On the eighteenth day of September in the year of our Lord one thousand eight hundred and fifty five, before us the undersigned Notaries Public duly commissioned and sworn in and for that part of the Province of Canada, heretofore called Lower Canada, residing in the City of Quebec personally came and appeared Margaret Bethel of the place called St. Gabriel of Valcartier, widow of the late John Delaney, who being in good health of body and of sound and disposing mind, memory and understanding, bless the Almighty God for the same, hath declared unto us the said Notaries that considering the certainty of death and the uncertainty of the time hereof, therefore she wished to make, publish and declare her last will and testament and accordingly she did make, publish declare and dictate the same word for word unto us the said Notaries in manner following:

1st the Testatrix doth recommend her soul unto the hands of Almighty God her Creator and her body she commits to the earth to be interred in a manner suitable to her condition at the time of her decease.

2nd the Testatrix doth will that her just debts & funeral expenses be fully paid and satisfied by her Executor hereinafter named as soon as conveniently may be after her decease.

3rd the Testatrix to recompense and give a mark of her gratitude to Maria Delaney, her daughter dwelling now with her for the love, attention and care that she bears towards her the said Testatrix, the said Testatrix doth give and bequeath unto her the said Maria Delaney her said daughter half of a certain lot of land situated at the above said place of St. Gabriel of Valcartier being the Lot Number Thirteen in the Fourth Range together with half of the house, barn, stable and other buildings thereon erected, and also the said Testatrix doth give and bequeath unto the said Maria Delaney her said daughter all and singular the moveable property or articles, household furniture, ready money and all other effects and things belonging to the said Testatrix at the time of her decease of what nature and kind the same may be to have and to hold the same by the said Maria Delaney as her own property from the time of the decease of her the said Testatrix who hereby institutes the said Maria Delaney her universal and residuary legatee for such is her true last will and testament, the said Testatrix annulling and cancelling all other former will and codicils she may have done before these presents.

And lastly, the said Testatrix for the execution of her present last will and testament doth hereby nominate and appoint Andrew Sweeney of the City of Quebec, Shoemaker.

Thus done, dictated and named by the said Testatrix to Alexandre Benjamin Sirois one of the undersigned Notaries, his colleague being present, and the present last will and testament having been read and read over again to the said Testatrix by one of the said Notaries, the other being present, she the said Testatrix persisted in the same in the City of Quebec in the office of the said Alexandre Benjamin Sirois, on the day and year first above written, under the number five thousand two hundred and thirty five and the said Testatrix being requested to sign her name hath declared not to know how to write or sign her name and the said Notaries signed in faith and testimony of the premises.

Notes by Patricia Balkcom: Margaret died 12 years later on the 28th of July 1867 at about 80 years old. She and John Delaney had nine known children, Maria, was the youngest.7

Deposition of William Bethel and Edward Sweeney and others for the Peace:
District of Quebec

The deposition of William Bethel of the place called ValCartier, cordwainer, taken at the city of Quebec the first day of December 1824 before me John Thompson, Esquire, of His Majesty’s Justice of the Peace for the District of Quebec.
Thus said William Bethel being duly sworn maketh oath -
That on the 29th day of November last this deponent being in company with one John Emery the elder, and John Emery the younger, on the road in the Settlement of Valcartier, one Edward Swiney (sic) one, and John Swiney (sic) two also settlers of that place, did violently threaten to hurt the deponent, and called upon him to fight them - using at the same time much violent and opprobrious language against the Peace. And the deponent further states that at several times before the 29th day of November above mentioned, the said John Swiney and the said Edward Swiney have behaved to the the deponent with similar violence having called upon him to fight and threatened to beat him. And the deponent further saieth that on Sunday the 21st of November last one Daniel Swiney, brother of the said Edward and John, meeting the deponent on the road in or near (?) did in like manner violently threaten to do some bodily hurt to the deponent and that ...? the deponent is in fer that the said Edward Swiney and the said John Swiney and the said Daniel Swiney will do unto him this deponent some bodily hurt against the Peace.

