to my descendants.

I trust all together to my wife and my will is that no inventory of my estate be made necessary as a consequence of the above clause for my will is that no Curator to the above substitution be appointed.

This last will & testament received by Cy. Tessier Notary in the presence of Ernest Labrèque his colleague, having been read to the Testator by the first named Notary in the presence of his said colleague, he has declared well to understand the same as containing his last intentions.

Thus done and executed in the Parish of Beauport, residence of the Testator. These presents remaining of record in the office of Cy. Tessier one of the undersigned Notaries under number eleven thousand and forty nine of his records.

In witness whereof the Testator has signed together with and in the presence of the said Notaries who have also signed in the presence of the Testator and of one another after the reading done as above and according to law.

One marginal note good & two words erased null & void.

On this day the twenty fourth of January in the year of our Lord one thousand eight hundred and sixty five, I the undersigned Notary Public duly commissioned and sworn for Lower Canada residing in the District of Quebec at the request of Judith Dalton, widow of the late Thomas Landers, residing in the Seigniory of Saint Gabriel at the place called ValCartier in the County of Quebec, went to the residence of the said Judith Dalton situated at ValCartier aforesaid.

Where being in the presence of Michael Griffin of ValCartier aforesaid, farmer, and John Donaldson of the parish of St. Catherine, County of Portneuf, also farmer, witnesses here unto required for the purposes, the said witnesses signing with me the said undersigned Notary and from the said Judith Dalton, sick in bed, nevertheless, sound of mind, memory, judgment and understanding as appeared to me the said undersigned Notary and to the said above named and undersigned witnesses by her actions, discourse, and words.

And the said Judith Dalton considering the certainty of death and the uncertainty of the hour thereof, doth hereby publish, declare and dictate unto Benjamin Lelievre, the said undersigned Notary in the presence of the said above named and undersigned witnesses, her last will and testament in manner and form following. That is to say:

The said Judith Dalton recommends her soul to God, her Creator, when it shall please Him to dissolve her mortal body, hoping for a free pardon and remission of all her sins through the intercession of his blessed Son and Savior.

The said Judith Dalton doth hereby give and bequeath unto Mary Landers, her daughter, wife of Francis Conway residing at ValCartier aforesaid, all her moveable and immoveable property generally without any reserve whatsoever, debts, sum and sums of money whether due by bond, note of lien, obligation, covenant or otherwise.

The said Mary Landers, her said daughter, to have, hold, use, possess and enjoy the said moveable and immoveable property in full property from and after the day of the decease of the said Judith Dalton.

The said Judith Dalton directs that her body be buried at the discretion of her Executor hereinafter named and that a solemn grand mass be sung on the day of her burial.

The said Judith Dalton directs that all her just and lawful debts be paid by her son hereinafter named Executor.

The said Judith Dalton doth hereby nominate and appoint the person of Francis Conway, her son-in-law, of ValCartier, aforesaid, farmer, as Executor of this her last will whom she doth hereby request to render her this last act of kindness.

The said Judith Dalton doth hereby annul, cancel, objurgate, and make void all former wills which may have been heretofore made and executed by the said Judith Dalton.

Thus done, made and dictated word by word by the said Judith Dalton to the said Benjamin Lelievre, the said undersigned Notary, in the presence of the said above named and undersigned witnesses at ValCartier aforesaid at the residence of the said Judith Dalton, on the day and year, first above written, under the number one thousand three hundred and fourteen, and after having read and re-read the present last will and testament to the said Judith Dalton, which she declared well to understand, she hath persisted therein as being her last will and meaning having the said Judith Dalton declare that she cannot write nor sign her name, but made her ordinary mark by a cross in the presence of the said above named and undersigned witnesses who have signed with me the said notary in faith and testimony of the promises.

On the twenty second day of June in the year of our Lord one thousand eight hundred and fifty eight, before the undersigned Notaries Public residing in the City of Quebec, personally came, appeared and was present Mary Dalton, of the place called St. Gabriel de Valcartier in the County of Quebec, wife of John Woodlock, Farmer who being in good bodily health and of sound mind and understanding as to us appeared by her manner and conversation and considering the certainty of death and the uncertainty of its hour hath declared unto us the said notaries that she desired to make her last will and testament which she hath requested us the said notaries to receive and which we Edward George Cannon, one of the said notaries in the presence of Mtre. Philippe Huot, our confrere, have taken down as dictated to us by the same Mary Dalton word for word and as follows, viz.,

I recommend my soul to Almighty God hoping for a free pardon and remission of my sins through the intercession of my Blessed Saviour Jesus Christ.

I will and direct that all my just debts be fully paid and satisfied by me Executor hereinafter named.

I give and bequeath unto my beloved husband the said John Woodlock, all and every the property real and personal, moveable and immovable (without any exception or reserve) which I may die possessed of herein after instituting her said husband her universal legatee.

It was thus made, dictated and named by the said Mary Dalton unto us the said Notaries in the day and year above written, and the present Last Will and Testament having been read over and over again lu et relu au long to the said Mary Dalton, Testatrix, by Mtre. Edward George Cannon one of us the said notaries in the presence of the said Philippe Huot who was present all the time during the execution hereof the said Mary Dalton declared to have perfectly heard and understood the said Will and Testament and persisted in the contents thereof.

Done and passed at the said City of Quebec in the Office of Edward George Cannon one of the undersigned notaries in Donnacona Street in the Upper Town of the said City of Quebec, under the number three thousand four hundred and two, the said Mary Dalton Testatrix having signed these presents first twice duly read as aforesaid with us the said notaries in faith & testimony of the promises.

On this day, the sixteenth of December, one thousand eight hundred and eight seven, before the undersigned Notaries Public for the Province of Quebec, Canada, residing in the City of Quebec, personally came and appeared Mrs. Mary Dalton, of the Parish of St. Gabriel of Valcartier, widow of the late John Woodlock, in his life time of the same place, Farmer, who has made as follows her last will and testament.

I give, devise and bequeath to my son Michael Woodlock all the property real and personal, moveable and immoveable which I may die possessed of without exception, to have and to hold the same in full ownership, instituting him my universal legatee and I leave to him to fix and arrange the manner and expense of my funeral.

This last will and testament received by Cy. Tessier Notary in the presence of G.F. C. de Léry, his colleague, having read to the Testatrix by the first named Notary in the presence of his said colleague, she has declared well to understand the same and has persisted in the same as containing her last instructions.

At Quebec, office of the said Cy. Tessier, under the number seven thousand three hundred and seventy six of his records.

In witnesses whereof the said Notaries have signed in the presence of one another and the Testatrix who has declared not to know how to write her name, these presents having been previously read according to law.

Notes by Patricia Balkcom: Mary had written an earlier will in 1858 leaving all her possessions to her husband. She outlived him and wrote this will leaving everything to her son, youngest surviving son, Michael. Mary and her husband had 11 children, six of them predeceased Mary. Mary died almost 10 years (1896) after writing this will so it is possible there is an even later one.13
