On this day, the eighth of May one thousand eight hundred and forty six, before us the undersigned Notaries Public duly admitted and sworn in and for this part of the Province of Canada heretofore constituting the Province of Lower Canada, residing in the City of Quebec in the said province, personally came and appeared Lieutenant Colonel Alexander Joseph Wolff commanding the Second Battalion of Militia of the County of Quebec who being in good bodily health and of sound and perfect mind, memory and understanding did request us the said Notaries to receive and write down his last will and testament which he instantly made, published, dictated and named word for word unto us the aid Notaries in manner and form following:

I recommend my soul to Almighty God hoping for a free pardon and remission of all my sins through the intercession of my Blessed Saviour Jesus Christ.

I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my executrix hereinafter named.

I will and direct that immediately after my decease a lawful inventory of all the goods, chattels and property moveable and immoveable of and comprising the community or communauté de biens existing between myself and Hana Kasel Ehlert, my wife be taken and closed in due form of law and that after my decease the said Hana Kasel Ehlert my said wife do have and enjoy the whole of my property moveable and immoveable in usufruct during her natural life.

I give and bequeath unto Charlotte Mary Eliza Boles Wolff, my daughter, the usufruct during her life of all my right title and interest in that lot of land known as lot No. Thirteen in the First Range or Concession of the Township of Templeton, the same to go and to belong after her death to her children lawfully begotten to whom I give and grant the same in full and absolute property. I likewise bequeath unto Caroline Amelia Wolff, my daughter, the usufruct during her life of all my right and title and interest in the other lot of land known as lot Number Twenty in the same range of the said township of one hundred acres of land in superficie the same to go and to belong after her death to her children lawfully begotten - and should the said Charlotte Mary Eliza Boles Wolff and Caroline Amelia or either one or the other die without children as aforesaid, then and in such case it is my will and intention that the property or lot of land thus enjoyed by the deceased under and in virtue of my present last will and testament do fall back and revert to their then surviving brothers and sisters.

And after the decease of the said Hana Kasel Ehlert my said wife, I give and bequeath the whole of the rest and residue of my property moveable and immoveable unto my children James Fitzgerald Wolff, Jacob George Alexander Wolff, Alexander Arthur Wolff, Charles Stewart Wolff, the said Charlotte Mary Eliza Boles Wolff, the said Caroline Amelia Wolff, and Margaret Maria Wolff now wife of John Parker Esquire, to be divided between them share and share alike. Provided however that those of my said children who have already received certain sums of money or property in lands or otherwise as is established by the books, papers and documents in the possession of the family shall be found to compensate with my estate and succession and their other brothers and sisters for what they shall have received in advance that is to say de supporter ou moins prendre as the law directs in such cases.

But I wish it to be well understood that the particular legacies herein before made to my daughters Charlotte Mary Eliza Boles Wolff and Caroline Amelia Wolff and heir children are made exclusive of their respective shares in my estate and succession and without prejudice thereto.

Lastly I name and appoint my said wife Hana Kasel Ehlert executrix of this my last will and testament hereby revoking and cancelling all former wills and codicils at any time heretofore by me made and declaring the present to be my only true last will and testament.

It is thus made, dictated and named word for word by the said Alexander Joseph Wolff, Testator, unto us the said Notaries and after wards the said will and testament having been read over and over again lu et relu to the said Testator by one of us the said Notaries the other being present, he declared that he has perfectly heard and understood the same and found it to contain in every respect his true last will and intention & therefore persisted in the contents thereof.

Done and passed at the City of Quebec in the day and year above written in the office of Louis Panet one of the said Notaries where he undersigned his colleague attended for the purpose and was present all the time - the said Alexander Joseph Wolff Testator having signed these presents first twice duly read aforesaid.

Three words erased are null. One marginal note approved is good.

On this second day of December in the year of our Lord one thousand eight hundred and ninety five, before me Cyrille Renaud, Public Notary, residing in the Parish of St. Ambroise undersigned, personally appeared Caroline Amelia Wolff, widow of Thomas Billing, residing in the Parish of St. Gabriel of Valcartier, Farmer, who being of sound and disposing mind, memory and understanding hath requested us the said Notary to write down and receive in due form of law her last will and testament which she has declared in manner and form following, that is to say:

Firstly and principally, I most willingly resign my soul into the hands of Almighty God my Creator in the humble hope that he will receive it to his favor through the sole merits and intercession of Jesus Christ my Saviour.