BE IT REMEMBERED that on the fourteenth day of December in the fifth year of the Reign of our Sovereign Lord George The Fourth, by the Grace of God of the United Kingdom of Great Britain and Ireland King, Defender of the Faith, came before me Robert J. Entimawille Esquire, one of the Justices of our said Sovereign Lord the King, assigned to keep the Peace within the Said District. Edward Sweeney of Valcartier, yeoman, and William McCloughty of the same place, yeoman, and Owen McKenna of Quebec, shopkeeper and acknowledged themselves to owe to our said Sovereign Lord the King, to wit: the said Edward Sweeney the sum of twenty Pounds sterling and the said William McCloughty and Owen McKenna the sum of ten pounds sterling each, to be respectively made and levied of their several goods and chattels, lands and tenements to the use of our said Sovereign Lord the King, his Heirs and Successors, if the said Edward Sweeney shall fail in performing the condition underwritten.

THE CONDITION of this Recognizance is such, that if the above bounden Edward Sweeney shall keep the Peace and be of good behaviour towards Our Lord the King and all his liege people, and especially towards William Bethel of Valcartier, yeoman, for the space of six calendar months next ensuing; then the said Recognizance shall be void, but otherwise shall remain in full force and virture.

Mr. Denis Cassen
You are served with this Process, to the intent, that you may appear either in person of by attorney in His Majesty’s Court of King’s Bench for the District of Quebec, at the return thereof, being the first day of October next in order to your defence in this action. Dated the 17 day of September, 1829.

Land was occupied by Michael Cassen ??? father and any agreement was with him.
Pltf. Was to have left ??? and receive ??? and pounds rent. ???? were not left. James ??? witness.
Subsequently agreed to leave the land rent free for the 2 years in consideration of improvements.
Agreed to ??? all parties for 200 bushels of potatoes. John Abraham, witness (no.1), George Bethel (no.2)

To the Honorable the Justice of His Majesty’s Court of King’s Bench of and for the District of Quebec, William Bethel of the Place or Settlement called Val Cartier in the County and District of Quebec, Farmer complaining of Denis Cassen of the same place also Farmer by this his Declaration doth humbly represent that whereas the Said William Bethel before and at the time of the making of the promise and undertaking of the Said Denis Cassen hereinafter mentioned was lawfully possessed as of his own property. The same unto him the Said William Bethel of right belonging and appertaining under and in virtue of the sale thereof to him made by deed executed at the City of Quebec on the twenty-second day of January one thousand eight hundred and twenty-four by Harris Heny (sic) (believe this to be Harris Haney) of Quebec, aforesaid Farmer before Campbell and (confrere?) things, to wit, of a certain other Land and Concession in the Fief or Seigneury of St. Gabriel aforesaid in the District of Quebec aforesaid being that of Lot Number three on the North West of the Concession of Messieurs Neilson and Stuart on the North West side of the River Jacques-Cartier consisting of three arpents in the front by about nineteen arpents and six perches in depth, bounded on the South West in front by the line between the third and fourth concessions on the North East in depth by the River Jacques-Cartier on the South East side by lot number two and on the North West side by Lot number four in the said fourth Concession, and thereupon, heretofore, to wit, on the thirtieth day of April in the year one thousand eight hundred and twenty-six, at Valcartier aforesaid, in consideration that the Said William Bethel, at special instance and request of the Said Denis Cassen, would then and there let and demise to him the above

described lots of land, buildings, and appurtenances, he the Said Denis Cassen then and there undertook and faithfully promised the Said William Bethel to pay him rent for the same at and after the rate of twenty one pounds lawful current money of this Province yearly and every year, and the Said William Bethel confiding in the Said promise and undertaking of the Said Denis Cassen did then and there to wit on the day and year last aforesaid lot and demise the Said two lots of land, buildings and appurtenances and the Said Denis Cassen who thereupon entered and from thence until the first day of May in the year one thousand eight hundred and twenty eight continued to hold the same by virtue of such demise by reason of which Said several premises he the Said Denis Cassen became liable to pay to the Said William Bethel the sum of forty two pounds lawful current money aforesaid

and the Said William Bethel further complaining of the Said Denis Cassen doth further humbly represent that the Said Denis Cassen to wit on the first day of May one thousand eight hundred and twenty eight at Valcartier aforesaid was indebted unto to the Said William Bethel in the sum of forty two pounds lawful current money of this Province for the use and occupation from the first day of May in the year one thousand eight hundred and twenty six until the first day of May one thousand eight hundred and twenty eight at and after the rate of twenty one pounds per annum of rent for the same to wit of two certain other lots of land, with the buildings and appurtenances , bounded, XXXX as follows, to wit a land and concession lying and being in the Seigneury of St. Gabriel, District of Quebec being lot No two on the North West of the tract and Concession

Cassen in consideration thereof afterwards XXXX on the day and year aforesaid at Valcartier aforesaid undertook and faithfully promised the Said William Bethel to pay him the Said sum of forty two pounds current money aforesaid when he the Said Denis Cassen should be thereunto afterwards requested.
Yet the Said Denis Cassen not regarding his Said several promises and undertakings hath not faithrully often requested paid the Said several sums of money or either of them, or any part thereof but the same to pay hitherto hath and still doth refuse to the damage of the Said William Bethel eighty four pounds lawful current money aforesaid.

All which Allegation the said Plaintiff doth hereby ave….and well founded in fact and in law, and the same will verify…..maintain when and as this Honorable Court shall direct.
WHEREFORE, the said Plaintiff pray the Process….honorable Court, and that the same issue to compel the said Defendant ….be and appear in this Honorable Court, on Thursday, ….first day of October next…to answer unto the said Plaintiff of the Demands contained …declaration, and that for the Causes aforesaid, by the Judgments of the Honorable Court, the said Defendant may be then and there adjudged and condemned to pay and satisfy to the said Plaintiff the said Sum of eighty four pounds lawful current Money aforesaid, with legal Interest and costs of Suit.

Personally appeared this fifteenth day of August in the year of our Lord one thousand eight hundred and thirty six, before me the undersigned one of His Majesty’s Trustees assigned to keep the peace within the District of Quebec.
David Davidson, farmer Val Cartier, who being duly sworn upon the Holy Evangelists of Almighty God doth declare, depose and say as follows, to wit that on the fourteenth day of August now instant at the aforesaid Settlement of Val Cartier, he was violently assaulted, severely struck and beat and kicked by William Bethel and Thomas Daleny of foresaid Settlement without provocation or cause and against the Peace of our Lord the King. Further the depondent saith not and hath signed the above.

On the twenty fifth day of January in the year of our Lord one thousand eight hundred and sixty, at the request of Mr. William Bethel of the City of Quebec, boot and shoemaker, the undersigned Notaries Public duly commissioned and sworn residing at the City of Quebec in the Province of Canada went to the residence of the said William Bethel, situate in St. John Street in the Upper Town of Quebec and then and there being we found the said William Bethel lying on a bed sick of body but of sound mind, memory, judgment, and understanding as appeared unto us the said Notaries from his manner and conversation who declared unto us that considering the certainty of death and the uncertainty of the hour thereof he was desirous of making his last will and testament which he accordingly requested Fisher Langlois one of us in the presence of Notary Henry Charles Austin, his colleague, to receive and reduce into writing word for word as follows, that is to say:

Firstly, I will and direct that all my just and lawful debts be paid and satisfied as soon as possible after my decease.

Secondly, I give, devise and bequeath unto my mother Bridget Kernerny, widow of the late William Bethel, the annual life rent of thirty five pounds to be paid her half yearly out of my estate during her natural life.

Thirdly, I give, devise and bequeath the whole of my property estate and effects whatsoever, real and personal, moveable and immoveable in whatever the same may consist and wherever situate being or to be found, to my brother Edward Bethel now residing in Syracuse in the United States of America in full and absolute property subject however to the payment by him of the aforesaid life rent to my mother, but should my estate not shew sufficient asset to represent a capital sufficient to meet the said rent in such the said life rent shall be reduced to an amount equal to the interest at the active of my said estate at the rate of six percent per annum. To have and to hold the said several legacies to the several parties above named in manner aforesaid.

Fourthly, I hereby revoke all other wills and codicils by me at any time heretofore made declaring these presents alone to contain my last will and intentions. Note by Patricia Balkcom: William died two years later in December, 1861 at the age of 33. He was a master shoemaker. He had married Emma Thompson six months after this will was written, so it is possible that a later will may be found. It also appears that he may have had a chronic illness. William had at least seven siblings, of which at least four predeceased him at very young ages.