Secondly, I desire that all my just debts, funeral and testamentary expenses be paid by my executor herein after named as soon as possible after my death.

I desire that the amount of one hundred and thirty two dollars or about being the balance or remaining of my property will be divided as follows:

I. I give and bequeath the sum of thirty dollars to my son Curtis Billing.
II. I give and bequeath the sum of five dollars to Carolina Thompson, daughter of George Thompson of Valcartier and the sum of five dollars to Jane McCoubray, daughter of Frances Patton.
III. I give and bequeath to William James Billing my son and his wife Jannet Billing, by equal share the balance or remainder of said sum of one hundred and thirty two dollars and I declare that all my other moveable and immoveable properties are given by a Deed of Donation to the said William James Billing before J.B. Delage the 7th November 1891.

I nominate, constitute and appoint the said William James Billing Executor of this my will.

I revoke all wills and codicils I may have heretofore made and I declare the present good for the said sum of one hundred and thirty two dollars.

The present will was thus declared by the said testatrix to the said Notary in presence of Arthur Wolff and Joseph Martin, both farmers of Valcartier, witnesses requested for the effects of these presents, read to the said testatrix in presence of said witnesses who declared to understand it fully and persist therein.

Done and passed at Valcartier under Notarial Number one thousand and forty two. And signed by said Testatrix with and in the presence of said Notary and witnesses also hereunto subscribing in his presence and in presence of each other, after due reading hereof.

On the twenty first day of the month of April in the year of our Lord one thousand eight hundred and seventy four, personally came and appeared in the residence of Mtre Jos. Laurin, Notary in the Parish of Ancienne Lorette, Mrs. Charlotte Wolff, widow of the late William Aikens, of the Parish of St. Gabriel of Valcartier, who being apparently sound of body and mind, memory and understanding requested me the undersigned Notary to write down and receive in due form of law, her last will and testament which she instantly made and dictated unto me the undersigned Notary in the manner and form following, viz.,

1º I recommend my soul to the Almighty God, hoping for a free pardon and remission for all my sins and my body I commit to the earth to be buried in the cemetery, leaving the care of my funeral to my Executrix.

2º I will and direct that all my just debts be fully paid and satisfied out of my estate and property by my Executrix hereinafter named.

3º I give and bequeath to any child not now born, all my properties, possessions and effects, real and personal of whatever kind and wherever situated, and all sums of money which I may leave undisposed of, and I institute my child not now born my universal legatee in full property, en pleine propriété, and in case of decease of my child before the age of majority, I give and bequeath to my sister Anna Wolff all my properties of whatever kind and wherever situated and sums of money which I may leave undisposed of at the time of my death and I institute herself my universal legatee in full property, en pleine propriété.

And lastly, I do hereby nominate and appoint my sister, Anna Wolff, my sole Executrix, and in hands of whom I divest and disseize myself of all and every my estate and property according to law.

And I hereby revoke and make null and void all other wills and codicils at any time heretofore by me made, declaring the present to be my only true and last will and testament.

It was thus made, dictated and named by the said Testatrix to Jos. Laurin, Notary, at the place aforesaid, in presence of Mr. Thomas O’Neill and Peter Johnston, both farmers of the Parish of Ancienne Lorette, especially demanded for and to the effect of these presents, and the present last will and testament having been read in full to the said Testatrix by the said Jos. Laurin, Notary, in the presence of the aforesaid witnesses, she the said Testatrix declared that she had perfectly heard and understood the same and found it to contain her true last will and intentions, therefore persisted therein, at the place aforesaid, on the day, month and year first above written under the number six thousand eight hundred and fifty six.

And in faith and testimony of the premises, the said undersigned Notary and the witnesses above named have signed these presents, the said Testatrix having declared that she could not write nor sign her name, these presents having been duly read according to law.

Note by Patricia Balkcom: From this Will, we can assume that Charlotte was pregnant when her husband died on October 21, 1873 and that the child was unborn when she wrote the Will. She and William had only been married sixteen months when he died so it appears that they had no other children. From the 1891 Census, it seems that Charlotte had a daughter born in 1874. She had remarried in 1882 to Ferdinand McClory and they had two children. It is very possible that there is a later Will for Charlotte. Ferdinand predeceased her in 1914 and she died on October 18, 1919 in Sherbrooke, Que.4