They arrived in Canada in the spring of 1836.
The birthdates of the children were given. There is no mention of son, Charles, who was born in 1820. He would have been 16 years old when the family left Germany. It's possible that he joined them in Canada later as he married Johanna O'Keefe there in 1854.1

On this nineteenth day of August one thousand nine hundred and four, before me Cyrille Renaud Public Notary residing in the Parish of St. Ambroise of Jeune Lorette personally appeared Catherine Billing, wife of David McKinley, residing in the Parish of St. Gabriel of Valcartier, Farmer, who being of sound mind and disposing mind, memory and understanding hath requested us the said Notary and witnesses to write down and receive in due form of law her last will and testament which she has declared in manner and form following, that is to say:

1º I desire that all my just debts, funeral and testamentary expenses be paid after my death as soon as possible by my executor hereinafter named.

2º I give and bequeath to my son John Joseph McKinley all my moveable and immoveable properties wherever the same may be found and to whatever the same shall amount hereby constituting my said son John Joseph McKinley my universal legatee. To the charge by the said John Joseph McKinley to pay to is brothers and sisters the sums following:
-1º To David McKinley, the sum of one hundred dollars one year after my death.
-2º To Andrew McKinley the sum of one hundred dollars one year after David.
-3º To Francis McKinley the sum of fifty dollars one year after Andrew.
-4º To Alice fifty dollars to one year after [Frances].
-5º To Mary Marguerite the sum of fifty dollars one year after Alice.
-6º To Susan the sum of fifty dollars one year after.
-7º To Curtis McKinley the sum of fifty dollars if he comes back one year after Susan.
-8º If David McKinley bought a land and that he needs a horse, John Joseph shall be obliged to give him a horse of about one year old.

3º I nominate, constitute and appoint my son John Joseph McKinley my universal legatee and testamentary executor.

4º I revoke all will and codicils I may have heretofore made and I declare the present to be my only true last will and testament.

Dane and passed at St. Ambroise under Notarial Number two thousand seven hundred and seventy four. And after the reading of the said will to the Testatrix by said Notary in presence of Pierre Joseph Abias Savard, Merchant & Ludger Roy, Blacksmith, both of the parish of St. Ambroise, witnesses requested for these presents, the Testatrix, the Notary and witnesses have signed with me, Notary.

On this twelfth day of July in the year of our Lord one thousand eight hundred and ninety nine, before me Edward O'Brien, Notary Public, residing in the Parish of Beauport, the undersigned and in presence of Messrs. Thomas Brown, Farmer of Valcartier, and Joseph Vezina, Gardener of the Parish of Ange Gardien, witnesses purposely called, and also undersigned, personally came and appeared Mr. Curtis Billings, Farmer, residing in the Parish of Beauport, who being of sound mind, will, memory and understanding, as appeared unto us the said Notary and witnesses, hath made, dictated and named unto me, the said Notary, in presence of the said witnesses, his last will and testament, as follows:

I recommend my soul to Almighty God, my Creator, entreating him through the merits of His Blessed son, my Saviour Jesus Christ for a free pardon and a remission of all my sins and offenses, my body I commit to earth to be interred in a descent and respectable manner.

I give, devise and bequeath unto my son Curtis John Billings, the sum of three hundred dollars & one cow or twenty dollars, to my daughters named Mary Alice Billings, wife of Herbert Wolff of Charlesbourg, the sum of forty dollars and to each of my other daughters namely Anne Charlotte Billings, Caroline Louise Billings, and Emily Frances Billings, the sum of one hundred dollars to be paid to the above named as follows: to my son Curtis John Billings, three hundred dollars & the cow as soon as he purchases a farm in his own name or intends making an advantageous use of his money according to the Codicil of his mother. The girls’ shares of one hundred dollars and forty dollars, payable to them after my death if I have not paid them myself before. But Caroline Louise Billings and Emily Frances shares of one hundred dollars to be paid to them at the time of their majority respectively. The interest on the above sums of money to be paid to my said children above named from the day of my death, my Executor to place the money I have in the Bank in the names of my said children in the proposition above mentioned should I not do so myself while I am living. As to the residue of all my property either moveable and immoveable, real or personal, of which I may die possessed of, I give, devise and bequeath the same unto my son Walter Billings, Farmer, of Beauport to have and to hold the same in full and entire property at and from the day of my death constituting him my universal and residuary legatee and appointing him the Executor of this my last will and testament. My son the said Walter Billings shall be bound to keep in his house, feed and clothe his brother and his sisters above named as long as they wish to remain, provided they work for him according to their sex and capacity, as they are now doing. I hereby specifically revoke all former wills & codicils I may have made before this my last will and testament, to which alone I adhere as containing my last intentions & will.

It was thus done, dictated and named by the said Testator to me the said Notary, in presence of the said witnesses, at the residence of the said testator on the day, month and year first above written, under the number seven thousand nine hundred and twenty four, of the minutes of the undersigned Notary. In faith and testimony whereof the said Testator hath signed with the said witnesses and the said Notary. The said witnesses having been all the time present. The said Testator and witnesses and the said Notary signing in the presence each one of the other, after the reading of the said will and testament after fulfilling all the requirements of the law.

On this day the fifth of July in the year of our Lord one thousand eight hundred and seventy eight,

Before the undersigned Notary Public, for the Province of Quebec, in the Dominion of Canada, residing at the parish of St. Ambroise of la Jeune Lorette and the witnesses herein after named and subscribed,

Personally came and appeared Mr. Arthur McBain Senior, of the parish of St. Gabriel of Valcartier, in the County of Quebec, farmer, who being in weak bodily health, but of sound mind, memory, and understanding as to us appeared by his manner & conversation, hath requested of us the said Notary to receive and reduce into writing this his Last Will and Testament which the said Notary in the presence of the said witnesses have taken down as dictated to us the said Arthur McBain word for word and as follows, that is to say:

Iº I recommend my soul to God asking him the everlasting beatitude by the merits of Jesus Christ, my Saviour.

IIº I wish & direct that my internment & the manner thereof shall be according to the direction of Executors herein after named.

IIIº I wish that my just and lawful debts shall be paid & satisfied with my property moveable and immoveable with which I hereby charge my said Executors herein after named.

IVº I do hereby give and bequeath unto Elizabeth Billings, my wife, all and every my property moveable and immoveable, all sum and sums of money that I may possess of the day of my decease instituting her, my said wife, my universal "legatee en propriété" and to be completed from the day of my decease as the condition that my wife never get married again in the case of that said marriage of my said wife Elizabeth Billing, all my said property, moveable and immoveable will be equally divided between my children named as follows: Mary Ann, John Joseph, Agnes, Arthur, Thomas and nothing to David and Curtis McBain on account of having received their shares already.

And for the execution of the present my Last Will and Testament I do hereby nominate and appoint Messr. Thomas Brown and Curtis Billings, both of the Parish of Valcartier, farmers, in favor of whom I do in conformity to the law & custom of this Province disseize and divest myself of all my property for the ends hereof, hereby revoking all other wills and codicils and testaments that I may have made prior to the present my Last Will and Testament to which alone I do adhere as my true instructions and last will.

Thus done and dictated word for word & published & declared by the said Testator, Arthur McBain, for & as his Last Will and Testament to and in the presence of the said Notary and Frederic Logie Tweddle and Frederic Lainez, witnesses expressly called and required for the effect hereof, in the day and year as above written under the number three hundred and forty one of the Minutes of the said Notary.

In faith and testimony whereof the said Testator, Arthur McBain, has signed his name when requested so to do in the presence of the said Notary & the said witnesses who have hereunto set & subscribed their respective names & signatures after due reading of these presents.

On this twenty sixth day of March, one thousand nine hundred and twenty one. Before one Cyrille Renauld, Notary, residing in Loretteville, undersigned personally appeared Mrs. Elizabeth Billing, wife of John Leady residing at St. Gabriel de Valcartier, farmer, who being of sound and disposing mind, memory and understanding hath requested us the said notary and witnesses to write down and receive in one form and have her last will and testament which she has declared in a manner and form following that is to say –

Firstly: I most willingly resign my soul unto the heralds (?) of Almighty God my Creator in the humble hope that he will receive it through his favor by the sole merits and intercession of Jesus Christ my saviour.

Secondly: I desire that any just debts funeral and testamentary expenses be paid by any executor hereinafter named as soon as possible after my death.

Thirdly: I give and bequeath to my beloved husband all my moveable and immoveable properties wherever the same shall be found and to whatever the same shall amount hereby constituting my said husband my universal legatee.

Fourthly: I nominate, constitute and appoint my said husband my testamentary executor and I revoke all will and testamentary I may have heretofore made and declare the present to be my only true last will and testament.

Done and passed at Loretteville under Notorial number eight thousand five hundred and fifty seven. After the reading of the present will to the testator by the notary in presence of Jules Falardeau, merchant and Joseph Bureau accountant both residents of Loretteville the testator the notary and witnesses have signed in the presence of each others.
